the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda
posted on City Hall Bulletin Board at 5:00 PM on January 2, 1981, and by refer-
ence made a part hereof.
ITEM 1 - CALL TO ORDER.
The meeting was called to order at 7:01 PM with Mayor Spencer presiding.
ITEM 2 - FLAG SALUTE.
Flag Salute was led by Mayor Spencer.
ITEM 3 - ROLL. CALL.

ITEM 4 - APPROVE CONSENT AGENDA ITEMS.
Motion was made by Al Lambert, seconded by Robbie Fickle, to approve Consent
Agenda items, as follows, DELETING Warrants 977 through 1097 for $28,617.14
which have been duplicated under Item 10, as published in the Owasso Reporter
on December 30, 1980, and by reference made a part hereof:
A. Approve Minutes of December 22, 1980 Special P4eeting.
B. Cancellation of Warrant 946 for $219.94.

ITEM 5 - PLANNING COr~TiSSION RECOMMENDATION TO ANNEX A 132' x 300' TRACT ON THE
SOUTH SIDE OF 99TH STREET NORTH, WEST OF GARNETT ROAD.
Carol Dickey reminded Council this is the same tract they reviewed previously
which lies North of El Rio Vista, and she requested it be tabled to the next
agenda as Mr. Tremain has not received the letter from Rural Water District No.
3 which was requested by the Council.
Motion was made by Dennis Burke, seconded by Al Lambert, to table annexation of
a 132' x 300' tract on the South side of 99th Street North, West of Garnett
Road, to January 20 meeting and be brought up at his personal request as it
violates the policy of continued items.

ITEM 6A - RECOMI~NDATION TO APPROVE ZONING FROM RS-3 RESIDENTIAL TO CG COMt~R-
CIAL GENEF.AL; A FIVE ACRE TRACT LOCATED SOUTH OF 86TH STREET NORTH, WEST OF
129TH EAST AVENUE.
Ms. Dickey said this is Zoning Case OZ-55 which has been heard by the Planning
Commission. She said staff recommended denial of this case, then after much
more discussion the Planning Commission recommended approval.
Mayor Spencer questioned how much property is between the two churches and r1s.
Dickey said it is 700 feet on the front and 800 on the back, which goes from
both church boundaries, with 3.5 acres of building space.
Mrs. Fickle commented she is concerned with bottle necking of traffic as it
seems this area is mostly commercial or churches. Ms. Dickey said there would
need to be a collector street.
Mr. Burke said he was in agreement with the Planning Commission recommendation
that all commercial be restricted to the major arterial intersections and does
not feet it has been violated with the shopping center we have on 86th Street
just East of Highway 169. He said he would object to the location of busi-
nesses of this type between two churches when more suitable use would be resi-
dential. The property is zoned for residential at this time and feels there is
adequate space in the 20 acres for this type development.
Bob Batchelor and three other gentlemen from First Christian Church were pre-
sent to express their concern about the type of businesses that:iwould go in
this location, such as creation of loitering, sale of magazines, alcohol or
trash that would be generated. Mr. Sokolosky, the applicant, said he guar-
antees there will be no alcoholic beverages sold. He said he has two deals
pending, one a convenience store to sell gasoline but no beer, and an automatic
car wash. He said there is another business that would be a service business
with a nice building but he was not at liberty to say what particular business
at this time. Mr. Sbkolosky said he was considering buying the property from
the corporation.
Mr. Burke asked why Mr. Sokolosky could not locate these businesses in the
existing commercial property and Mr. Sokolosky responded that he would like to
see that 20 acres better used, and if it were not for the gas pumps and the car
wash he would go to a lessor zoning.
Mr. Wayne Alburty expressed his concern with strip commercial zoning and felt
this was a monumental decision regarding 86th Street North. He said as he reads
the Comprehensive Plan he finds this request is not in compliance with the Plan
and would like the Council to consider the residents in that area and requested
they overturn the Planning Commissions recommendation and deny this request.

Mr. Sokolosky rebutted the use of 86th Street and said the Comprehensive Plan is
only utilized as a guideline.
Motion was made by Dennis Burke to deny application for CG zoning.
Motion died for lack of a second.
Motion was made by Robbie Fickle, seconded by Al Lambert, to approve Planning
Commission's recommendation to rezone a five acre tract located South of 86th.
Street North, West of 129th East Avenue, Case OZ-55, from RS-3 to Commercial
General, and by reference made a part hereof.

ITEM 6B - RECOMMENDATION TO WAIVE PLATTING REQUIREMENTS FOR A 132' X 300' TRACT
LOCATED ON THE SOUTH SIDE OF 99TH STREET NORTH, WEST OF GARNETT ROAD.
Ms. Dickey requested this item be continued to the same meeting as the annexa-
tion of the same property. Mayor Spencer assured Mr. Tremain that at the next
meeting the Council would give him a yes or no answer.
Motion was made by Dennis Burke, seconded by Robbie Fickle, to table recommen-
dation to waive platting requirements for a 132' X 300' tract located on the
South side of 99th Street North, West of Garnett Road, to January 20 so it can
be acted on with the annexation petition.

