Presentation and Discussion -Economic Development Strategic Plan OWASSO PLANNING COMMISSION April 9, 2018 Page No. 2 ITEM 7. Reolat of a Portion of Garrett Creek Commercial Center Phase II - Consideration and appropriate action relating to the request for the review of a replat of Lot 2, Block 1, Garrett Creek Center Phase II. This action will create three (3) lots total with a net gain of two (2). The subject property is approximately 18.64 acres, more or less. The general location is west of US -169 and approximately 11 100 to 11500 block of N 135th E Ave. The property is zoned CS (Commercial Shopping). Karl Fritschen presented the staff report. The property location was described. The Technical Advisory Committee reviewed the replat at the March 21, 2018 meeting. The applicant's representative was present to answer any questions. Discussion was held regarding the forty (40) foot entrance access, discussing if a fifty (50) foot be better. Mr. Chris Gray, with Crofton Tull, stated that a forty (40) foot drive access should be sufficient. It would accommodate three (3), twelve (12) foot lanes. Staff recommends approval of the replat for a portion of Garrett Creek Commercial Center Phase II. Mr. Vines moved to approve. Mr. Miller seconded the motion, for the approval of the replat for Garrett Creek Commercial Center Phase II, subject to TAC and Staff recommendations. A vote on the motion was recorded as follows: YEA: Miller, Dr. Loving, Horton, Vines, Balthrop NAY: None Motion carried 5 -0. ITEM 8. Rezonina - The Church of the Holy Cross - Consideration and appropriate action relating to the request for the review of a rezoning from AG (Agriculture) zoning to OM (Office Medium) zoning. The property is approximately 3.88 acres, more or less. The property location is 9309 N 129th E Ave, Owasso, OK. The legal description for the subject property is Lot 1, Block 1, The Church of the Holy Cross, Episcopal. Morgan Pemberton presented the staff report. The property location was described. The applicant was present to answer any questions. Notices were mailed to surrounding property owners and the notice was advertised in the Owasso Reporter. Staff recommends approval of the rezoning request (OZ 18 -02) to rezone the subject property from AG (Agriculture) to OM (Office Medium). Dr. Loving moved to approve. Mr. Miller seconded the motion, for the approval of the rezoning for The Church of the Holy Cross. The subject property is currently zoned AG (Agriculture) in Tulsa County and is approximately 9.75 acres in size. The applicant has also submitted a concurrent rezoning request to change the property from AG (Agriculture) to OM (Office Medium) upon annexation into Owasso City Limits. The applicant requests the property be rezoned to OM (Office Medium) if the annexation request is approved. The GrOwasso 2030 Land Use Master Plan identifies this property for transitional land uses, which typically includes attached housing and offices. Therefore, staff concludes that the OM (Office Medium) zoning would be appropriate for the subject property. The Technical Advisory Committee reviewed the annexation request on April 18, 2018. No issues were found with the annexation of the property. It was determined that the City would be able to provide EMS and utility services to the site. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements of the City of Owasso. RECOMMENDATION: Staff recommends approval of the annexation request (OA 18 -02), bringing the subject property into Owasso City Limits. Staff also recommends approval of the accompanying rezoning request (OZ 18 -03), rezoning the subject property from AG (Agriculture) to OM (Office Medium). The subject property was annexed with Ordinance 1125 in February 2018, and the PUD for McKnight Farm (OPUD 18 -01) was approved by City Council in March 2018 with Ordinance 1126. The rezoning request (OZ 18 -01) that was approved concurrently with OPUD 18 -01 assigned an underlying zoning of RS -3 (Residential Single - Family High Density) to the property. The Preliminary Plat for McKnight Farm proposes 120 lots in 6 blocks, with lot widths ranging from fifty -five (55) feet to sixty (60) feet wide. Two (2) fifty (50) foot access points are shown on N 161st E Ave, and one (1) one hundred -five (105) foot access point is shown on E 86th St N. All streets within the development would be public. Sidewalks would be constructed within the development as well as along the arterial streets. The Preliminary Plat identifies fifty (50) feet of right -of -way and a ten (10) foot landscape easement along E 8611, St N and N 16W E Ave. Perimeter and interior utility easements are shown on the Preliminary Plat. These easements would allow access for utility providers to supply and maintain utility service to the proposed development. A Conceptual Utilities Plan has been submitted with the Preliminary Plat. There are five (5) reserve areas identified on the Preliminary Plat. Reserve Area A is located at what is proposed to be a landscaped entryway on E 86th St N. Reserve Area B is identified in OPUD 18 -01 as a dog park and trail connection point to Centennial Park. Reserve Area C acts as a twenty (20) foot access easement. Reserve Area D is the proposed location of a clubhouse, swimming pool, and playground as well as the location of proposed stormwater detention. Finally, Reserve Area E will remain open space as a nature preserve. The Preliminary Plat calls for the establishment of a Homeowners' Association for McKnight Farms that would be responsible for the maintenance of all reserve areas, landscaped entryways, open space, amenity