HomeMy WebLinkAbout1979.08.23_City Council MinutesOn Tuesday, August 23, 1979, the Owasso City Council met in a Special Session, in the Recreation Room of the Community Center (due to Municipal Court being held in Council Chambers) for the purpose of finalizing unfinished business from the August 21, 1979, regular City Council meeting, per Notice of Public Meet- ing and Agenda, posted on City Hall Bulletin Board at 4:30 PM on August 23, 1979, and by reference made a part hereof. This Special Meeting was called by Vice Mayor Fickle at 6:00 PM on Tuesday, August 21, 1979. Present: Boyd Spencer, Mayor Robbie Fickle, Vice Mayor Don Thompson, Councilman Robert Wrestler, Councilman Harold Charney, City Attorney Wayne Meyer, City Manager Wauhilleau Webb, City Clerk Absent: Al Lambert, Councilman The meeting was called to order at 6:03 PM with Mayor Spencer presiding. ITEM 1 - APPROVE WOODSTONE FINAL PLAT Mr. Bill Lewis, Engineer for Terry L. Davis Companies, was pre- sent and stated that the final plat meets all subdivision regu- lations. Mr. Thompson recalled this is the same multi-family where they requested it rezoned so they would not have to cross a creek. Mr. Thompson had been given a preliminary site plan by Mr. Bill Lewis and he said it more or less alleviated the problem about on-street parking but it presented another problem in that it appears we have too large a percentage of land covered with dwellings, although he felt sure they were. in compliance with zoning regulations but there are 40 units of dwellings on 6.9 acres. Mr. Lewis commented that is less than half of what they are allowed. Mr. Gorzeman said Mr. Lewis is correct, they are allowed 90 plus units. Mr. Wrestler commented he did not see a recreation area on the map and Mr. Lewis replied when they first platted the Three Lakes area they used six acres for park, just two blocks away from this platted area. Mrs. Fickle stated these are final plans only and site plans will be submitted later. Mr. Thompson said this process seemed to him to be putting the cart before the horse. Mr. Gorzeman said it would cost a builder a lot of money it they did not re- late to each other at the time the site plans are submitted. Mr. Meyer suggested the site plan and plat be submitted togeth- er. Mr. Gorzeman said the problem with that is the site plan could change many times, even change hands. It will continue Owasso City Council August 23, 1979 Page Two to change as it is developed and he feels a developer needs that option and flexibility. Mr. Thompson reexpressed his concern about what he feels are too narrow of streets. Mr. Spencer asked the average width of streets and Bill Williams replied 26' is average. Mr. Gorzeman suggested he could alert the TAC Committee that the City Coun- cil is concerned with parking. Mr. Spencer said he knows it shows very little parking but it meets requirements, so what actually can be done about it. Mr. Gorzeman said we can spot some of those problems when they review the site plan. Motion was made by Robbie Fickle, seconded by Boyd Spencer, to accept and approve bloodstone Final Plat per Planning Commission and City Engineer's recommendations. Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - Robert Wrestler Motion passed. Mr. Thompson asked that it be made a part of the minutes that the TAC Committee must very, very carefully look at the site plan when it comes before them for approval and that they be read the minutes of this meeting as well as the August 21, 1979, meeting, regarding the Council's apprehensions regarding this particular plat. ITENI 2 - REAFFIRM APPROVAL OF JOURrdAL ENTRY JUDGr~NT ON HALE VS. CITY 0 OWASSO, CASE N0. C-79- 7 9 TULSA DISTRICT COURT Mr. Spencer referred to the mention of County Specifications in the August 15, 1979, cover letter that was with the bond. Mr. Hale's attorney, Mr. DeLaFleur said it will be City specifica- tions as the amount of the bond, $29,705.75 is for City, and the Journal Entry of Judgment refers to City specifications. Mr. DeLaFleur suggested the City call Mr. Jim Pierce with Mid- Continent if they have any doubts about it being for City spec- ifications. Motion was made by Don Thompson, seconded by Robert Wrestler, to approve Journal Entry of Judgment as prepared and presented by City Attorney, to be approved by all parties thereto, Case No. C-79-1749 Tulsa District Court, Hale vs. City of Owasso, and present to Judge for his signature and filed of record, and by reference made apart hereof. ITEM 3 - REAFFIRM WAIVING REQUIREMENTS OF SIDEWALKS, CURBING AND GUTTERING IN UNCOMPLETED PORTION OF HALE ACRES II IN ACCORDANCE WITH JOURNAL ENTRY OF JUDGMENT Motion was made by Don Thompson, seconded by Robert Wrestler, to waive requirements of sidewalks, curbing and guttering in the uncompleted portion of Hale Acres II, complying with the Journal Entry of Judgment, Case No. C-79-1749 Tulsa District Court, Hale vs. City of Owasso, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion passed. ITEM 4 - REAFFIRM DIRECTING CITY MANAGER AND STAFF TO COMPLY WITH JOURNAL ENTRY JUDGMENT AND G VE FINAL INSPECTIONS AND UTILITY SERVICES Motion was made by Robert Wrestler, seconded by Don Thompson, that the City Manager and his staff be directed according to the Journal Entry of Judgment, Case No. C-79-1749 Tulsa Dis- trict Court, Hale vs. City of Owasso, to comply and give final inspections and utility services, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion passed. ITEM 5 - DISCUSSION ON UNMOWED PROPERTY IN WHICH OWNERS HAVE BEEN NOTIFIED It was discussed if the City Council was going to enforce the declared public nuisances that have not been mowed, and Mayor Spencer commented he is for enforcing it but we had better really look the City over good and take care of it all. City Clerk was directed to put discussion of unmowed property on the agenda for September 4, 1979. Owasso City Council August 23, 1979 Page Four ITEM 6 - DISCUSSION ON COURT CASE N0. 91870 Motion was made by Robbie Fickle, seconded by Robert Wrestler, to instruct City Attorney to give a release of judgment on Court Case No. 91870 in a lump term settlement as City Attor- ney deems is in the best interest of the City.
