The Owasso Economic Development Authority met in regular session on Thursday, September 10, 2015 in
the Lower Level Conference Room at City Hall, 111 N Main, Owasso, Oklahoma per the Notice and

Warren Lehr reported on the status of Vision 2025 excess fund projects currently underway;
discussed local city efforts to recapture the expiring Vision 2025 sales tax and the City of Tulsa
and WATCO efforts to relocate the railway switching station to an area near the airport.

BACKGROUND:
On April 10, 2014, Attorney Dean M. Solberg appeared before the OEDA and requested that the
Authority join his client, Precision Leasing Company, LLC (`Precision "), in a "friendly suit" to clear
the title on a piece of property owned by Precision. The OEDA authorized the action by
unanimous vote and the suit was filed. However, despite signature by the City Attorney on a
journal entry consenting to the action, the Court did not sign order which would have cleared
the title. Consequently, Mr. Solberg has requested that the OEDA execute a corrective quit
claim deed to Precision so that the eighty -seven (87) foot tract omitted in the original deed can
be conveyed and the title thereby cleared.
The proposed corrective quit claim deed is attached for your review. Mr. Solberg and the City
Attorney will be present at the meeting to answer any question the Trustees may have.
PROPOSED ACTION:
Authorization for the OEDA Chair to execute the proposed quit claim deed.

Judge Morrissey has refused to sign the approved Judgment and is requiring a dismissal
of the action. In the past, her office has advised me of wanting an evidentiary hearing on
the claims but without any clarification as to what evidence of disputed claims, there
being known, to present. At the disposition hearing held yesterday, Judge Morrissey
advised me that this matter is "not a reformation case" and that she would not approve
the approved Journal Entry of Judgment and is requiring dismissal of the case.
While it is my opinion that the `friendly' lawsuit and approved Judgment was in the best
interest of my client, I have no other recourse but to respectfully request your assistance
and approval of a corrective Quit Claim Deed, attached, and conveying all of the lands
that were purchased actually purchased.

BACKGROUND:
Attorney Dean Solburg contacted the City Attorney several months ago to discuss a potential
"friendly suit" he intends to file in correction of the legal description contained in a 1999 General
Warranty Deed from the OEDA to Precision Components Company. Specifically, Mr. Solburg
alleges that the Warranty Deed, dated July 1, 1999, conveyed "The North Three Hundred Fifty
(350) Feet of the East Two Hundred Thirteen (213) Feet," when the deed should Instead conveyed
"The North Three Hundred Fifty (350) Feet of the East Three Hundred (300) Feet." (Copies of the
proposed Petition and Journal Entry of Judgment are attached for your review.)
A "friendly suit" is a judicial tool utilized to settle a matter which requires court adjudication but Is
not contested by the parties. Typically, the defendant in such a suit does not actively defend
the case or oppose an order entered by the court granting the relief requested by the parties.
Because the parties to the suit do not function is adversarial roles as is usually the case in
litigation matters, the suit is deemed to be "friendly."
Mr. Solburg has requested an opportunity to present the basis for the legal action he anticipates
filing to the OEDA and he seeks the Authority's cooperation in resolving this matter. He
previously met with the City Attorney and the directors of Community Development and
Economic Development.
PROPOSED ACTION:
Authorization for the City Attorney and staff to take such action as is deemed appropriate in
response to the anticipated "friendly suit" legal action by Precision Leasing Co, LLC.

