HomeMy WebLinkAbout1979.03.20_City Council MinutesOn Tuesday, March 20, 1979, the Owasso City Council met in reg- ular session, in Council Chambers at City Hall, per ~lotice of Public Meeting and Agenda, referenced and made a part hereof. Present: Boyd Spencer, T~ayor Robbie Fickle, Vice Mayor Don Thompson, Councilman ~ Robert Wrestler, Councilman Wayne Meyer, City Manager Harold Charney, City Attorney Wauhilleau Webb, City Clerk Absent: None The meeting was called to order at 7,30 PM, with Mayor Spencer presiding. Motion was made by Don Thompson, seconded by Robbie Fickle, to approve minutes of March 13, 1979, meeting and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion was made by Robbie Fickle, seconded by Robert Wrestler, to approve warrants for payment, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle, with Mrs. Fickle abstaining on warrants 1222 and 1224. Nays - None Motion was made by Don Thompson, seconded by Robert Wrestler, to approve Notice to Bidders for repairs to City pool, and by re- ference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion was made by Robbie Fickle, seconded by Don Thompson, to approve Ordinance 254 correcting numerical designation of that portion of Ordinance 250 set out as Chapter 9, Article 1, Sec- tion 9-14, of the Owasso City Code, to be corrected to read as Chapter 9, Article 1, Section 9-15(a), and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Council publicly accepted for record February 1979 Financial Statements, and by reference made a part hereof. Owasso City Council March 20, 1979 Page Two ,~,,,~„ When the Larkin Bailey property annexation came before the City Council, Mrs. Fickle excused herself and left the room during consideration of this annexation and Mayor Spencer explained to the public the reason Mrs. Fickle excused herself is that her husband has an interest in this annexation. Don Thompson asked City Attorney what the City's legal responsibility is to pro- vide City utilities to this nine acres, to which Mr. Charney replied none. Motion was made by Robert Wrestler, seconded by Don Thompson, to approve Ordinance 252 for Larkin Bailey property annexation, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler Nays - None Abstain - Mrs. Fickle (as not being present) Motion was made by Robert Wrestler, seconded by Don Thompson, to approve emergency clause to Ordinance 252. ,~...~,~ Ayes - Messrs. In regard to accepting bids on water line replacement, Mr. Thompson asked if asbestos pipe meets EPA requirements, and Mr. Williams replied it does. Motion was made by Don Thompson, seconded by Robert Wrestler, to accept Mansur-Daubert-Williams recommendations and purchase per tabulations the water line replacement on HUD grant, which will include several different companies and different items, and by reference made a part hereof. Spencer, Thompson, Wrestler Nays - None Abstain - Mrs. Fickle Motion was made by Don Thompson, seconded by Robbie Fickle, to """ remove Item 10 from Owasso City Council agenda and place same on Owasso Public Works Authority agenda. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion was made by Robbie Fickle, seconded by Don Thompson, to accept City Attorney request to increase his fee from $40.00 to $50.00 per hour during normal business hours, with his fee re- maining at $40.00 for Council meetings, and by reference made a part hereof. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion was made by Don Thompson, seconded by Robbie Fickle, to approve and accept Fiscal 77-78 Financial Audit by independent auditor. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Discussion of commercial refuse service was moved to the Spec- ial Meeting scheduled for March 22, 1979. Motion was made by Robbie Fickle, seconded by Robert Wrestler, to approve Ordinance 253 Amending Chapter 9, Article 2, Section 9-2 of the Owasso City Code providing for mandatory refuse col- lection by persons occupying residential or commercial premises and by reference made a part hereof. Ayes ,Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Motion was made by Don Thompson, seconded by Robert Wrestler, to approve emergency clause to Ordinance 253. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None i~iotion was made by Robbie Fickle, seconded by Don Thompson, to table Parcel 10 portion of Rezoning Application 0ZR43 until the partitioner asks it to be put back on the agenda for Council`s consideration, and City Clerk notify applicant of same. Ayes - Messrs. Spencer, Thompson, Wrestler, Mrs. Fickle Nays - None Owasso City Council March 20, 1979 Page Four No one on Council had appointments for the Personnel Board or the Planning Commission. Bill Williams reported he still has not heard from Emulco re- garding the streets in Elm Creek and they have not been as of this date repaired. Mr. Thompson commented the weather still has not been cooperative. Mr. Thompson directed Mr. Williams to provide Council with a list of what needs to be repaired. Motion was made by Don Thompson, seconded by Robert Wrestler, to table discussion on Elm Creek streets to April 17, 1979, meet- ing. Ayes - Messrs.
