HomeMy WebLinkAbout1979.12.04_City Council MinutesOn Tuesday, December 4, 1979, the Owasso City Council met in xegular session, at the Community Center, per Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 PM on November 30, 1979, and by reference made a part hereof. Present: Boyd Spencer, Mayor Robert Wrestler, Councilman Don Thompson, Councilman (.arrived 7:07 PM) Al Lambert, Councilman Harold Charney, City Attorney (arrived 7:15 PM) Wauhilleau Webb, Acting City Manager Merrilyn Merchant, Deputy City Clerk Absent: Robbie Fickle, Vice Mayor The meeting was called to order at 7:00 PM with Mayor Spencer presiding. ITEM 1 - APPROVE CONSENT AGENDA ITEMS Motion was made by Robert Trestler, seconded by Al Lambert, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on November 29, 1979, and by reference made a part hereof. A. Approve Minutes of November 20, 1979 B. Approve Warrants for Payment Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 2 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT Motion was made by Boyd Spencer, seconded by Robert Wrestler to Approve Additional Warrants for Payment, and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 3 - APPROVE AWARDING BID FOR POLICE VEHICLES Mayor Spencer read the bids for Police Vehicle as opened and recorded on November 29, 1979, and by reference made a part hereof. Mayor Spencer indicated that bid invitations had been sent to nine different firms, and out of the nine, Fred Jones sent a letter declining to bid and the Cox Motor Company sent a bid of $6,157.73. He felt one bid was not sufficient to award the contract and we should find out why the others were not bidding and go out for bids again. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 4 - APPROVE PERSONNEL ACTION Acting City Manager, Wauhilleau Webb, told the City Employees that as Acting City Manager she had seen a side of the City Council that she had not realized as City Clerk. She indicated that the Council really cares about the employees. She said the Council is very aware that some of the employees are working on Christmas and holidays, out working in 100° weather, out giving citations in school zones and then having the citizens call City Hall to complain that their son or daughter has been given a citation. She said the Council is very aware of these situations and they are trying to get things for the employees. Effective December 16, 1979, the Council has unanimously voted to give all City employees a 72% salary increase. Motion was made by Robert Wrestler, seconded by Al Lambert, to Approve Personnel Action of 72% salary increase for all City employees. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried Motion was made by P4ayor Spencer, seconded by Robert Wrestler, to declare Christmas Eve as an additional holiday this year. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 5 - APPROVE ZONING CASE OZ-50; PUBLIC SERVICE OPERATIONS CENTER Motion was made by Robert Wrestler, seconded by Don Thompson, to Approve Zoning Case OZ 50; Public Service Operations Center, and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried. Owasso City Council December 4, 1979 Page Three ITEM 6 - APPROVE ZONING CASE OZ-51; GENERAL LOCATION NORTHWEST CORNER OF 129th EAST AVENUE AND 76th STREET NORTH Motion was made by Don Thompson, seconded by Al Lambert, to Approve Zoning Case OZ-51; General Location Northwest Corner of 129th East Avenue and 76th Street North, and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 7 - DISCUSSION AND POSSIBLE ACTION ON MTTA BUS SERVICE Mayor Spencer indicated that he had been talking with Mr. Gail of Broken Arrow and he said that Broken Arrow did not have to guarantee a certain amount of money each month to MTTA, that they paid by the hour only, and it was up to the people who rode to underwrite the program. The MTTA spokesman indicated this was not true, that Broken Arrow had to subsidize the service just as Owasso was having to do, but in the year they have had the service they have never had to subsidize because the program was paying for itself. Mayor Spencer said Mr. Gail had indicated that the Council in Broken Arrow voted they would not take any funds out of the City to go into the bus service, that they would operate on ticket sales and federal funds. The Mtta spokesman said that Broken Arrow had a contract to subsidize the service but so far they had not had to do so. He said the contract was with Broken Arrow, Broken Arrow was billed for the collections and the reimbursement was made by Broken Arrow in two checks, one for ticket sales, and one for tax that Broken Arrow charges. Bob Wrestler asked why MTTA doesn't just offer the service, why does it have to go through the City? The spokesman for MTTA said the City of Tulsa pays for the entire defecit operation and would not extend outside the City of Tulsa. Bob Grestler asked Ron Ketter if he would still consider being a full-time committee, handling complaints, re-scheduling, more bus service? Mr. Ketter replied "sure". Bob Wrestler asked Ron Ketter that since he lived outside the City limits, did he feel the people would still want the service if they had to drive into the City to park and catch the bus? Mr. Ketter said this might limit some riders to a certain degree, but he really couldn't say. Bob Wrestler asked if there would be any problem in limiting the sale of passes to one place? Mr. Ketter suggested if we have one place that it be the Bank of Commerce because of access to the working people. Al Lambert asked if there would be any conflict between MTTA operating between Owasso and Tulsa in regard to tariff regulations. The MTTA spokesman indicated he does not forsee any problems since we would be on the base basis as Broken Arrow - 18 to 20 miles from Tulsa. Owasso City Council December 4, 1979 Page Four The MTTA spokesman said at the present time MTTA would not