Consideration and appropriate action relating to OA- 15 -05, annexing property located along the southern edge of the SKO Railroad spur just west of the Public Works facility (301 W 2nd Ave) Karl Fritschen Subject to Planning Commission recommendation, staff will recommend approval of OA 15- 05, the request to annex the subject property into the corporate limits of the City of Owasso maintaining the Agriculture (AG) zoning. 7. Consideration and appropriate action relating to OA- 15 -06, annexing property located north of 76th St N adjacent to Ranch Creek and to the west of the property associated with annexation case OA 15 -05 Karl Fritschen Subject to Planning Commission recommendation, staff will recommend approval of OA 15- 06, the request to annex the subject property into the corporate limits of the City of Owasso maintaining the Agriculture (AG) zoning. 8. Consideration and appropriate action relating to OA- 15 -07, annexing property located north of 761h St N just west of Ranch Creek Karl Fritschen Subject to Planning Commission recommendation, staff will recommend approval of OA 15- 07, the request to annex the subject property into the corporate limits of the City of Owasso maintaining the Agriculture (AG) zoning. 9. Consideration and appropriate action relating to the renewal of the Pelivan Transit Agreement Bronce Stephenson Staff recommends approval of the Purchase of Service Agreement between the City of Owasso and Grand Gateway Economic Development Association (Pelivan Transit) in the amount of $51,000 for transportation services. 10. Consideration and appropriate action relating to the purchase of a vehicle in the Fire Department Chris Garrett Staff recommends approval to purchase a 2015 Dodge Charger in the amount of $31,223.50 from John Vance Motors of Guthrie, Oklahoma per the Oklahoma State Bid award. 11. Consideration and appropriate action relating to the purchase of a vehicle in the Stormwater Division Tim Doyle Staff recommends approval to purchase a 2016 Ford F250 Crew Cab dedicated CNG pickup in the amount of $43,399 from Bill Knight Ford of Tulsa, Oklahoma per the Oklahoma State Bid award. Consideration and appropriate action relating to a budget amendment for FY 2014 -15 Budget Carryover for re- appropriation in the FY 2015 -16 budgets Linda Jones Staff recommends the following FY 2016 budget amendments: • increase the estimated revenues by $82,867 and the appropriation for expenditures by $640,970 for the General Fund; • increase the appropriation for expenditures in the Half -Penny Sales Tax Fund by $338,037; • increase the appropriation for expenditures in the Ambulance Service Fund by $20,591; • increase the appropriation for expenditures in the Cemetery Care Fund by $540; • increase the appropriation for expenditures in the Hotel Tax Fund by $60,133; and • increase the appropriation for expenditures in the Stormwater Management Fund by $815,406. 13. Consideration and appropriate action relating to a request for an executive session for the purpose of discussing confidential communications between the City Council and the City Attorney, concerning pending litigation styled Patrick Ross v. City of Owasso et aL, CJ -2013- 898; as provided in Title O.S. 25, Section 307(B)(4) Julie Lombardi 14. Consideration and appropriate action relating to Resolution 2015 -16, designating the City Manager as the settlement representative for the mediation in the litigation styled, Patrick Ross vs. City of Owasso et al., CJ- 2013 -898, and additionally granting full and final settlement authority in this litigation matter to the City Manager Julie Lombardi Staff recommends approval of Resolution 2015 -16. 15. Sherry Bish6l6, City Clerk t- OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, September 1, 2015 The Owasso City Council met in regular session on Tuesday, September 1, 2015, in the Council Chambers at Old Central, 109 N Birch, Owasso, Oklahoma per the Notice of Public Meeting and Agenda filed in the office of the City Clerk and posted on the City Hall bulletin board at 6:00 pm on Friday, August 28, 2015. 1. Call to Order Mayor Jeri Moberly called the meeting to order at 6:30 pm. 2. Invocation The invocation was offered by Daniel Copeland, Youth Pastor of Owasso Pentecostal Church. 3. Flag Salute Councilor Kelley led the flag salute. 4. Presentation of the Character Trait of Dependability Mike Henry, Character Council Member, presented the Character Trait of Dependability for the month of September. 