the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda
posted on City Hall Bulletin Board at 3:00 PM on February 29, 1980, and by re-
ference is made a part hereof.
Present: Boyd Spencer, Mayor
Robbie Fickle, Vice Mayor

Absent: None
The meeting was called to order at 7:04 PM, with Mayor Spencer presiding.
ITEM 1 - PUBLIC HEARING ON PROPOSED OWASSO HOUSING ASSISTANCE PLAN
Richard Brierre explained to Council that this is the first step for possible
participation in a Community Development Block Grant program and the purpose of
the public hearing is to receive suggestions from the public.
Don Thompson asked what about the possibilities of Owasso receiving any funds
and would our chances be better after the 1980 census. Mr. Brierre replied that
our chances of receiving funds would depend greatly on what other cities apply,
as it is a competitive program, and Owasso does not stand up too well under the
competition.

Housing Assistance Plan, and by reference is made a part hereof.

the Council meetings. He said they will have complete Council packets and will
'have imput in discussions, but no voting power. The two students present were
Pam Rice and Mike Williams.
ITEM 2 - APPROVE CONSENT AGENDA ITEMS
Motion was made by Robbie Fickle, seconded by Al Lambert, to approve Consent
Agenda items, as follows, as published in the Owasso Reporter on February 28,
1980, and by reference is made a part hereof.
A. Approve Minutes of February 19, 1980 Regular Meeting.
B. Approve Warrants for Payment.
C. Approve Resolution No. 80-5 Adopting New Municipal Budget Act.
D. Approve Minutes of February 25, 1980 Special Meeting.
E. Approve Ordinance No. 282 Establishing Ambulance Rates.

ITEM 9 - REVIEW CONTRACT FOR CITY HALL JANITOR SERVICE
This item was moved up in the agenda per Dave Thompson's request.
Councilman Thompson requested that the minutes reflect he left the room during
this discussion as he has a personal interest in the item.
Ken Thompson said a problem has arisen with the cleaning of three rooms; the
Dispatcher's office, Officers' room and Police Chief's office. We are now re-
questing Dave Thompson to clean these rooms and he is requesting an amendment
to his contract to do so as he did not originally include the rooms in his bid.
The additional charge per month would be $30.00. Ken Thompson mentioned the ex-
clusion of the rooms was not a part of the contract, but he was apparently ad-
vised by the previous City Manager to not clean the rooms.
Mayor Spencer said he didn't remember the Council discussing not cleaning the
three rooms so the City Manager must have taken it upon himself to give that
direction. Dave Thompson confirmed it was the City Manager that told him not
to clean the rooms.

Mayor Spencer then said the question is, were the other three bidders told the
same thing he was told about not cleaning the rooms, and if they also exluded
the rooms from their bids. Mayor Spencer asked that the other bidders be con-
tacted. Mayor Spencer asked Dave Thompson if he felt that would be fair and
Dave Thompson said "yes".
Mayor Spencer directed this item be tabled to the April lst meeting and directed
Mr. Thompson to continue cleaning as he has been until that meeting.
ITEM 3 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT
Motion was made by Robbie Fickle, seconded by Boyd Spencer, to approve addi-
tional warrants for payment, and by reference made a part hereof.

ITEM 4 - APPROVE CONDITIONAL FINAL PLAT ON FORREST DRIVE INDUSTRIAL PARK
Carol Dickey, City Planner, advised Council that the staff and Planning Commis-
sion recommend approval.
Motion was made by Boyd Spencer, seconded by Don Thompson, to approve condi-
tional final plat on Forrest Drive Industrial Park, and by reference made a part
hereof.

ITEM 5 - APPROVE RESCHEDULING OR CANCELLING MARCH 18, 1980 COUNCI_L_MEETING DUE
TO STAFF ATTENDING NATIONAL LEAGUE OF CITIES CONFERENCE.
Motion was made by Robbie Fickle, seconded by Al Lambert, to cancel March 18,
1980 Council meeting due to council and staff attending NLC conference.

ITEM 6 - RECONSIDERATION OF ZONING OF PROPERTY AT 86TH STREET NORTH AND 129th
EAST AVENUE.
Mayor Spencer asked City Attorney his opinion on this matter, and Mr. Charney
responded that he didn't see anything wrong with it but the Council was really
bothered by some things, so he didn't want to influence them. He did state that
the City cannot deny use of the land if it is within reason.
Carol Dickey said in researching this application, the original application was
heard by the Planning Commission then by the City Council last October. At that
time the Council denied the entire application and that action is final. Ms.
Dickey said the applicant now has two options: 1) take action to District Court,
and 2) wait the required 180 days to make anew application to the Planning Com-
mission. Ms. Dickey said her opinion is that this application cannot be heard
by the City Council without being readvertised and/or going back to the Planning
Commission.
Ron Skoller, attorney for the applicant, responded that from a legal standpoint
the City has the authority to reopen the matter, considering the new facts and
that it would be different if the Planning Commission had rejected the original
plan. He said it can be placed on the agenda as any other item can be place on
the agenda.

Mr. Charney said they possibly have a point in that the Council is being asked
to reconsider their own action.
Carol Dickey confirmed the map before the Council is the original map presented
to the Planning Commission.
Rick Riddle, Ron Skoller's associate, said they are asking this to be recon-
sidered by the Council before they have to take same legal action, as they will
file a law suit.
Due to a problem of litigation, Don Thompson requested the Council go into an
executive session.
Ms. Dickey again mentioned that this item had not been advertised, to which Mr.
Riddle responded: "Yes, it has been by being on the agenda".
Mr. Riddle said the original concern had been with the width of the streets, the
30' right of way being dangerous as far as access to emergency vehicles. He
said they are willing to make those concessions. Mr. Riddle said the problems
between the City and the developer can be compatible but in October these dif-
ferences were not understood and clarified.
Mayor Spencer called a recess at 8:10 PM to go into Executive Session to discuss
the threat of a law suit to the City.
Mayor Spencer reconvened Owasso City Council at 9:06 PM.
Mayor Spencer said this item is tabled to the April 1, 1980 City Council meet-
ing.
ITEM 7 - DISCUSSION ON RESIDENTIAL LAND USE PLAN
Ms. Dickey said this item is brought to the Council at this time only for infor-
mation and comments. It is Phase One. Phone Two will be finished by the end of
the year. She said it was given to the Planning Commission at their last meet-
ing.
Don Thompson asked what it is to be used for. Ms. Dickey said that hopefully
we can use it as a guide for capitol improvement planning.
Ken Thompson said it is simply making predictions for the future and asking us
if we agree or disagree.
ITEM 8 - REQUEST BY INCOG TO INDICATE IF CITY OF OWASSO WANTS TO PARTICIPATE IN
THREE YEAR ENTITLEMENT PROGRAM FOR LAW ENFORCEMENT ASSISTANCE GRANTS
City Manager recommended the LEA grant through INCOG would be in our favor as we '
would only be competing with local funds.

Mayor Spencer mentioned some problems in the past with this type grant. Ken
Thompson said we will be very selective in what we do but at present we have
nothing in mind.

three year entitlement program for Law Enforcement Assistance Grant through
INCOG.

ITEM 10 - REQUEST TO EXTEND ANNUAL FISK MAINTENANCE AGREEMENT
Motion was made by Don Thompson, seconded by Robbie Fickle, to approve exten-
sion of annual Fisk maintenance agreement, and by reference made a part hereof.
