HomeMy WebLinkAbout1980.02.05_City Council MinutesOn Tuesday, February 5, 1980, the Owasso City Council met in regular session, in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall Bulle- tine Board at 2:00 PM on February 1, 1980, and by reference made a part hereof. Present: Boyd Spencer, Mayor Robbie Fickle, Vice Mayor Don Thompson, Councilman Al Lambert, Councilman Kenneth Thompson, City Manager Harold Charney, City Attorney Wauhilleau Webb, City Clerk Absent: None The meeting was called to order at 7:31 PM, with Mayor Spencer presiding. This meeting was scheduled thirty minutes later due to cable television election. Mayor Spencer announced that the unofficial tabulation result of the cable television election is 374 voted yes for cable television and 8 voted no. ITEM 1 - APPROVE CONSENT AGENDA ITEMS Motion was made by Don Thompson, seconded by Al Lambert, to ap- prove Consent Agenda items, as follows, as published in the Owasso Reporter on January 31, 1980, and by reference made a part hereof. A. Approve Minutes of January 15, 1980, meeting. B, Approve Warrants for Payment. C. Approve Fire Run Contract with Oklahoma Farmers Union Insurance; Property Owner Jerry Keys, D. Approve Ordinance No. 281 on OZ-52, Approved at the '~. January 15, 1980, Council meeting. E. Approve Resolution No. 80-2 Calling for City Elections. F. Approve Acceptance of Marilyn Hinkle's Resignation From Community Center Advisory Board. Ayes - Messrs, Spencer, Thompson, Lambert, Mrs. Fickle Nays - None Motion carried. ITEM 2 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT Motion was made by Al Lambert, seconded by Don Thompson, to ap- prove additional warrants for payment, and by reference made a Hart hereof. Mayor Spencer commented he has noticed the City is conserving gasoline as the consumption has gone down. ITEM 3 - APPROVE WAIVING PLAT ON FRY PROPERTY Steve Carr reminded Council that concern has been expressed in the past by both the Council and the Planning Commission re- garding the access to this property and the protection to the residential property. Mr. Carr said no mention was made to the Planning Commission that they would be asking to waive the plat. Mr. Carr stated access must be off Forrest Drive. He mentioned in the past we have issued temporary building permits for re- quests of this type of waiver and could do so again on this case. He said access off Elm or Second is not recommended by the Planning Commission. Mr. Fry said their reason for asking for the waiver is due to the creek channel not being completed. He said they want to build a personal shop of their own and have no intention of any additional industrial construction at this time, and they are presently using Forrest Drive. Mrs. Fickle asked what access he would be using into the prop- erty if the City grants the waiver, and Mr. Fry answered Elm Place and Second Street. Mrs. Fickle then asked if he was ask- ing for a permanent waiver or a temporary building permit. Mr. Fry said he was not certain what "procedure" he was asking for, just whatever was necessary for a period of a year to construct the one building. Mr. Carr commented that temporary access could be granted sub- ject to the law water bridge. Mrs. Fickle asked P'Ir. Fry if he would have any difficulty with a temporary waiver until the drainage is determined and then submitting a plat. Mr. Fry said he could live with this re- quirement, but the platting seemed very complicated to him. Mr. Carr commented it would actually be easy to plat. Mr. Fry mentioned that Second Street is not an all-weather road and Elm Place is. Motion was made by Robbie Fickle, seconded by Don Thompson, to grant a temporary building permit for one building only, waive ~~ temporarily the platting of the Fry property, and permit Mr. Fry to use Elm Street for a period of six months, and at that time rZr. Fry is to submit a plat for the City's consideration. Owasso City Council February 5, 1980 Page Three Ayes - Messrs. Spencer, Thompson, Lambert, Mrs. Fickle Nays - None Motion carried. Mayor Spencer said the City had agreed to open Elm Street up to Mr. Fry at one time. ITEM 4 - AMEND CHARTER TO ALLOW: COUNCILMEN TO BE PAID $25.00 PER MEETING, NOT TO EXCEED FOUR MEETINGS PER MONTH Mr. Charney advised that after he had requested this item to be placed on the agenda, he felt the amount should be $35.00. Motion was made by Don Thompson, seconded by Robbie Fickle, to place on the ballot for March 18, 1980, by Resolution No. 80-4, the question of amending the City Charter to pay councilpersons $35,00 per meeting, not to exceed four meetings per month, same to