OBOA-00-01 - A request from Nancy Wood for a Special Exception of the Owasso Zoning Code - Chapter 10, Sectio 1002, to allow for a non-permenent accessory vendor on property currently zoned CS (Commercial Shopping Center) Zoning District. The property is descried as Lot 1, Block 1, Clark Plaza Fourth Addition, further described as property on the north side of E 86th Street North, east of the Owasso Expressway. The applicant requests permission to operate a refreshment stand in the parking lot of Reasor's grocery, 11815 E 86th Street N. 5. OBOA-00-02 - A request from Allison Andreoli for a Special Exception of the Owasso Zoning Code - Chapter 10, Section 1002, to allow for a non-permanent accessory vendor on propoerty currently zoned CS (Commercial Shopping Center) Zoning District. Adjournment CITY OF OWASSO Planning Department OBOA-00-01 Staff Report GENERAL INFORMATION APPLICANT/STATUS OF APPLICANT: Nancy Wood, applicant. REQUESTED ACTION AND PURPOSE: A request for a Variance to the Owasso Zoning Code Section 1002 "Areawide Special Exception Uses" to allow for a Non Permanent Accessory Vendor in a CS (Commercial Shopping Center) zoning district. LOCATION: The subject side is described as being a potion of Lot 1, Block 1, Clark Plaza Fourth Addition. The subject property is located as the sourthwest corner of the Reesor's Parking Lot. EXISTING LAND USE: Currently, the subject side is developed as a parking lot. SURROUNDING LAND USE: The subject side is bordered on the north and east by additional commercial property zoned CS (Commercial Shopping Center), a majority of which is developed as a parking lot. The subject property is bordered on the south by E. 86th Street North. The subject property is bordered on the west by N. 117th E. Avenue, while farther west lies Hardee's Restaurant. APPLICABLE REGULATIONS: City of Owasso Zoning Code Section 1002 "Areawide Special Exception Uses" and Sections 1400 through 1490 (Board of Adjustment). CASE HISTORY: The Board of Adjustment approved a Special Exception request at this location in March 1999 (OBOA-99-04). ANALYSIS: The applicant, Nancy Wood, is requesting a Special Exception in order to allow for a non-permanent accessory vendor in a CS (Commercial Shopping Center) zoning district. The subject property is located in the southwest corner of the Reasor's Parking Lot. the type of sales that would be conduted at this location are landsaping flowers. In April and May of 1997, the staff addressed a long-standing problem regarding vendors of this nature (snowcone machines, BBQ trailers, landscape and flower stands). Over the land several years, an increasing number of this type of vendor became prevalent in our community; however no review process has been established for such a use. Concerns regarding the placement of these structures ina manner that OBOA-00-01 STAFF REPORT Page 2 of 2 interrupts traffic circulation, as well as the occosional seasonal abandonment of these facilities, have lead to ur present requirment for Special Exceptions to the zoning code. Staff deevloped a requirement for this type of use to be reviewed through the Board of Adjustment so that site concerns could be reviewed as they relate to the proposed specific location. Additionally, all property owners within 300 feet woul dbe notified as well, thus allowing their input. Staff has reviewed the proposed location of this vendor service and has no concerns regarding the request. Surrounding property owners have been contacted and no objections to the request have been received by the Community Development Department. Staff noted no specific somplaints about this facility during last years operation. Additionally, the required legal ad was publishished in the Owasso Reporter and is attached for your information and review. Staff would recommend, however, that signage relating to the specific use be limited to that which is affixed to the non-permanent structure itself. Additionally, staff would caution the Board and future applicants that review of this type of Special Exception request will be site specific and by no means should this be considered to be a blanet approval for future requests, as perhaps with this request more than any other, the direct input from surrounding property/business owners will carry significant weight. RECOMMENDATION: Staff recommends approval of the Special Exception request with the following conditions: 1. Signage must be limited to that which is affixed to the structure itself, 2. A trash receptacle must be provided, 3. The structure must be removed from the site by the last day of October, 2000. ATTACHMENTS: 1. Area map, 2. OBOA-00-01 application, 3. LOCATION: The subject site is described as Lot 1, Block 1, Clark Plaza Fourth Addition (Reasor's Parking Lot), further described as 11815 E. 86th Street North. EXISTING LAND USE: Currently, the subject site where the vendor would be located is developed as a parking lot. The proposed flower tent is to be located in the same location that the Board of Adjustment approved in previous years. SURROUNDING LAND USE: The subject site is borded on the north and east by additional parking, Reasor's and Drug Mart. E 86th Street N borders the subject site on the south N 117th E Avenue borders the site to the west. APPLICABLE REGULATIONS: City of Owasso Zoning Code Section 1002 "Areawide Special Exception Uses" and Sections 1400 through 1490 (Board of Adjustment). CASE HISTORY: The applicant appeared before the Board of Adjustment in April 1998 (OBOA-98-10), and in March of 1999 (OBOA-99-05) with a nearly identical request. The previous requets have been approved. A snow cone vendor has also operated at this location which is presented elsewhere in this agenda. ANALYSIS: The applicant, Allison Bennett, is requesting a Special Exception in order to allow for a non-permanent accessory vendor in a CS (Commercial Shopping Center) zoning district. The subject property is located in the southwest corner of the Reasor's parking lot. Landscaping and plant ales would be conducted at this location. In May of 1997, a section of the zoning code was amended to address long-standing problems regarding vendors of this nature (snowcone machines, BBQ trailers, landscape and flower stands). Over the last several years, the number of these types of vendors had increased, however, no review process had been establsihed. Staff developed a requirement for this type of use to be reviewed through the Board of Adjustment so that site concerns could be reviewed as they relate to the proposed specific location. Additionally, all property owners within 300 feet would be notified as well, thus allowing their input. OA-00-02 STAFF REPORT PAGE 2 OF 3 Staff has observed operations at this location in previous years and stands by previous recommendations in order to avoid potential circulatio problems: 1. That the tent should be erected as near as possible to the E 86th Street N edge of the parking lot within the boundary of the first row of parking stalls, 2. That the tend and/or sales operations should not be obstruct and adjacent aisle behind the first row of parking stalls. Surrounding property owners have been contacted and no objections to the request have been received by the Community Development Department. Additionally, the required legal ad was published in the Owasso Reporter and is attached for your information and review. It is important to note that there have been conplaints regaring the operations of this vendor and that there is nothing different about this years proposal. Staff recommends that signage relating to the specific use be limited to that which is affixed to the non-permanent structure itself, as well as a requirement that the applicant have a trash receptacle at that location during hours of business operation. In reviewing the code amendment and licensing requirements, staff notes that the intent of the code is to allow the itinerate vendor an opportunity to legaly operate a business in the City. When that use is discontinued as the close of the season, the status of the facility chagnes. it is no thte intent of these portions of the code to allow a permanent occupancy to a seasonal business. therefore, a staff recommendation that this operation, as well as any other itinerant vendor operation, be dismantled and/or removed from the site at the close of the sales season. RECOMMENDATION: Staff recommends approval of the Special Exception request with the following conditions: 1. That the tent be erected within the first row of parking stalls along E 86th Street N and that the tent and sales operations not encroach into the adjacent isle, 2. Signage be limited to that which is affixed to the structure itself, 3. A trash receptacle during the hours of business operation, 4. Obtain vendor license from the City Clerk's Office, 5.
