AN ORDINANCE CLOSING TO THE PUBLIC USE A PORTION OF A UTILITY EASEMENT LOCATED IN THE
EAST HALF OF THE SOUTHWEST QUARTER (E /2, SW /4) OF SECTION 9, TOWNSHIP 21 NORTH, RANGE
14 EAST OF THE INDIAN BASE MERIDIAN, TULSA COUNTY, STATE OF OKLAHOMA,
WHEREAS the City of Owasso retains the absolute right to reopen the same
without expense to the municipality, and repealing all ordinances or parts of
ordinances in conflict herewith; and
WHEREAS, the City of Owasso, Oklahoma has deemed it necessary and
expedient to close to the public use a portion of a certain public utility and
drainage easement; and
WHEREAS, said portion of the utility easement is described as follows:
A TRACT OF LAND LOCATED IN THE E/2 OF THE SW /4 OF SECTION 9, T -21 -N, R -14 -E OF THE INDIAN
BASE MERIDIAN, TULSA COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE OFFICIAL U.S.
GOVERNMENT SURVEY THEREOF, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING FROM THE SOUTHWEST CORNER OF THE SOUTHEAST QUARTER OF THE SOUTHWEST
QUARTER (SE /4, SW /4); THENCE NORTH O1 013'58" WEST ALONG THE WEST LINE OF THE E /2, SW /4
FOR 1999.79 FEET; THENCE NORTH 88 044'37" EAST FOR 280.00 FEET; THENCE SOUTH O1 °13'58" EAST
PARALLEL WITH THE WEST LINE OF THE E /2, SW /4 FOR 571.58 FEET TO THE POINT OF BEGINNING OF
SAID TRACT OF LAND; THENCE CONTINUING SOUTH 01 013'58" EAST PARALLEL WITH SAID WEST LINE
FOR 1032.15 FEET; THENCE SOUTH 88 °46'02" WEST FOR 20.00 FEET; THENCE NORTH 01013'58" WEST
PARALLEL WITH SAID WEST LINE FOR 1043.14 FEET; THENCE SOUTH 62 026'17" EAST FOR 22.82 FEET
TO THE POINT OF BEGINNING OF SAID TRACT OF LAND.
SAID PROPERTY IS APPROMMATLEY 20,752.9 SQUARE FEET IN SIZE.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
THAT TO WIT:
Section 1. That all ordinances or parts of ordinances in conflict with this ordinance are
hereby expressly repealed.
Section 2. All ordinances, or parts of ordinances, in conflict with this ordinance are hereby
repealed to the extent of the conflict only.
Section 3. If any part or parts of this ordinance are deemed unconstitutional, invalid or
ineffective, the remaining portion shall not be affected but shall remain in full force and effect.
Section 4. The provisions of this ordinance shall become effective thirty (30) days from the
date of final passage as provided by state law.
Section 5. That there be filed in the office of the County Clerk of Tulsa County, Oklahoma,
a true and correct copy of this Ordinance.

closed. All documents shall be submitted 21 days in advance of the TAC meeting, at which the closure
will be reviewed. The applicant and/or the applicant's consultant should attend both the
Technical Advisory Committee and City Council meetings.

DATE: April 29, 2016
BACKGROUND:
At the April 5, 2016 meeting, the Owasso City Council approved a request to close a portion of a
utility easement on property where Rejoice Christian School is located. Attached is a copy of
Ordinance 1076 that formally adopts the City Council's action of April 5, 2016.
RECOMMENDATION:
Staff recommends approval of Ordinance 1076.
