16. Consideration and appropriate action relating to bids received for Fire Room Lining System
for the Owasso Public Safety Operations and Training Complex

Staff recommends awarding the bid to Jahnke and Sons Construction, Inc., DBA /WHP
Training Towers, in an amount not to exceed $356,714 and authorization to execute the
contract.
17. Consideration and appropriate action relating to an Assistance to Firefighter Grant

Staff recommends acceptance of the grant award in the amount of $68,000 for the
purchase and installation of a Self- Contained Breathing Air Compressor to be located at the
Owasso Public Safety Operations and Training Complex.
18. Consideration and appropriate action relating to a contract for construction administration
services for the Owasso Public Safety Operations and Training Complex

Staff recommends approval of a contract with Williams Spurgeon Kuhl and Freshnock (WSKF)
of Kansas City, for Construction Administration Services for an amount not to exceed
$326,205 and authorization to execute the contract.
19. Consideration and appropriate action relating to acceptance of the Waggin' Trail Dog Park
Project and authorization for final payment

Staff recommends acceptance of the Dog Park Phase 2 construction and authorization to
issue final payment to Carter Douglas in the amount of $21,905.32, resulting in a final
contract amount of $232,412.40.
20. Consideration and appropriate action relating to acceptance of the Skate Park Lighting
Project and authorization for final payment

Staff recommends acceptance of the Skate Park lighting construction and authorization to
issue final payment to Third Generation Electric, Inc. in the amount of $6,270, resulting in a
final contract amount of $125,400.
21. Consideration and appropriate action relating to Ordinance 1110, relating to Ordinance 759;
repealing said ordinance combining the office of city clerk and city treasurer; repealing all
ordinances or parts of ordinances in conflict; and declaring an effective date

The Owasso City Council met in regular session on Tuesday, September 5, 2017, in the Council
Chambers at Old Central, 109 N Birch, Owasso, Oklahoma, per the Notice of Public Meeting and
Agenda filed in the office of the City Clerk and posted at City Hall, 200 S Main St, at 6:00 pm on
Friday, September 1, 2017.
1. Call to Order
Mayor Lyndell Dunn called the meeting to order at 6:30 pm.
2. Invocation
The invocation was offered by Pastor Scott Carlson of Central Baptist Church.

determination of capital improvement projects eligible for funding from the capital
improvements fund to include the Festival Park and the Fiber Installation Owasso Police
Department to Public Works

There were no comments from the audience. After discussion, Mr. Bush moved, seconded
by Dr. Kelley to approve Resolution 2017 -15, as recommended.

Consideration and appropriate action relating to FY 2016 -2017 Street Repair Project (Crack
Sealing)
Earl Farris presented the item recommending approval of the purchase of crack sealing from
Keystone Services at the state contract price of $0.40 per linear foot with the total amount
not to exceed $95,000.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Mr. Bush to approve the purchase of cracking sealing, as recommended per
the Oklahoma State Bid.

10. Consideration and appropriate action relating to an agreement for engineering services for
Miscellaneous Stormwater and Erosion Control Projects
Dwayne Henderson presented the item recommending approval of the Agreement for
Engineering Services with Meshek & Associates, LLC of Tulsa, Oklahoma, in an amount not to
exceed $50,000 and authorization for the Mayor to execute the agreement.
There were no comments from the audience. After discussion, Dr. Kelley moved, seconded
by Mr. Bonebrake to approve the agreement in an amount not to exceed $50,000 with
Meshek & Associates, LLC, and authorize the Mayor to execute the agreement, as
recommended.

11. Consideration and appropriate action relating to sign relocation from the right -of -way and
easement for the Garnett Road Improvements from East 96 Street North to East 106 Street

Roger Stevens presented the item recommending approval of the agreement with Lamar
Outdoor Advertising for the relocation of two (2) billboard signs from the right -of -way and
authorization for payment in amount of $30,000.
There were no comments from the audience. After discussion, Mr. Bush moved, seconded
by Mr. Bonebrake to approve the agreement in the amount of $30,000 with Lamar Outdoor
Advertising, and authorize execution of the agreement, as recommended.

12. Consideration and appropriate action relating to an Agreement for Gas Facilities Relocation
between Oklahoma Natural Gas Company and the City of Owasso for Garnett Road
Improvements from East 96 Street North to East 106 Street North
Roger Stevens presented the item recommending authorization for the City Manager to
execute the Agreement for Gas Facilities Relocation for Garnett Road Improvements. Staff
further recommends authorization for the City Manager to terminate the agreement (as
allowed by paragraph 6 of the agreement) if revised estimates submitted by ONG become
more than $668,157 prior to commencement of construction and if it is determined by the
City Manager that the revised estimate no longer fits within the City budget.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Dr. Kelley to approve the agreement in the amount not to exceed $668,157
with ONG, and authorize the City Manager to execute and authorize the City Manager to
terminate the agreement if needed, as recommended.

