OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, April 4, 2017 The Owasso City Council met in regular session on Tuesday, April 4, 2017, in the Council Chambers at Old Central, 109 N Birch, Owasso, Oklahoma, per the Notice of Public Meeting and Agenda filed in the office of the City Clerk and posted at City Hall, 200 S Main St, at 6:00 pm on Friday, March 31, 2017. 1. Call to Order Mayor Lyndell Dunn called the meeting to order at 6:30 pm. 2. Invocation The invocation was offered by Father Bryan Beard of Church of the Holy Cross. 3. Flag Salute Boy Scouts Troop #26 of Good Shepard Lutheran Church led the flag salute. 4. Roll Call Present Absent Mayor - Lyndell Dunn None Vice-Mayor- Chris Kelley Councilor- Doug Bonebrake Councilor - Bill Bush Councilor - Jeri Moberly A quorum was declared present. Presentation of the Character Trait of Flexibility Larry Langford, Director of Recreation & Culture and Character Council Member, presented the Character Trait of Flexibility for the month of April. 6. Presentation of Proclamation Mayor Dunn and the City Council presented a proclamation declaring April 9 -15, 2017, as National Public Safety Telecommunicators Week in the City of Owasso. Consideration and appropriate action relating to a request for approval of the Consent Agenda. Accept a grant awarded by the Verizon Foundation Volunteers Program and approve a budget amendment in the Hotel Tax Fund increasing the estimated revenues by $1,500 and increasing the appropriation for expenditures in the Strong Neighborhood department by $1,500 Mr. Bonebrake moved, seconded by Ms. Moberly to approve the Consent Agenda with claims totaling $390,310.03. At 7:47 pm, the Council returned to open session. 10. Consideration and appropriate action relating to Resolution 2017 -01, approving the Policy Guide for implementation of the Owasso Redbud District Project Plan and Increment District No. 1, City of Owasso, a sales tax and ad valorem increment district Bronce Stephenson presented the item recommending approval of Resolution 2017 -01. There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Dr. Kelley to approve Resolution 2017 -01, as recommended. YEA: Bonebrake, Bush, Kelley, Moberly, Dunn NAY: None Motion carried: 5 -0 11. Consideration and appropriate action relating to Resolution 2017 -02, determining the Sales Tax Base of Increment District No. 1 and the formula for determining the sales tax increments generated from the Increment District Bronce Stephenson presented the item recommending approval of Resolution 2017 -02. There were no comments from the audience. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve Resolution 2017 -02, as recommended. Consideration and appropriate action relating to Resolution 2017 -03, requesting assistance from the Tulsa County Community Development Block Grant Urban County Program, approving the application identifying the installation of new sanitary sewer lines in the Hale Acres subdivision as the preferred project for the 17 -18 funding cycle, and authorizing the Mayor to execute all necessary documents Karl Fritschen presented the item recommending approval of Resolution 2017 -03. There were no comments from the audience. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve Resolution 2017 -03, as recommended. YEA: Bonebrake, Bush, Kelley, Moberly, Dunn NAY: None Motion carried: 5 -0 13. Consideration and appropriate discussion relating to Ordinance 1099, closing to the public use a utility easement on unplatted property located at 708 N Atlanta Karl Fritschen presented the item recommending approval of Ordinance 1099. There were no comments from the audience. After discussion, this item was deferred to the next Council meeting agenda (April 18, 2017) due to the agenda language not written as an action item. 14. Consideration and appropriate action relating to acceptance of the Owasso Dog Park Clearing and Grubbing Project and authorization for final payment Larry Langford presented the item recommending acceptance of the project and authorization for final payment to J.E Dirtwurx, LLC in the amount of $31,248.38. There were no comments from the audience. After discussion, Dr. Kelley moved, seconded by Ms. Moberly to accept the project and authorize final payment, as recommended. YEA: Bonebrake, Bush, Kelley, Moberly, Dunn NAY: None Motion carried: 5 -0 15. Consideration and appropriate action relating to the award of a bid for Owasso Dog Park Improvements Phase 2 Larry Langford presented the item recommending the award of the base bid and alternate #1, alternate #3 and alternate #6 to Douglas Carter of Beggs, Oklahoma, in the amount of $248,183.09. There were no comments from the audience. After discussion, Mr. Bush moved, seconded by Ms. Moberly to award the base bid and alternates #1, #3, and #6 to Douglas Carter in the amount of $248,183.09, as recommended. Consideration and appropriate action relating to a request for an executive session for the purpose of discussing the employment and evaluation of the City Manager as provided for in Title 25, O.S. § 307(B)(1) Items 16 and Item 17 were voted together. Report from City Manager Mr. Lehr announced: the Monthly Public Works Project Status Report is available online; Councilor Moberly, other board and several staff, members attended the OU Placemaking Conference on April 3; Keep Owasso Clean was April 1; and 55 new single - family residential permits were issued in March. 