Inter -local Agreement Intersection Improvements for engineering design services (E

engineering design services at the intersection of East 116th Street North and North 129th

The Owasso City Council met in regular session on Tuesday, April 5, 2016, in the Council
Chambers at Old Central, 109 N Birch, Owasso, Oklahoma per the Notice of Public Meeting and
the Agenda filed in the office of the City Clerk and posted on the City Hall bulletin board at 6:00
pm on Friday, April 1, 2016.

The invocation was offered by Pastor Chris Wall, Senior Pastor of First Baptist Church.

E. Approve Ordinance 1075, enacting Council approval (March 15, 2016) accepting,
adding, and annexing to the City of Owasso, Oklahoma, additional lands and
territory as referenced in annexation case OA -16 -01 and approving zoning
application number OZ -16 -02 changing the zoning of property located in the
southwest corner of the southwest quarter of the southwest quarter (SW /4 SW /4) of
Section Five (5), Township Twenty -one (21) North, Range Fourteen (14) East of the
Indian Base and Meridian, Tulsa County, State of Oklahoma, according to the U.S.
government survey thereof, provided that from and after the passage and
publication of this ordinance that all of the real property within said territory herein
described shall be a part of the City of Owasso, Oklahoma, and further declaring
that all persons residing therein shall be subject to the jurisdiction, control, laws, and
ordinances of the City of Owasso, Oklahoma establishing the some as part of ward
one of said city and directing the filing of this ordinance, and repealing all
ordinances or parts of ordinances in conflict herewith
F. Accept the donation from Southern Agriculture and approve a budget amendment
in the Police Department, Half -Penny Sales Tax Fund, increasing the estimated
revenue and the appropriation for expenditures by $681
G. Accept the donation from Ascension Health and approve a budget amendment in the
Ambulance Service Fund, increasing the estimated revenue and the appropriation for

totaling $702,407.77.

8. Consideration and appropriate action relating to items removed from the Consent Agenda

9. Consideration and appropriate action relating to PUD -16 -02 (OZ- 16 -03), Owasso Senior Living
(13707 E 96 +h St N)
Bronce Stephenson presented the item recommending approval of OPUD 16 -02 and OZ -16-
03, with the following conditions:
• The number of units be maximum of 31.
• A community garden area be provided for the residents.
• At least two (2) trees or large shrubs per unit be provided on the site.
• A screening berm at least six (6) feet in height be provided along E 961h St N.
Landscaping shall be provided atop and surrounding the berm to screen and
soften the transition.
• Perimeter screening fence of at least six (6) feet in height shall be constructed
with steel support poles set in concrete along the western, northern and eastern
boundaries. The smooth side of the fence shall be placed outward.

Signage along the E 961h St N frontage be constructed as a monument sign no
greater than four (4) feet in height, and set in a landscaped bed.
The development only be allowed as Senior Living Units with only those 55 years
and older allowed as tenants or residents, in accordance with Fair Housing Law.
Nine people addressed the Council. After discussion, the item died for lack of motion.
PUBLIC HEARING
10. The City Council will conduct a public hearing for the purpose of receiving citizen input
relating to the 2016 -2017 Community Development Block Grant application and the
proposed project to replace sanitary sewer lines in the Hale Acres subdivision
Karl Fritschen presented the item. The Mayor opened the Public Hearing for comment. One
person offered input.
11. Consideration and appropriate action relating to Resolution 2016 -04, requesting assistance
from the Tulsa County CDBG Urban County Program and approval of the application
identifying the installation of new sanitary sewer lines in the Hale Acres subdivision as the
preferred project for the 2016 -17 funding cycle and authorization for the Mayor to execute
the necessary documents
Karl Fritschen presented the item recommending approval of Resolution 2016 -04 and
approval of the application identifying the installation of new sanitary sewer lines in the Hale
Acres subdivision as the preferred project for the 2016 -17 funding cycle and authorization for
the Mayor to execute the necessary documents.
There were no comments from the audience. After discussion, Mr. Bush moved, seconded
by Mr. Bonebrake to approve Resolution 2016 -04, as recommended.

12. Consideration and appropriate action relating to a partial easement closure for Rejoice
Christian School (13413 E 106th St N)
Karl Fritschen presented the item recommending approval of the partial sanitary sewer
easement closure request.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Mr. Dunn to approve partial easement closure, as recommended.

