HomeMy WebLinkAbout1980.05.20_City Council MinutesOn Tuesday, May 20, 1980, the Owasso City Council met in regular session, in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 3:00 PM on May 16, 1980, and by reference made a part hereof. Present: Boyd Spencer, Mayor Robbie Fickle, Vice Mayor (arrived at 7:10 PM) Al Lambert, Councilman Dennis Burke, Councilman Clyde Fry, Councilman Kenneth Thompson, City Manager Harold Charney, City Attorney Merrilyn Merchant, Deputy City Clerk Absent: None Mayor Spencer called the Owasso City Council to order at 7:00 PM. ITEM 1 - APPROVE CONSENT AGENDA ITEMS Motion was made by Al Lambert, seconded by Clyde Fry, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on May 15, 1980, and by reference made a part hereof: A. Approve Minutes of May 6, 1980 Meeting. B. Approve Warrants for Payment. Ayes - Messrs Spencer, Burke, Fry, Lambert Nays - None Motion carried ITEM 2 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT Motion was made by Al Lambert, seconded by Dennis Burke, to approve additional warrants for payment, and by reference made a part hereof. Ayes - Messrs Spencer, Burke, Fry, Lambert Nays - None Motion carried ITEM 3 - APPROVE ORDINANCE N0. 284 REQUIRING INSTALLATION OF SMOKE DETECTORS AND PROHIBITING WOOD SHINGLES ON MULTI-FAMILY BUILDINGS City Attorney, Harold Charney, indicated this ordinance is practically identical to the BOCA code, except for wood shingles. He asked Raymond May to look over , the ordinance and they felt it should not include smoke detectors as this is already covered in the BOCA code which we have adopted. He indicated the City had adopted the entire BOCA Code in Ordinance 4261. Motion was made by Clyde Fry, seconded by Al Lambert, to approve Ordinance No. 294, prohibiting Wood Shingles and Shakes on Multi-Family Buildings. Nays - None Motion carried Motion was .made by Robbie Fickle, seconded by Dennis Burke, to adopt the emergency clause to Ordinance No. 284, making the ordinance effective immediately. Ayes - Messrs Spencer, Burke, Fry, Lambert, Mrs. Fickle Nays - None Motion carried ITEM 4 - APPROVE REQUEST TO AUTHORIZE SALE OF THREE CITY OWNED VEHICLES: 1967 3/4 TON INTERNATIONAL PICKUP, 1966 1/2 TON GMC PICKUP, AND 1973 FORD SEDAN City Manager, Kenneth Thompson, indicated bids had been received in the following amounts: 1967 3/4 Ton International Pickup -- $200.00; 1966 1/2 Ton GMC Pickup - $410.00; 1973 Ford Sedan - No Bid. He also said that since the auction, we had received a written bid for $100.00 on the 1973 Ford Sedan. Motion was made by Robbie Fickle, seconded by Dennis Burke, to accept the bids on all three vehicles. Ayes - Messrs Spencer, Burke, Fry, Lambert, Mrs. Fickle Nays - None Motion carried ITEM 5 - APPROVE FILING GRANT APPLICATION WITH LEAA FOR POLICE TRAINING AND PREVENTION PROJECT Mayor Spencer asked if this would be an addition to the Police Department personnel, or training for a present member of the force. Mr. Thompson replied it would be training for one of the present Sergeants. Motion was made by Robbie Fickle, seconded by Al Lambert, to approve filing the grant application with LEAA for Police Training and Prevention project. Ayes - Messrs Spencer, Burke, Fry, Lambert, Mrs. Fickle Nays - None Motion carried ITEM 6 - APPROVE PURCHASE OF NEW 1/2 TON COMPACT PICKUP FROM GENERAL REVENUE SHARING FUNDS ,~ ; Mr. Thompson requested that the City purchase one 1/2 Ton Pick-up to replace one sold, transfer the animal control truck back to OPWA, and purchase one Volare. Owasso City Council May 20, 1980 Page Three He also indicated the Council might want to consider this item along with Item No. 8, which is a request to purchase an automobile from General Revenue Sharing Funds. Bids on the 1/2 Ton Compact Pickup were received as follows: Datson, 4-speed - $6130.00 5-speed - $6135.00 Ford Courier, 4 speed - $5380.00 Toyota, 4-speed, no air - $5115.00 Chevrolet, no air but included radio - $5411.20 Mr. Thompson also said the car he was recommending was a Plymouth Volare, 1979 model, 22,000 miles at $3623.00. This auto is a 4-door sedan with power steering and brakes, from Cox Motor Company, turned in on rental, with a slant 6 engine. Discussion on purchase of the vehicles was as follows: Mr. Fry indicated he thought we should get a pick-up and car. Mr. Lambert said he would prefer the Volare because it has a slant 6 engine and that engine is a proven engine. Mayor Spencer said he would like the 1/2 ton pick-up, but did not feel we should buy another automobile. He indicated we have one now that Bill (Williams) can use. He would rather have two pick-ups than one pick-up and one automobile. Mr. Burke thought we should go with the Toyota pick-up. He would not want us to go with a Volare as he had one that was not very good and his opinion of Chrysler products was not very high. Mrs. Fickle said she assumed that the Toyota would be the best purchase. She questioned which Revenue Sharing Fund would be used. Mr. Thompson said the 79-80 General Government - City Improvements and Acquisitions. We have around $10,000 in this fund per Kenneth Kite, City Treasurer. Mrs. Fickle felt two trucks would probably be more beneficial to the City. Kenneth Thompson felt a car would be better