HomeMy WebLinkAbout1982.01.05_OPWA MinutesOn Tuesday, January 5, 1932, the, Owasso Public Works Authority met in regular session in the Council Chambers at City Hall per the Notice of Public Meeting and Agenda posted on City Hall bulletin board at 2:00 P.M. on December 31, 1981, and by reference is made a Dart hereof. ITEM 1: CALL TO ORDER. The meeting was called to order at 9:00 P.M. with Chairman Wasserman presiding. ITEM 2: FLAG SALUTE. ITEM 3: ROLL CALL. PRESENT: Lyle Wasserman, Chairman Phyllis Gross, Vice Chairman Boyd Spencer, Trustee John Stadler, Trustee Jim Smalley, Trustee Ron Cates, City Attorney Kenneth Thompson, City Manager Sue Shelley, Recording Secretary ABSENT: None ITEM 4: APPROVE MINUTES OF SPECIAL OWASSO PUBLIC WORKS AUTHORITY MEETING ON DECEMBER 22, 19 1. Motion was made by Phyllis Gross, seconded by Chairman Wasserman to approve minutes of December 22, 1981, AYES: Messrs, Wasserman, Stadler, Smalley and Mrs. Gross NAYS: None ABSTAIN: Mr. Spencer Motion carried. ITEM 5: APPROVE MINUTES OF REGULAR OWASSO PUBLIC WORKS AUTORITY MEETING ON DECEMBER 15, 1981. City Manager stated that on Page Three first paragraph „ Item 9 from 86th Street to 96th Street" is correct instead of"86th Street to 86th Street': Motion was made by John Stadler, seconded by Phyllis Gross to approve minutes of December 15, 1981 meeting with the correction as above noted to change from "86th Street to 96th Street". ITEM 6: REPORT BY CITY ATTORNEY AND CITY MANAGER ON INVESTIGATION WITH MR. H.D. HALE REGARDING PAYMENT CLAIMS ON WATER AND SEWER LINE COSTS IN HALE ACRES I AND II. City Manager and City Attorney gave a summary, in which they stated three decisions that they think the Council should make. 1. There is a valid contract for water line payback with Mr. Hale for Hale Acres I. These payments will be made when Mr. Hale completes the water lines and when proper bills have been submitted strictly in accordance with the 1967 contract. 2. There is no legal obligation to pay back waterline costs in Hale Acres II. 3. There is no legal obligation to pay any costs for sewer lines in Hale Acres I or II. If a moral obligation to pay Mr. Hale for the extra depth of the sewers, Mr. Hale should Drove the extra cost and submit a reasonable bill which would be prorated to adjourning property owners when they connect to sewer. Mr. Hale wanted to know whether the Council wanted to buy or lease the 4940' of waterline installed under the Hale Acres I contract. A lenghty discussion followed on all Points and District Court Adjudication was suggested as a possible solution to the entire matter. Motion was made by Boyd Spencer, seconded by John Stadler that no action to be taken on Payback on Hale Acres I and II and no sewer paybacks on Hale I and II. AYES: Messrs. Spencer, Stadler and Smalley NAYS: None ABSTAIN: Wasserman and Mrs. Gross Motion carried. Owasso Public Works Authority Page Three January 5, 1982 ITEM 7: REQUEST APPROVAL AND SET DATE FOR CITY BOND ELECTION FOR IMPROVEMENTS AND EXTENSIONS TO THE CITY WATER AND SANITARY SEWER SYSTEM. No motion was mde until committee is set un to study question. ITEM 8: REPORT BY CITY ATTORNEY ON STATUS OF CONDEMNATION ACTION ON H.D. HALE PROPERTY NORTH OF HALE ACRES II SUBDIVISION. City Attorney stated the alternatives, authorize dismissal, do not take any action, or authorize to Droceed on the case. Mr. Thornton, attorney of record in the condemnation action, reports that there will be a hearing, if the court approves commissioner's report in the Hale appeal case, if we pay the sum of $2,500.00 the City will be able to tie into the sewer line. Mr. Stan Robinson, Manager of Wal-Mart offered to pay the $2,500.00 for the comdemnation action. Motion was made by John Stadler, seconded by Boyd Spencer to take no action on the condemnation action at the present time. AYES: Messrs. Wasserman, Spencer and Stadler NAYS: None ABSTAIN: Smalley and Mrs. Gross Motion carried. City Manager stated that sincethe condemnation action has been initiated against the 1' strip owned by Mr. Hale, the letter from Mr. Thomason initiating the freezing of sewer taps in the subdivision is no longer applicable. Since the condemnation action will take aresidence over the letter. ITEM 9: APPROVE WARRANTS FOR PAYMENT. City Manager gave a report that a supplemental OPWA warrant was added #1240-82 for $2,371.00. Boyd Spencer stated that this warrant was for more than $2,000,00, that it had to be broken down below the $2,000.00 figure. Motion was made by Phyllis Gross, seconded by Jim Smalley to accept warrants #635 through 677 for $19,225.02 with the exception of #1240-82. AYES: Messrs, Wasserman, Stadler, Spencer, Smalley and Mrs. Gross NAYS: None Motion carried.