13. Consideration and appropriate action relating to an agreement for design services for the
Festival Market Place Project
Larry Langford presented the item recommending approval of an agreement with GH2 of
Tulsa, Oklahoma for design services for the Festival Market Place Project in the amount of
$101,172 and authorization for the City Manager to execute the agreement.
There were no comments from the audience. After discussion, Dr. Kelley moved, seconded
by Mr. Bush to approve the agreement in the amount of $101,172 with GH2 of Tulsa,
Oklahoma, as recommended.

14. Consideration and appropriate action relating to the purchase of furnishings for the New City
Hall Project
Teresa Willson presented the item recommending authorization for the City Manager to
execute a contract for the purchase of furnishings for the new City Hall facility.
There were no comments from the audience. After discussion, Dr. Kelley moved, seconded
by Mr. Bonebrake to authorize the City Manager to execute a contract for furnishings for the
New City Hall not to exceed $223,239.22, as recommended.

15. Consideration and appropriate action relating to a right -of -way acquisition for the Garnett Rd

easement and compensation for damages in the amount of $56,322.05 to BAK
Development Enterprises, LLC, and authorization for payment.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Mr. Dunn to approve the purchase of right -of way and payment in the amount
of $56,322.05, as recommended.

Tuesday, April 12, 2016
The Owasso City Council, Owasso Public Works Authority, and Owasso Public Golf Authority met
in a joint regular meeting on Tuesday, April 12, 2016, in the Council Chambers at Old Central, 109
N Birch Street, Owasso, Oklahoma per the Notice of Public Meeting and the Agenda filed in the
office of the City Clerk and posted on the City Hall bulletin board at 6:00 pm on Friday, April 8,
2016.
1. Call to Order
Mayor /Chair Jeri Moberly called the meeting to order at 6:05 pm.

2. The meeting will recess and reconvene at the Wastewater Treatment Plant, 600 S Main St to
tour the facility. Following the tour, the Councilors /Trustees will return to Council Chambers,
109 N Birch, to continue meeting.
The Council /Trustees recessed the meeting at 6:05pm and reconvened the meeting at
7:06 pm. Councilor Kelley arrived at 6:10pm and did not attend the tour.
3. Discussion relating to Community Development items
A. Annexation Request OA 16 -02 - north side of E 761h St N approximately 3/4 mile
west of N 16151 E Ave
B. Final Plat Request - Charity Auto Sales (1 1595 E 11 6th St N)
Bronce Stephenson presented each item and discussion was held. It was explained that
both requests would be on the May 3, 2016 Council agenda for consideration and
action.
4. Discussion relating to rate increase of golf fees
Sherry Bishop presented the item and discussion was held. It was explained that a
resolution would be on the May 3, 2016 OPGA agenda for consideration and action.
5. Discussion relating the FY 2017 Budget
Sherry Bishop presented the item and discussion was held. It was explained that the required
public hearing would be held during the June 7, 2016 Council meeting.
6. Discussion relating to City Manager contract and evaluation process and the City Attorney
contract
Michele Dempster presented the item and discussion was held. It was explained that an
executive session would be placed on the May 10, 2016 worksession for an evaluation
presentation by Greenwood Performance. It was further discussed that an executive session
would be placed on the May 17, 2016 agenda to discuss the FY 2017 contract between the
City and the City Attorney.

7. Discussion relating to City Manager items
• Monthly sales tax report
• City Manager report
Linda Jones presented the monthly sales tax report and discussion was held. Under the City
Manager Report, Mr. Lehr advised staff received notification from the City of Tulsa regarding
an increase in the water rates to be effective October 1, 2016; staff continues to review
quotes and furniture options for the City Hall remodel project; staff and members of the
Planning Commission, City Council, and Board of Adjustment will attend an OML training on
Friday, April 15, 2016; and provided an update on the City's annual free landfill day. Bronce
Stephenson provided an update on the public downtown branding campaign and the
Mowery development on 1 stand Main Street.
8. City Council /Trustee comments and inquiries
Councilors expressed appreciation for the Wastewater Treatment Plant Tour and the
opportunity to attend the OML training on Planning Commissions and Boards of Adjustment.

At the April 5, 2016 meeting, the Owasso City Council approved a request to close a portion of a
utility easement on property where Rejoice Christian School is located. Attached is a copy of
Ordinance 1076 that formally adopts the City Council's action of April 5, 2016.
RECOMMENDATION:
Staff recommends approval of Ordinance 1076.

date of final passage as provided by state law.

a true and correct copy of this Ordinance.