13. Consideration and appropriate action relating to a change order to the contract with Grade
Line Construction for the E 76 Street North and Main Street Intersection Improvements project
Roger Stevens presented the item recommending approval of Change Order #3 to the
contract with Grade Line Construction increasing quantities for sewer pipe replacement and
adding sanitary sewer manholes for a contract increase of $147,180.00 and a total contract
amount of $1,807,617.29.
There were no comments from the audience. After discussion, Mr. Bush moved, seconded
by Dr. Kelley to approve Change Order #3, and authorize payment of $147,180 to Grade
Line Construction, as recommended.

14. Consideration and appropriate action relating to the purchase of police vehicles
Scott Chambless presented the item recommending approval of the purchase of police
vehicles at the state contract price from John Vance Auto Group as follows:
• Six (6) Dodge Chargers in an amount not to exceed $23,367 per vehicle
• Three (3) Dodge Ram Trucks in an amount not to exceed $29,241 per vehicle
• Three (3) Ford Explorers in an amount not to exceed $29,262 per vehicle

Scott Chambless presented the item recommending approval of the purchase of twelve

by Mr. Bonebrake to approve the purchase of twelve (12) COP in -car cameras, as
recommended.

The Owasso City Council, Owasso Public Works Authority, and Owasso Public Golf Authority met
in a joint regular meeting on Tuesday, September 12, 2017, in the Council Chambers at Old

that a proposed development agreement would be placed on the September 19, 2017

• Monthly sales tax report - Linda Jones presented the sales tax report and
discussion as held.
• City Manager report - Mr. Lehr reported on activities of the Fire Department
during their annual fundraiser for the Muscular Dystrophy Association; a
groundbreaking scheduled for Friday, September 29 at 9:00am for the Public
Safety Operations and Training Complex; the annual conference of the
Oklahoma Chapter of the American Planning Association; a local Girl Scout
community service project; and notification to be sent to Owasso dental
practices regarding new wastewater discharge regulations by the
Environmental Protection Agency.

BACKGROUND:
In August of 2017, the foundation, "Friends of the Owasso Police Department," donated
$10,000 to the police department. The funding will be utilized to purchase equipment
that supports police operations.
To date, Friends of the Owasso Police has donated over $61,000. The funding has
purchased three police dogs, K -9 equipment, load bearing vests for officers, investigative
equipment, TASERs, ballistic shields, rifle rated ballistic vests, and Honor Guard
equipment. The opportunities and extra levels of safety that these donations have
created have been invaluable.
RECOMMENDATION:
Staff recommends acceptance of the donation from the Friends of the Owasso Police
Department and approval of a budget amendment in the Police Department, Half -
Penny Sales Tax Fund increasing the estimated revenue and the appropriation for
expenditures by $10,000.

Easement Closure - Wahle Homes
DATE: September 15, 2017
BACKGROUND:
The City of Owasso received a request from Malcolm Wahle ( Wahle Homes LLC) for the closing
of a portion of a utility easement. The location of the easement lies on Lot 26, Block 2, located
at 7906 N 144th E Ave in the Champions East subdivision.
When the mortgage survey was prepared for this lot, it revealed that the home was
inadvertently built over the drainage and utility easement by 0.8 feet at the north corner of the
home and 2.8 feet at the south corner. The overall impact to most of the utilities appears to be
minimal; however the sanitary sewer line is in very close proximity to the edge of the easement
and closing any portion of the easement would put the sewer line in jeopardy should the need
to service the line ever occur. Due to the proximity of the sewer line, the applicant was informed
that the sewer line would have to be relocated in order to accommodate the closure request.
In July of 2016, this request was taken before the Technical Advisory Committee (TAC) where all
of the franchise utility companies as well as City staff reviewed and commented on the closure
request. Outside of the sanitary sewer line, there were no other concerns.
Since the TAC meeting, the applicant has relocated the sewer line within a newly recorded
fifteen (15) foot wide sewer easement that runs along the western portion of the subject lot as
well as one (1) lot to the south (Lot 25) and two (2) lots to the north (Lots 27 and 28). The new
sewer line had to run this distance in order to connect it properly to the existing manholes
located on Lot 25 and Lot 28.
The new sewer easement is also shared with a fifteen (15) foot drainage easement. The only
portion of the existing seventeen and one -half (17.5) foot utility easement that will be closed will
be on the subject lot (Lot 26). The easement closure request is necessary to ensure clear title to
the property and allow the homeowner to secure a mortgage.
Upon Council action to close the easement, the applicant should take the closure Ordinance
request to District Court and file for vacation of the easement which will completely remove it
from the books.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the request at their meeting in July of 2016. At that
time, the Public Works Department was not in favor of the requested easement closure as the
sewer line itself was within the area to be closed.
Since that time the sewer line has been relocated and the Public Works Department has no
further issues. No other utilities appear to be affected by the closing of this portion of the
easement.
RECOMMENDATION:
Staff recommends approval of Ordinance 1106, approving the partial utility easement closure
request.

