HomeMy WebLinkAbout1979.06.05_City Council MinutesOn Tuesday, June 5, 1979, the Owasso City Council met in regular session, in Council Chambers at City Hall, per Notice of Public Meeting and Agenda posted on City Hall Bulletin Board at 4:30 PM on June 1, 1979, and by ref- erence made a part hereof. Present: Boyd Spencer, Mayor Don Thompson, Councilman Al Lambert, Councilman Robert Wrestler, Councilman Harold Charney, City Attorney (arrived 7:08) Wauhilleau Webb, Acting City Manager Merrilyn Merchant, Deputy City Clerk Absent: Wayne Meyer, City Manager Robbie Fickle, Vice Mayor In the absence of the City Manager, Wauhilleau Webb was asked by Mayor Spencer to represent the City at Council Meeting as Acting City Manager with Merrilyn Merchant to act as Deputy City Clerk for this meeting. The meeting was called to order at 7:05 PM, with Mayor Spencer presiding. Joe Deitsch was elected Employee of the Month for May; however formal pre- sentation was not made since he could not be present because of an out of town training session. Motion was made by Don Thompson, seconded by Bob Wrestler, to approve the minutes of the May 15, 1979, Regular Meeting and. the May 22, 1979, Special Meeting, and by reference made a part hereof. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. Don Thompson questioned so many warrants for tools since the Mechanic was supposed to have his own tools. Bill Williams explained these were shop tools and also that part of the charges were for parts. Mr. Williams also stated that a few tools had been stolen from the shop area. He also explained that he had put out for bids at three or four different places for tools and parts, and they could be purchased at Owasso Auto Supply cheaper. Don Thompson expressed opinion he would prefer we spread our business around in the City. Don Thompson questioned warrant to Lo-Dall, which Bill Williams explained was for bumper, paint job and tires. Mayor Spencer voiced opinion he does not think we should pay for the paint job but Bill Williams said he was sure the Council told him to get it painted. Mr. Thompson suggested Bill Williams contact Lo-ball to see if they would pay for the paint job since we leased the truck from them. Mr. Williams that this machinery was in demand and he did not think they would paint it if they did not have to. Mr. Thompson suggested it wouldn't hurt to try. Bob Wrestler asked if the warrant for the dog pound fence was for repairs or a new one and Bill Williams said that was not in his field, but he thought this was for repairs. Owasso City Council June-5, 1979 Page 2 Motion was made by Don Thompson, seconded by Bob Wrestler, to approve warrants for payment, and by reference made a part hereof. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. Motion was made by Don Thompson, seconded by Al Lambert, to approve Fire Run Contract with Liberty Mutual, property owner Joe M. Caudle, and by reference made a part hereof. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. There was general discussion on zoning for OZ-45 in the general location of the northwest corner of Highways 169 and 20, in which it was pointed out by City Planner, Jack Gorzeman, that his staff was recommending two 5 acre tracts rather than the entire 17 acres requested by the developers to be zoned commercial. He pointed out any property zoned CS would have to come before the planning commission and CG zoning would not have to come back be- fore the planning commission. He commented approximately 30 people attended the planning commission meeting to voice concern they did not want commercial zoning abuting their property, but were shown it would not. Also, the Menno- nite Church expressed concern at the planning commission meeting that trash would blow over on their property. They were assured a fence would be erected around the property. Al Lambert expressed the view that he was disturbed by the CG zoning proposal, however he understood the type of business proposed would determine the type of zoning requested and this seems to conform to the basic guide set forth by the comprehensive plan. Don Thompson questioned Mr. Butler, one of the property owners, as to how much of the five acres would be utilized for a lum- ber yard and he indicated the lumber yard would take up most of this property, as indicated by Crews Lumber Yard. Don Thompson expressed the view that we had 1320' deep commercial zoning on the south side of 116th Street and he thought we should consider lining up the zoning on the north side of 116th street to comply with south side. This would make approximately seven acres of commercial zoning on the north side of 116th street, instead of five acres. Another of the property owners, Clyde Johnson, indicated if the City went for seven acre zoning, the two acre tract would not have required frontage necessary for commercial zoning, since CG requires 100' frontage and CS requires 150' frontage, which Jack Gorzeman agreed with. Mr. Johnson indicated he was interested in developing homes in this 120 acre area and very careful planning had gone into planning the whole area