NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT TO WIT: SECTION 1. SECTION 2. That from and after the passage and publication of this Ordinance, the real estate and territory described above shall be a part of the City of Owasso, Oklahoma, and in Ward Four. SECTION 3. All ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed to the extent of the conflict only. SECTION 4. If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. SECTION 5. The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. SECTION 6. The property is approximately 20 acres and is located northeast of McCarty Park at 8200 N 91 E Ave. The property is unplatted with most of it being in the 100 -year floodplain and the present zoning on the property is AG (Agriculture). The property was gifted to the City by the Larkin Bailey Trust, is currently zoned AG (Agriculture) and a majority of the land lies in the 100 -year Floodplain. A portion of this property would accommodate a proposed dog park that would be financed with the excess Vision 2025 funds. The remaining portion of the property will remain undeveloped for the immediate time, with the possibility of future park and recreation uses. Upon annexation the property will be subject to all development standards, codes and ordinances of the City of Owasso, including, but not limited to paved streets, storm water detention, sidewalks, life safety, and landscaping. COMPREHENSIVE PLAN CONSISTENCY: The GrOwasso 2030 Land Use Master Plan calls for Residential and Parks & Recreation development on the subject property. The proposed use of a dog park conforms to the Land Use Master Plan. PLANNING COMMISSION: The Planning Commission considered this item at their regularly scheduled meeting on February 13, 2017, and voted unanimously for approval of OA 16 -05. RECOMMENDATION: Staff recommends approval of Ordinance 1097 annexing the subject property into the City Limits of Owasso with a zoning designation of AG.