6. Consideration and appropriate action relating to a request for approval of the Consent Agenda. (All matters listed under "Consent" are considered to be routine and will be enacted by one motion. Any Councilor /Trustee may, however, remove an item from the Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable.) A. Approve minutes - August 18, 2015 B. Approve claims Dr. Kelley moved, seconded by Mr. Bonebrake to approve the Consent Agenda with claims totaling $145,632.48. Also, included for review were the self- insurance claims report and the payroll report for 08/22/15. Public hearing and consideration and appropriate action relating to Planned Unit Development (PUD- 05 -02A), for property located at between E 116th St N and E 126th St N, and between N 129th E Ave and US -169 Bronce Stephenson presented the item recommending approval of PUD- 05 -02A with the following conditions: • No A/C condensers be allowed in side yard setbacks in the residential areas • All residential lots shall maintain a minimum 25 foot front yard setback • Multi- family development shall only be allowed in Commercial Area 'G' The Mayor opened the Public Hearing for comment. No citizen input was offered. After discussion, Dr. Kelley moved, seconded by Mr. Dunn to approve PUD- 05 -02A with conditions, as recommended. YEA: Bonebrake, Dunn, Kelley, Moberly NAY: None Motion carried: 4 -0 9. Consideration and appropriate action relating to the award of a bid for lighting for the 4 -plex located in the south portion of the Owasso Sports Park Larry Langford presented the item recommending award of the bid to Shawnee Lighting in the amount of $339,665 for the installation of lighting for the baseball 4 -plex at the Owasso Sports Park. After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to award the bid in the amount of $339,665, as recommended. YEA: Bonebrake, Dunn, Kelley, Moberly NAY: None Motion carried: 4 -0 10. Consideration and appropriate action relating to Ordinance 1059, Rules of Debate, amending 2- 411(H) to include a provision establishing a motion to reintroduce a new item of business within six (6) months of the City Council's original vote on an item Julie Lombardi presented the item recommending approval of Ordinance 1059. After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to approve Ordinance 1059, as recommended. YEA: Bonebrake, Dunn, Kelley, Moberly NAY: None Motion carried: 4 -0 11. Consideration and appropriate action relating to Resolution 2015 -16, supporting the letter requesting an opinion from the Oklahoma Attorney General regarding the Interlocal Cooperative Jail financing Agreement submitted on or about August 20, 2015, signed by attorneys for the City of Tulsa, the City of Sand Springs, the City of Jenks and the City of Collinsville Julie Lombardi presented the item. Tulsa County Commissioner John Smaligo addressed the Council regarding this item. Call to Order Mayor /Chair Moberly called the meeting to order at 6:03 pm. Discussion relating to an application for Surface Transportation Funds (E 96th St N & N 1451h E Ave) Dwayne Henderson presented the item and discussion was held. It was further explained that a proposed resolution would be submitted for Council consideration and action during the October 6, 2015 meeting. 4. Discussion relating to Community Development items A. Pelivan Contract renewal B. Annexations - OA 15 -05, OA 15 -06, OA 15 -07 Bronce Stephenson presented item A and discussion was held. It was further explained that a proposed renewal agreement would be submitted for Council consideration and action during the September 15, 2015 meeting. Karl Fritschen presented item B and discussion was held. It was further explained that each annexation request would be placed on the September 15, 2015 Council agenda for consideration and action. 5. Discussion relating to the purchase of the radio system upgrade Larry White presented the item and discussion was held. It was further explained that proposed purchase contract would be placed on the October 6, 2015 Council agenda for consideration and action. 6. Discussion relating to Finance items A. It was further explained that item A would be placed on the September 15, 2015 Council and OPWA agendas for consideration and action and item B would be placed on the October 6, 2015 Council agenda for consideration and action. No discussion held. 8. Discussion relating to the annual Mayoral election process Mayor Moberly presented the item and discussion was held. An opportunity for additional discussion will be placed on the March or April 2016 worksession agenda prior to the mayor and vice -mayor election in May. 9. Discussion relating to City Manager items • Tulsa's Future III - Mr. Lehr presented the item and staff's intention to continue participation in the program. Discussion was held. • Election date changes - Mr. Lehr advised of new legislation affecting election dates conducted by the County Election Board and how the changes will affect future Owasso elections. Discussion was held. • Monthly Sales Tax Report - Linda Jones presented the sales tax report. Discussion was held. • City Manager Report - Mr. Lehr reported that Teresa Willson, IT Director, returned from a conference in Washington D.C. where she was invited to present information on the city's use of the NextDoor social media tool. 10. City Council /Trustee comments and inquiries Mayor Moberly provided an update on the Tulsa Regional Chamber intercity visit to Nashville, TN with area elected officials, regional business, chamber, and civic representatives. 