BACKGROUND:
Oklahoma Municipal Retirement Fund (OkMRF), the retirement plan for non - police and fire
employees, requires the City Council acting as the OkMRF Retirement Committee to approve
applications for retirement. To be eligible for retirement benefits through OkMRF, an employee
must have a minimum of five years of employment. Once an employee has five years of
service, the employee is considered vested and upon leaving employment with the City has
three options depending upon age.
1. Normal Retirement is available to a vested employee age 65 or older.
2. Early Retirement is available to a vested employee between ages 55 and 65.
3. Deferred Retirement is available to vested employees under the age of 65. Deferred
Retirement allows an employee to "defer" retirement benefits until a future date, at
which time the employee would begin receiving monthly retirement benefits.
April 12, 2016 was the last day of employment for Sandra Vossen of the Finance Department
Utility Billing Division. Ms. Vossen was a participant in the OkMRF retirement plan while employed
with the City for five years and has applied for, and meets the prerequisites for Deferred
Retirement,
RECOMMENDATION:

With the assistance of Mr. Michael Watson, a local insurance professional with Allstate Insurance,
the fire department qualified for and received a donation from the Allstate Insurance
Foundation in the amount of $1,000. The donated funds are to be used to support the
community through enhanced fire department operations. The fire department intends to utilize
the funds to purchase updated training materials.
RECOMMENDATION:
Staff recommends the acceptance of the donation from the Allstate Insurance Foundation and
approval of a budget amendment in the Fire Department, Half -Penny Sales Tax Fund (37 -250)
increasing the estimated revenues and the appropriation for expenditures by $1,000.

ANALYSIS:
The final plat for Charity Auto Sales proposes one (1) lot on one (1) block. The property is
located along E 1161h St N just south of the Brookfield Crossing Subdivision. This property was
recommended for annexation approval by the Annexation Committee on February 24, 2016
(OA 16 -01).
There is an existing recorded 11 -foot utility easement along both sides and rear of the property
as well as a 17.5 -foot utility easement along the front of the property. The utility easements will
provide utility companies adequate access to provide and maintain utility service for the future
use on the property. Any development that occurs on the subject property must adhere to all
subdivision, zoning, and engineering requirements including but not limited to paved streets,
landscaping, and sidewalks. The proposed commercial use for the property conforms to the
land use prescribed under the 2030 Owasso Land Use Master Plan. The property is subject to all
applicable paybacks as described in the above table. The City of Owasso will provide sanitary
sewer for this property.
Since the original review of this item, staff has worked with the developer of the property and will
request an access easement on the west side of the property to allow for connection to future
development and to provide secondary means of emergency access to the site. The site plan
will determine the exact location needed, so staff will simply ask the Council to require a mutual
access to be determined by staff. The applicant has agreed to this request.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed the final plat for Charity Auto Sales at their
regularly scheduled meeting on March 23, 2016. All TAC comments have been addressed by
the applicant.
PLANNING COMMISSION:
The Owasso Planning Commission considered this item at their meeting on April 11, 2016, voting
unanimously to recommend approval of the Final Plat.
RECOMMENDATION:
Staff recommends approval of the Final Plat for Charity Auto Sales, with the addition of a mutual
access easement located along the western property boundary, with location to be
determined by staff upon review of site plan.

BACKGROUND:
City staff is currently involved in the acquisition of rights of way and easements for the Garnett
Road Improvements from East 961h Street North to East 106th Street North. As a part of those
acquisitions, negotiations for the purchase of land from Gahlib AI- Kazaz, for 4,422 square feet of
right of way and from Mr. and Mrs. (Thomas and Ernestine) Sanders for 14,273 square feet of right
of way, have been successfully completed.
DESCRIPTION /PURCHASE PRICE:
Gahlib AI -Kazaz - The appraised value of the right of way is $7.25 per square foot, for a purchase
price of $32,060. Compensation for damages and permanent easement in the amount of
$10,766 was included in addition to the right of way cost, for a total offer of $42,826 (see
Attachment). Mr. AI -Kazaz counter offered in the amount of $99,000. After several discussions,
Mr. AI -Kazaz accepted the increased offer of $47,652 (see Attachment) - which calculates to be
$8.34 per square foot for right of way.
Mr. and Mrs. Sanders - The appraised value of the right of way is $4.00 per square foot, for the
purchase price of $57,118. Compensation for damages and permanent easement in the
amount of $1,432 was included in addition to the right of way cost, for a total offer of $58,550
(see Attachment). During discussions with Mr. and Mrs. Sanders, Mr. Sanders requested
consideration for the loss of an existing fence and 5 mature trees. As a result, staff acquired
estimates and determined Mr. Sanders should be compensated an additional $5,422 due to the
damages mentioned. Mr, and Mrs. Sanders accepted the increased offer of $63,972 (see
Attachment).
FUNDING:
Funding for this purchase is available from the project budget in the Capital Improvements Fund.
RECOMMENDATION:
Staff recommends approval to purchase rights of way, easements and compensation for
damages in the amount of $47,652 to Gahlib AI- Kazaz, and $63,972 to Thomas and Ernestine
Sanders and authorization for payment.

