MINUTES OF REGULAR MEETING
Monday, March 7, 2016
The Owasso Planning Commission met in regular session on Monday, March 7, 2016 at
Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 3:00 p.m. on March 3, 2016,

ITEM 5. Approval of Minutes from February 8, 2016 Regular Meeting.
The Commission reviewed the minutes,
David Vines moved, seconded by Mr. Miller, to approve the minutes from the
February 8, 2016 meeting. A vote on the motion was recorded as follows:

ITEM 6. Final Plat (Amended) - Ator Center II - Consideration and appropriate
action relating to the request for the review and acceptance of a final
plat proposing four (4) lots on one (1) block containing 5.87 acres. The
subject property is located north of the northwest corner of E. 86m St. N.
and Hwy 169, on the west side of N. Garnett Road.
Bronce Stephenson presented the staff report and described the location. The
property has never been fully developed. Perimeter utility easements are shown on the
plat that will provide utility companies access. The Technical Advisory Committee
reviewed the plat for Ator Center II at their regularly scheduled meeting on January 27,
2016. Staff recommends approval of the final plat for Ator Center II.
David Vines moved, seconded by Mr. Miller, to approve the final plat for Ator Center ll,
subject to TAC and Staff recommendations.

ITEM 7, OA 16 -01 Annexation /Rezoning 16 -02 - 11595 E. 11 61h St. N. -
Consideration and appropriate action relating to the request for the
review and acceptance of an annexation and a rezoning of
approximately .52 acres in size from AG (Agriculture) zoning district to CS
(Commercial Shopping) zoning district. The subject property is located at
11595 E. 116th St. N., Owasso, OK.
Bronce Stephenson presented the staff report and described the location. The
applicant is requesting to be assigned a Commercial Shopping (CS) zoning upon
annexation. The proposed rezoning to commercial will be in conformance with the
Land Use Master Plan. The Annexation Committee met on February 24, 2016 and
voted unanimously to recommend approval of the request. Staff recommends
approval of the above annexation and rezoning with an assigned zoning of
Commercial Shopping (CS).
Ms. Carolyn Knight requested to address the Planning Commission. She stated that
there are several neighbors that are not happy about this annexation and rezoning.
She did not get notified and she is within 300' of property. She also explained that the
people behind this property wanted to buy the subject tract.
Mr. Miller moved, seconded by Ms. Mowery, to approve OA 16 -01 annexation and
OZ 16 -02 rezoning.

ITEM 8. OPUD 16 -02 /Rezoning OZ 16 -03 - Smalygo - Consideration and
appropriate action relating to the request for the review and
acceptance of a planned unit development with the underlying zoning
of RTH (Residential Townhome) zoning district. The subject property is
located at 13707 E. 96 St N.
Bronce Stephenson presented the staff report and described the location. The
proposed housing development is planned for senior townhome -style rental units. The
development would consist of single -story units arranged in four buildings that center
around a courtyard that would house the majority of the amenities. The amenities
would include sidewalks throughout the development, a recreational area, gazebos,
outdoor grills, a pond with aerator, storm shelters, recycling area and fire sprinklers in
each unit.
Staff published legal notices in the Owasso Reporter and mailed notices to property
owners within a three - hundred (300) foot radius of the subject property. The Technical
Advisory Committee reviewed this item on February 24, 2016.
After considering the proposal and the current and expected development of the
area and consulting with the GrOwasso 2030 Land Use Master Plan, staff recommends
approval of OPUD 16 -02 and OZ 16 -03, with the following conditions:
• The number of units be reduced by at least 10 %, or four (4) units
• A community garden area be provided for the residents
• At least two (2) trees or large shrubs per unit be provided on the site
• A screening berm at least six (6) feet in height be provided along E 96th St N.
Landscaping shall be provided atop and surrounding the berm to screen and
soften the transition,
• Perimeter screening fence of at least six (6) feet in height shall be constructed
with steel support poles set in concrete along the western, northern and easterr
boundaries. The smooth side of the fence shall be placed outward.
• Signage along the E 96th St N frontage be constructed as a monument sign no
greater than four (4) feet in height, and set in a landscaped bed.
• The development only be allowed as a Senior Living Units with only those 55 years
and older allowed as tenants or residents, in accordance with Fair Housing Law.
This item was opened for public hearing at 6:27 pm. The following are comments/
concerns made by citizens:
Mr. Stuart E. Van De Wiele, Attorney for Smalygo Properties - He stated that Mr. Smalygo
has built over 400 homes and he saw a need for senior housing. The 35 unit structure fits
the site. With all the landscaping, signage and amenities, we might not be able to
reduce the units much more. There are residential structures to the east and west. A
cedar plank fence is planned. This is not a Section 8 project. The traffic concerns will be
addressed. The final plat will show the detention area. There is a need for this type of
project.