BACKGROUND:
The City of Owasso received a request from Wallace Engineering for the complete closure of
two (2) utility easements as part of the Final Plat for Seven6Main. The address of the property is
201 S Main, The Council approved the re -plat for this site (Seven6Main) on August 15, 2017.
This property will contain the new Smoke Restaurant, along with other retail spaces and loft
apartments. The new plat records new utility easements to serve the development. The old
easements currently in place are no longer necessary to serve the new development and
therefore a closure request is being processed to ensure clear title to the property.
Required notice was sent to all franchise utility companies. The City of Owasso Public Works
Department was also contacted regarding the closing of the portion of the old easements and
indicated there should be no impacts to future utilities. No other utilities appear to be affected
by the closing of this portion of the easements.
Upon Council action to close the easements, the applicant should take the Ordinance to District
Court and file for vacation of the easement which will complete the closing process.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the request at their August 16 meeting. No
comments or concerns regarding negative impacts to utilities were expressed at the meeting.
RECOMMENDATION:
Staff recommends approval of Ordinance 1107, closing the subject easements.

The Community Development Department received a request for the annexation of property
located on the east side of N Mingo Rd, approximately a quarter mile south of the intersection of

ANALYSIS:
The property is currently zoned AG (Agriculture) in Tulsa County, and the applicant is requesting
annexation into Owasso's corporate limits. The GrOwasso 2030 Land Use Master Plan calls out
this area for residential uses. A single - family residential neighborhood is proposed for this site,
which would conform to the land use plan.
The City of Owasso would provide sanitary sewer, Fire, Police, EMS, and water service to the
property upon development. Sanitary sewer service would need to be extended from the west
or south to serve the property. Upon annexation into Owasso city limits, any development that
occurs on the subject property shall adhere to City of Owasso subdivision, zoning, and
engineering requirements including but not limited to paved streets, landscaping, and sidewalks.
ANNEXATION COMMITTEE:
The Owasso Annexation Committee met on August 30, 2017, and voted unanimously to
recommend approval of the annexation request for the subject property (OA 17 -04).
PLANNING COMMISSION:
The Planning Commission considered this item at their regular scheduled meeting on September
11, 2017, voting 5 -0 to recommend approval of Annexation case OA- 17 -04.
RECOMMENDATION:
Staff recommends approval of Ordinance 1108, annexing the subject property and assigning a
zoning of AG (Agriculture).

BACKGROUND:
The Community Development Department received a Final Plat application for review and
approval of Morrow Place. The property is located on the east side of N 129th E Ave,
approximately a quarter mile south of the intersection of E 126th St N and N 1291h E Ave. The
subject property is approximately 32.63 acres in size and is within the Morrow PUD (OPUD 05-
02A), which was approved with Ordinance 1060 in 2015. Morrow place is a proposed residential
single- family development with eighty -nine (89) lots in three (3) blocks within "Development Area
B" of the Morrow PUD. Area B in the Morrow PUD calls for residential uses and is zoned RS -3
(Residential Single - Family High Density).

BACKGROUND:
City staff is currently involved in the acquisition of rights of way and easements for Garnett
Roadway Improvements from E 106 St N to E 116 St N. As a part of those acquisitions,
negotiations for the purchase of land from Martin Fisher for 9,301.02 square feet of right of way,
including 4,650.71 square feet of easement, have been successfully completed.
DESCRIPTION /PURCHASE PRICE:
Martin Fisher - The appraised value of the right of way within the vicinity is $2.50 per square foot,
for a purchase price of $23,252.55. Compensation for permanent easement in the amount of
$5,813.39 was included in addition to the right -of -way cost, for a total offer of $29,065.94 (see
attachment).
Funding for this purchase is available in the project from the Capital Improvements Fund.
RECOMMENDATION:
Staff recommends approval of the purchase of rights of way and easement in the amount of
$29,065.94 from Martin Fisher and authorization for payment.

Operations and Training Complex, an 80 ft. communications tower will need to be installed on
site. A specification bid package was developed and mailed to eight area vendors specializing
in communications towers and installation services. Bid packages were also advertised in a
newspaper of general circulation in accordance with the Oklahoma Competitive Bidding Act
and posted on the City of Owasso website. Staff received seven bid package submittals.
Bids were publicly opened on September 5, 2017. Staff has reviewed all bid submittals for
content and conformity to the bid specifications. After a thorough review, staff was unable to
determine the best bid and recommends rejecting all bid submittals for this project.
FUTURE ACTION:
Staff intends to develop a new set of bid specifications that will better outline the required needs

BACKGROUND:
Bids for components of the Owasso Safety Public Operations and Training Complex were
advertised and publicly opened on September 5, 2017. The Owasso Public Safety Operations
and Training Complex will have four live -fire burn buildings consisting of one Class A fire (ordinary
combustibles) burn building and three Liquefied Petroleum Gas (LPG) burn buildings, ranging
from single story to three stories in height. These buildings represent the typical structures and
floor plans found here in Owasso.
Each of these structures will contain rooms that will experience rapid heating with the ignition of
LPG and Class A fires. The rooms will also experience rapid cooling as a result of extinguishment.
Therefore, to ensure the structural stability of the masonry and the long -term life of these
structures, a protective lining system must be installed in each burn area.
Due to safety concerns, the multi -level structures will be restricted to LPG fires only. The LPG live -
fire system has built in safety devices and shut -off mechanisms to ensure the safety of firefighters
during the live -fire training evolutions at elevated levels.
The combination of the LPG live -fire burn props and fire room lining system will allow the
firefighters to become proficient in fire flashover tactics, direct and indirect fire attack, interior
and exterior fire extinguishment, along with search and rescue techniques.
The LPG props in the various buildings, at multiple elevations, within the rooms, utilizing differing
attack tactics will replicate the following fire scenarios:

