HomeMy WebLinkAbout1982.09.07_OPWA MinutesOn Tuesday, September 7, 1982, the Owasso Public Works Authority met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda posted on City Hall bul- letin board at 10:00 a.m. on September 3, 1982, and by reference is made a part hereof. ITEM 1: CALL TO ORDER ® The meeting was called to order at 8:35 p.m. with Chairman Spencer presiding. ITEM 2: FLAG SALUTE ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Chairman Von Stockler, Trustee Phyllis Gross, Trustee Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, Recording Secretary ABSENT: Wauhilleau Webb, Vice -Chairman Jim Smalley, Trustee ITEM 4: APPROVE MINUTES OF REGULAR OWASSO PUBLIC WORKS AUTHORITY MEETING ON AUGUST 17, 1982. Motion was made by Phyllis Gross, seconded by Von Stockler to approve the minutes of August 17, 1982. AYE: Messrs. Spencer and Stockler; Mrs. Gross NAY: None Motion carried. ITEM 5: BUSINESS No business at this time. ITEM 6: REPORT FROM CITY MANAGER A. ENGINEERING SERVICE - SEWER IMPROVEMENTS Mr. Cates reported that concerning the McLaughlin -Conner claims he has been in contact with Crawford & Co. and with the Shanks agency. Crawford & Co. has advised that McLaughlin and Conner have not provided certain information requested of them and if information is not forthcoming, they will have to close their file on the matter in 30 days. Mr. Cates has again tried to advise McLaughlin and Conner of this problem. He has been advised that there are problems with the easement agreements presented to the respective attorneys. Mr. Block reported that the grinder pump has been purchased, but as yet cannot get on the property to do any work. OWASSO PUBLIC WORKS AUTHORITY PAGE TWO SEPT. 7, 1982 Mr. Block reported that Dr. Bryson is looking into the possibility of a sewer improvement district. Other possibilities he is con- sidering are: getting the sewer addition built without the city's participation, putting in a pump system for himself and the Nazarene Church and using a temporary lagoon until a sewer improvement dis- trict could be worked out. Mr. Block reported on the status of the E.P.A. application for Federal participation in sewer improvement. Since the City entered into an agreement with Mansur, Daubert, Williams, Inc. on this project, the Federal government has stopped giving grants to do Steps 1 or 2 in the project. The City is now responsibile for Step 1 and 2 with possible reimbursement during Step 3 of the operation. The percentage of reimbursement has not been defined. The current Federal ratio is 75% Federal - 25% City, but this will change in 1984 to 55% Federal - 45% City. Mr. Block believes it is possible for the City to reach the level of Step 3 before the ratio changes. The contract with Mansur, Daubert, Williams, Inc. was entered into when the Federal government was involved in Steps 1 and 2 and Mr. Block asked the City Attorney to review it with the consideration of possible cancellation. Mr. Cates reported that cancellation was possible, but would entail payment for ser- vices previously rendered and settlement costs. Mrs. Gross suggested that the City present a 10, sales tax proposal to the people with an plan outlining its use, particularly for water and sewer improvements, so that we could begin to collect the funds that we will need. Mr. Block stated that if we can cancel the contract with Mansur, Daubert, Williams, Inc. and still show an appreciable savings to the city, it would be good to resubmit it for proposals from various companies including Mansur, Daubert, Williams, Inc. Mr. Cates suggested that Mr. Block find out exactly what work has been done to date on the contract, find out if the City has a com- mittment on the settlement clause, and determine if it would be profitable to the city to cancel the contract. Mr. Cates said the biggest concern in cancelling the contract would be third party committments made by the engineering firm that would be binding to the City.