ITEM 6C - REFERRAL OF A MODIFIED ZONING RECOPM~IENDATION FOR A 20 ACRE TRACT
LOCATED SOUTH OF 116TH STREET NORTH, EAST SIDE OF HIGHWAY 169.
Ms. Dickey commented that although this is in Tulsa County and not Owasso City
limits Tulsa County and TZIAPC requested the Council's opinion on the zoning as
it is so close in our fence line. She said request has been before the Owasso
Planning Commission, and staff`s recommendation was to approve Commercial along
a 400 foot strip along the frontage and deny the remainder of the tract.
Mr. Burke questioned why the Planning Commission changed their mind between
their November and December meetings regarding this application. Ms. Dickey
said they were concerned with industrial and also there are several new

members on the Commission. Ms. Dickey said they were concerned with setting a
precedent with the depth of the zoning request.
Mayor Spencer said since this is in the County and we have the problems we have
with furnishing water and sewer he would like to see it referred back to TMAPC
with them being aware that the water and sewer problem exists. Mr. Burke re-
minded him they referred it to Owasso wanting to know our desires. Ms. Dickey
commented that TMAPC did not want to make a decision without Owasso's referral,
by both the Council and the Planning Commission.
Dr. Clark, the applicant, said he plans to build a mall in the front area. The
mini-storage. is primarily to help fund the property and wants to place them in
the back 2z acres which would not be seen from Highway 169. Mr. Burke commented
that portion of Highway 169 will never be four-laned because of the new express-
way and it will not be maintained well and said he was also concerned it would
be breaking our Comprehensive Plan. Mayor Spencer disagreed on the condition of
Highway 169 as he felt Tulsa County will keep it well maintained.
Mr. Charney asked Ms. Dickey if we need to amend the Comprehensive Plan and she
said on zoning changes it should be.
Motion was made by Dennis Burke, seconded by Al Lambert, to deny entire appli-
cation for CS zoning on 20 acre tract located South of 116th Street North,
East side of Highway 169, as it does not follow the Comprehensive Plan, and by
reference made a part hereof.

Abstain - Tars. Fickle
Motion carried.
Motion was made by Dennis Burke, seconded by Al Lambert, to concur with Plan-
ning Commissions recommendation that the front 450 feet of 20 acre tract that
fronts Highway 169 be zoned CS and deny the 250 feet in the back, and so advise
TMAPC.

ITEM 6D - RECOMMENDATION TO ANNEX BALANCE OF SECTION 21, TOWNSHIP 21 NORTH,
RANGE 14 EAST; NORTHEAST OF 86TH AND 129TH EAST AVENUE.
Council asked Ms. Dickey who initiated this application and she said the City
Manager .had asked the Planning Commission to consider it. Mr. Burke said he
would be interested in annexing this property but questioned why it was on the
agenda at this point as it had not been through the proper annexation procedure.
The water and sewer problem was discussed and it-was confirmed this property is
in Rogers County.
Motion was made by Boyd Spencer, seconded by Dennis Burke, that the Council
would consider this property for annexation.

Chair recessed Owasso City Council at 8:22 PM and reconvened at 8:30 PM.
ITEM 6E - ACKNOWLEDGE RESIGNATION OF ELRAY STEVENS FROM PLANNING COMMISSION AND
APPROVE LETTER OF APPRECIATION FOR HIS SERVICE,
Motion was made by Boyd Spencer, seconded by Dennis Burke, to accept resigna-
tion of Elray Stevens from the Planning Commission, and by reference made a
part hereof.

ITEM 6F - TULSA COUNTY ZONING REFERRAL POLICIES.
Council agreed with policy that they will hear zoning cases in Tulsa County that
are within our fenceline.
ITEM 7 - APPROVE FINANCIAL REPORTS FOR NOVEPZBER 1980.
Council commented they like the new format Mr. Fugate is using for the reports.
Motion was made by Dennis Burke, seconded by Boyd Spencer, to approve November
1980 Financial Statements, and by reference made a part hereof.

ITEM 8 - PROPOSED OPERATION POLICIES FOR OWASSO RECREATION CENTER.
Mayor Spencer asked Mr. Leach how he would charge the school when they use it
and Mr. Leach said the school never uses it, it is the FOR. Mr. Burke ques-
tioned how he would determine profit and non-profit organizations and Mr. Leach
said all non-profit organizations have a tax exempt number.
Motion was made by Al Lambert, seconded by Dennis Burke, to approve Operating
Policies, dated January 6, 1981, for the Owasso Recreation Center, and by re-
ference made a part hereof.

ITII~4 9 - PROPOSED AGREETZENT ~,TITH OKLAHOMA TAX COr~IISSION FOR COLLECTION OF CITY
SALES TAX.
Motion was made by Boyd Spencer, seconded by Dennis Burke, to approve Agreement
for Administration of Sales Tax Ordinance with Oklahoma Tax Commission for a
period of July 1, 1980 through June 30, 1981, and by reference made a part
hereof.

ITEM 10 - APPROVE ADDITIONAL WARRANTS FOR PAYr4ENT
TZotion was made by Dennis Burke, seconded by Robbie Fickle, to approve addi-
tional Warrants 977 through 1101, REP~40VING Warrant 1092 for further clarifica-
tion, for $30,826.52, and authorize Mayor to sign same, and by reference made
a part hereof.

ITEM 11 - NEW BUSINESS.
Item
Mr. Thompson said some time back Warrant No. 34 in the amount of $462.42 was
questioned. Mr. Thompson explained it was for a special evidence cabinet in
the Police Department.
Motion was made by Dennis Burke, seconded by Boyd Spencer, to Approve Warrant
34 in the amount of $462.42.

Item
Council agreed with Mr. Thompson's recommendation in his memo regarding an
Appreciation Dinner to the various Boards. Council directed Mr. Thompson to
make arrangements for the dinner.
Being no further business before the. Owasso City Council, Chair adjourned at
8:52 PM.
