HomeMy WebLinkAbout1981.01.20_OPWA MinutesOn Tuesday, January 20, 1981, the Owasso Public Works Authority met in regular session, in the Council Chambers at City Hall, per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 3:30 PM on January 16, 1981, and by reference made a part hereof. ITEM 1 - CALL TO ORDER. The meeting was called to order at 8:13 PM with Chairman Spencer presiding. ITEM 2 - ROLL CALL. Present: Boyd Spencer, Chairman Al Lambert, Trustee Dennis Burke, Trustee Kenneth Thompson, City Manager Harold Charney, City Attorney Wauhilleau Webb, Recording Secretary Absent: Robbie Fickle, Vice Chairman ITEM 3 - APPROVE CONSENT AGENDA ITEMS. Motion was made by Boyd Spencer, seconded by Al Lambert, to approve Consent Agenda items, as follows, as published in the Owasso Reporter on January 15, 1981, and by reference made a part hereof. A. Approve Minutes of January 6, 1981 Regular Meeting. B. Approve Warrants 546 through 557 for $19,093.31, and authorize Chair- man to sign same. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 4 - PRESENTATION OF FINANCIAL STATEMENTS FOR DECEMBER 1980. Motion was made by Boyd Spencer, seconded by Al Lambert, to accept financial statements for the month of December 1980, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 5 - APPROVAL OF ACTIONS NECESSARY TO SETTLE THE LAWSUIT WASHINGTON COUNTY RURAL WATER DISTRICT NO. 3 VS. OWASSO PUBLIC WORKS AUTHORITY AND AUTHORIZE PAY- MENT OF $7,350.45 INCLUDING RWD3's ATTORNEY FEES, COURT COSTS AND FINE. Mr. Spencer questioned why the area on Garnett Road was not included all the way to 126th Street North. Mr. Charney and Mr. Thompson did not recall that area ever being considered. Owasso Public Works Authority January 20, 1981 Page Two Mr. Thompson was concerned that in later years the Settlement Agreement would not be clear as to who should and should not pay. Mr. Charney said we are not going to get involved in who they will charge but agreed to amend Paragraph 2 of the proposed Settlement Agreement to read "RWD3 has agreed that no charges will be made to any persons for permission to hook onto the OPWA water system in the above enumerated subdivisions". Motion was made by Dennis Burke, seconded by Al Lambert, to approve Settlement Agreement to settle the lawsuit of Washington County Rural Water District No. 3 vs. Owasso Public Works Authority and payment of $7,350.45 including RWD3's attorney fees, court costs and fine. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 6 - APPROVE ADDITIONAL WARRANTS FOR PAYMENT. Motion was made by Boyd Spencer, seconded by Al Lambert, to approve additional warrants 576 through 617 for $12,452.09, and authorize Chairman to sign same, and by reference made a part hereof. Ayes - Messrs. Spencer, Lambert and Burke Nays - None Motion carried. ITEM 7 - NEW BUSINESS. Item Mr. Thompson said we have received Permit No. WL-80-245 from the State Depart- ment of Health to construct the 86th Street North Water line. The Health De- partment directed that receipt of the permit should be acknowledged in the Board's minutes. Motion was made by Al Lambert, seconded by Dennis Burke, to accept Oklahoma State Department of Public Health Permit No. WL-80-245 for construction and maintenance of water line connection to Tulsa at 86th Street North, and by reference made a part hereof.