BACKGROUND:
On April 21, 2015, the City of Owasso and Tulsa County entered into an Inter -local Agreement for
the engineering fees to design the intersection at 1161h Street North /129th East Avenue. The
intersection is jointly owned and maintained by Tulsa County and City of Owasso. Tulsa County
and the City of Owasso agreed to share costs for the engineering design for the project, right -of-
way, utility relocation and construction. Both parties agreed and selected WP Moore, Inc. to
perform the engineering for the intersection improvements for a total design fee of $168,000. The
engineering consultant has prepared design plans to 60% completion and we have been
waiting for the NEPA (environmental) approval to move to right -of -way acquisition and then
utility relocation.
While waiting for the preparation for the NEPA document and subsequent approval by the
Federal Highway Administration (FHWA), Wal -Mart announced plans to purchase and construct
a new Neighborhood Market at the southeast corner of the intersection. The improvements to
the roadway (adding an additional temporary lane on 116th Street North), addition of temporary
signals to the intersection, drainage, driveways and utility improvements rendered the survey
data outdated. Also, the design at that intersection will need to be reevaluated and the road
design modified to work with the new driveways and new utility locations.
INTER -LOCAL AGREEMENT AMENDMENT:
After the City of Owasso received the as -built plans from Wal -Mart, WP Moore reviewed the
data and proposed resurveying the area in order to incorporate the changes in the topography
onto the original survey. Once the survey changes are made, WP Moore can make changes
that are needed to the roadway /intersection design. After approval of these changes, WP
Moore will begin working with the utility companies on corridor alignments and preparations for
relocations.

WHEREAS, the County Is desirous of participating in projects and the provision of services
mutually advantageous to the County and other units of government;
THEREFORE, in consideration of the covenants and conditions hereinafter contained, the
parties hereto agree as follows:
1. The duration of this Agreement shall be from the date of execution of this
Agreement until the project is complete.
2. The purpose of this Agreement shall be to provide for engineering design for the
improvements of the intersection of 116th Street North and 129th East Avenue.
3. The City and County shall select an Engineering Consultant to provide the design
for the project.
4. The County shall contract with and pay the invoices for the services provided by
the Engineering Consultant.
5. The City shall reimburse the County one half the actual costs for contracting with
the Engineering Consultant.
6. This Agreement shall be effective from and after the date of execution hereof
and is intended only for the purpose described in Section 2 above.
7. The rights, duties, and obligations under or arising from this Agreement shall not
be assigned by either party hereto without the express written consent of the other.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 4,032
linear feet of eight (8) inch PVC sanitary sewer line and all appurtenances to serve the City of Owasso,
located in Section 7, T -21 -N, R -14 -E, Tulsa County, Oklahoma, in accordance with the plans approved
March 30, 2016.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance
with the "Oklahoma Pollutant Discharge Elimination System Standards - OPDES" (OAC 252:606) rules
and to comply with the state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and
regulations adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new project.
3) That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:666- 54(c)(3) of the standards for Water
Pollution Control Facility Construction.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 10 gallons per inch of pipe
diameter per mile per day.
6) That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.

