RESOLUTION NUMBER 93-04
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF OWASSO, OKLAHOMA, AUTHORIZING
THE PERFORMANCE OF POLICE FUNCTIONS BY
DULY COMMISSIONED MEMBERS OF THE OWASSO
POLICE DEPARTMENT OUTSIDE OF THE INCORPORATED
LIMITS OF THE CITY OF OWASSO, OKLAHOMA.
WHEREAS, under the provisions of 11 O.S. Section 34-103,
members of the Owasso Police Department may, upon request of the
Mayor or his designee, or Chief of Police or his designee, of any
as well as upon request of a County Sheriff or
his designee or upon request of the Oklahoma High,,,7ay Patrol, serve
as law enforcement officers for the requesting municipality,
Sheriff's office or the Oklahoma Highway Patrol respectively, if
such service has been authorized by prior resolution by the
governing body of the City of Owasso, Oklahoma;
WHEREAS, upon
receipt of such
authorization, tinder
the afore
stated provisions,
the police officers
of the City of Owasso,
Oklahoma, are thereby
possessed of
the same powers and
duties as
though employed by
the requesting law
enforcement agency
and when
so act-ingly shall
be deemed to be acting within the
scope of
employment of the
requesting law
enforcement agency;
excepting
therefrom, however,
that salaries,
insurance and other
benefits
shall be provided
in their regular
manner by the City of
Owasso,
Oklahoma; and
WHEREAS, it is the desire of the City Council, as governing
body of the City of Owasso, Oklahoma, to authorize the duly
commissioned members of the Owasso Police Department, Owasso,
Oklahoma, to provide assistance to other law enforcement agencies
where provision. of such assistance is deemed necessary by the
requesting law enforcement agency and the provision of such law
enforcement assistance by the commissioned members of the Owasso
Police Department, Owasso, Oklahoma, to the requesting agency would
not be deemed by the Chief of Police of the Owasso Police
Department, Owasso, Oklahoma, to be contrary to the health, safety
and welfare of the inhabitants of the City of Owasso, Oklahoma,
NOW, THEREI'OREI, BE IT RESOLVED by the City Council of the City
of Owasso, Oklahoma, that, to wit:
SECTA'ON ONE - The duly commissioned members of the Owasso
Poli-c(a, Department of the City of Owasso, Oklahoma, be, and same
hereby are, authorized to serve as police officers in any
municipality requesting their assistance, as well as law
enforcement officers for the Sheriff of Tulsa County, Oklahoma, the
Sheriff of Rogers County, Oklahoma, or the Oklahoma Highway Patrol,
upon request for such service as given by the Mayor or his
designee, or Chief of Police or his designee, of any other
municipality, upon request of the Sheriff of Tulsa County,
Oklahoma, or Rogers County, Oklahoma, or their designee, or upon
request by a. member of the Oklahoma Highway Patrol, respectively.
SECTION TWO - This Resolution shall be deemed effective from
and after the date of its adoption.