because of future residential plans. He indicated everyone they had talked with indicated pleasure in his plans. He reminded the City Council he was offering Owasso City Council .June 5, 1979 Page 3 to the City a business that would produce more revenue than 120 homes, with minimal fire and police protection. Bob Wrestler indicated he was in favor of splitting the zoning. to line up with the south side, as indicated earlier by Mr. Thompson, to keep from having CG and CS zoning split. Mr. Johnson suggested that the Council zone the west property CG also, instead of splitting. Jack Gorzeman recommended that 1320' would be a good stopping point for commercial zoning. Al Lambert made the motion, seconded by Don Thompson, to adopt the planning commission recommendation to adopt CS zoned 5 acres and CG zoned 5 acres, as shown on the OZ-45 map, and by reference made a part hereof. Mr. Thompson did voice his opinion that although he was seconding the motion, he felt we would have trouble with the zoning later on down the road. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. In regard to approving Constitution and By-Laws for the Senior Citizens Advisory Board, Don Thompson questioned why it was necessary to adopt the laws of another group. Mr. Charlie Cramer, representing the Sr. Citizens Advisory Board, ex- plained that since the Senior Citizens Advisory Council on Aging is incorporated, and no longer under Federal funding, but at the-mercy of the City Council to help them, Mr. Wayne Meyer had requested that they revise their by-laws where the City Council would have the control to appoint members to the Advisory Board for the Sr. Citizens. Their by-laws have been revised to show that the City Manager is the director of the Senior Citizens Advisory Committee and the employees at the Sr. Citizen's Center work for the City of Owasso. Don Thompson made the motion, seconded by Bob Wrestler, that approval of the Constitution and By-Laws for the Senior Citizens Advisory Board be tabled for two weeks. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. City Planner, Jack Gorzeman, presented the BOCA Housing Code for Owasso stating that it was felt this was the best code available for housing. He would like to see the Council give imput on this code and also to adopt the code for Owasso. Boyd Spencer voiced his opinion that the code was too involved for the Council to tackle at this time and that we could not enforce the code without using an attorney. Mr. Gorzeman stated that an ordinance is only as good as the system behind it. It was decided by the Council that discussion of the BOCA Housing Code would be at a special work session July 12, 1979, at 7:00 PM. Owasso City Council June S, 1979 Page 4 --~, Regarding approval of hiring two summer employees; one for park and one for streets, Mr. Spencer questioned why the Council had to make this approval and it was noted that the Council feels too much is put on the agenda that is really not necessary. Motion was .made by Don Thompson, seconded by Al Lambert, to create two new summer positions. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler. Nays - None. Motion carried. OLD BUSINESS Ordinance No. 261 Adopting BOCA Code for Building, Plumbing and Mechanical Inspections, along with the emergency clause to ordinance No. 261, was passed to the next Council meeting to allow City Attorney time to prepare all three ordinances. Jack Gorzeman outlined the Capital Improvements Program for the City of Owasso, as outlined in the Capital Improvements Plan, and be reference made a part hereof. He indicated that some of the plans are very real needs and some are „„, dreams, but the Council should be aware of all requests for future consideration. Mr. Spencer asked why the Capital Improvements Plan Study had been done, and Mr. Gorzeman indicated the Council had asked for the study and funds had been obtained to do it. Mr. Thompson did not feel a resolution was necessary. He recommended approval to use as a guide, but not accept as a resolution. Mr. Spencer voiced his opinion that as far as he was concerned, out of all the pro- grams outlined in the Capital Improvements Plan, there was only one priority, and that was the water line west of town. Mrs. Webb asked Mr. Gorzeman if funding of any of the projects down the road would require the passing of a resolution, to which Mr. Gorzeman replied that he really could not say at this point. Mr. Spencer indicated that they could all see these needs and that they had been discussed and some had even been put in the budget this year. It is reflected in the minutes that the Council identifies and recognizes the Capital Improvements Plan as a guide for the City of Owasso. NEW BUSINESS Mrs. Wauhilleau Webb asked for acceptance of the Three Lakes II storm sewer and paving. Mr. Bill Williams introduced new procedure to obtain Council approval on matters of acceptance of storm sewers and paving. Motion was made by Bob Wrestler, seconded by Don Thomspon to accept the Three Lakes II storm sewers and paving. Ayes - Messrs Spencer, Thompson, Lambert and Wrestler.
