Consideration and appropriate action relating to Owasso City Council /OPWA /OPGA Policy Statement 2017 -02 - Check Signing Julie Stevens Staff recommends approval of Policy Statement 2017 -02, Check Signing, repealing and replacing the "Municipal Check Signing Policy" of 1993. 14. Consideration and appropriate action relating to the purchase of a Communications Tower for the Owasso Public Safety Operations and Training Complex Mark Stuckey Staff recommends approval of the purchase of a communications tower to include installation, from JTS of Dallas, Texas, in the amount of $ 63,993.58 per the State of Oklahoma Office of Management and Enterprise Services Contract ITSW 1027. 15. Consideration and appropriate action relating to a budget amendment for Carryover Budgets for re- appropriation in FY 2017 - 2018 Linda Jones Staff recommends the following FY 2017 - 2018 budget amendments: • Increase the estimated revenues by $41,566 and the appropriation for expenditures by $294,617 in the General Fund; • Increase the appropriation for expenditures in the Street Department, Half -Penny Sales Tax fund by $632,260; • Increase the appropriation for expenditures in the Hotel Tax Fund by $8,000; and • Increase the appropriation for expenditures in the Stormwater Management Fund by $307,310. OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, November 7, 2017 The Owasso City Council met in regular session on Tuesday, November 7, 2017, in the Council Chambers at Old Central, 109 N Birch, Owasso, Oklahoma per the Notice of Public Meeting and Agenda filed in the office of the City Clerk and posted at City Hall, 200 S Main St, at 6:00 pm on Friday, November 3, 2017. 1. Call to Order Mayor Lyndell Dunn called the meeting to order at 6:30 pm. 2. Invocation The invocation was offered by Pastor Ted Johnson of Bible Church of Owasso. 3. Flag Salute Councilor Bush invited the Boy Scouts to lead the flag salute. 4. Roll Call Present Absent Mayor - Lyndell Dunn None Vice- Mayor- Chris Kelley (arrived at 6:50 pm) Councilor - Doug Bonebrake Councilor - Bill Bush Councilor -Jeri Moberly A quorum was declared present. Presentation of the Character Trait of Wisdom Warren Lehr, Character Council Member & City Manager, presented the Character Trait of Wisdom for the month of November. 6. Consideration and appropriate action relating to a request for approval of the Consent Agenda. Consideration and appropriate action relating to Resolution 2017 -19, opposing Tulsa County Board of Adjustment Case CBOA -2651, Special Exception to permit mining and mineral processing in the AG District, NW of the intersection of E 66th St N & N 145th E Ave Warren Lehr presented the item recommending approval of Resolution 2017 -19. There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Mr. Bush to approve Resolution 2017 -19, as recommended. Consideration and appropriate action relating to the acquisition of rights -of -way and easement for the Garnett Roadway Improvements Project (E 106 St N to E 116 St N) Roger Stevens presented the item recommending approval of an agreement with BAK Development, LLC for the acquisition of rights -of -way and easement in the amount of $76,400 and authorization for payment. There were no comments from the audience. After discussion, Mr. Bush moved, seconded by Ms. Moberly to approve the agreement and payment in the amount of $76,400, as recommended. Consideration and appropriate action relating to the acquisition of rights -of -way and easement for E 106 St N and N 145 E Ave Intersection Improvements Roger Stevens presented the item recommending approval of an agreement with the Robinson Family for the acquisition of right -of -way and easement in the amount of $275,000 and authorization for payment on behalf of the Robinson Family to Investors Title and Escrow Company. There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Ms. Moberly to approve the agreement and payment in the amount of $275,000, as recommended. Consideration and appropriate action relating to the acquisition of rights -of -way and easement for E 106 St N and N 145 E Ave Intersection Improvements Roger Stevens presented the item recommending approval of an agreement with the Stephens Family for the acquisition of right -of -way and easement in the amount of $235,310 and authorization for payment on behalf of the Stephens Family to Investors Title and Escrow Company. There were no comments from the audience. Mr. Bush moved, seconded by Dr. Kelley to approve the agreement and payment in the amount of $235,310, as recommended. Consideration and appropriate action relating to an agreement with Public Service Company of Oklahoma (PSO) for electrical utility work at the Owasso Public Safety Operations and