ular session, in Council Chambers at City Hall, per Notice of
Public Meeting and Agenda posted on City Hall Bulletin Board at
4:15 PM on April 16, 1979, and by reference made a part hereof.
Present: Boyd Spencer, Mayor
Robbie Fickle, Vice Mayor

Harold Charney, City Attorney

Absent: None
The meeting was called to order at 7:05 PM, with Mayor Spencer
presiding.
Mayor Spencer presented a plaque to Bill Williams honoring him
for his many years of service to the City, serving on various
Boards and as Mayor.
Motion was made by Don Thompson, seconded by Robbie Fickle, to
approve Consent Agenda items, as follows, as published in the
Owasso Reporter on April 12, 1979, and by reference made a part
hereof.
1. Approve Minutes of April 3, 1979, Meeting.
2. Approve Warrants for Payment
Ayes - Messrs. Spencer, Thompson, Wrestler and Mrs. Fickle, with
Mrs. Fickle abstaining on Warrant 1362.
Nays - None
Motion was made by Robert Wrestler, seconded by Don Thompson, to
approve additional warrants for payment, and by reference made a
part hereof.

r1r. Robert E. Yadon, the architect for the new school gymnasium,
was present at the request of the Owasso School Board, to re-
quest the City Council to consider changing the city building
code standards from our present Southern Code to the BOCA Code.
Mr. Yadon commented that on one building construction for the
school it cost an additional 5% of total building cost to con-
struct according to the Southern Code and on the high school it
cost an additional 9%. He said it is a good building code, may-
be too good a building code. Council was advised that the re-
quested BOCA code is used by Tulsa, Oklahoma City, Tulsa County
and Broken Arrow. It is anticipated the Southern Code will
cause a 20% to 25% cost increase to construct the gymnasium.
Mr. Thompson asked who writes the BOCA Code and Mr. Yaden said

it is written by building code officials such as fire marshals
and building inspectors. Mayor Spencer asked what is the most
important reason for changing the code, if it was only for the
gymnasium. Mr. Yadon answered no, and it would actually be
saving the tax payers' money. Mrs. Fickle asked why this pro-
ject would be 25% additional cost to which Mr. Yadon replied
due to the reinforced concrete construction required. Mr.
Charney asked if one code is as safe as another and Mr. Yadon
replied yes. Mr. Charney then asked if there would be a differ-
ence in building life expectancy between the types of construc-
tion. Mr. Yadon replied they would be very near the same. Mr.
Thompson asked if there is a climate difference in building
codes to which Mr. Yadon answered yes, the Southern Code was
designed in the Gulf States where they consider hurricanes. Mr.
Charney mentioned the possibility of the City writing an ordi-
nance deviating from the Southern Code rather than changing
codes. Mr. Yadon commented it would seem to him Council would
have that right, but he would not recommend a policy of making
deviations. Mrs. Fickle asked Aubrey Thomas, of the School
Board, if the school plans on additional school buildings in
the future. Per. Thomas said yes, the school's master plan for
eight or nine years from now is for an auditorium. Mr. Thomp-
son commented that they are actually requesting the City to
change something on an emergency basis to accomodate just their
immediate needs and why had they not asked Council for this
sooner as it affects too many people. Mr. Thomas answered they
did not know until the last few months the cost difference in-
volved. Mr. Thompson asked if the City is that much "out of
step with the world" in our building code. Mr. Yadon said no,
just with the immediate area. Bill Williams commented he has
reviewed both codes and the major difference is with larger
construction, not residential. Mayor Spencer asked how much
money would they save. Mr. Thomas said it would not be a sav-
ings of actual money but that savings would be applied to a
better building. Mayor Spencer commented that he hopes they
were not expecting the Council to make a decision tonight. Mr.
Thomas said no, certainly not. Mayor Spencer directed the City
Manager to get together with Dale Johnson, the School Board,
and others to work t'nis out to a decision. Mr. Charney asked
when they must have the City's decision. Mr. Yadon said by
mid May.
In regard to the pool repair, a bid was received after the
stated bid opening time and City Attorney advised Council they
could accept this bid, with a motion, for consideration.

