HomeMy WebLinkAbout1981 02_OPWA_Social Security_1981.02.03 OKLAHOMJ!.~ 81-02 OIrJASSO RESOLUTION NO CITY OF RESOLUTION OF THE OWASSO PUBLIC WORKS AUTHORITY, EXTENDING TO OFFICERS AND EMPLOYEES OF THE AUTHORITY AND TO THEIR DEPENDENTS AND SURVIVORS THE BASIC PROTECTION ACCORDED TO OTHERS BY THE OLD-AGE AND SURVIVORS INSURANCE SYSTEM ES- TABLISHED BY TITLE II OF THE SOCIAL SECURITY ACT (PUBLIC LAW 734, H. R. 6000, 8lst CONGRESS) AND AS AUTHORIZED BY 56, CHAPTER 7, PAGE 375, O.S.L. 1949: AUTHORIZING THE EXECUTION AND DELIVERY OF AN AGREEMENT BETWEEN THE AUTHORITY AND THE DEPARTllliNT OF PUBLIC WELFARE OF THE STATE OF OKLAHOMA UNDER WHICH THE AUTHORITY AGREES TO EXTEND TO S EMPLOYEES AND OFFICERS THE BASIC PROTECTION ACCORDED BY THE OLD-AGE AND SURVIVORS INSURANCE SYSTEM: PLEDGING TO ~1AKE AVAILABLE AND }~INTAIN FUNDS FULLY SUFFICIENT TO rlliET ALL CONTRIBUTIONS REQUIRED UNDER SAID SOCIAL SECURITY ACT AND AUTHORIZING CERTAIN OTHER ACTS NECESSARY TO EFFECTUATE THE INTENTION OF THIS RESOLUTION AND THE PERFOR11ANCE OF SAID AGREEMENT WHEREAS, Public Law 734, 81st Congress, Authorizes the Soc- ial Security Administrator, at the request of any State, to enter into an agreement with such State for the purpose of extending the benefits of the Old-Age and Survivors Insurance system es- tablished by Title II of the Social Security Act, to employees of such State or any political subdivision thereof; and WHEREAS, said Social Security Act defines the term I1politi- cal Subdivisionll to include an instrumentality of the State and WHEREAS, The Owasso Public Works Authority, created and existing pursuant to Title 73, O.S. 1961, is an instrumentality of the State of Oklahoma, and by reason thereof the Authority, its officers, and employees, are entitled to participate in the benefits of the Old-Age and Survivors Insurance system; and WHEREAS, pursuant to the authority of Title 56, Chapter 7, Page 375, O.S.L. 1949, and Article XXV of the Oklahoma Constitu- tion, the State of Oklahoma, acting by and through its Depart- ment of Public Welfare, has entered into an agreement with said Social Security Administrator for the purpose of extending the benefits provided by said Title II to its employees and to those of its political subdivisions, and that said agreement became effective from January 1, 1977: and WHEREAS, the officers and employees of the Authority have requested the Authority to participate in said Old-Age and Sur- vivors Insurance System in order that the benefits of said in- surance may be extended to them, and have consented and agreed that the Authority may withhold from their salaries and wages the contributions required under said Acts to be made by said officers and employees; and 'VJHE RE AS , the members of the Authority are of the opinion that it is necessary and convenient to the Authority business and to the best interests of its officers and employees that the Authority participate in said Old-Age and Survivors Insurance system as established by Title II of the Social Security Act and that the Authority, as employer, contribute such funds as may be required under said Acts, and that such contributions shall be made from the Authority's "Special Fund"; and vVHEREAS, it is necessary in order to accomplish and carry out said purpose that the Authority enter into an agreement with the State of Oklahoma, acting by and through the Department of Public Welfare; and Oklahoma 81-02 City of Owasso, Resolution No Page Two WHEREAS, there has been presented to and discussed at this meeting a proposed form of agreement to be entered into between the State of Oklahoma, acting by i.md through its Department of Public Welfare, and the Authority, setting forth a plan for ex- tending the benefits of Title II of the Social Security Act, in conformity with the applicable Federal and State Laws, to offi- cers and employees of the Authority, said form of agreement has been marked "AGREEMENT" and initialed by the Secretary of the Authority for the purpose of identification and filed with the minutes of this meeting, BE IT RESOLVED BY THE OWASSO PUBLIC WORKS NOW, THEREFORE AUTHORITY: 1, That said form of agreement hereinabove referred to and identified as "Agreement", be, and the same is hereby approved and adopted, and that the proper officers of the Authority, be, and they are hereby authorized to execute said agreement for and in the name of the Owasso Public Works Authority. 2. That the Authority agrees to impose upon its officers and employees, as to services covered by said agreement, a con- tribution with respect to wages and salaries (as defined in Sec- tion 2 of said Title 56, Chapter 7) not exceeding the amount of tax which would be imposed by Section 1400 of the Federal Insur- ance Contribution Act (if said services constitute employment within the meaning of that Act) and to deduct the amount of such contributions from the wages and salaries as and when paid, and to pay same into the "Contribution Fund" in the State Treasury, and to pay into said "Contribution Fundll all contributions re- quired to be made by the Authority, as employer (together with the Contributions deducted from salaries and wages of its officers and employees) in accordance with the rules and regulations of the Oklahoma Public Welfare Commission, and hereby pledges it will maintain in its "Special Fundll at all times, funds suffic- ient to pay the Authority's share of the contribution, together with the contributions deducted from salaries and wages of its officers and employees which will become due and payable to the Department of Public Welfare under the term of said agreement 3. That the officers of the Owasso Public Works Authority are hereby expressly authorized and directed to execute any and all papers and to do any and all acts and things, from time to time, necessary or desirable in order to effectuate the intention of this resolution or to carry out or to comply with the terms and provisions of said agreement approved and authorized by this resolution, or to comply with any applicable law or regulation promulgated or issued pursuant to any applicable law or laws 4, This resolution shall be retroactive to January 1, 1977 and all benefits extending to officers and employees and to the dependents and survivors shall be computed, authorized and paid as if this resolution were passed January 1, 1977 City of Owasso, Oklahoma Resolution No. 81-02 Pa2:e Three ATTEST (SEAL)
