HomeMy WebLinkAbout1981.01.20_City Council MinutesOn Tuesday, January 20, 1981, the Owasso City Council met in regular session in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall Bulletin Board at 3:30 PM on January 16, 1981, and by refer- ence made a part hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 7:01 PM with Mayor Spencer presiding. ITEM 2 - FLAG SALUTE. Flag salute was led by Mayor Spencer. ITEM 3 - ROLL CALL. Present: Boyd Spencer, Mayor Al Lambert, Councilman Dennis Burke, Councilman Harold Charney, City Attorney Kenneth Thompson, City Manager Wauhilleau Webb, City Clerk Absent: Robbie Fickle ITEM 4 - APPROVE CONSENT AGENDA ITEPI.S . Mr. Burke requested Item B be removed from the Consent Agenda. Motion was made by Al Lambert, seconded by Dennis Burke, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on January 15, 1981, and by reference made a part hereof. A. Approve Minutes of January 6, 1981 Regular Meeting. B. Approve Warrants 697 through 1151 for $13,416.96, Resubmitted Warrant 1001 for $466.74, Cancellation of Warrant 546 for $675.00, Revenue Sharing Warrants 40 and 41 for $6,661.65, Street and Alley Fund Warrants 1 and 2 for $734.70, and Authorize Mayor to Sign same. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. Mr. Burke said he has been contacted by five citizens expressing their concern about approval of Zoning Case OZ-55 from Residential to Commercial General on 86th Street North. Mr. Burke said he wanted to urge the Council to reconsider this as he feels it is a mistake as we are violating our Comprehensive Plan. Mayor Spencer said this may appear as spot zoning but 86th Street North from Highway 169 to 129th East Avenue for the biggest part is commercial. Mr. Burke said he has been notified there will be a lawsuit filed if the City goes ahead with this. He said Mr. Sokolosky promised the people in that area that the pro- perty would remain residential and now he is making further promises. Owasso City Council January 20, 1981 Page Two Mr. Lambert commented he has not been contacted by anyone and in some respects it may seem that the action taken at the last meeting might be against our Comprehensive guidelines, but it is not something hard and fast that we must live by. He said the Planning Commission did a lot of work on this and he is going to rely on their judgement. He said he gave it a lot of thought before approving it and he hasn't changed his mind. Mayor Spencer said the thing that is really involved is two powers butting heads in who will control 86th Street as far as developers. He said he had it put to him that if it had been anyone other than Sokolosky it would have been turned down. ~4r. Burke commented he felt the twenty acres that are zoned Commercial General is more than adequate for what the applicant is asking. Motion was made by Al Lambert, seconded by Boyd Spencer, to approve Ordinance No. 296 on Zoning Case OZ-55 for Commercial General zoning approved on January 6, 1981, and by reference made a part hereof. Ayes - Messrs. Spencer and Lambert Nays - Mr. Burke Motion carried. ITEM 5 - PRESENTATION OF FINANCIAL REPORT FOR DECEMBER 1980. PZotion was made by Boyd Spencer, seconded by Dennis Burke, to accept December 1980 Financial Statements, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, and Burke Nays - None Motion carried. ITEM 6 - REVIEW BIDS FOR THREE CIVIL DEFENSE WARNING SIRENS. Mr. Thompson publicly read the bids which were received on the warning sirens and are as follows: Goddard Enterprise - $17,613.30 (Including installation) Bill Story Company - $16,218.00 (Including installation) Law Enforcement Equipment - $14,597.70 (No installation) Mr. Thompson said he has contacted Public Service and we can get the poles from them for $690.00 ($230.00 each) and they will set them for us free, and the poles are in stock. Mr. Thompson said this would save the City around $600.00 by installing them ourselves. Owasso City Council January 20, 1981 Page Three Motion was made by Boyd Spencer, seconded by Dennis Burke, to award bid for three Civil Defense warning sirens to Law Enforcement Equipment Company for $14,597.70, with the City furnishing the poles, and by reference made apart hereof. Ayes - Messrs. Spencer, Lambert and Burke Nays ~ None Motion carried. ITEM 7 - REQUEST FOR SIX MONTH EXTENSION OF FINAL PLAT APPROVAL FOR 76 CENTER SUBDIVISION (NORTH SIDE OF 76TH STREET NORTH, WEST OF MINGO VALLEY EXPRESSWAY). Motion was made by Al Lambert, seconded by Dennis Burke, to deny request for a six month extension of final plat approval for 76 Center Subdivision. