HomeMy WebLinkAbout1980.09.02_City Council MinutesOn Tuesday, September 2, 1980, the Owasso City Council met in regular session, in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda, posted on City Hall Bulletin Board at 3:00 PM on August 29, 1980, and by reference made a part hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 7:10 PM, with Mayor Spencer presiding. ITEM 2 - FLAG SALUTE. Flag Salute was led by Mayor Spencer. ITEM 3 - ROLL CALL. Present: Boyd Spencer, Mayor Robbie Fickle, Vice Mayor Al Lambert, Counc~;lman Dennis Burke, Councilman Harold Charney, City Attorney Kenneth Thompson, City Manager Wauhilleau Webb, City Clerk Absent: Clyde Fry, Councilman ITEM 4 - APPROVE CONSENT AGENDA ITEMS. Motion was made by Robbie Fickle, seconded by Al Lambert, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on August 28, 1980, and by reference made a part hereof. A. Approve Minutes of August 29, 1980 Meeting. B. Approve General Fund 79-80 Warrant 1468 for $102.25, General Fund 80- 81 Warrants 167 through 203 for $21,929.54, Revenue Sharing 79-80 Warrant 37 for $320.00, Revenue Sharing 80-81 Warrants 11 through 14 for $1,632.53, Senior Citizen Grant Warrant 1, for $124.02, and authorize Mayor to sign same. Ayes - Messrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. ITEM 5 - ANNEXATION OF HILLSIDE ESTATES. Mayor Spencer explained we will not go to Court until next Monday on the Rural Water District lawsuit, for which we are awaiting the outcome, before making a decision on annexation. Motion was made by Robbie Fickle, seconded by Dennis Burke, to table Hillside Estates annexation issue until the City has concrete information on which to base this decision. Ayes - Messrs. ITEM 6 - APPROVE CORRECTION OF TYPOGRAPHICAL ERROR IN SECTION 1 OF ORDINANCE NO. 279, TO READ EAST 540.00 FEET, RATHER THAN EAST 202.00 FEET. Motion was made by Robbie Fickle, seconded by Boyd Spencer, to approve correc- tion of typographical error in Section 1 of Ordinance No. 279, to read the East 540.00 feet, rather than East 202.00 feet, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. ITEM 7 - PRESENTATION OF RECREATION AND OPEN SPACE REPORT BY THE CORPS OF EN- GINEERS. Mr. Tom Hendricks, PZanager of the Tulsa Urban Study for the Corps of Engineers reminded Council that when he spoke with them and the Planning Commission ap- proximately a year ago they were told four things as a result of the Corps' study: 1) there were not any flood problems in Owasso serious enough to war- rant building a federal project; 2) there are water supply problems both on a local and regional scale that could develop in the future; 3) we have recrea- tional shortages that could be met by using flood plain land; 4) could develop some plans at Owasso's request. The City did request by letter that they do develop flood plain maps under full urbanization conditions. According to the 1980 census Owasso has a population of approximately 6,000 peo- ple. He has learned that we have about 450 soccer players, 400 little league baseball players, 150 little league football players and 250 softball players. The national average of people that participate in unorganized sports show that 4,000 more are involved in jogging or walking, 3800 swimmers, 2800 are riding bicycles, 1900 are tennis players, 900 are golfers and 800 are horseback riders, which totals around 15,000 people. He said these figures tell us that about every person in Owasso is participating in at least two difference forms of recreation. It is estimated that about 10 acres of land per thousand people are needed to provide these activities, plus 8 acres per thousand people for open space, which means 85 acres of recreational land is needed in Owasso based on our cen- sus. We presently have 55 acres which means we have a shortage of 30 acres and if we project our population to the year 2000 we will need an additional 500 acres of land to meet our future growth plans. There are 1500 acres of flood plain land in the Owasso area which is more land than we need to meet desired acreages and extends into every part of the City. By using flood plain land Owasso City Council September 2, 1980 Page Three for recreational purposes it turns a liability into an asset. In selecting the planned areas they look at the volume of the flood plain land, how wide it is, the scenic value, trees, access, and topography for the various types of ter- rain needed for different recreations. Not all of the flood plain land has been used, as it is not needed. The Corps of Engineers cannot finance the construction of these parks but the City can get help with financing through the Heritage Conservation Recreational Service. Mr. Spencer commented that when this plan was presented previously a lot of peo- ple got the impression it was all going to take place at once. This report was left for the Council to study and make recommendations. ITEM 8 - REQUEST 30 DAY EXTENSION OF FINAL PLAT APPROVAL FOR ROBINSON DEVELOP- MENT SUBDIVISION (SOUTH SIDE OF 76TH STREET NORTH, WEST OF SANTA FE RAILROAD). Motion was made by Boyd Spencer, seconded by Al Lambert, to approve request for 30 day extension of final plat approval for Robinson Development Subdivision (South side of 76th Street North, West of Santa Fe Railroad). Ayes - Messrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. ITEM 9 - REQUEST FOR 30 DAY EXTENSION OF FINAL PLAT APPROVAL FOR 76 CENTER SUB- DIVISION (NORTH SIDE OF 76TH STREET NORTH, WEST OF MINGO EXPRESSWAY). Motion was made by Robbie Fickle, seconded by Al Lambert, to approve request for a six week extension of final plat approval for 76 Center Subdivision (North side of 76th Street North, West of Mingo Expressway). Ayes - Messrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. ITEM 10 - APPROVE ADDITIONAL GENERAL FUND WARRANTS FOR PAYMENT. Motion was made by Boyd Spencer, seconded by Robbie Fickle, to approve addi- tional General Fund Warrants 204 through 233 for $30,169.99, and authorize the Mayor to sign same, and by reference made a part hereof. ITEM 11 - REQUEST TO TRANSFER APPROPRIATIONS IN 1979-1980 BUDGET, GENERAL FUND. Mr. Thompson explained this is a normal procedure to balance out the 1979-80 budget, and we are transferring $51,200.00. Mr. Burke questioned the cause of the street repair being $31,000 over budget in Personal Services, and Mr. Kite was not present to explain. Motion was made by Dennis Burke, seconded by Robbie Fickle, to table approval of transfer of appropriations in 1979-1980 General Fund Budget to September 16 for furthur clarification. Ayes - Messrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. ITEM 12 - NEW BUSINESS. Item Mr. Charney reported on the H. D. Hale condemnation that he has received from the attorney all the papers that need to be filed in that case. The City Man- ager was under the impression that the one foot left unplatted was against platting procedures so he asked if we could not just sue as that might save us some money. They are pursuing that question. Item Motion was made by Robbie Fickle, seconded by Boyd Spencer, that when an item appears on the agenda three times without any action being taken that it not appear again for two months except it could be replaced on the agenda at the request of any Council member, effective immediately, Ayes - PZessrs. Spencer, Lambert, Burke, Mrs. Fickle Nays - None Motion carried. Item Mayor Spencer directed Mr. Charney to look over Resolution No. 80-7 which will ~ ~` be considered at the Oklahoma Municipal League Convention, regarding Rural Water Districts.