Training Complex Mark Stuckey presented the item recommending approval of a Work Payment Agreement with PSO for electrical utility work at the Owasso Public Safety Operations and Training Complex for an amount not to exceed $180,741 and authorization for the Mayor to execute the agreement. There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Ms. Moberly to approve the agreement in an amount not to exceed $180,741 with PSO, and authorize the Mayor to execute the agreement, as recommended. Consideration and appropriate action relating to Resolution 2017 -20, authorizing the City Treasurer to invest in a Revenue Anticipation Note of the Owasso Public Works Authority in an amount not to exceed $7,000,000, approving the OPWA indebtedness, authorizing the execution of documents and containing other provisions relating thereto Linda Jones presented the item recommending approval of Resolution 2017 -20. There were no comments from the audience. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve Resolution 2017 -20, as recommended. Consideration and appropriate action relating to a budget amendment in the capital improvements fund increasing estimated revenues and the appropriation for expenditures by $7,000,000 Linda Jones presented the item recommending approval of a budget amendment in the capital improvements fund. There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Dr. Kelley to approve the budget amendment to increase the estimated revenue and increase the appropriation for expenditures, as recommended. Discussion relating to City Manager items Warren Lehr • Monthly sales tax report- Linda Jones presented the sales tax report and discussion as held. • City Manager report - Mr. Lehr and Ms. Lombardi reported on the Tulsa County Board of Adjustment meeting held November 14, 2017, more specifically the denial of CBOA -2651 requesting a Special Exception to permit mining and mineral processing in an AG (Agricultural) District located at 14219 E 66 St N. • Calling an Election for Council Wards 1 & 2 - Mr. Lehr advised that a resolution calling an election for selecting representation would be placed on the November 21, 2017, consent agenda for consideration and approval. 10. City Council /Trustee comments and inquiries Councilor Moberly commented on a Clean Air presentation made during the November 14, 2017, INCOG Board of Directors Meeting. 11. This grant is provided through the Bulletproof Vest Partnership Program. In order to participate in the program, there is a requirement that the department only purchase DOJ approved bullet resistant vests. Once purchased, the department seeks reimbursement from DOJ for fifty- percent of the purchase price. Stevens Deputy City Clerk SUBJECT: Resolution 2017 -23, City Council Election DATE: November 17, 2017 ACTION REQUESTED: Pursuant to the provisions of the Owasso City Charter governing the election of City Council members, "the Council shall take action by Resolution to call any necessary Ward Elections." In 2018, such election is required for Wards 1 and 2, each for a three -year term. Staff is requesting Council action to approve a resolution calling for an election to be conducted for City Council Wards 1 and 2 on Tuesday, February 13, 2018. In addition, the proposed resolution identifies the process to be followed in order to meet all legal requirements and allows for proper notification to the Tulsa County and Rogers County Election Boards. ELECTION DETAILS: The election date and filing periods are set in accordance with state laws governing elections conducted by the County Election Board. The primary election will be held on February 13, 2018. The general election, if necessary, will be held on April 3, 2018. Only qualified electors who reside within the ward shall be qualified to hold the office of City Council Member for that ward. However, all registered voters residing within the Owasso city limits may vote in the election. Should one of the candidates not receive the majority of all votes cast for the particular ward, a general election will be held. FILING PERIOD FOR INTERESTED CANDIDATES: The filing period for "interested candidates will be December 11, 12, and 13, 2017. The easement was originally established on the north side of the Brookfield Crossing subdivision in Tulsa County to allow for the construction of a drainage structure. The easement and drainage structure are necessary to address drainage issues occurring in the Brookfield Crossing subdivision. The existing easement contains more area than is necessary for the drainage structure. As a result, a new easement is being prepared that will be filed after the existing one is closed and vacated. Required notice was sent to all franchise