be able to supply the service because all of their buses were committed. However he did want to encourage the Council to approve the program so MTTA could furnish at the earliest possible date. He indicated they were also talking to Bixby and Sand Springs for similar service. He said MTTA was currently experiencing a 23% increase in ridership in Tulsa which was above their expectations. Bob Wrestler asked if there was any guess as to when they could provide the service if it was approved tonight. The spokesman replied that much of the in- crease in Tulsa was on an experimental basis but the earliest they could predict would probably be July. However, he did encourage the Council to approve so Owasso could be on the top of the list for the next available bus. He said that MTTA must furnish Tulsa first and they use their spare equipment to furnish Broken Arrow, Owasso, Bixby, etc. Mayor Spencer asked when MTTA had decided they could not furnish service to Owasso and the representative indicated they had a wreck in Tulsa last Monday and would have had to pull our bus, even if we had already implemented the plan. Bob Wrestler asked if we agreed to this action wouldn't we be locked into a contract with MTTA to which he was told that we would only be giving a good faith indication, not a contract. The contract would come at the time a bus was actually available. Bob Wrestler asked if we entered into a contract now would MTTA be able to buy a bus? The spokesman said no, buses took a year for delivery and you didn't just go out and buy equipment, that they would have to go through bid procedures the same as other cities. He indicated bus companies were overloaded on bus requests now and the cost of buses was approximately $120,000 per bus, plus $15,000 to $20,000 extra for wheelchair lifts if they become mandatory on buses. Motion was made by Robert Wrestler, seconded by Al Lambert, that we go into contract for service with MTTA for the first possible date they can furnish a bus, one bus at this time until ticket sales indicate need for additional bus, with tickets to be on sale at City Hall until the track record is determined. Ayes - Messrs Wrestler, Lambert, Thompson Nays - Mayor Spencer Motion carried Ron Ketter asked if tickets would be available in the evenings for the convenience of the working people, and Mayor Spencer indicated they would be. ITEM 8 - APPROVE PETITION FOR ANNEXATION: WESTPORT MENNONITE CHURCH Motion was made by Don Thompson, seconded by Al Lambert, to Approve Petition for Annexation; Westport Mennonite Church. ~""` Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried Owasso City Council December 4, 1979 Page Five ITEM 9 - SET DATE FOR FIRST COUNCIL MEETING IN JANUARY, DUE TO FIRST TUESDAY BEING ON NEW YEAR'S DAY Motion was made by Robert Wrestler, seconded by Boyd Spencer, that first Council Meeting in January be set for Wednesday, January 2, 1980. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 10 - APPROVE CITY COUNCIL'S 1980 SCHEDULE OF REGULAR MEETINGS Date for first meeting of January was set for January 2, 1980. Motion was made by Robert Wrestler, seconded by Boyd Spencer to Approve City Council's 1980 Schedule of Regular rleetings, and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 11 - APPROVE ORDINANCE N0. 276 ESTABLISHING UTILITY FRANCHISES BY ORDINANCE Motion was made by Don Thompson, seconded by Al Lambert, to Approve Ordinance No. 276 Establishing Utility Franchises by Ordinance, and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 12 - APPROVE EMERGENCY CLAUSE TO ORDINANCE N0. 276 Motion was made by Robert Wrestler, seconded by Boyd Spencer, to Approve Emergency Clause to Ordinance No. 276. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried ITEM 13 - APPROVE ORDINANCE N0. 277 ESTABLISHING 2% GAS TAX Motion was made by Don Thompson, seconded by Al Lambert, to Approve Ordinance No. 277 Establishing 2% Gas Tax and by reference made a part hereof. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried Owasso City Council ;Decor !4, 1979 Page Six ITEM 14 - APPROVE EMERGENCY CLAUSE TO ORDINANCE N0. 276 Motion was made by Don Thompson, seconded by Boyd Spencer, to Approve Emergency Clause to Ordinance No. 276. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried. Chair called for a five minute break before continuing the meeting at 7:50 PM ITEM 15 - DISCUSSION OF EMPLOYMENT PRACTICES REQUESTED BY MARVIN SPEARS Mr. Marvin Spears, Attorney, requested that the Council look into hiring practices as to state law, referring such to legal council. He stated that Article 11, Section 29-101 of the State Statutes says the Chief of a paid fire department shall have three years experience to be Chief. Also, we should look into advertising for particular jobs in the City of Owasso, that since we receive Federal funds we have a requirement to advertise every job. Mr. Spears asked to be placed on the agenda for the next meeting so the Council could let him know the City's policy as to hiring practices concerning advertising for jobs and concerning the State Statutes on hiring of Fire Chief. ITEM I6 - APPROVE TRANSFER OF FUNDS, GENERAL FUND, FISCAL YEAR 79-80 Motion was made by Don Thompson, seconded by Al Lambert to approve Transfer of Funds, General Fund, Fiscal Year 79-80. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried. ITEM 17 - NEW BUSINESS Mayor Spencer asked the Council to declare December 19 as Rick Antle Day in honor of Rick Antle, defensive Lineman for OSU. Motion was made by Boyd Spencer, seconded by Don Thompson, to declare by Proclamation that December 19, 1979, be Rick Antle Day. Ayes - Messrs Spencer, Wrestler, Lambert, Thompson Nays - None Motion carried. Mayor Spencer advised the Council at 1:30 PM on December 19, 1979, there would be ceremonies for Rick Antle at the High School and the Council was requested to be there if possible.
