HomeMy WebLinkAbout1979.07.17_City Council MinutesOn Tuesday, July 17, 1979, the Owasso City Council met in regu- lar session, in Council Chambers at City Hall, per Notice of Public Meeting and Agenda posted on City Hall Bulletin Board at 4:00 PM on July 16, 1979, and by reference made apart hereof. Present: Boyd Spencer, Mayor Robbie Fickle, Vice Mayor Robert Wrestler, Councilman Don Thompson, Councilman (arrived at 7:11 PM) Al Lambert, Councilman Wayne Meyer, City Manager Wauhilleau Webb, City Clerk Absent: Harold Charney, City Attorney The meeting was called to order at 7:04 PM, with Mayor Spencer presiding. ITEM 1 - PRESENTATION OF AWARD The presentation of this award to the volunteer firemen recog- nizing the donated hours to the City was postponed as most of the firemen were in school. ITEM 2 - APPROVE CONSENT AGENDA ITEr'IS Motion was made by Robert Wrestler, seconded by Robbie Fickle, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on July 12, 1979, and by reference made a part hereof. 1. Approve Minutes of July 3, 1979, Regular Meeting 2. Approve Warrants for Payment 3. Approve Ordinance No. 267 on Zoning Case OZ-46, Approved July 3, 1979 4. Approve Contract with County to Improve Drainage Ditch on West Side of Mingo Valley Expressway Between 76th Street North and 4th Street Ayes - Messrs. Spencer, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 3 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT Motion was made by Robbie Fickle, seconded by Robert Wrestler, to approve additional warrants for payment, and by reference made a part hereof. Ayes - Messrs. Spencer, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. Owasso City Council July 17, 1979 Page Two ITEM 4 - PENAL PROVISIONS OF THE MUNICIPAL ORDINANCES BY JUDGE PICKERILL Judge Pickerill commented that from what we are experiencing in our municipal court it is his opinion that we are going to have to "grow up" and utilize forces already given to us by the ex- isting State Statutes and our ordinances can be amended to com- ply with State Statutes; that being, "imprisonment not exceeding thirty (30) days or both the fine and imprisonment". Judge Pickerill also stated he felt it is time for the City to have imprisonment, as in today's society the simple imposition of a fine does not have much significance. He said our jail facili- ties are a problem but that should not prevent us from imposing imprisonment as we could have a cooperative agreement with the City of Tulsa. Judge Pickerill said we have the authority to do it and need a judge that will not abuse it. It would apply to traffic viola- tions only, and to those that have built up a long record. 1'Ir. Thompson asked if he was speaking of increasing fines to which the Judge said no, he is speaking of a fine and/or imprisonment not to exceed thirty days. Mr. Thompson suggested increasing the fines and the Judge said we are limited to the $100.00 fine by State laws. Mrs. Fickle said she felt that it was very im- portant if we can help rehabilitate a person with this proposed change, rather than the parents just continuing to pay the fines over and over again. Mayor Spencer said he was for the proposed change also. Mr. Wrestler commented that a change was needed now, in his opinion, as he had attended our municipal court and he was shocked and felt we needed more than just the monetary fine. Motion was made by Robbie Fickle, seconded by Robert Wrestler, to have our City Attorney amend our present penal ordinances to provide for imprisonment not exceeding thirty days, as presented by Judge Pickerill, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 5 - APPROVE ZONING ORDINANCE N0. 268 Motion was made by Don Thompson, seconded by Robert Wrestler, to approve Zoning Ordinance No. 268, and by reference made a part hereof . ITEM 6 - APPROVE EMERGENCY CLAUSE TO ORDINANCE N0. 268 Motion was made by Robert Wrestler, seconded by Don Thompson, to approve Emergency Clause to Ordinance No. 268. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 7 - APPROVE HERITAGE CONSERVATION AND RECREATION SERVICE PROJECT N0. 0-0 6 W SSO ELM CREEK PARK BOR GRANT Mr. Thompson asked when the City could get the money and Mr. Meyer said as soon as we sign the agreement and get it back to the Tourism and Recreation Department and acquire the property and request the money. He explained it is a reimbursement type grant; we submit payment requests as we spend it. Our ortion of the grant is in two payments of $55,000, a total of p$110,000. The City applied for this grant two and half years ago. Motion was made by Don Thompson, seconded by Robbie Fickle, to approve Heritage Conservation and Recreation Service Project No. 40-00694, which is a BOR Grant for Owasso Elm Creek Park, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Abstain - Mr. Lambert Motion passed. ITEM 8 - DISCUSSION ON EXISTANCE OF POSSIBLE PUBLIC NUISANCE IN HALE ACRES AND HALE ACRES II Council asked City Clerk if in fact the property mentioned is actually Hale property to which Mrs. Webb replied she had not verified ownership of the residential lots. Mr. Thompson said he lives in this area and it is quite unsightly and the vacant residential lots are the real problem more than the commercial area along the highway, but it should all be taken care of. Owasso City Council July 17, 1979 Page Four Mayor Spencer mentioned there is a also a problem at 2nd and Birch and owners should be notified. Robert Wrestler also mentioned property at 4th or 5th and At- lanta where there are cars, boats, trash and junk. Motion was made by Don Thompson, seconded by Robert Wrestler, to declare a public nuisance of grass and weeds on the commercial and duplex zoned property, and residential property in Hale Acres I and-Hale Acres II, after determining property ownership, and calling same for 7:00 PM on August 7, 1979, preceding the regular City Council meeting, and file formal complaints on the other property mentioned in these