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. Motion was made by Al Lambert, seconded by Boyd Spencer, to grant until Febru- ary 27, 1981, for filing of final plat for 76 Center Subdivision. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 8 - RECOMMENDATION TO ANNEX 132' X 300' TRACT ON THE SOUTH SIDE OF 99th STREET NORTH, WEST OF GARNETT ROAD. Mr. Burke said the Council has had this item before them several times and he had requested that it be placed back on this agenda. Motion was made by Dennis Burke, seconded by Boyd Spencer, to annex a 132' X 300' tract on the South side of 99th Street North, West of Garnett Road, and further described as follows: A tract of land beginning at a point on the South line of the NE% SE% of Section 18, Township 21 North, Range 14 East of the IB&M, according to the U.S. Government Survey thereof, said point being 1,155 feet West of the Southeast corner of the NE4 SE14, thence North 132 feet; thence East 300 feet; thence South 132 feet; thence West 300 feet to point of beginning. ITEM 9 - RECOMMENDATION TO WAIVE PLATTING REQUIREMENTS FOR A 132' X 300' TRACT ON THE SOUTH SIDE OF 99th STREET NORTH, WEST OF GARNETT ROAD. Motion was made by Dennis Burke, seconded by Boyd Spencer, to waive platting requirements for a 132' x 300' tract on the South side of 99th Street Pdorth, West of Garnett Road, the legal description being same as in Item 8. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 10 - APPROVE ADDITIONAL WARRANTS. ,.- ~: Motion was made by Boyd Spencer, seconded by Dennis Burke, to approve additional warrants 1250 through 1275, EXCEPT 1262 and 1270, for payment for $30,970.33, and authorize Mayor to sign same. Plotion was made by Boyd Spencer, seconded by Al Lambert, directing City Manager to return to Continental Research Corporation, Warrant 1270, what we don't need of the aero grease, paying for what we keep. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 11 - APPROVE ORDINANCE N0. 295 REVISING CITY WARD BOUNDARIES. Ms. Dickey commented the major changes in the ward boundaries are moving and changing Ward 5 to the East of Highway 169 and Ward 1 all to the North. Motion was made by Al Lambert, seconded by Dennis Burke, to approve Ordinance No. 295 revising the City ward boundaries, and by reference made a part here- t of. Ayes - Messrs. Spencer, Lambert and Burke Owasso City Council January 20, 1981 Page Five Nays - None Motion carried. ITEM 12 - APPROVE EMERGENCY CLAUSE TO ORDINANCE N0. 295. Motion was made by Boyd Spencer, seconded by Al Lambert, to approve Emergency Clause to Ordinance No. 295. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 13 - NEW BUSINESS Item Dennis Burke presented PZayor Spencer with a letter from Don Coolce resigning his position on the Personnel Board and requesting to be considered for the vacancy on the Planning Commission. Mayor Spencer publicly read Mr. Cooke's letter. Motion was made by Boyd Spencer, seconded by Al Lambert, to accept Don Cooke's resignation from the Personnel Board, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. Motion was made by Dennis Burke, seconded by Al Lambert, to appoint Don Cooke to the Owasso Planning Commission to fill a seat vacated by Elray Stevens which will expire on June 30, 1982. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. Item Motion was made by Boyd Spencer, seconded by Al Lambert, to discontinue use of the Consent Agenda. Ayes - Messrs. Item Mr. Charney advised Council that employees should sign a form at the time of their employment stating they understand that they are a classified or un- classified employee. Item Motion was made by Boyd Spencer, seconded by Al Lambert, to approve additional Warrant 1276 for $1,736.39, and by reference made a part hereof, and authorize Mayor to sign same. Ayes - Messrs. Spencer, Lambert and Burke Nays - None P•4otion carried. Item Mr. Lambert questioned why the siren on the East side of the service road by the lift station was down then back up. Mr. Thompson said it was behind a billboard and they were raising it so it would clear the billboard. Mr. Lambert then questioned if billboards can be controlled and Mr. Thompson replied yes, they can actually be prohibited.