BACKGROUND:
The City of Owasso received notice of upcoming Tulsa County Board of Adjustment case CBOA-
2550 requesting a Special Exception to permit mining and quarrying in an AG (Agricultural)
District located at the NW corner of E 66th St N & N 145th E Ave.
An existing quarry owned by Anchor Stone has been in operation to the east of the subject
property for many years.
Anchor Stone has tried to expand the quarry in recent years, but was unsuccessful. Beginning in
the 2003, Anchor Stone tried to expand the existing quarry operations to the east (within Rogers
County). The application was denied by the Rogers Board of County Commissioners, with a
lawsuit of Anchor Stone vs. Board of County Commissioners as a result. The lawsuit continued for
many years but was dropped in 2007 when the plans for the Stone Canyon development began
and the land was purchased by the developers. The surrounding community came out in great
numbers to fight the quarry expansion to the east and north due to impacts on their homes and
their quality of life (blasting, dust, noise, etc.).
ANALYSIS:
In July 2014, the City of Owasso adopted its new long range master plan, named GrOwasso
2030. This plan, which took 18 months to develop, involved significant public input as well as
interviews with various stakeholders in the Community. The area in question was identified for
residential uses based on the input received and pending residential projects in this area of
Owasso and solid planning principles.
Additionally, discussions with Anchor Stone during this time revealed they had no plans for
expansion, would mine their existing property for another 30 years and close an eastern section
of the quarry approximately 80 acres in size, which would be allowed to fill with water with
eventual use as a recreation amenity dedicated to the City of Owasso.
Years of discussion with Anchor Stone revealed that they would not expand beyond their current
boundaries and Owasso has planned and developed accordingly. While the subject property
lies outside the Owasso City Limits, we have some serious concerns about the negative impacts
the expansion will promote.
• The proposed expansion does not conform to Owasso's adopted GrOwasso 2030 Land
Use Master Plan, as the area is called out for residential uses not industrial uses as the
quarrying operation would introduce. Residential uses are the lowest possible impact
uses and this area is called out for these types of uses. Expansion of intrusive industrial
type uses is the highest and most intense possible uses, directly violating Owasso's
fenceline's adopted land use plan.
• The City recently completed a $5.5 million sanitary sewer interceptor line expansion in this
vicinity in preparation for expanded and more intense residential uses. The sanitary
sewer line was setup as a payback in which developers of residential property would pay
a fee back to the City based on the acreage developed. The City has already had one
instance in which a 200 plus lot development was canceled after the developer heard
of the potential quarry expansion,
• Expanding the quarry will make it increasingly difficult to develop this area for residential
uses and cost the City millions of dollars in lost revenue and development. Development
of the subject property as a rock quarry will severely impact potential residential
development in this area and will further negatively impact the existing residential uses in
Tulsa and Rogers County, and Owasso City limits.
• The quarry expansion will cause negative impacts to area residents from blasting, truck
traffic, noise, and dust. Per Section 43 -113, Chapter 1, Title 11 of the State Statues,
specific use permits "shall be viewed as to its probable effect on adjacent properties
and community welfare." Approval of this type of harmful use would cause a great
negative impact on the surrounding area and the community as a whole.
• Further, the expansion will devalue private property near the expansion location. Real
estate prices in the area already reflect the negative impact that the quarry has on
homes.
• The City of Owasso has been told on numerous occasions by Anchor Stone that the
quarry would not expand any further than its current operation limits. The City views the
proposed application as a violation of the established trust in this regard. This expansion is
substantial and will have a dramatic impact on this part of the county as well as the City
of Owasso.
• Based on a map of the proposed expansion boundary, it appears that there will be
significant disturbances to aquatic habitats as several ponds and a stream will be
eliminated by the expansion.
RECOMMENDATION:
Staff recommends approval of the Resolution 2015 -02, opposing the quarry expansion.

WHEREAS, Roy Johnsen, representing the Anchor Stone, who operates the existing quarry
located at the NE corner of E66th St N & N 145th E Ave is proposing to expand the quarry
operations westward into approximately 47 acres of agricultural land located in Tulsa County,
with the City of Owasso fenceline; and,
WHEREAS, the application is in direct violation of the City of Owasso's adopted GrOwasso
2030 Land Use Master Plan that calls for this area to be used only for single- family and agricultural
uses; and,
WHEREAS, the City of Owasso made a significant monetary investment for infrastructure in the
area to allow for the development of single - family homes, which would be harmed by approval of
this application; and,
WHEREAS, the request submitted would directly result in the de- valuation of existing homes
and significant pending development both in Tulsa County and Owasso City Limits.
WHEREAS, the request submitted would reduce the quality of life in Owasso and cause long
lasting environmental and social impacts to Tulsa County and Owasso residents.
NOW THEREFORE, BE IT RESOLVED by the Owasso Economic Development Authority, that the
Authority opposes Tulsa County Board of Adjustment Case CBOA -2550.