minutes, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 9 - RECEIVE AND FILE JUNE 1979 FINANCIAL STATEMENTS Motion was made by Robert Wrestler, seconded by Robbie Fickle, to accept June 1979 Financial Statements as presented, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 10 - APPROVE 1979-1980 ESTIMATE OF NEEDS AND FINANCIAL STATEMENT FOR FISCAL YEAR 1978-1979 TO BE SUBMITTED TO COUNTY EXCISE BOARD AND PUBLISHED IN THE OWASSO REPORTER Motion was made by Don Thorpson, seconded by Robert Wrestler, to approve 1979-1980 Estimate of Needs and Financial Statement for Fiscal Year 1978-1979 to be submitted to County Excise Board and published in the Owasso Reporter, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. Owasso City Council July 17 , 1979 Page Five ITEM 11 - APPROVE INCREASE IN FEE FOR FIRE RUNS TO VOLUNTEER FIREMEN Mr. Meyer recommended to Council that the volunteer firemen be paid $5.00 per run, rather than the present $4.00. Motion was made by Robert Wrestler, seconded by Al Lambert, to approve increase in fee for fire runs to volunteer firemen from $4.00 to $5.00, effective August 1, 1979, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Lambert, Mrs. Fickle Nays - None Motion passed. ITEM 12 - APPROVE ACCEPTANCE OF JANITORIAL SERVICE BID Bids for janitorial service were opened by staff and presented to Council. Three bids were received as follows: Patty R. Dodwell P. 0. Box 506 Owasso, Oklahoma 74055 Commercial & Home Cleaning Services 237 S. 102nd East Avenue Tulsa, Oklahoma 74128 Shirley A, Fry 206 North Elm Place Owasso, Oklahoma 74055 $900.00 Per month $1,075.00 Per Month $1,076.00 Per Month Mrs. Dodwell withdrew her bid due to other commitments she had made. Mr. Meyer said his recommendation would be to go with Mrs. Fry's bid, although both parties are present if Council wishes to ask them any questions. Also, Mr. Meyer mentioned the successful bidder is to supply all cleaning supplies, but not paper supplies and both bidders are aware of this. Mayor Spencer asked Mr. Goodson (bidder and present janitor) if he has been subcontracting the cleaning service. Mr. Goodson said no, they are his own employees. It was commented that the City Manager is not satisfied with the present cleaning perfor- mance. Mr. Goodson said he was not aware of that. Mr. Meyer said "has Merrilyn not given you numerous messages?". Mr. Goodson Owasso City Council July 17, 1979 Page Six replied "no, I have not been told; well, maybe I have had 7 calls in the last year". Mr. Meyer advised Council that our City Attorney said if the Council determines the quality is not what it should be that they can reject the lowest bid and go to the next lowest bid- der. Mr. Thompson asked if there are any letters documenting the City's dissatisfaction. Mr. Meyer said not since a letter of May 1978 written by Tom Baines. Mr. Goodson commented he felt the whole thing should be "dropped". Mayor Spencer said "do you mean you want to withdraw your bid?". Mr. Goodson said it is obvious his bid was opened and passed around for other bidders to look at since it is only one dollar off from another bid. Motion was made by Don Thompson, seconded by Robbie Fickle, to reject all bids. Ayes - Mr. Thompson and Mrs. Fickle Nays - None Abstain - Messrs. Spencer, Wrestler ~.nd Lambert Motion did not pass. Mayor Spencer commented this is just exactly why bids should be opened at Council meetings so this type of accusation cannot be made. Mr. Meyer said bids are opened by staff prior to Council meetings per direction of the Council in order to utilize actual Council meeting time. Mr. Thompson said that is correct; if we do not have enough confidence in our staff to do bid openings properly, then we need to get the right people. Mayor Spencer said that he does not mean any reflection on staff, it is just that if they are not opened in public it can raise some ques- tions. Motion was made by Boyd Spencer, seconded by Robert Wrestler, to accept Shirley Fry's bid. Ayes - Messrs. Spencer and Wrestler Nays - Mr. Thompson Abstain - Mr. Lambert and Mrs. Fickle Owasso City Council July 17, 1979 Page Seven Motion did not pass. Motion was made by Robbie Fickle, seconded by Don Thompson, to reject all bids received and go out for bid again as promptly as possible. Ayes - Messrs. Lambert and Thompson, Mrs. Fickle Nays - None Abstain - Messrs. Spencer and Wrestler Motion passed. ITEM 13 - OLD BUSINESS None ITEM 14 - NEW BUSINESS Item Mrs. Donna Lolato of Pinocchio's Child Care Center address the Council regarding a lack of recreation for children in Owasso. She referred to the new Community Center which is not utilized for anything except Senior Citizens, and the Recreation Center. She proposed funding these activities through fees charged to parents of children who would participate in the planned activ- ities. Mrs. Lolato said she thinks it is time to get a program organized for the children in Owasso, and there are qualified people in Owasso to teach these various activities. Mr. Thompson replied "help us get it organized". He said you are right, the buildings do need to be utilized but the City does not have the funds to pay for Directors. Mr. Thompson also suggested getting the Senior Citizens and children together. Mrs. Fickle asked Mrs. Lolato to let the Council think about her recommendations for a day or two and see what they can do with it and they will be back in touch with her. Item Mrs. Donna Lolato also spoke regarding stray dogs at her home in Graceland Acres and at the Day Care Center. Mr. Meyer advised her she would need to call Tulsa County regarding the dogs at Graceland Acres as it is not in Owasso city limits, but she de- finitely should call our Police Dispatcher when dogs are around the Day Care Center. Owasso City Council July 17, 1979 Page Eight FIRST PUBLIC HEARING ON PROPOSED USE OF REVENUE SHARING FUNDS Motion was made by Robbie Fickle, seconded by Al Lambert, to postpone the hearing to 7:00 PM on August 7, 1979.