11. TO: The Honorable Mayor and City Council City of Owasso FROM: Scott Chambless Chief of Police, Owasso Police Department SUBJECT: 2016 Oklahoma Highway Safety Office Grant DATE: September 11, 2015 BACKGROUND: In February of 2015, the Owasso Police Department applied for grant funding through the "2016 Highway Safety Office Grant." This grant is made available by the Oklahoma Highway Safety Office (OHSO). The purpose of the grant is to provide Oklahoma law enforcement agencies with resources to reduce the number of injury /fatality collisions in Oklahoma. OHSO notified staff that $69,000 has been awarded to the Police Department. OHSO designated $63,000 for overtime to be directed toward general traffic enforcement and DUI enforcement. Additionally, OHSO designated $6,000 for the purchase of three radar speed detection units. Partnering with OHSO to reduce collisions is consistent with the department's objective to reduce traffic related fatalities and injuries. The police department has been receiving OHSO grant funding since 2006. Funding has steadily increased since 2006 with the last few years being fairly stable in the amount of funding awarded. GRANT FUNDING: There is no match requirement for the grant award; however, the Police Department will be responsible for fuel and maintenance costs for police vehicles used during grant overtime traffic patrols. The grant is funded using a cost reimbursement system. The Police Department will expend monies through its existing budget and then claim reimbursement from OHSO. In order to receive grant funding, the City of Owasso must enter into a contract with OHSO and provide resources to manage the grant. RECOMMENDATION: Staff recommends City Council acceptance of the 2016 Highway Safety Grant, authorization for the City Manager to execute the contract with the Oklahoma Highway Safety Office for management of the grant and approval of a budget amendment in the General Fund increasing the estimated revenues and the appropriation for expenditures in the Police Services budget by $69,000. Problem Identification: Owasso's current population is approximately 31,000 people. Growth in retaillrestaurant business, schools sod hospitals has resulted in additional traffic congestion and motor vehicle crashes. This growth continues to increase non - resident traffic which contributes to a strain on Owasso PD's resources- According to data from the Oklahoma Highway. Safety Office, in 2013 the City of Owasso ranked 14th in the state for total KAB crashes, 14th in unsafe speed KAB crashes and 17th in alcohol - related KAB crashes. Project Description: The Owasso Police Department will implement activities in support of state and national highway safety goals, targeting violations that contribute to the cause and /or severity of KAS crashes. Using the appropriate funding source; officers will conduct overtime enforcement activities with emphasis on speed abatement, occupant protection and impaired driving violations. Agency will also support areawide ENDUI task force efforts. overtime assignments will target locations identified by crash reports. violation reports and citizen complaints as having a significant incidence of KAS crashes or violations contributing to such. Public information and education activities will be regularly conducted to inform the public of traffic safety . issues and related events . The project site is located on the historic Morrow Farm consisting of over 240 acres along the U.S. Highway 169 Corridor. Great care was taken in the 'master planning' phase of this development to insure a compatible development with existing land uses and to maintain an historic connection with the past uses. Section 820 of the Owasso Zoning Code states the purposes of the Planned Unit Development (PUD) are to permit innovative land development while maintaining appropriate limitations on the character and intensity of use. Additionally, a purpose of the PUD is to permit flexibility within the development to best utilize the unique physical features of the particular site and provide and preserve meaningful open space. The proposed PUD meets and exceeds this requirement and the stated purposes of the Owasso Zoning Code. The PUD is divided into seven various development areas, each with a unique set of development standards for regulated, quality development. The residential areas proposed for the development will vary in lot size and dwelling sizes in order to provide a greater variety of housing types and price points. Although specific commercial uses are not known at this time, the configuration of the commercial area maximizes the highway and arterial street frontages. Commercial uses are highly restricted and limited to only those uses appropriate with the surrounding uses. Throughout the PUD, a property owner's association will be formed for the residential areas. A similar association may be formed for the non - residential areas depending on the method and timing of those development areas. Each platted area will establish private covenants which set forth minimum dwelling sizes, percent of masonry, architecture review of elevations and other criteria which will establish and maintain a