RESIDENTIAL DEVELOPMENT
Lake Valley V, Phase III - Final Plat has been approved and development of the
infrastructure is under way. This is the final phase of the successful Lake Valley
neighborhood. Infrastructure is near complete.
Cottages at Tallgrass Point - Plat has been approved. Apartment complex to be
located at the northwest corner of E 86th St N & N Mingo Rd. 266 -unit apartment
complex to begin construction this summer. Earth change has been granted and has
begun. It is important to note, NO infrastructure plans have been approved. Dirt work
only at this time.
Abbott Farms - New residential subdivision located to the west of the South Sports Park
alone E 106th St N. 166 single - family residential lots are planned for this neighborhood.

WORKFORCE DEVELOPMENT
Macy's plans to hire 2,400 seasonal associates this year at the new Tulsa County
Fulfillment Center. This is more than double the original estimate of 1,000 seasonal
associates. Due in large part to the assistance and cooperation Macy's has received
from state and local government they have been able to ramp up this facility much
quicker than originally expected.
Here are some quick facts about the facility:
• Facility Footprint is 1.3 million square feet
• 2.2 million square feet of space including mezzanines
• Storage capacity - 800,000 pairs of shoes
• 14 miles of powered conveyor, monorail, trolley systems
• This year during Holiday Peak 2015 plan to ship 160,000 units per day (Facility Max
Capacity Design 320,000 units per day)
• Will employ approximately 1500 core associates, over 2000 seasonal employees
during Peak Season
• Raised close to $30,000 in this years United Way Campaign (1st year) with over
200 associates donating
• Participated in the Race for the Cure on 9/26/15
• Has partnered with the Cherokee Nation on numerous hiring events

PROJECT STATUS REPORT
City of Owasso Public Works Department

E 76th Street North Widening (from U.S. Hwv169 to N. 129th East Avenue)
- In October 2010, the City received notice that INCOG selected the project to receive
federal funding in the amount of $2,090,000 for engineering, right -of -way and utility
relocation costs. A 20% required match will be funded through the City of Owasso's
Capital Improvement Fund.
- In October 2011, the City received notice that INCOG selected the project to receive
federal funding in the amount of $3,470,000 for construction and administration costs. A
20% required match will be funded through the City of Owasso's Capital Improvement
Fund.
- In February 2012, ODOT officials informed City staff of funds available in the Federal
Surface Transportation Fund for the planning phase of E. 76th Street North Widening
Project.
- In March, INCOG presented this project to its members for consideration to receive
funding in 2012 for the engineering design. Project was approved by the Technical
Advisory, Transportation Policy Committee, and INCOG Board of Directors
- Engineering agreement for Poe & Associates, Inc. of Tulsa, Oklahoma and funding
agreement was approved at the May 7, 2013, Council Meeting.
- The engineering design is approximately 60% complete.
- Right -of -way documents have been submitted to ODOT for final review
- In reference to the NEPA document, ODOT has provided comments to the engineering
consultant. Currently, Poe & Associates are addressing the comments and anticipate
sending a response within the next two weeks. Staff anticipates approval from ODOT and
FHWA by September 2015.
- On July 21, 2015, ODOT, Poe & Associates and City of Owasso met on location and
conducted a plan -in -hand meeting.
- As a result of the meeting, ODOT granted permission to Poe & Associates to complete
and submit right -of -way plans for review.
- NEPA document is still being reviewed by ODOT with approval expected by the state
agency in November 2015.
Garnett Widening (from E.961h Street North to E. 1061h Street North)
- In November 2012, Council approved an engineering agreement with Dewberry in the
amount of $345,600.
- A Public Meeting for the Garnett Widening project was held June 27, 2013 with City staff
and representatives from PSA Dewberry to receive citizen comments regarding the
design. In October 2013, INCOG presented this project to its members for consideration
to receive federal funding in FY 2017 for the construction phase. Project was approved
by the Technical Advisory and Transportation Policy Committees.
- On November 12, 2013, the INCOG Board of Directors approved federal funds to be
allocated to this specific project in the year 2017 or sooner, if funding is available. The
City of Owasso will receive $3.2 million in federal funds.
- The engineering design is approximately 80% complete.
- ODOT staff has approved the environmental study.
- In July 2015, the NEPA document was approved by FHWA.
- ODOT is still reviewing ROW documents and approval is anticipated in mid - October 2015.
Once approved, City staff will begin ROW negotiations with the property owners along
Garnett Road from E 96th St N to E 106th St N.
• FY 2014 -2015 Street Rehabilitation Program
- In August 2014, City Council approved the project priority list.
- Funding in the amount of $1 million is included in the FY 2014 -2015 Capital Improvements
Fund for this project.
Bid awarded to Becco Construction on March 3rd 2015.
Becco Construction has completed all necessary base and curb /gutter work from N 117