because we could use it for meetings and to take people around on visits. Mr. Lambert questioned if we had considered a carry-all instead of a pick-up or car, to which Mr. Thompson replied he felt they would not be economical, probably getting only around 10 m.p.g. Mr. Lambert said in 1964 they got around 16-17 m.p.g. but maybe they had changed in the later cars. Motion was made by Clyde Fry, seconded by Dennis Burke, to purchase one Toyota Pick-up at a cost of $5115.00 as bid. Ayes - Messrs Spencer, Burke, Fry, Lambert, Mrs. Fickle Nays - None Motion carried ITEM 8 - UNFINISHED BUSINESS A - REQUEST TO PURCHASE AUTOMOBILE FROM GENERAL REVENUE SHARING FUNDS Motion was made by Dennis Burke, seconded by Al Lambert, to follow the City Manager's recommendation and purchase the used 1979 Volare from Cox Motor Company, as described in Item No. 6. Ayes - Messrs Burke, Fry, Lambert Nays - None Abstain - Mayor Spencer (Mrs. Fickle chose not to vote) B - APPROVE ELECTRICAL INSPECTIONS BY OWASSO BUILDING INSPECTOR Mr. Wilson, City of Tulsa Inspector, was asked by the City Council if he felt Mr. Raymond May would be qualified to do electrical inspections. Mr. Wilson said it was hard to have a man for two days and tell if he was qualified; how- ever, he does seem knowledgeable on the electrical code. Mr. Wilson felt it was not his place to tell if he would be qualified or not. Mr. Wilson was asked how he became qualified to which he replied he was an electrician for 40 years and took a test. He indicated Tulsa follows House Bill 1024, which applies to cities of 188,000 population, which states that any inspector must have 10 years experience as a Class A Journeyman Electrician before he can be an inspector. He also said smaller towns usually have one person to do mechanical, electrical and building inspections. He indicated it is left up to the individual cities as to how they determine who is qualified. Mr. Thompson said he had tried to obtain a written test locally and wondered if Mr. Wilson might have one. Mr. Wilson said Ohio had a written test which every- one must take, but that law had thus far been defeated in Oklahoma. He indi- cated that BOCA is currently getting in line to have a test to check inspectors. He also indicated he would furnish a test and administer it for the City. He said Tulsa was the only city in Oklahoma operating under House Bill 1024. Other cities in Oklahoma operate under city ordinances. Al Lambert asked if Mr. Wilson could forsee any problems in Mr. May inspecting licensed electricians. Mr. Wilson, and the Tulsa County Inspector, indicated licensed electricians would resent it very much if an unlicensed inspector inspected their work. The Class A Journeyman test requires three years experience before you can even take the test. Mr. Wilson said it would be rough not to have the experience and have to refer to the book on making inspections. Owasso City Council May 20, 1980 Page Five Mr. Bill Maples, Tulsa County Inspector, said he would ask the City Council to preserve the integrity of the City by having an inspector that has at least 10 years experience. He said Owasso is a beautiful little city and should not be trying to save the fee by sending someone that is not qualified. He brought some items to the Council which he felt should be used to set up an inspection office. He indicated that Public Service engineers would be glad to come in and do inspections for the City. Also, a representative from Public Service at Oologah might be utilized. He said if we wanted to terminate our agreement with Tulsa County, we could do this with 30 days notice. Mr. Maples indicated Owasso is growing and deserves to have its own inspection team. He said in April, 1979, 42 inspections were made at a cost of $433.00, $216.50 of which came to the city; May, 1979, 45 inspections - $589.00; June, 1979, 40 - $538; July, 1979 - $614.00; March, 1980, 9 - $57.40; April, 1980, 13 - $67.00. Mr. Maples said there were 200+ electrical contractors in this area. Class A Electricians can do commercial businesses and Class B are qualified to do residential only. He indicated that the Wyzard brothers were in this area and he had never had to turn down any of their work. Ken Wyzard is Class A and J.D. Wyzard is Class B. There are also others who would be good to hire to do inspections. Motion was made by Robbie Fickle, seconded by Al Lambert, to deny approval of Electrical Inspections by Owasso Building Inspector, and to continue as we are now doing with the Tulsa County Electrical Inspector making the inspections, until such time as all avenues have been exhausted to get Mr. May licensed to do electrical inspections. Ayes - Messrs Spencer, Burke, Fry, Lambert, Mrs. Fickle Nays -None Motion carried ITEM 9 - APPROVE SUPPLEMENTAL APPROPRIATION City Treasurer, Ken Kite, told the Council once we reach 90% of total appropria- tions, we are allowed to supplement the appropriation. We have now reached this figure and can go back to the Excise Board for further appropriations. We can take this money and add to the money we need. There will be another appro- priation at a later date. Motion was made by Robbie Fickle, seconded by Dennis Burke, to approve the supple- mental appropriation.