Brad Beaird - 9322 N 138 E Ave - Consulted a traffic engineer regarding this area, He had
the traffic counts calculated. This development is not appropriate for this location. N
133rd E Ave receives approximately 14,000 vehicles per day. There will be a 10% increase
by adding this development. It is not appropriate at this location.
Mr. Musman - 807 W Center, Collinsville, OK - Lives in the Collinsville facility owned by Mr.
Smalygo. He waited six months for the property to be built. It's very high quality and a
very quiet place. There is a need for more 55+ communities.
Stephen Grey - 3101 N Hemlock Circle, Broken Arrow, OK - Mr. Grey is representing the
Nottingham homeowners. Mr. Grey stated that there is no similar zoning in the area, no
other multi - family zoning. Traffic safety issues with E 96th St N being a two lane street. The
water supply is a 4" water line, a 12" line should be installed for fire suppressant. Sanitary
sewer line is an 8" line, it's overloaded now without addition developments. Expressed
drainage concerns. It's not the development that is being opposed, it's the location.
Safety issues were discussed regarding the one way in and one way out. He also stated
that he has public Infrastructure concerns.
Ron Cates - 202 E 2nd Ave - Representing the Honeyacres (next door neighbors) - He is all
for the project, but the 2030 Land Use Master Plan is being tossed aside.
Barbara Johnson - 9810 N 135 E Ave - She owns the 4,000 sq ft home to the west. Objects
to the development. It's not a good fit for this area and not a good plan for seniors. The
small units around all these large homes. It's a poor plan, no private outdoor space, no
garages, no space for guest parking. Does not see a benefit here for seniors.
Catherine Sallee - 9503 N 137 E Ave - Expressed appreciation for listening to their
concerns. Please continue to do that.
Seth Ann Baird - 9322 N 135 E Ave - Nottingham HOA President - We want the covenants
to state that this development will only be used by 55+ years of age seniors. Staff needs
to study the number of units. That is a lot of units for the acreage. Consider turning off the
emergency sirens when coming or leaving the development. We all have traffic
concerns and water concerns. State in the covenants that there will not be subsidized
vouchers (work this out with attorney). Thank you for your civic duty. We love our homes
and our neighborhoods.
Robert Jerome - 9117 N 137 E Ave - Traffic issues need to be addressed.
Brian Jacobs - 9505 N 137 E Ave - Don't put more traffic on E 96 St N. High density
apartments are not going to help the high traffic on E 96 St N. There needs to be
sidewalks for safety purposes. Please listen to us and do not set a precedence.
Delmar Davis - Traffic issues, especially during church hours. He had sanitary sewer
concerns. His church always wanted a computerized sign, but was told no by city
officials.