BACKGROUND:
The Assistance to Firefighter Grant (AFG) is a federally funded cost share program. The primary
goal of the AFG is to enhance the safety of the public and firefighters with respect to fire - related
hazards by providing direct financial assistance to eligible fire departments, nonaffiliated
Emergency Medical Services organizations, and State Fire Training Academies. This funding is for
critically needed resources to equip and train emergency personnel to perform at recognized
standards, enhance operations efficiencies, foster interoperability, and support community
resilience.
The AFG application period opened for 30 days in late summer of 2016. The program guidance
indicated that only high priority items, as determined by the program committee, would be
funded. The applications are electronically pre- scored, reviewed by a panel of peers, and
program grant staff conducts a post panel review. The AFG awards are 90% federally and 10%
locally funded.
Upon staff review of the grant program priorities, it was determined that an application for a Self -
Contained Breathing (SCBA) Air Compressor would be favorably considered during the review
process. Staff submitted the completed application in the fall of 2016.
On September 8, 2017, staff received official notification of grant award in the amount of
$68,000, of which the federal share is $61,819 and the local share is $ 6,181 for the purchase and
installation of a Self- Contained Breathing Air Compressor to be located at the new Owasso
Public Safety Operations and Training Complex.
SCBA COMPRESSOR SYSTEM:
The high pressure SCBA air compressor system refills the firefighters SCBA cylinders with
compressed breathing air, which allows them to operate safely in hazardous atmospheres such
as inside burning structures, confined spaces, vehicle fires, and at hazardous materials incidents.
The SCBA air compressor system consists of multiple high pressure storage cylinders, a refill
station, and a high capacity air compressor. The compressor specified has an operating pressure
of 7,500 psi and will rapidly refill multiple SCBA cylinders at a time. This will allow the firefighters to
quickly re- service the SCBA and be available for the next emergency response.
FUNDING:
Funding for the local cost share of $6,181 will come from the Capital Improvements Project fund
for the Owasso Public Safety Operations and Training Complex.
RECOMMENDATION:
Staff recommends accepting the Assistance to Firefighter Grant award in the amount of $68,000,
of which the federal share is $61,819 and the local share is $6,181 for the purchase and
installation of a Self- Contained Breathing Air Compressor to be located at the new Owasso
Public Safety Operations and Training Complex.

Construction Administration Services Contract

BACKGROUND:
In March 2016, City Council approved the contract with Williams Spurgeon Kuhl and Freshnock
Architects, Inc. (WSKF) of Kansas City, Missouri, for architectural design and engineering services
for the project's Master Plan to include Fire Station No. 4 with Training Center and Headquarters.
The Master Plan, presented to the City Council in August 2016, took into account the fire
department's need to address current and future needs in all three components, maximizing the
most efficient use of space, the use of the training facilities by other city departments and the
community (where appropriate), and current and anticipated fire hazards within the
community. Additionally, the facilities were designed to: be "50 -year solutions "; utilize low
maintenance construction elements; incorporate environmentally - friendly options wherever
possible; and present a professional image for the city.
City Council approved an architectural and engineering contract between the City of Owasso
and WSKF for the Owasso Public Safety Operations and Training Complex project, for an amount
not to exceed $1,097,425, at the October 4, 2016, City Council Meeting.
The next step in the project is to enter into a contract agreement with a firm to provide
construction administration services, to begin with the signing of the contract and concluding
with the one year facility warranty period of the Owasso Public Safety Operations and Training
Complex. Staff has reviewed the proposed contract with WSKF of Kansas City to provide the
required services. Funding for the contract would come from the Capital Improvements Fund.
SCOPE OF CONSTRUCTION ADMINISTRATION SERVICES:
The scope of the construction administration services for the Owasso Public Safety Operations
and Training Complex is to administer the construction and documentation associated with the
construction of the facility to final completion. (See Table 1.) These proposed services will
continue until the final inspection at the end of the one year warranty period.

