SUBJECT: OBOA 17 -01, Special Exception for Billboard

BACKGROUND:
The City of Owasso received a request for a Special Exception to allow for the construction of a
billboard located on the southern portion of a lot along the west US -169 Service Road that is
north of E 3rd Ave S. The northern portion of the lot contains Worley's Nursery.
The applicant, Ken Robinson, has owned and operated a number of billboards in the Owasso
area. Billboards are not an allowed type of sign within the City of Owasso, but the billboards
visible in the Owasso area are 'grandfathered in' or located outside of City Limits on County
property. Mr. Robinson has a number of billboard locations along the east US -169 service road,
including sites just to the north of the Tulsa Tech location. When Tulsa Tech was looking to locate
in Owasso, the campus had need for on additional 5 acres along the US -169 Service Road that
contained one of Mr. Robinson's signs. The City, partnering with Tulsa Tech to construct the
campus, proposed to compensate Mr. Robinson for the loss of revenue associated with
removing the sign from the property needed for the Tulsa Tech campus. Instead of purchasing
the sign, Mr. Robinson agreed to donate the land (and sign location)to Tulsa Tech in exchange
for the ability to erect a billboard sign near the location of E 3m St S and the west US -169 service
road. The former City Manager and Mr. Robinson finalized the deal with a letter that outlined
the transfer of billboard rights (see attached letter).
When Mr. Robinson approached the City about his desire to construct the billboard, staff looking
into the matter and determined that the only body that could grant the right to construct the
billboard is the Board of Adjustment. The City Manager and even the City Council do not have
the authority to issue Special Exceptions to City Code. Staff informed Mr. Robinson that the
appropriate step was to take the application through the Board of Adjustment for approval. The
City staff understands the importance of honoring the transfer of billboard rights for Mr. Robinson,
but wants to ensure that the proper steps are followed.
ANALYSIS:
The billboard location lies within Owasso City Limits, where billboards are not allowed. The
applicant has a letter authorizing the transfer of billboard rights to the proposed location. The
Board of Adjustment is asked to make a decision authorizing a Special Exception to allow a
billboard in this location. Under typical circumstances, staff would not be in favor of allowing a
billboard within City Limits, but because the applicant has a letter authorizing the transfer of
rights, staff is in favor of honoring the agreement.
The sign would have to meet all State and Federal requirements in order to operate in the
proposed location. Additionally, staff would recommend that any approval of a Special
Exception include the requirement for a decorative brick base on the pole that would support
the billboard.
The Zoning Code states:
The Board of Adjustment shall hold the public hearing and, upon the concurring vote
of three members, may grant the Special Exception after finding that the Special
Exception will be in harmony with the spirit and intent of the code, and will not be
injurious to the neighborhood or otherwise detrimental to the public welfare.
Provided that the Board in granting a Special Exception shall prescribe appropriate
conditions and safeguards, and may require such evidence and guarantee or bonds
as it may deem necessary to enforce compliance with the conditions attached.