Brandy Marion - 9512 N 137 E Ct - Do you have a vision for Owasso? She opened a
dance studio at 22 years old. She had a vision for Owasso. Nottingham is a
neighborhood of distinction just like Swan Lake is in Tulsa.
Phil Havizal - 9311 N 138 E Ave - Has served on the board for Nottingham. His trust was
broken when the large churches were built. The developer could sell to somebody else
and they could go Section 8 housing. Thank you for your time. This has connected all of
these subdivisions to become one. That is a very good thing.
Mike Evans - 9310 N 138 E Ave - The impact is going to be on the value of our homes.
Traffic along N 138 E Ave is terrible. Think what you are doing in advance.
Rob Haskins - 13601 E 96 St N - Traffic is terrible on E 96 St N, The other developments in
Oologah and Collinsville have streets on either side of the development. This one does
not, it same way in and out. There are drainage issues. With the right of way along E 96 St
N, it will be very tight. The Commission has the opportunity to make this right.
Ken Yates - 14007 E 87 Ter N (Silver Creek) - Concerns with drainage. Would like to see an
engineer report to reflect the stormwater drainage in that area. The detention pond is
just a drawing on a piece of paper. This pond and the drainage can effect Windsor
Lake, Silver Creek, Camelot Estates and Nottingham.
Jack Ojala - 13616 E 96 St N - Thank you for listening to our concerns. Spoke with Renee
Mowery and she was very kind. This development is not the right fit for this area. We
appreciate the added roof dormers, the added berm and the rock entryway. The
comments and concerns are: the small 2.59 acre tract condensed to 26 units, maybe
consider making the pond larger and the entry larger and gated. Would like to see an 8'
fence along the west, north and eastern boundaries. We would like to see it legally
bound that this property remains a 55+ senior facility.
Ms. Palmer - 121 S 8m St, Collinsville, OK - After the death of her husband she ended up at
Baptist Retirement Center. Her daughter showed her the Smalygo senior living center in
Collinsville and she loves it. They are well designed and everything is very comfortable.
We all love each other and are one big family. We feel that we have a place in the
community. Very proud to be a resident of Smalygo Property.
Cathy Breese - 13505 E 93 St N - I thought Mr. Miller was impartial. Where is the greeting
area, in the outside middle? What is that for? The seniors need something to do in the
facility. Traffic is terrible with the churches.
Jim Breese - 13505 E 93 St N - I feel like this is spot zoning. Is this the way to get the zoning
for what you want?
J.D. McCully - Smalygo Properties Resident - Collinsville - Mr. Smalygo is very kind. The
low rent comment is not true. Most of the people in the Collinsville facility have good
finances.

Phyllis Ogilvie - 9314 N 138 E Ave - The seniors are not the issue here. The infrastructure is
the issue. I have a strong heart for the Baptist Village and consider all the hearts of
Owasso. Please consider what is right for Owasso,
Chairperson Dr. Loving asked if there were more concerns /comments from the meeting
attendees, With no more comments, the public hearing was closed at 7:55 pm.
Mr. Stephenson explained the planning process and Mr. Daniel Dearing explained the
engineering phase process. He explained that all plans are required to be reviewed by a
state licensed engineer at the office of Meshek & Associates.
Attorney Van De Wiele stated that they would consider accel /decel lanes at the platting
stage to help with traffic.
Commissioner Miller stated that he had read all of the emails, he lives within a 1/4 mile from
this proposed development. He has been a builder for 25 years. Mr. Smalygo could
develop this property with 12 to 15 homes. The City of Owasso is a city of character,
culture, hospitality, faith and honor. We need companion. Tonight he wanted to hear
everyone views of the proposed development. We study all of the issues at hand. Thank
you for coming out tonight.
After discussion, Mr. Vines moved, seconded by Mr. Miller, to approve OPUD
16 -02 /Rezoning OZ 16 -03, subject to TAC and Staff recommendations.

Motion carried 4 -1.
A motion to recess for 10 minutes was made by Mr. Vines, seconded by Ms. Koscelny at
8:15 pm.
The meeting was brought back to order at 8:25 pm.
ITEM 9. Community Development Report
• Report on Monthly Building Permit Activity.
• Director's Update
Mr. Vines suggested that Mr. Stevens, Public Works Director, attend the next meeting to
discuss how road improvement projects are decided upon. To make sure we are all on
the same page.
ITEM 10. Report on Items from the February 24, 2016 TAC Meeting.