BACKGROUND:
In November 2014, the Tulsa County Vision Authority approved Owasso's eligible to receive
excess Vision 2025 funds totaling $6,882,761. A dog park was included among the projects
identified in Resolution 2015 -08 approved by the City Council on April 21, 2015.
A contract for Phase 1 of the Owasso Dog Park project was awarded to J.E. Dirtwurx LLC in the
amount of $245,815.55 on December 20. 2016. Phase 1 included grubbing, clearing, earthwork,
and preparation of a road and parking lot for future asphalt work by Tulsa County, as well as
sewer line relocation and installation of casing for future water and electric for lighting. The
contractor also sodded and seeded the area to prevent erosion.
The Phase I project was accepted by the Council on March 31, 2017 with a final contract
amount of $234,460.35 (an underrun of $11,355.20).
On March 31, 2017, City Council approved a contract with Carter Douglas of Beggs, Oklahoma,
in the amount of $248,183.09 for Phase 2 construction of the Owasso Dog Park including base
design with fencing, irrigation, sodding, element installation, and concrete work.
FINAL INSPECTION:
Carter Douglas completed all required work identified with the construction contract In August
2017. Final inspection of construction was completed in August 2017 by the Parks Department.
All standards for acceptance have been met.
FUNDING:
Funds for construction of Owasso Dog Park are included in the Vision 2025 Funds and the Park
Development Fund.
RECOMMENDATION:
Staff recommends acceptance of the Owasso Dog Park Phase 2 construction and authorization
to issue final payment to Carter Douglas in the amount of $21,905.32, resulting in a final contract
amount of $232,412.40 (an underrun of $15,770.69).

BACKGROUND:
In September 2012, the City of Owasso completed the construction of a state -of- the -art skate
park with funding assistance from Tulsa County Community Development Block Grant and the
use of Park Development Funds. At the time, funding was not available to light the skate park.
An advertisement for bids was published on March 29, 2017 and April 5, 2017 for construction of
lighting at the skate park. Design included five (5) 50 -foot poles, twelve (12) LED lighting fixtures
with 20 foot - candles of illumination and a remote interactive control system.
On May 12, 2017, City Council awarded a contract to Third Generation Electric, Inc. in the
amount of $125,400 for the construction of lighting at the Owasso Skate Park,
FINAL INSPECTION
In August 2017, Third Generation completed all required work identified with the construction
contract.
Final inspection of construction was completed in August 2017 by the Parks Department. All
standards for acceptance have been met.
FUNDING:
Funds for Owasso Skate Park lighting construction are available in the Park Development Fund.
RECOMMENDATION:
Staff recommends acceptance of the Owasso Skate Park lighting construction and
authorization to issue final payment to Third Generation Electric, Inc. in the amount of $6,270,
resulting in a final contract amount of $125,400.

BACKGROUND
Proposed changes to the Code of Ordinances to separate the offices of the city clerk and the
city treasurer were presented and discussed at City Council work sessions over the past several
months. The attached ordinance and policy statement would effectively separate the offices
and authorize the city manager to supervise the city clerk.
The charter provides that the city clerk be "elected by the council for an indefinite term:' Since
1993, the council has appointed an existing employee, hired and supervised by the city
manager, to serve as the city clerk.
ORDINANCE:
Repeal of Ordinance 759 would separate the offices of city clerk and city treasurer which were
combined in 2003. Separating those offices would allow the city manager to appoint the
finance director to be the city treasurer. The current city clerk would continue in that office until
a new clerk is appointed by the city council.
The attached Ordinance 1110 would repeal Ordinance 759 separating the offices of the city
clerk and the city treasurer.
COUNCIL POLICY:
The city charter states that the city clerk be elected by the council, but does not address the
authority to supervise that employee. By charter, the city manager supervises all employees of
the city.
The attached Policy Statement 2017 -01 would formalize a policy addressing the authority to
supervise the city clerk. The policy states the Council's intent that the city manager will supervise
the city clerk.
RECOMMENDATION:
Staff recommends approval of Ordinance 1110 repealing Ordinance 759, effectively separating
the offices of city clerk and city treasurer.
Staff further recommends approval of Owasso City Council Policy Statement 2017 -01
documenting the authority of the city manager to supervise the city clerk.

The expressed purpose of this statement is to formalize a policy addressing the authority
to supervise the City Clerk of the City of Owasso.
The Charter of the City of Owasso states that "The city clerk shall be elected by the
council for an indefinite term ...."
The Charter further states that the city manager shall:
.'a. Appoint and, when deemed necessary for the good of the service,
lay off, suspend, demote, or remove all directors, or heads, of
administrative departments and all other administrative officers and
employees of the city except as they may authorize the head of a
department, an officer, or an agency to appoint, lay off, suspend,
demote, and remove subordinates in such department, office or
agency.
b. Supervise and control, directly or indirectly, all administrative
departments, agencies, officers, and employees."
The Charter does not specify whether the city council or the city manager should be
responsible to supervise the city clerk.
The intent of this Council Policy is to state that the city manager shall have the same
authority to supervise the city clerk as stated in the charter in regard to all other city
employees.