very high quality of development. The developers will work with land planners to develop aesthetic features such as nicely landscaped entries, neighborhood recreation areas and proper screening and landscaping buffers between commercial and residential uses. East 116th Street North is designated as a 120' Primary Arterial with East 126�h Street North and North 129th East Avenue designated as a 100' Secondary Arterial by the Major Street and Highway Plan. Access points to the development will be reviewed and approved by the City during the platting process and controlled through limits of access shown on the plats. Public Infrastructure improvements include 443 Linear Feet of sanitary sewer line and all appurtenances to serve Morrow Place Phase II. FINAL INSPECTIONS: Final inspections for the infrastructure components were completed in September 2015 by the Public Works Department. All standards for acceptance have been met. Additionally, the construction contractor and design engineer have supplied the necessary two -year maintenance bond and required as -built drawings. RECOMMENDATION: Staff recommends Council acceptance of Sanitary Sewer infrastructure improverents at Morrow Place Phase II. This procedure includes a recommendation from the Owasso Capital Improvement Committee, followed by a public hearing before the Council may adopt a resolution amending the project listing. The Capital Improvements Committee conducted a public meeting on September 10, 2015, to consider a proposed amendment to the list of projects proposed to be funded by the third - penny sales tax. The City Council conduct's a public hearing to receive and consider citizen input relevant to the recommendation made by the Capital Improvements Committee. Notice of the public hearing must be made no less than five days prior to the public hearing. At the conclusion of the public hearing, the City Council must continue the matter for at least two weeks before taking any action to amend the listing of projects. Any action taken by the City Council to amend the current list of projects must be made by adopting a resolution. Currently, this particular segment of Garnett Road has approximately 9,700 vehicles per day traveling to and from Owasso. Lastly, the Transportation Master Plan recommends this roadway be improved by FY 2020. SCOPE OF WORK: The proposed roadway improvements would include four lanes, plus a left turn lane to access other public streets. In addition with "Complete Streets" in mind, the design would include a boulevard concept with landscaping, bicycle lanes and sidewalk. The estimated project cost is $7.9 million which includes engineering, land acquisition, utility relocation and construction costs. FUNDING: Funding for the improvements is proposed for the Capital Improvements Fund. The roadway improvements will extend in each direction nearly 700 feet from the intersection. The storage bays for each left turn lane will be 250 feet. The intersection will be signalized. The estimated project cost is $2.6 million which includes engineering, land acquisition, utility relocation and construction costs. Currently, this intersection has approximately 7,345 vehicles per day traveling East /Westbound and 4,590 vehicles per day traveling North /Southbound. In conclusion, the Transportation Master Plan recommends this intersection be improved by FY 2020. SCOPE OF WORK: The proposed intersection improvements would include five lanes on all legs of the intersection. The roadway improvements will extend in each direction nearly 700 feet from the intersection. The storage bays for each left turn lane will be 250 feet. The intersection will be signalized. The estimated project cost is $4.3 million which includes engineering, land acquisition, utility relocation, construction costs and inflation. FUNDING: ODOT funding for this project will be sought through the Surface Transportation Program, which will fund 80% of eligible project costs, while the local government funds the remaining 20 %. Stephenson Director of Community Development SUBJECT: Pelivan Transit Agreement Renewal DATE: September 11, 2015 BACKGROUND: Pelivan Transit is a demand - response transportation service operated by the Grand Gateway Economic Development Association. Pelivan Transit is a non - profit organization, operating primarily on funding from government and corporate entities, including federal and state grants. Pelivan Transit focuses on providing transportation to individuals who do not consistently have a private means of transportation. Now in its seventh year of operation in Owasso, the program appears to have developed a stable and growing customer base. Demand and ridership has increased each year since the program inception. Pelivan Transit began its Owasso operations in December 2007, following City Council action to approve a one -year agreement for transportation services between the City of Owasso and Grand Gateway in the amount of $41,975. Following a surge in the price of fuel, the city's contribution increased in the second year of operation to $49,393. The