areas, stormwater detention areas, and all fencing and landscaping along the arterial streets. Sanitary sewer service would be provided by the City of Owasso. Water service would be provided by Rogers County Rural Water District #3. Any development that occurs on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso. TECHNICAL ADVISORY COMMITTEE (TAC): The Technical Advisory Committee reviewed the Preliminary Plat for McKnight Farm at Preston Lakes at their meeting on April 18, 2018. Comments from that meeting are attached to this memo. RECOMMENDATION: Staff recommends approval of the Preliminary Plat for McKnight Farm at Preston Lakes. Stephenson, MPA Director of Community Development SUBJECT: Update to Owasso Zoning Code DATE: May 2, 2018 BACKGROUND: The Zoning Code is the document that guides the development process, and it sets standards that must be met when developing property in Owasso. The Zoning Code also establishes zoning districts, bulk standards, and design requirements. It is a responsible practice to continuously update the Zoning Code as often as possible to keep up with changing standards, technology, economically- driven changes in the development world, and changes in the community. ANALYSIS: The new Zoning Code utilizes a large part of the existing Zoning Code as a framework, but every section of the Code is being rewritten. A great deal of attention has been paid to the changing development trends occurring in Owasso. The major changes proposed to the Zoning Code are • The addition of the RNX (Residential Neighborhood Mixed) Zoning District, which was passed by Council in 2016 with Ordinance 1087. • Permitted and prohibited uses for all Zoning Districts have been simplified into tables and re- categorized under definitions of uses in the North American Industry Classification System (NAICS) guide. • The addition of a chapter specifically for Overlay Districts. • No new zonings of CH (Commercial Heavy) would be allowed in Owasso. • A new zoning category called DM (Downtown Mixed) to accommodate the downtown development. • The height requirements for Accessory Structures would be changed. • The Code would establish the Official Zoning Map of Owasso. • The addition of Temporary Use Permits and requirements for them. The City would regulate sno -cone stands and flower tents among other uses. They would be approved with Administrative Review rather than going to the Board of Adjustment. • Mechanical equipment would no longer be allowed to encroach into the side yard setback. • The addition of the PF (Public Facilities) zoning district, which is intended to set a standard zoning district for public /institutional /quasi - public uses that are distributed throughout Owasso. This includes uses like public parks, City /Municipal buildings or yards, public safety facilities, public schools, cultural areas, and utilities. A new chapter for site design standards, which includes site plan requirements, required screening, site access requirements, and architectural design requirements. For carports, language has been added to assist with determining a recommendation and decision when brought before the Board of Adjustment, whereas none currently exists. • Several definitions have been added. TIMELINE: Staff began the process of updating the Zoning Code about 18 months ago. Many cities utilize outside firms to write a new Code, but as with the GrOwasso 2030 Land Use Master Plan update, the proposed Zoning Code is being prepared in -house by Community Development Staff. The creation of the updated Zoning Code, when completed, will be the result of a long process that involved well over 1,000 hours of Staff time and input from the Planning Commission, Board of Adjustment, City Council, and the development community. Staff introduced the rough draft of the Zoning Code update at the August 8, 2017, City Council work session meeting, and Council provided input at the September 12, 2017, work session. The Planning Commission has been working on the update to the Zoning Code by holding work sessions and providing input throughout the process. The most recent draft of the document was reviewed by the Planning Commission at their February 12, 2018 meeting. The draft of the Zoning Code update was posted to the City of Owasso webpage for public review and comment on February 12, 2018. A Public Input Meeting was held on March 29, 2018, from 6:00 -8:00 PM in the Community Room at City Hall. Input provided by the public at that meeting was summarized and provided to the Planning Commission at their meeting on April 9, 2018 as well as to City Council at the April 10, 2018 work session. Public Hearings on the Zoning Code update were held at the Planning Commission meeting on April 9, 2018, and the City Council meeting on April 17, 2018. Notices for the Public Input Meeting as well as the Public Hearings appeared in the Owasso Reporter on March 21 and March 28, 2018. There were no comments or concerns on the Zoning Code update provided by the public at these Public Hearings. Staff brought an updated draft of the proposed Zoning Code in two halves to the March 13, 2018, and April 10, 2018, City Council work sessions for discussion. This week, Staff will bring the complete final draft of the Zoning Code update for review to a Planning Commission work session on May 7, 2018 and also to the City Council work session on May 8, 2018. It is anticipated that the Planning Commission will vote on the Zoning Code update at their meeting on June 11, 2018 before it will be brought to City Council for consideration and final action at the June 19, 2018 meeting.