be effective at the installation of new officials at the first meeting in May, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Lambert, Mrs. Fickle Nays - None Motion carried. ITEM 5 - APPROVE FINAL ADJUSTMENT TO STATE DEPARTMENT OF TRANS- PORTATION ON TRAFFIC LIGHT AT 86th AND HIGHWAY 69 Ken Thompson explained to Council this is an old bill back to 1975 and no one seems to know why it took so long to pay. It is in the amount of $1,312.16, of which Tulsa County will pay half. He said this was the agreement at the time the light was installed. Motion was made by Al Lambert, seconded by Boyd Spencer, to ap- prove final adjustment to State Department of Transportation on traffic light at 86th and Highway 169, and by reference made a part hereof . Owasso City Council February 5, 1980 Page Four ITEM 6 - APPROVE MINUTES OF JANUARY 21, 1980, SPECIAL P~IEETING Motion was made by Al Lambert, seconded by Robbie Fickle, to approve minutes of January 21, 1980, special meeting, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Lambert, Mrs. Fickle Nays - None Motion carried. ITEM 7 - ACCEPTANCE OF CARL SEIM'S VETERAN FLAG Ken Thompson explained to Council that the widow of Carl Seim, who was our Park Superintendent, has requested the City accept this veteran flag to fly at the City building. He explained her request is quite an honor to the City. Motion was made by Don Thompson, seconded by Al Lambert, to accept Carl Seim's veteran flag, from P~Zrs. Seim, to be flown at the Recreation Center, with a plaque, subject to Mrs. Seim's permission. Ayes - Messrs. Spencer, Thompson, Lambert, Mrs. Fickle Nays - None Motion carried. ITEM 8 - APPROVE AGREEMENT WITH TULSA COUNTY FOR FIRE EQUIPMENT It was explained the County has donated this new four-wheel drive equipment to us, to be used mainly for rural fire runs. County will maintain title, although we will house the vehicle and maintain it, and fees collected on fire runs may be kept by Owasso, The truck is here now, but not in use. City Attorney advised he has no objections to this arrangement. Motion Baas made by Al Lambert, seconded by Robbie Fickle, to accept fire equipment from Tulsa County and approve agreement for same, and by reference made a part hereof. Owasso City Council February 5, 1980 Page Five ITEM 9 - SET DATE FOR PUBLIC HEARING ON OWASSO HOUSING ASSIS- TANCE PLAN Ken Thompson explained this is the starting process to qualify Owasso for a Community Development Block Grant for upgrading of certain sections of the community. He said it involves two public hearings, one by the Planning Commission, and one by the City Council. He said a Fair Housing Ordinance will be needed to comply with State and Federal laws. Mrs. Fickle commented this has been discussed in the past but it has never been carried through. Motion was made by Robbie Fickle, seconded by Al Lambert, to set March 4, 1980, at 7:00 PM, as the date to hold Public Hear- ing to receive recommendations for housing plans for the City of Owasso, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Lambert, Pers. Fickle Nays - None Motion carried. ITEM 10 - NEW BUSINESS Item Mayor Spencer questioned the status of the Civil Defense siren which was budgeted in Revenue Sharing. City Clerk advised Mr. Schick had picked up specifications from her office. Item Mayor Spencer mentioned there are some loose-ends that need to be covered in a work session and then be placed on the agenda. Work session was set for Thursday, March 6, at 6:30 PM. Item Mr. Charney mentioned a legal opinion given to the City Manager regarding emergency escort. He said his opinion was that if an individual has an emergency and requires an escort, our Police could not do it as we have no authority outside of our City and could involve the City in a law suit. The City should recommend calling our ambulance. Another legal opinion given was the medical care of prisoners. He said the City must provide adequate medical care, so if a prisoner is sick and has to be taken to a hospital, the City Owasso City Council February 5, 1980 Page Six must take him. In a 1956 Supreme Court case, it was decided that if a prisoner is indigent, and cannot pay for his hospital care, the City is responsible. Item Mr. Charney requested that Item 4 of the OPWA Agenda, Approve Vacating Portion of Sewer Easement in Three Lakes Shopping Cen- ter, also be approved under City of Owasso. Motion was made by Don Thompson, seconded by Al Lambert, to ap- prove vacating portion of sewer easement in Three Lakes Shop- ping Center in accordance with the plan as approved by Bill Williams, and by reference made a part hereof.