city's contribution remained the same for the third and fourth year of operation as Grand Gateway continued to receive additional state and federal grant funding. The FY 2013 request was $49,393 and the FY 2014 and FY 2015 requests were $51,000. For the FY 2016 Grant year, Pelivan is again requesting $51,000 from the City of Owasso to cover the local match, 18% of the total operating budget for Pelivan. These funds were included in the City's annual budget. The total budget for FY -2016 will be $280,092 and the requested local match from the City of Owasso is 18% of this amount. We have secured $229,092 through federal, state and other local grants for this valuable service. Pelivan Transit is committed to the City of Owasso's proactive involvement in the CNG fueling infrastructure and we will operate with a dedicated CNG fleet during 2016. We were able to coordinate a CMAQ grant through INCOG's Tulsa Clean Cities Coalition and local matched the CNG portion from an Apache Corporation grant for a new MV; I ADA equipped mini -van expected delivery this Spring 2015 for the Owasso operation. The fuel savings has afforded us the ability to keep the local match request to the City of Owasso stable without an increase for FY -2016. We have not requested any local match for vehicle procurement since the inception of this service to Owasso began. Our only concern is the growing demand and popularity of this successful program for the citizens of Owasso. It would be easy to operate a four vehicle service and extend hours daily and offer weekend transit services as well. This employee's job duties will require the majority of their time be spent out in the business community, conducting inspections, and developing pre -fire plans, etc. The addition of this employee will necessitate the acquisition of an additional staff vehicle to the fire department fleet. To ensure the efficient utilization of vehicles within the fleet, the fire department intends to reassign one of the department's four -wheel drive Tahoes to the new position, and then purchase a less- expensive, two -wheel drive sedan to replace it. This adjustment will provide the new inspector with the ability to navigate in and around construction sites and new developments when conditions require. PROPOSED ACTION: Staff is proposing the purchase of a Dodge Charger, similar to the Police Department's newer patrol vehicles. This type of vehicle should meet the needs of the fire department's current administration functions. STATE BID: The State of Oklahoma Bid award for a Dodge Charger was awarded to John Vance Motors of Guthrie, Oklahoma. While the appropriation of these items was included in the FY 2015 budget, the actual expenditure for all or part of these open items will occur during FY 2016. One example is the fire capital purchase. It was approved by Council for expenditure from the FY 2015 budget. However, the receipt of the pumper truck will not occur until FYI 6. Because the pumper truck was appropriated and encumbered in FY 2015, it was not included in the FY 2016 Budget. In order to keep from having purchase orders open for multiple years, past practice of Council is to close prior year purchase orders at the end of September and reappropriate the funds to the subsequent year along with authorizing the City to re -issue the purchase orders in the new year. Because the FY 2016 budget was prepared prior to year -end, before it was known whether projects would be completed or not, fund balances used to develop the budget were projected as though all projects and purchase orders would be completed and expended by year -end. Therefore, approval of carryover budgets does not reduce estimated June 30, 2016, fund balances. Furthermore, since Generally Accepted Accounting Principles (GAAP) do not recognize encumbrances, closing out old encumbrances where goods and services have not been received, will enable the City's budgetary financial statements to more closely align with audited GAAP statements. Ross v City of Owasso et al DATE: September 11, 2015 BACKGROUND: An action was filed against the City of Owasso by former city councilor Patrick Ross alleging violations of the Oklahoma Open Meeting Act and Open Record Acts in August of 2013. Counterclaims were subsequently filed against Mr. Ross by the City on September 30, 2013. Thereafter, Mr. Ross filed an Amended Petition on July 28, 2014, with the court alleging claims of defamation against the Mayor and a private citizen. The Plaintiff and Defendants have agreed to mediate this matter and have scheduled mediation to occur on September 30, 2015. Mediation traditionally requires the attendance by at least one person with full settlement authority for each party. Settlement authority on behalf of the City is generally given to the city manager. PROPOSED ACTION: Approval of proposed Resolution 2015 -16 conferring full and final settlement authority upon the City Manager, or his designee if necessitated, and additionally naming the City Manager or his designee as the City's representative at the scheduled mediation.
