NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT TO WIT: SECTION 1. All ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed to the extent of the conflict only. SECTION 4. If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. SECTION S. The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. SECTION 6. There shall be filed in the office of the County Clerk of Tulsa County, Oklahoma, a true and correct copy of this Ordinance and correct map of the territory annexed. Stephenson, MPA Director of Community Development SUBJECT: Ordinance 1112 / Annexation OA- 17 -05- E 1061" St N & N Garnet Road Right -Of- Way DATE: October 13, 2017 BACKGROUND: The Community Development Department received a request for the annexation of portions of the intersection of E 106th St N and N Garnett Rd. The request specifically refers to the northwest right -of -way and southeast right -of -way of the intersection of E 106th St N and N Garnett Rd. These properties were acquired by the City for intersection improvements at this location, but were never annexed. Both of the properties lie in Tulsa County. The applicant, the City of Owasso, acquired these properties from Tulsa County when the intersection of E 1061h St N and N Garnett Rd was improved. The properties were never brought into the City Limits and are being annexed at this time to ensure proper ownership and maintenance responsibilities. The properties will be used solely for road right -of -way. ANNEXATION COMMITTEE: The Owasso Annexation Committee met on September 27, 2017, and voted unanimously to recommend approval of the annexation request for the subject properties (OA 17 -05). RECOMMENDATION: Staff recommends approval of Ordinance 1112, approving annexation request (OA 17 -05) to annex the subject properties into the corporate limits of the City of Owasso and assigning an AG Zoning Designation.
