HomeMy WebLinkAbout1985 07_Implement Liquor by the Drink Laws_1985.02.05WHEREAS, the assembled members of the City Council for the City of Owasso appreciate the complexity in establishing a new body of law under the recently enacted constitutional amendment authorizing retail sales of alcoholic beverages by the individual drink; and, I,kEREAS, Oklahoma's voters have voted for local control over liquor-by- the-drink matters; and, TJHEREAS, we encourage the Oklahoma Legislature to impose uniform minimum state standards which encourage wide spread compliance with new liquor-by-the drink laws; and, WIHEREAS, cities and towns currently regulate and control bottle clubs in regard to land use, building, health and safety codes; and, WBEPEAS, cities and towns currently regulate and control bottle clubs in regard to their own coununity standards on hours of operation and any vice activities which might occur; and, WHEREAS, the City of Owasso, Oklahoma, urges the Oklalnonn Legislature and Governor to not preempt local government authority in the state's ilaste to enact implementing legislation by denying local governments and local communities the right to establish or maintain stricter com=ity standards through the adoption of local ordinances or denying them local enforcement tools by remval of licensing and permitting authority at the local level; and, W[IEREAS, we do not believe that the legislature or Governor would intentionally strip local communities of locally derived community standards on such a controversial issue as liquor and liquor establish- mants; and, W)HEREAS, the Oklahoma Legislative Interim Committee on Liquor-by-the Drink was presented position statements on December 4, 1984, adopted by I the Oklahoma Municipal League, Oklahoma Association of Local Governments and the Oklahoma County Commissioners Association calling for the reten- tion of local licensing of on- premises liquor establishments; and, WHEREAS, The Honorable George Nio-i, Governor, has endorsed the retention of local control and comnmity standards through licensing of liquor-by- the drink establishamts by local governments; and, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Owasso, Oklahoma urges that the Oklahoma Legislature and Governor in the in-plemen- tation of the constitutional amendment authorizing retail sales of alcoholic beverages by the individual drink establish that: 1. The state standards set forth in the regulation of alcoholic beverages shall be mini nm standards; 2® The State of Oklahoma, its cities and towns shall jointly and concurrently enforce the alcoholic beverages laws of this State; 3. The cities and towns of Oklahoma should be allowed to maintain community standards through the regulation of on-premise liquor establishments; and 4. Cities and towns be specifically delegated authority to enact and enforce reasonable ordinances in conformity with state law and further authorized to issue local licenses for such establishments when applicants have complied with all ordinances relating to building, fire and health codes, non-discriminating zoning ordinances and operating standards of the local government.