The city clerk shall be elected by the council for an indefinite term; provided, that the

A list of all rates and fees was provided to the council at the June 13, 2017, work session as an
introduction to a series of discussions over the next several months relating to recommended
changes.
Recommended fee changes fall into three categories:
Existing Fees - Existing fees that are recommended to be increased or decreased;
New related fees - Fees that are related or similar to existing fees, but would change or
restructure those charges or would be a new charge for services; and
Completely new fees - New fees for services that have previously been free or
unregulated.
Three areas of service fee changes have been included in current discussion: animal control
and ambulance service, and community development /building services.
ANIMAL CONTROL:
The Animal Control division is proposing to increase one fee, decease one fee and to eliminate
one fee. The Animal Control division charges fees to the public for the capture, housing, care
and adoption of dogs and cats. The adoption fees established in 2007 include the vaccinations
and sterilization (spay or neuter) required as part of the adoption of an animal.
The current fee for adoption of a dog is $110.00 and adoption of a cat is $75.00. The $110.00 fee
for dog adoption is more than others in the surrounding area, so staff is recommending the
decrease of this fee to $75.00.
The current fee to drop off a deceased animal at the Animal Control shelter is less than the
actual cost for the cremation. Staff recommends that this fee be increased from $10.00 to
$15.00.
In past years, Animal Control had animal traps available for loan. A deposit was required for the
use of an animal trap. Traps are no longer available from the Animal Control shelter. The rate
for trap deposits can be eliminated.
Resolution 2017 -16 establishes fees for all animal control services with an effective date of
November 1.
RECOMMENDATION:
Staff recommends approval of Resolution 2017 -16 establishing fees and charges for Animal
Control services.

BACKGROUND:
The Owasso Ambulance service fee and mileage rate was last updated by Owasso City Council
on June 18, 2013. Resolution 2013 -12 established our fees and mileage rate as follows.
• Ambulance Service Fee - $1,100.00
• Mileage Rate - $15.00 /Per Loaded Mile
• $0.00 Treat /No Transport
A survey of ambulance fees and mileage rates was conducted through e-mail and phone
inquiries with Mediclaims (our ambulance service billing vendor) and various EMS agencies
across the region.
Following the regional and statewide analysis of fees and rates, staff evaluated the
department's scope of pre - hospital medical services as it related to billing practices. Staff found
that it was logical for the City to maintain a single fee for ambulance transport calls and a
mileage rate for loaded transport miles. Staff also recommends a new fee for treat no /transport
services.
Revenue projections based on fiscal year 2016 year -to -date billed charges were provided by
Mediclaims. This data was used to estimate the potential impact of an increase in ambulance
fees on the citizens of Owasso. Increasing the ambulance service fee to $1,300.00, maintaining
the mileage rate of $15.00 /per loaded mile and instituting a $100.00 treat /no transport fee, is
projected to increase annual receipts by $440,889.62.
The impact of the proposed ambulance fee increase would be experienced by our patients'
health insurance companies and by patients who reside outside of Owasso City limits and do
not pay a subscription fee. The increase would not impact patients who live within Owasso City
limits and pay the monthly fee on their utility bill.
Given that (1) the last rate increase occurred in 2013, (2) call volume continues to increase (3)
there are associated costs with treat /no transport calls (4) calls for service and operational costs
related to providing ambulance service have risen annually; the fire department proposes
increasing the ambulance service fee, maintaining the current mileage rate, and adding a
treat /no transport fee.
SERVICE COMPARISON:
The Owasso Fire Department is one of only three fire departments licensed by the State of
Oklahoma as a Paramedic -level ambulance service, and our paramedics provide a level of
clinical care that is equal to or greater than other ambulance services across the Tulsa region.
The department provides advanced life support patient care and ambulance transport to a
response area that exceeds 70 square miles and 45,000 people. Additionally, ninety -four
percent (94 %) of the City's Firefighters are licensed paramedics; permitting us to place more
paramedics at the patient's side than any other ambulance service in the region and allowing
our staff to simultaneously perform multiple life- saving skills on patients who are in serious or
critical condition.
NEW SERVICE FEES:
Additionally, staff would like to include a $250.00 lift assist fee and a $500.00 non - emergency
transfer fee. These fees would be specifically designated to charge only healthcare facilities
(hospitals, nursing homes, memory care centers, urgent cares, doctor offices, etc.).
Area healthcare facilities frequently utilize emergency services for patient lift assists and non -
emergency transfers. These calls for service often overburden the emergency system,
decreasing the availability of fire, ambulance and dispatch resources for emergency calls.
Fire department staff routinely informs healthcare facility staff, that other ambulance service
providers should be contacted for availability prior to contacting the Owasso ambulance
service. While some healthcare facilities adhere to the City ordinance, other facilities continue
to utilize the City's emergency services for non - emergency patients.
The City of Owasso, Code of Ordinances, Part 13, Section 13 -235 states
B. Upon proper notification, and under the limitations set forth herein, the ambulance
service shall respond to a request for non - emergency medical transport of a non -
emergency medical patient, as defined herein, residing within the areas set forth in
Section 13 -333, if no other ambulance provider is available and that:
1. The fire chief determines that, in his or her judgment and discretion, the City's ability to
provide emergency medical services would not be adversely affected by such a transfer
and;
2. Such non - emergency medical transport shall be to or from an area within that area set
forth in Section 13 -333 hereof, and to or from a health care provider within a radius of
twenty -five miles of the corporate limits of the city; and
3. A charge for such non - emergency medical transport shall be assessed and collected
in accordance with a fee schedule as approved by city council by motion or resolution.
The impact of the proposed lift assist and non - emergency fee would be experienced by our
area healthcare facilities. This fee is not intended to drive revenue. Instead the fees are meant
to discourage the use of emergency service for non - emergency calls. The hope is that the City
would not need to charge these fees to a healthcare facility.
PROPOSED ACTION:
Staff plans to recommend the following:
• Increase the ambulance service fee to $1,300.00
• Maintain the mileage rate of $15.00 /per loaded mile
• Establish a treat /no transport fee of $100.00
• Add a $250.00 fee for patient lift assists
• Add a $500.00 fee for non - emergency transports from healthcare facilities