utility companies and abutting property owners. No other utilities appear to be affected by the closing of the drainage easement. Closing of the easement will ensure clear title to the property. Upon Council action to close the easement, the City will file it in District Court to vacate the easement which will completely remove it from the books. All statutory requirements in terms of notifying franchise holders thirty (30) days prior to Council action on the closure request were met. No comments or concerns regarding negative impacts to utilities were expressed from any utility providers. If this item is approved by the City Council, staff will prepare a closing ordinance for Council consideration. RECOMMENDATION: Staff recommends City Council approval of Ordinance 1116. BACKGROUND: During the November 2017 work session, staff presented the Annexation Policy adopted by the City Council on March 1, 1988, and discussion was held. Staff opined that state statutes have evolved over time to create rigid procedures for city and towns in regards to the annexation of territory into its corporate limits, rendering the 1988 policy obsolete. Included within the 1988 Annexation Policy is an administrative procedure that institutes a standing annexation committee. The committee is charged with reviewing each annexation application to determine whether or not the request falls under the annexation policy guidelines and recommending approval or denial to the Planning Commission and City Council. It is important to remember that in 1988, city staffing levels were much smaller and the standing annexation committee provided oversight for the annexation process. As city staffing levels increased and state statutes regarding annexation by municipalities strengthened, the vetting of each annexation application is handled through the Community Development department. A complete technical analysis is conducted by the Community Development, Public Works, Police and Fire departments to determine if the request is consistent with the GrOwasso 2030 Land Use Master Plan and if the City of Owasso is able to provide services to the property upon development. The annexation request and analysis conducted by city staff is also reviewed with the Technical Advisory Committee to review any potential utility concerns. Staff then provides a recommendation to the Annexation Committee, Planning Commission and City Council for approval or denial of the application. Dissolving the Annexation Committee would provide efficiencies in the process for both the applicant and city staff. RECOMMENDATION: Staff recommends Council action to repeal the 1988 Annexation Policy to include dissolving the Standing Annexation Committee. Stevens Deputy City Clerk SUBJECT: Council Policy related to Annexation DATE: November 10, 2017 BACKGROUND: During the September 2017 work session, staff commented that a review of Council adopted policies had begun and that we anticipated discussions over the next several months to consider repealing or revising policies that are obsolete or covered by a more current ordinance or administrative policy or procedure. A discussion item has been included on the November works session agenda to discuss two such policies: Annexation Policy and Municipal Check Signing Policy. ANNEXATION POLICY: On September 15, 1987, the City Council authorized an annexation study intended to provide Council and staff with data to assist in decisions concerning specific annexation requests, as well as setting an annexation policy aimed to provide direction to individuals or groups seeking to be annexed into the city limits. The Annexation Policy was adopted by Council on March 1, 1988, and sets the guidelines and procedures for both Council sponsored and Citizen sponsored requests for annexation. Included in the procedures is a review of each application by a Standing Annexation Committee and for that committee to provide a recommendation to the Planning Commission and City Council for approval or denial of the request. The policy does not dictate the make -up of the Standing Annexation Committee; however, committee members (majority being city staff) have been appointed by the City Council since 1989. Title 11 of the Oklahoma Statutes, Part I Annexation and Detachment, sets forth the process and procedure for annexation by a municipal governing body as well as remedies available to the applicant should a petition for annexation be denied. Staff administers annexation requests in accordance with state statutes, rendering the 1988 adopted Annexation Policy obsolete. In addition, staff has concluded that the review provided by the Standing Annexation Committee is actually accomplished during a separate Technical