19. Call to Order Mayor /Chair Lyndell Dunn called the meeting to order at 6:00 pm. It was further explained that both items would be placed on the April 18, 2017, Council agenda for consideration and action. 3. Discussion relating to Public Works items A. Country Estates Detention Facility B. Country Estates Stormwater Channel Improvements Councilor Moberly arrived. Roger Stevens presented Items 3A and 3B and discussion was held. It was further explained that the item 3A would be placed on the May 2, 2017, Council agenda for consideration and action. 4. Discussion relating to FY 2018 Budget Linda Jones presented the item and discussion was held. It was further explained the proposed FY 2018 budget would be submitted to the Council during the May 9 Work Session. 5. Discussion relating to Administrative items A. Proposed Ordinance relating to a public display of fireworks B. Proposed Ordinance relating to the City Clerk and City Treasurer positions Councilor Bush left the meeting at 6:50pm. Sherry Bishop presented Items 5A and 5B and discussion was held. It was further explained that both items would be placed on a future Council agenda for consideration and action. 6. Discussion relating to term lengths for all Boards & Committees Councilor /Trustee Moberly presented the item, suggesting the standardization of term lengths for the various citizen boards and committees and discussion was held. Discussion relating to City Manager items • Alarm Ordinance and Fee Resolution - Warren Lehr presented the item and discussion was held. A proposed Ordinance and Resolution would be placed on a subsequent agenda for Council consideration and appropriate action. • Monthly sales tax report - Linda Jones presented the sales tax report and discussion was held. • City Manager report - Mr. Lehr advised that staff was considering a proposal to include the purchase of public safety vehicles from the Capital Improvement Fund and would be presenting the proposal to the Capital Improvements Committee during their April 25, 2017, meeting; provided participation results for the monthly Keep Owasso Clean event and Free Landfill Day for Owasso Residents event; and encouraged appreciation and support for the city's emergency communications team in recognition of National Public Safety Telecommunicators Week. 8. City Council /Trustee comments and inquiries Councilor Bonebrake offered appreciation for communication efforts. Mayor Dunn commented on various legislative efforts discussed during the April INCOG Board of Director's meeting. 9. Adjournment The meeting adjourned at 7:52 pm. Documents required as a result of that adoption include two different agreements, one which must be submitted by the developer and one which must be submitted by the developer's engineer. The agreements are as follows: ENGINEER AGREEMENT: The agreement required to be submitted by the developer's engineer is titled "Agreement for Urban Engineering Services" (Section 0114.1(B). This agreement requires the engineer to list all improvements associated with the proposed development, attest that all designs will be in compliance with City standards (outlined in the design criteria), pay all fees associated with the plan review, attest that he /she is a Registered Professional Engineer in the State of Oklahoma, and attest that he /she maintains Professional Liability Insurance in limits directly correlated to the cost of the project specified in the attached agreement. Christensen for the complete closure of a utility easement. The easement is located on the western side of an unplatted piece of property beneath a large outbuilding that was built as part the church complex that operated on the property for many years. The address of the property in question is 708 N Atlanta. The Montessori Academy of Owasso is looking to occupy this property for its school operations (SUP 17 -01). The abstract on the property discovered the issue with the utility easement. The easement needs to be closed and vacated to ensure clear title to the property. Required notice was sent to all franchise utility companies. The City of Owasso Public Works Department was also contacted regarding the closing of the portion of the easement and indicated there should be no impacts to future utilities. No other utilities appear to be affected by the closing of this portion of the easement. Upon Council action to close the easement, it is suggested that the applicant take the Ordinance to district court and file for vacation of the easement which will complete the Closing process and remove it from the books. This item was additionally discussed at the Council Meeting on April 4, 2017, but due to an error on the agenda language, action could not be taken at that meeting. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee reviewed the request at their January 25, 2017, meeting. No comments or concerns regarding negative impacts to utilities were expressed at the meeting and there are no lines inside the easement. RECOMMENDATION: Staff recommends approval of Ordinance 1099, closing to the public use a utility easement on unplatted property located at 708 N Atlanta. TO: The Honorable Mayor and City Council City of Owasso FROM: Sherry Bishop Assistant City Manager SUBJECT: Ordinance 1102 Amending Requirements for the Public Display of Fireworks DATE: April 14, 2017 BACKGROUND: Proposed changes to the Code of Ordinances relating to the authority to approve a public display of fireworks were presented and discussed at the City Council work sessions on March 14 and again on April 11, 2017. The Owasso Code prohibits the sale, use, display, firing, igniting, lighting or discharge of fireworks within the city. However, the Code authorizes the City Council to approve a fireworks display with certain requirements. For many years, the City's Red, White and Boom! was the only fireworks event in the community. In recent years, complications have arisen as other groups have requested to sponsor fireworks events. Occasionally, a request for Council approval of an event is not timely. Authorizing the city manager to approve the fireworks display would alleviate this problem. Strict compliance with the Code is difficult for these other events due to the current restrictive language. The Code states that City Council may "approve and sponsor a public display of fireworks within the city celebrating Independence Day." The City Council does not "sponsor" events by other groups and sometimes those events are not to celebrate "Independence Day." Another concern is the requirement that a fireworks display must be "open to the public, free of charge." This becomes a problem when the fireworks display is on private property or may be in conjunction with another event with a paid admission such as a football game. Certainly the aerial display may be viewed by anyone, but the event is not "open to the public, free of charge." ORDINANCE 1102: The attached ordinance would remove some restrictive language and authorize the city manager to approve a public display of fireworks. None of the existing safety requirements for the public display of fireworks would change. The proposed changes would only affect the public display of fireworks. Nothing in this ordinance would change the currently prohibited sale and use of fireworks. The attached ordinance would amend the existing code relating to the public display of fireworks as follows: • Change "council" to "city manager" for authority to approve. • Delete "sponsor" from "approve and sponsor." • Delete "celebrating Independence Day." • Delete 'open to the public, free of charge." RECOMMENDATION: Staff recommends approval of Ordinance 1102, amending the requirements for a public display of fireworks. The group(s) organizing the event and igniting the fireworks must indemnify and hold the city harmless for any damage caused by the event and provide an insurance policy, with the city named as an insured, covering and protecting the city from liability to the extent it is not immune by state law. SECTION TWO (2): REPEALER All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict only. SECTION THREE (3): SEVERABILITY If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. SECTION FOUR (4): DECLARING AN EFFECTIVE DATE The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. Parcel No. 3 is located at 9711 North Garnett Road and is owned by Doris J. Barnes. On May 17, 2016, the Council authorized staff to proceed with condemnation against Ms. Barnes to obtain this parcel of land for the Project. Subsequent to that approval, an agreement to purchase the property was negotiated with the landowner. However, the property has a mortgage upon it held by Financial Freedom Senior Funding Corporation, a subsidiary of IndyMac Bank, F.S.B., with a second mortgage held by the Secretary of Housing and Urban Development. It is necessary to obtain the approval of both mortgagees before the City may access the property, and neither mortgagee has responded to inquiries from staff or counsel. Time is now of the essence given that utility relocation has already begun on this property. Staff believes the City's sole recourse is condemnation, and requests authorization to file condemnation proceedings against the mortgagees.