and Operation of the Owasso Youth Court

BACKGROUND:
The City of Owasso began contracting with Youth Services, Inc., in 2008 for implementation and
operation of the Owasso Youth Court and the City Council has approved annual renewals of
the contract since that time. The current contract expires on September 30, 2017. The contract
provides that Youth Services will employ its specialized knowledge, skill and experience with
trained personnel to administer and oversee a youth court in Owasso. Fulfillment of this goal
requires recruitment and training by Youth Services of both attorney advisors and teen
volunteers within the Owasso community. In addition, Youth Services employs a full -time
coordinator based in Owasso to manage the Youth Court and provides counseling services as
needed and used by both the Municipal and Youth Courts. Youth Services assumes all
responsibility for the Youth Court's scheduling, documentation and administrative operations
and is required to work closely with the Owasso Municipal Court and related staff to effectuate
these duties.
From August 1, 2016, through August 31, 2017, approximately 123 youth were referred to the
Owasso Youth Court for adjudication of their cases, and numerous referrals were made by the
Municipal Court for counseling services. All but 2 of the youth referred successfully completed
the Youth Court program. As in past years, numerous parents and teachers within the
community have voiced their approval and appreciation for the program.
The Youth Court currently has several attorney advisors and approximately 39 youth volunteers.
All aspects of the Youth Court, including prosecution, defense and sentencing of the youth
offenders, continue to be conducted solely by teen volunteers from Owasso who receive
numerous hours of instruction and training prior to participation in court proceedings.
Compensation for Youth Services in the proposed contract is $49,500 for 2017 -2018 which is
payable in twelve equal monthly payments beginning on October 1, 2017. The proposed
compensation is unchanged from the previous year. If renewed, the new contract will be
deemed effective as of October 1, 2017, and will terminate on September 30, 2018. This item
was included in the approved Fiscal Year 2018 budget. Based upon the Owasso Youth Court
program's success and achievements in past years of operation, staff will recommend renewal
of the contract for an additional year.
RECOMMENDATION:
Staff recommends approval of the contract with Youth Services of Tulsa, Inc., in the amount of
$49,500 for 2017 -2018, and further recommends authorization be given to the City Manager to
execute the contract as well as any additional documentation required.