Motion was made by Don Thompson, seconded by Robert Wrestler, to
open bid from Bob Vale Painting for repairs to City pool, for
City's consideration.

The bid was opened and was for a total price of $3,667.00. This
job was estimated by the City to be around $4,000.00, Mrs.
Fickle asked Mr. Williams if he knew Mr. Vale and Mr. Williams
replied yes as T•~r. Vale did the pool repair previously and did
a good job and would recommend him as he is familiar with the
structure.
Motion was made by Don Thompson, seconded by Robert Wrestler, to
award bid for repairs on the City pool to Bob Vale Painting Com-
pany, per his bid amount of $3,667.00, and by reference made a
part hereof.

Motion was made by Robert Wrestler, seconded by Don Thompson, to
receive and file March Financial Statements, and by reference
made a part hereof.

In regard to increasing the pay grade for a City Mechanic, Mr.
Meyer commented that this is a highly specialized field and we
cannot secure a qualified person at any less salary.
Motion was made by Don Thompson, seconded by Robert Wrestler, to
approve pay grade change for City Mechanic position from Grade
12 to Grade 14.

Motion was made by Robbie Fickle, seconded by Robert Wrestler,
to have Mr. Meyer go out for bid for two 4,000 gallon fiberglass
gas tanks with pumps to accomodate the City's needs, and by re-
ference made a part hereof.

Motion was made by Don Thompson, seconded by Robert Wrestler,
to table Item 9 Approve Ordinance No. 256 on Fire Runs Outside
City Limits and Item 10 Approve Emergency Clause to Ordinance
No. 256, to the May 15, 1979, meeting.

Motion was made by Robbie Fickle, seconded by Don Thompson, to
approve Lohrey and Jay for the 1978-1979 Audit of City of Owasso
Funds .

Motion was made by Don Thompson, seconded by Robert Wrestler,
to approve Lohrey and Jay for the Revenue Sharing Compliance
Audit for 1978-1979.

Motion was made by Robert Wrestler, seconded by Don Thompson,
to approve Council on Aging Board Members, and by reference made
a part hereof.

Motion was made by Robert Wrestler, seconded by Don Thompson, to
approve Ordinance No. 255 increasing retirement fund contribu-
tion retroactive to July 1, 1977, and by reference made a part
hereof.

Motion was made by Robert Wrestler, seconded by Don Thompson, to
approve emergency clause to Ordinance No. 255, and by reference
made a part hereof.

Bill Williams called Council's attention to his report on the
condition of Elm Creek streets which was included in their pac-
ket. One project remains to be completed and is to be done the
following week.
Motion was made by Robbie Fickle, seconded by Robert Wrestler,
to approve staff recommendation on Parcel 10 of Zoning Applica-
tion OZ-43 from RS-2 to RS-3, per letter from developer, and by
reference made a part hereof.

Chair reconvened Owasso City Council at 9:24 PM.
NEW BUSINESS:
Motion was made by Don Thompson, seconded by Robert Wrestler, to
call a building moritorium on land presently zoned RM-1 until.
further notice by City Council. Legal description as follows:
General Location: 86th Street and 129th Street
Beginning at the Southeast corner of the East Half of Sec-
tion 20, Township 21 North, Range 14 East, Tulsa County,
Oklahoma; thence North along the East line thereof, a dis-
tance of 660 feet to the true point of beginning; thence
North 330 feet along said East line to a point; thence
West 1,350 feet to a point; thence Southwesterly to a point
on the South line of said East Half of Section 20; said
point being 2,030 feet West of the Southeast corner there-
of; thence East along said South line a distance of 680
feet to a point; thence North 500 feet to a point; thence
Northeasterly to a point that is 1,050 feet West and 660
feet North of the Southeast corner of said Section 20;
thence East a distance of 1,050 feet to the point of be-
ginning.

Motion was made by Don Thompson, seconded by Robbie Fickle, to
initiate City Council action for an application to Planning
Commission on the aforementioned property from present RM-1 to
RS-3.