7) That the permittee will take steps to assure that the connection of house services to the sewers is
done in such a manner that the functioning of the sewers will not be impaired and that earth and
ground water will be excluded from the sewers when the connection is completed.
8) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the
construction of this project.
9) That the recipient of the permit is responsible for the continued operation and maintenance of
these facilities in accordance with rules and regulations adopted by the Environmental Quality
Board, and that this Department will be notified in writing of any sale or transfer of ownership of
these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
11) That the permittee is required to inform the developer /builder that a DEQ Storm Water
Construction Permit is required for a construction site that will disturb one (1) acre or more in
accordance with OPDES, 27A O.S. 2 -6 -201 et. seq. For information or a copy of the GENERAL
PERMIT (OKR10) FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES,
Notice of Intent (NOI) form, Notice of Termination (NOT) form, or guidance on preparation of a
Pollution Prevention Plan, contact the Storm Water Unit of the Water Quality Division at P.O. Box
1677, Oklahoma City, OK 73101 -1677 or by phone at (405) 702 -8100.
12) That all manholes shall be constructed in accordance with the standards for Water Pollution
Control Facility Construction (OAC 252:656 -5 -3), as adopted by the Oklahoma Department of
Environmental Quality.
13) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in
Water Pollution Control Facility Construction OAC 252:656- 5- 4(c)(1) and OAC 252:656- 5- 4(c)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested using the ASTM air test procedure with no detectable leakage prior to backfilling,
in accordance with the standards for Water Pollution Control Facility Construction OAC 252:656 -
5-4(c)(3).

Enclosed is Permit No. WL000072160173 for the construction of 2,062 linear feet of eight (8) inch PVC,
1,980 linear feet of six (6) inch PVC, 1,184 linear feet of four (4) inch PVC potable water line and all
appurtenances to serve the City of Owasso, Tulsa County, Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans approved by this
Department on March 30, 2016. Any deviations from the approved plans and specifications affecting
capacity, flow or operation of units must be approved, in writing, by the Department before changes are
made.
Receipt of this permit should be noted in the minutes of the next regular meeting of the City of Owasso,
after which it should be made a matter of permanent record.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 2,062
linear feet of eight (8) inch PVC, 1,980 linear feet of six (6) inch PVC, 1,184 linear feet of four (4) inch
PVC potable water line and all appurtenances to serve the City of Owasso, located in Section 7, T -21 -N,
R -14 -E, Tulsa County, Oklahoma, in accordance with the plans approved March 30, 2016.
By acceptance of this permit, the permittee agrees to operate and maintain the facility in accordance with
the Public Water Supply Operation rules (OAC 252:631) and to comply with the State Certification laws,
Title 59, Section 1101 -1116 O.S. and the rules and regulations adopted thereunder regarding the
requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) This water line provides adequate fire flow in accordance with the 2009 International Fire Code
through the approved hydraulic analysis. The fire flow provided is 1,000 gpm.
2) That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new project.
3) That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
4) That the Oklahoma Department of Environmental Quality shall be kept informed on occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.
5) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with Public Water Supply Construction Standards (OAC
252:626- 19 -2].

6) That before placing this facility into service, at least two samples of the water, taken on different
days, shall be tested for bacteria to show that it is safe for drinking purposes.
7) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the
construction of this project.
8) That the recipient of the permit is responsible for the continued operation and maintenance of
these facilities in accordance with rules and regulations adopted by the Environmental Quality
Board, and that this Department will be notified in writing of any sale or transfer of ownership of
these facilities.
9) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
10) That the permittee is required to inform the developerlbuilder that a DEQ Storm Water
Construction Permit is required for a construction site that will disturb one (1) acre or more in
accordance with OPDES, 27A O.S. Section 2 -6 -201 of seq. For information or a copy of the
GENERAL PERMIT (OKR10) FOR STORM WATER DISCHARGES FROM CONSTRUCTION
ACTIVITIES, Notice of Intent (NOT) form, Notice of Termination (NOT) form, or guidance on
preparation of a Pollution Prevention Plan, contact the Storm Water Unit of the Water Quality
Division at P.O. Box 1677, Oklahoma City, OK 73101 -1677 or by phone at (405) 702 -8100.
11) That any notations or changes recorded on the official set of plans and specifications in the
Oklahoma Department of Environmental Quality files shall be part of the plans as approved.
12) That water lines shall be located at least fifteen (15) feet from all parts of septic tanks and
absorption fields, or other sewage treatment and disposal systems.
13) That whenever plastic pipe is approved and used for potable water, it shall bear the seal of the
National Sanitation Foundation and meet the appropriate commercial standards.

14) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in
Public Water Supply Construction Standards OAC 252:626- 19- 2(h)(1) and OAC 252:626-19 -
2(h)(2), respectively, the sewer shall be designed and constructed equal to water pipe, and shall
be pressure tested to the highest pressure obtainable under the most severe head conditions of
the collection system prior to backfilling.
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will
constitute acceptance of the permit and all conditions and provisions.