AGREEMENT BETWEEN THE CITY OF OWASSO AND YOUTH SERVICES OF TULSA, INC.
FOR THE MANAGEMENT AND OPERATION OF THE
OWASSO YOUTH COURT
The City of Owasso, Oklahoma (hereinafter referred to as "City ") and Youth Services of Tulsa, Inc.
(hereinafter referred to as "Youth Services ") agree as follows:
The City determined in 2008 that there was a need to provide an alternative to prosecution for
first time, non - violent and non - felony juvenile offenders who have committed offenses which
would normally be heard in the City of Owasso's Municipal Court. The City recognizes that Youth
Services has significant experience implementing and facilitating alternative venues known as
Youth Courts within Tulsa County, and that Youth Services is comprised of knowledgeable
people having many years experience in this field who are able to operate a Youth Court.
Based upon the need faced by the City of Owasso to provide prosecution alternatives to
traditional sentencing of juveniles in the municipal court setting, and upon the expertise and
ability of Youth Services to establish and operate youth courts, the City and Youth Services
hereby agree to mutually execute a contract to continue funding and operation of a juvenile
court program. The Owasso Youth Court will be conducted by youth peers who have
successfully completed the mandatory training program conducted by Youth Services. All
aspects of the Owasso Youth Court shall be conducted by volunteer youth including
prosecution, defense and sentencing.
The terms of this Agreement shall be effective as of October 1, 2017, and shall expire on
September 30, 2018. This Agreement shall not renew automatically and will terminate on
September 30, 2018, unless an extension of this Agreement, in writing, is executed by the City of
Owasso and Youth Services of Tulsa, Inc. prior to the termination of the Agreement.
The City shall pay Youth Services forty -nine thousand, five hundred dollars ($49,500) as total
compensation for operation of a Youth Court for one (1) year, including the employment of a
full -time coordinator who will oversee and manage the daily operations of the Owasso Youth
Court. The total sum of compensation shall be paid to Youth Services in twelve (12) equal
monthly payments.
Youth Services shall employ personnel with the necessary degree of knowledge, experience,
training and credentials to facilitate and operate the Youth Court, and shall at all times during
the pendency of this Agreement employ at least one (1) person to serve as a full -time
coordinator to supervise, direct and oversee the Owasso Youth Court and serve as a liaison
between the City and Youth Services. As partial compensation for this Agreement, the City shall
provide two (2) office spaces in the Old Central Building for the full -time coordinator of the
Owasso Youth Court and a counselor.
Youth Services shall fully train all youth peers who make application and are selected by Youth
Services to participate as youth volunteers in the Youth Court program. Youth Services will work
with the Owasso schools to recruit youth desiring to serve in the program and will be responsible
for providing the required training before youth volunteers may serve in any official capacity
within the program. Youth Services will also work with the City to obtain a list of attorneys who
might be willing to serve as attorney advisors to the Youth Court program, and shall take all other
actions necessary to ensure that each Youth Court session shall have an attorney advisor
present.
Youth Services shall be an independent contractor under this Agreement. This Agreement shall
not be construed to create the relationship of agent, servant, employee, partnership, joint
venture or association between the City and Youth Services or its officers, employees,
contractors or representatives for any purpose. Youth Services shall bear the sole responsibility
and liability for furnishing Workers' Compensation benefits to any employee (other than staff
members of the City of Owasso) or other person for injuries from or connected with services
performed pursuant to this Agreement.
As partial consideration for this Agreement, Youth Services agrees to indemnify, defend (at the
City's option), and hold harmless the City, its employees, officials, agents, representatives and
volunteers from and against any and all liabilities, damages, injuries (excluding death), property
damage (including loss of use), claims, liens, judgments, costs, expenses, suits, actions, or
proceedings and reasonable attorney's fees, and actual damages of any kind or nature, arising
out of or in connection with any of the acts, omissions, negligence or willful misconduct of Youth
Services, its employees, agents, officers, contractors, or their performance or failure to perform
under the terms and conditions of this Agreement. Such indemnification, hold harmless and
defense obligation shall exclude only such liability actions as arise directly out of the sole
negligence or willful misconduct of the City and in accordance with the terms, conditions and
exceptions contained in the Governmental Tort Claims Act. The indemnification and defense
obligations set forth herein shall survive the termination of this Agreement
Without limiting the City's right to indemnification, Youth Services and each of its contractors
shall obtain no less than, or on terms more restrictive than, the following: General Liability
Insurance covering all premises and activities, with an applicable limit of liability not less that
One Million Dollars ($1,000,000) per claimant; One Million Dollars ($1,000,000) annual aggregate;
and Comprehensive Automobile Liability Insurance applicable to all owned, hired and non -
owned vehicles in an amount not less than One Million Dollars ($1,000,000) per occurrence; and
Workers' Compensation Insurance Coverage in compliance with the Workers' Compensation
Laws of the State of Oklahoma. Youth Services shall include the City as an Additional Insured on
all required insurance policies. Youth Services shall also require its contractors to list the City as
an Additional Insured. Youth Services shall submit certificates of insurance to the City's Risk
Manager for approval prior to allowing any individuals to engage in any activities under this
Agreement. Youth Services and its contractors shall maintain the required insurance with insurers
that carry a Best's "A" rating and which are licensed and admitted to write insurance in
Oklahoma. Failure of Youth Services or its contractors to obtain and maintain any required
insurance shall not relieve Youth Services from any liability hereunder. Such coverage shall not
be canceled or materially changed without giving the City at least thirty (30) days prior written
notification thereof.
This Agreement shall be subject to termination if Youth Services fails to keep, perform and
observe all promises, covenants, conditions and agreements set forth in this Agreement. Any
waiver of any breach of any one or more of the covenants, conditions, terms and agreements
herein contained shall not be construed to be a waiver of any subsequent or other breach of
the some or of any other covenant, condition, term or agreement herein contained, nor shall
failure to require exact, full, and complete compliance with any of the covenants, conditions,
terms or agreements herein contained be construed as in any manner changing the terms of
this Agreement or stopping the City from enforcing the full provisions thereof.
Neither this Agreement, nor any of the rights hereunder, shall be sold, assigned, or encumbered
by Youth Services.
This Agreement shall be construed under the laws of the State of Oklahoma. Exclusive original
jurisdiction and venue for any action relating to this Agreement shall be solely in the Tulsa
County District Courts of Oklahoma.

This Agreement constitutes the entire agreement and understanding between the parties, and
supersedes all proposals, oral or written, and all other communications between the parties with
respect to the subject matter of this Agreement.
This document may be modified only by further written agreement. Any such modification shall
not be effective unless and until executed by the parties.

BACKGROUND:
At the OPWA meeting of September 19, 2017, the trustees will consider a Development and
Financing Agreement with BROGRAN, LLC for the Mowery Lofts & Retail project in the Owasso
Redbud (TIF) District, Increment District No. 1.
Because the obligation for payments extends into future fiscal years, the agreement is a debt of
the OPWA. In Oklahoma, any indebtedness or obligation of a public trust requires the approval
of two- thirds (2/3) of the membership of the governing body of the beneficiary (60 O.S. 176) .
Any debt of the OPWA requires the approval of four members of the City Council.
RECOMMENDATION:
Staff recommends approval of the indebtedness of the OPWA in the Development and
Financing Agreement with BROGRAN, LLC.