E. 1 16Lh Street North and 1291h East Ave Intersection Improvement Protect
Tulsa County and City of Owasso have partnered together to fund the engineering
design, utility relocation and construction.
In August 2014, application for funding for the construction phase of this project was
submitted to INCOG. If funded, the "matching grant' will result in a grant of 80% ODOT
funding, 10% Tulsa County funding and 10% City funding.
In October 2014, INCOG Transportation Technical Advisory Committee and the
Transportation Policy Committee voted to recommend this project as eligible to receive
STP funds. In addition, the INCOG Board of Directors met on Thursday, November 13th
and approved this project to receive federal funds in the amount of $2,186,000. As a
result, federal funds for construction will be available in FY 2018, or sooner, if funding is
available.
Environmental study commenced in April 2015 with approval expected by March 2016.
Engineering design is approximately 60% complete.
E. 1 16th Street North and N 140th East Ave Siqnalization Project
Plans approved by ODOT and City of Owasso
City of Owasso 20% Funding, Maintenance Agreement and Resolution approved at
January 20, 2015 Council Meeting.
In February 2015, ODOT advertised this project for bids.
Bid opening occurred in March 2015.
Bid Award occurred in April 2015.
A preconstruction meeting was held between ODOT and contractor on July 8.
Based on a discussion with the contractor, the project is expected to commence in mid -
October with completion by December 2015.
U.S. 169 Highway Widening Project (from E. 56M Street North to E. 66th Street Northl
- In March 2015, ODOT is tentatively scheduled to advertise this project for bids with bid
opening in April. Construction start date will be provided at a later date by ODOT.
- Project bids were let on March 19, 2015
- Bid award occurred in April, 2015 with construction commencing in July 2015.
- ODOT administered a preconstruction meeting with Becco in mid -June 2015.
Construction commenced on July 6 with completion scheduled to occur by February
2017.
- Progress continues with the construction of multiple bridges and widening from E 56th St N
to E 661h St N. At this time, the project is on schedule for completion by February 2017.
Brookfield Crossing Stormwater Improvements
- In October 2014, City Council approved an agreement for engineering services with
Kellogg Engineering.
- Engineering design is approximately 50% complete with final design expected to be
complete in September 2015.
- At this time, the engineering consultant is designing another option which would
reduce the amount of excavation within the Brookfield Crossing neighborhood. This
new option in design is taking longer than anticipated but we are optimistic it will
result in fewer residential yards and driveways disturbed during the construction
phase.
- Public Works anticipates the planning phase should be complete this fall with
construction beginning in the summer of 2016.