Advisory Committee meeting. PROPOSED ACTION: Staff is proposing the repeal of the 1988 Annexation Policy and cessation of the Standing Annexation Committee. Oklahoma statutes provide that checks are prepared and signed in accordance with procedures and requirements provided by municipal ordinance or in the absence of an ordinance, by the treasurer. In 1993, Owasso did not have an ordinance addressing the authority to sign checks. With four employees in the finance department, only the treasurer or acting treasurer was authorized to sign checks for the city. Ordinance 819, approved in 2005, established the procedures and requirements for preparing and signing checks. The Owasso Code of Ordinances, Chapter 1, Finance and Budget Administration, Sections 7 -102 and 7 -106 authorize the treasurer to sign checks. The proposed policy is based on that authority and accommodates current staffing and changes in electronic banking. Stuckey Assistant Chief SUBJECT: Communications Tower Project DATE: November 17, 2017 BACKGROUND: To ensure the stability of emergency services wireless communications at the new Owasso Public Safety Operations and Training Complex, an 80 -ft. communications tower will be installed on site. Staff has coordinated the height of the tower with the City of Owasso Information Technology Department and the location of the tower with the project civil engineers. The Community Development Department has researched and confirmed compliance with all applicable rules, regulations and permits. The tower will be a metal three -leg main- frame, free - standing, cross- braced structure. This type of tower affords the least visual impact for the public, maximum cost effectiveness and a long- term life span with minimal maintenance. The communications components to be mounted on the tower will be: two wireless network transmission /receivers, an 800 mhz. radio antenna, and two security cameras for the facility. The tower will be located on the west side of the complex behind and to the side of the Headquarters building. This area was chosen to minimize the visual impact and optimize the proximity of the tower to the building. BID PROCESS: A specification bid package was developed, advertised and mailed to vendors specializing in communications towers and installation services. Seven bid package submittals were received and opened on September 5, 2017. The submittals ranged in price from $42,350 to $98,763, and varied in the type of tower and the installation services offered. Staff reviewed the details of each bid submittal and determined that due to the variances, all bids should be rejected. On September 19, 2017, the City Council approved the rejection of all bids. STATE BID: On September 25, 2017, the State of Oklahoma Office of Management and Enterprise Services awarded State Contract ITSW 1027 for communications towers to JTS of Dallas, Texas. Staff contacted JTS and received a State Contract price quote of $63,993.58 for a completed 80 -ft. tower, including all installation services. Staff contacted another local tower vendor in order to complete a price comparison and received a price quote of $65,330.00. Staff reviewed the JTS State Contract ITSW 1027 and determined that the State Contract submittal is in the best interested of the City of Owasso. FUNDING: Funding for the communications tower would come from the Capital Improvements Project fund for the Owasso Public Safety Operations and Training Complex. A total of $ 80,000 was budgeted for this project. RECOMMENDATION: Staff recommends approval of the purchase of a communications tower to include installation, from JTS of Dallas, Texas, in the amount of $ 63,993.58 per the State of Oklahoma Office of Management and Enterprise Services Contract ITSW 1027. While the appropriation of these items was included in the FY 2017 budget, the actual expenditure for all or part of these open items will occur during FY 2018. One example is the ground penetrating radar survey for 76th Street Widening. It was approved by Council for expenditure from the FY 2017 budget. However, due to delays in the 76th Street project, it will occur in FY2018. Because the services were appropriated and encumbered in FY 2017, they were not included in the FY 2018 Budget. Because the FY 2018 budget was prepared prior to year -end, before it was known whether funds would be expended or not, fund balances used to develop the budget were projected as though all non -salary budgets would be expended by year -end. Therefore, approval of carryover budgets does not reduce estimated June 30, 2018, fund balances. In order to keep from having purchase orders open for multiple years, past practice of Council is to close prior year purchase