Notice is hereby given that a public hearing will be held before the
Owasso Board of Adjustment at Old Central, 109 North Birch,
Owasso, Oklahoma at 6:00 PM on the 24'h day of June, 2008. At
that time and place the Owasso Board of Adjustment will consider
a request from Denham Homes, LLC for a VARIANCE from the
Owasso Zoning Code, Section 430.1 (Bulk and Area Requirements
in RS Districts) to allow an encroachment of 5 ft. 6 in. into the 20
ft. building line. The property is located at 7005 North 123 East
Avenue, Owasso, Oklahoma, Tulsa County, Oklahoma.

SUBJECT: OBOA- 08 -06, A REQUEST FOR A SPECIAL EXCEPTION TO
ALLOW FOR THE CONSTRUCTION OF A CARPORT

BACKGROUND:
The City of Owasso has received a request for a Special Exception from the Owasso
Zoning Code, to allow for the construction of a carport over the front driveway in a
residential zoning district.
LOCATION:
The subject property is located at 403 East 16'h Street in the Ator Heights Addition.

RS -3 (Residential Single - Family)
ANALYSIS:
The applicant owns a house in Ator Heights III without a garage on the property. The
owners would like to protect their vehicles in addition to minimizing the risk of
themselves being harmed by the elements (snow, ice and rain) as they transition from
house to vehicle. They have two apparent options, either construct an attached garage or
erect a connected carport. The applicant has chosen to build a carport 20' X 20' to cover
the entire width of the driveway. Carports are allowed in the City of Owasso by Special
Exception requiring Board of Adjustment approval according to the Owasso Zoning
Code as such the applicant has brought this request to the Board of Adjustment for
review.
"The Board of Adjustment shall hold the public hearing and, upon the concurring vote of
three members, may grant the Special Exception after finding that the Special Exception
will be in harmony with the spirit and intent of the code, and will not be injurious to the
neighborhood or otherwise detrimental to the public welfare. Provided that the Board in
granting a Special Exception shall prescribe appropriate conditions and safeguards, and
may require such evidence and guarantee or bonds as it may deem necessary to enforce
compliance with the conditions attached." - Section 1480.4 Owasso Zoning Code.
After reviewing the site and surrounding area staff found no other carport in the
neighborhood on the same street as the subject site. However, other carports are found in
the same subdivision. The construction of a metal carport in the front yard of the subject
property would not be detrimental to the public welfare as it will be entirely on the
applicants property and out of any possible driving site lines. The Ator Heights
neighborhood is zoned RS -3 and with that designation there is a 25' building setback.
The applicant's house meets this regulation and as such the proposed carport would be
18' from the abutting street. Staff is inclined to believe that an upgrade in the materials
selected for the construction of the carport could assist the carports ability to blend into
the neighborhood a little better, in the absence of a material change landscaping beside
the carport and driveway could improve the carports appearance.
Letters were mailed to all property owners within three- hundred (300) feet of the subject
property and the request was advertised in the Owasso Reporter. Staff received no
objections concerning OBOA 08 -06.
RECOMMENDATION:
Staff recommends approval of OBOA 08 -06 with the consideration of additional
elements to improve the carports appearance or surroundings.

rear yard setback on a property zoned RD (Residential Duplex), located at 109 West 2nd Street
North.
LOCATION:
The property is located at 109 West 2nd Street North, in the Original Town of Owasso. A
general area map is attached.

PRESENT ZONING:
RD (Residential Duplex)
APPLICABLE REGULATIONS:
Owasso Zoning Code, Section 43 1. 1 — Bulk and Area Requirements in Residential Districts.
ANALYSIS:
The applicant is requesting a variance from the Owasso Zoning Code Development Standards to
allow for the construction of a residence that encroaches 6.5' into the 20' rear yard setback, as
shown in the site drawing.
The subject is proposed to contain a residential duplex dwelling. It is the intent of Maven
Investments to complete the project and rent the property.
The staff has evaluated the request, and finds that approval of the variance will not result in any
detrimental impact on the surrounding area. It is the opinion of the staff that the character of the
neighborhood will not be adversely affected by granting the variance.
Letters were mailed to all property owners within three- hundred (300) feet of the subject property
on and the request was advertised in the Owasso Reporter.
RECOMMENDATION:
The staff recommends approval of OBOA 08 -07.

East Avenue in the Keys Landing I addition.
LOCATION:
The property is located in the Keys Landing I addition at 7005 North 123rd East Avenue. A
general area map is attached.

APPLICABLE REGULATIONS:
Owasso Zoning Code, Section 431.1 - Bulk and Area Requirements in Single- Family
Residential Districts.
ANALYSIS:
The applicant is requesting a variance from the Owasso Zoning Code Development Standards to
allow for the construction of a residence that encroaches 6.25' into the 20' rear yard setback.
As shown in the site drawing, the structure was constructed 6.25' over the eastern portion of the
rear yard.
The subject property contains a 2,600 sq ft single family dwelling. The applicant has informed
staff that while measuring the property lines the builder measured from the radius pin rather than
the property line pin, thus the reason for the request. It is the intent of Denham Homes to
complete the project and sell the residence.
The staff has evaluated the request, and finds that approval of the variance will not result in any
detrimental impact on the surrounding area. It is the opinion of the staff that the character of the
neighborhood will not be adversely affected by granting the variance.
Letters were mailed to all property owners within three- hundred (300) feet of the subject property
on and the request was advertised in the Owasso Reporter.
RECOMMENDATION:
The staff recommends approval of OBOA 08 -08.
