Present: Boyd Spencer, Vice Mayor Don Thompson, Councilperson Robbie Fickle, Councilperson Wayne Meyer, City Manager Harold Charney, City Attorney Wauhilleau Webb, City Clerk Absent: None The meeting was called to order at 7:05 Pl`~i, with Vice Mayor Spencer presiding. Employee o~ the Month Award was presented to Lorraine Mallory in the Purchasing Department. :'lotion was made by Don Thompson, seconded by Robbie Fickle, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on March S, 1979, and by reference made a Hart hereof. 1. Approve Minutes of February 20, 1979, Meeting 2. Approve Warrants for Payment Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None 1`~otion was made by Robbie Fickle, seconded by Don Thompson, to approve the March 20 Council meeting to be held at 7:30 PM rather than 7:00 PM, due to City Elections. Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None Motion was made by Don Thompson, seconded by Robbie Fickle, to approve additional warrants for payment, and by reference made a part hereof. Ayes - i~essrs. Spencer, Thompson, Mrs. Fickle Nays - None In regard to accepting bid for payroll and budget software programs from Boyle and Associates, Mr. Thompson asked about the $3,000.00 on the bid. Mr. ~'Ieyer explained Boyle is us- ing a basic control system but will charge $3,000.00 to add the additional reports that we require. Mr. Thompson then asked how far along we are on the computer programs and Mr. r•Zeyer replied when the computer arrives we will immediately Owasso City Council March 13, 1979 Page Two go on the utility billing, go on budget program July 1, and go on payroll September 1. Motion was made by Don Thompson, seconded by Robbie Fickle, to approve and accept bid from Boyle and Associates for the payroll and budget software programs, and by reference made a part hereof_ . Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None In regard to approving the increase in City Attorney's fees Mr. Charney commented he does not intend to increase his hourly rate for evenings as he is willing to donate that much to the City, but during his business day he must in- crease his rate to $50.00 per hour, which is still below his regular hourly charge to clients. Mrs. Fickle stated she would like to take this action under advisement until next meeting. City Clerk was directed to place this item on the March 20, 1979, agenda. Boyd Spencer said he had read the financial audit for 77-78 and he wanted to do more searching and reading, although he felt it is something the City is going to have to do and do in the near future. Mr. Jay was asked if it must tonight be accepted, to which Mr. Jay replied no, but it needs to be accepted by April 1. Motion was made by Don Thompson, seconded by Robbie Fickle, to table approving and accepting Fiscal 77-78 Financial Audit by independant auditor to March 20, 1979, Council. Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None Motion was made by Don Thompson, seconded by Robbie Fickle, to approve Supplemental Approriation for General Fund 78-79. Ayes - Messrs. Spencer, Thomason, Mrs. Fickle Nays - None Wayne Meyer reminded Council that the CETA grant for Fire Department personnel has been submitted in the past and we were advised we could submit our application again. Motion was made by Robbie Fickle, seconded by Don Thompson, to apply for CETA Grant for Fire Department personnel. Owasso City Council March 13, 1979 Page Three Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None Motion was made by Robbie Fickle, seconded by Don Thompson, to approve going out on bid for pager system for Fire De- partment. Ayes - i~essrs. Spencer, Thompson, Mrs. Fickle Nays - None In regard to discussion on commercial refuse service, City Attorney commented he had conferred with City rlanager and looked at statutes and ordinances and it appears ambiguous. Mr. Charney stated he would like a week to review and then render a legal opinion based upon the law and not upon per- sonal opinions. He further stated his present opinion is that it is definitely ambiguous; however, he understands that there is a new ordinance he has not seen. Mr. Tom Hilborne replied that the ordinance he is referring to is on rates only. Council tabled this item and directed City Clerk to place same on the March 20, 1979, Council agenda. Council directed City Clerk to table Item 12 Approve Ordi- nance 251 for Building Setback Lines from Center of Roads, Amending Chapter 2, Section 280 of Owasso Zoning Code and Item 13 Approve Ordinance 252 for Larkin Bailey Property annextion to April 17, 1979. OLD BUSINESS: City Clerk was notified that Never Fail was still not ready to present their case on Rezoning Application OZ-43 and had asked that it be continued. Jack Gorzeman commented that it is okay for Council to just consider Parcel 10 of this application and not the entire application as previously understood. Applicant is requesting this Parcel 10 to be rezoned from RS-2 to R:~-l. Planning Commission recommends RS-2 to RS-3. With regard to appointments to the Personnel Board and the Planning Commission, Boyd Spencer commented he could not get any response when talking to people to fill these posi- tions. Mr. Thompson replied the same thing happens to him when he talks to citizens as they just reply "no, I don't think I want to do that". George Phillips asked Council just how effective is the Planning Commission. Mr. Spencer replied very effective. Mr. Thompson asked Mr. Phillips how Owass City Council March 13, 1979 Page Four he means "'effective". Mr. Phillips said he understands their function is to study and made recommendations to the City Council so he means effective in regard to Council using the Commission's recommendations. Mr. Thompson answered yes, their recommendations are used. Mayor Spencer asked Mr. Phillips if he would like to serve on the Planning Commis- sion to which Mr. Phillips replied he didn't know, he would have to think about it. Mayor Spencer then asked if anyone present would be interested in serving on either of these Boards. Mayor Spencer explained the purpose of the Person- nel Board is to hear employees that might be terminated and request a hearing regarding his termination. Bill Williams stated he had talked with Emulco and they had assured him that next week they will get the streets in Elm Creek repaired. Council tabled this item to the March 20th Council meeting. NEW BUSINESS: Mr. Eldon Winslow was present in audience and asked what Council has done about the carport that was built in vio- lation of City Code. City Attorney advised Mr. Weston that he could file a citizens injunction against the other citi- zen as he has violated the subdivision platting regulation. Mr. Winslow asked Council if they would issue him a build- ing permit to construct a carport. Mayor Spencer said that would be the Building Inspectors decision. City Attorney said he would advise the City not to give a building permit for this carport as it would be against the setback ordi- nance. Mr. Thompson asked Mr. Charney what the Council's responsibility is to Mr. Winslow as a citizen as the other citizen did build this structure without a building permit. Mr. Charney replied that everyone is asking a lot of legal questions he cannot immediately answer but Mr. Charney still suggests Mr. Winslow can accomplish more on a citi- zen's injunction than the City can accomplish. Mr. Wayne Vines addressed the Council stating he likes the new trash service and feels it is working out really well. Lee DeBoer commented to Council he would like to have some answers to the questions posed at the March 2nd town meet- ing held by citizens of which a copy of their minutes was presented to City Council. Motion was made by Don Thompson, seconded by Robbie Fickle, to appoint Boyd Spencer as Mayor for remainder of previous mayor's term. Ayes - Mr. Thompson and 1-Zrs. Fickle Nays - None Motion was made by Don Thompson, seconded by Boyd Spencer, to appoint Robbie Fickle as Vice Mayor for remainder of pre- vious vice mayors term. Ayes - Messrs. Thompson and Spencer Nays - None Motion was made by Robbie Fickle, seconded by Don Thompson, to appoint Robert Wrestler, Jr., for the remainder of the unexpired term of Ward 1. Ayes - Messrs. Spencer, Thompson, Mrs. Fickle Nays - None Oath of Office was given to Mr. Wrester by City Attorney, and by reference made a part hereof.