orders at the end of September and re- appropriate the funds in the subsequent year along with authorizing the City to re -issue the purchase orders in the new year. Furthermore, since Generally Accepted Accounting Principles (GAAP) do not recognize encumbrances, closing out old encumbrances where goods and services have not been received will enable the City's budgetary financial statements to more closely align with audited GAAP statements. However, building permit fees established by Ordinance 76, approved in 1966, are still included in the code of ordinances. Part 5, Building Regulations and Codes, Chapter 10, Remodeling, Section 5 -1008 Permit Fees includes old fees based on the valuation of construction. Repeal of this section of the code would remove the conflict between the fees in the code and fees established by more recent Council action. The attached draft ordinance would repeal Chapter 10, Remodeling, Section 5 -1008 Permit Fees and amend Chapter 1, Section 5 -107 Building Code and Permits. New language proposed to be added in Section 5 -107 states that "Fees shall be established by City Council Resolution." The proposed ordinance includes an emergency clause making the ordinance effective immediately upon approval by the Council. RECOMMENDATION: Staff recommends approval of Ordinance 1117 relating to Part 5, Building Regulations and Codes, repealing Chapter 10, Remodeling, Section 5 -1008 Permit Fees; amending Chapter 1 Building Codes and Permits. Staff further recommends approval of the attachment of an emergency clause making the Ordinance effective immediately. Three areas of service fee changes were included: the animal control, the ambulance service, and the community development /building services departments. Resolutions establishing fees for animal control and ambulance services were approved in September. COMMUNITY DEVELOPMENT FEES: The Community Development proposed fee changes includes more than 50 different permits, inspections and other charges, most of those to be increased. The schedule including both the proposed and the current fee is attached. Fees currently included in the Code of Ordinances are recommended to be repealed. All rates and fees are recommended to be established by resolution. The proposed Resolution with Attachment A - Schedule of Rates & Fees would establish all fees associated with building and development to be effective January 1, 2018. Schedule of Rates and Fees After final review, the attached Schedule includes some modifications from the Schedule (dated 11/10/2017) provided at the work session meeting of November 14. Sequencing and wording differences are intended to provide better definition and clarity. The community development has changed the recommended fee for a Certificate of Occupancy for a Commercial building to $100.00. The amount for a Commercial Certificate of Occupancy on the Schedule dated 11/10/2017 should have been $200.00, but was shown as $20.00 in error. Attached Schedule includes a recommended fee of $100.00. The recommended calculation for Sign Permit fees for pole signs has been modified. The new recommendation is to stay with a fee of $20.00 per foot of sign height rather than change to a flat fee for a range of sign heights. The flat fee may have encouraged the use of taller signs because the permit for an 11' sign was the some amount as a 20' sign. This change seems to be more equitable. RECOMMENDATION: Staff recommends approval of Resolution 2017 -22, establishing rates and fees for all community development and building services. City of Owasso DATE: November 17, 2017 BACKGROUND: On November 9, 2017, staff and counsel for the City of Owasso, Keith Wilkes, appeared before Magistrate Judge Jodi Jayne at a mandatory settlement conference in the matter of Cody Mathews v. City of Owasso, et al., 16 -CV- 438- GKF -JFJ. The City Manager, Warren Lehr, was the authorized settlement representative for the City. Full settlement authority was given to Mr. Lehr prior to the settlement conference through Resolution 2017 -11, approved on July 18, 2017. Following over four hours of negotiation, a settlement in the amount of $40,000 was reached by the parties. This is a global settlement which releases all Defendants in the litigation, and prohibits the Plaintiff from appealing summary judgments previously entered by the Court on behalf of the City of Owasso, Officer Andy Eubanks and Officer Mike Denton. RECOMMENDATION: Staff recommends the City Council approve the proposed settlement in the amount of $40,000, authorize payment of the settlement to Cody Mathews, his attorneys and any other necessary lien holders or parties, and authorize the City Manager to execute all final settlement documents.
