The Owasso Planning Commission met in regular session on Monday, May 7, 2018 at Old
Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main
(west side) at 9:00 am on May 3, 2018.

Consideration and appropriate action relating to the request for the
review of an annexation and a rezoning. The subject property is
approximately 9.75 acres, more or less and is located at 10920 N Garnett

Rd. Upon annexation, the entire subject property would be brought into
the City Limits of Owasso as OM (Office Medium).
Morgan Pemberton presented the staff report. The property location was described.
The applicant was present to answer any questions. Notices were mailed to surrounding
property owners and the notice was advertised in the Owasso Reporter.
Staff recommends approval of the annexation request (OA 18 -02) and a rezoning
request (OZ 18 -03) to rezone the subject property from AG (Agriculture) to OM (Office
Medium).
Mr. Vines moved to approve, Mr. Miller seconded the motion, for the approval of the
annexation request (OA 18 -02).

ITEM 7. Preliminary Plat — McKnight Farm at Preston Lakes — Consideration and
appropriate action relating to the request for the review of a preliminary
plat proposing one hundred - twenty (120) lots on six (6) blocks on
approximately 45.9267 acres, more or less. The general location is the
northwest corner of E 86th St N and N 161St E Ave and is presently zoned
OPUD 18 -01, with an underlying zoning of RS -3 (Residential Single - family
High Density).
Morgan Pemberton presented the staff report. The property location was described. The
Technical Advisory Committee reviewed the preliminary plat at the April 18, 2018
meeting. The applicant's representative was present to answer any questions.
Staff recommends approval of the preliminary plat for McKnight Farm at Preston Lakes.
Mr. Vines moved to approve, Mr. Horton seconded the motion, for the approval of the
preliminary plat for McKnight Farm at Preston Lakes, subject to TAC and Staff
recommendations.

OPEN MEETING ACT
1. Meetings of public bodies shall be held at times and places.
convenient to the public.
2. The Planning must have three (3) members present to constitute a
,quorum at a meeting. However, any time three (3) members of the
Commission gather and discuss city business of any type, a "meeting"
has been convened which potentially violates the Open Meeting Act.
Penalties for violation of the Act include a fine not to exceed Five
Hundred dollars, ($500) and imprisonment in the County jail for a period
of time not to exceed one (1) year.
To avoid violation of the Act, special care should be taken by
Commissioners in groups of three (3) or more to avoid discussing any
possible Commission business at social events or following Commission
meetings.
3. Bodies may discuss items by teleconference in certain situations.
However, a quorum must be present at the meeting site, the agenda
must indicate that the meeting will include videoconferencing
locations and the member participating by videoconference must be
located within the City of Owasso.
4, Planning Commission meetings, and meeting of all city boards,
commissions and public trusts, must be scheduled a year in advance,
and notice of all meetings for the following year must be given to the
City Clerk /Secretary of State by December 15th. . Notice must be
posted if a meeting is cancelled. A meeting may not be
"rescheduled" unless ten (10) days' notice is given. Rather, the
meeting must be cancelled and a special meeting must be
scheduled. A special meeting requires forty -eight (48) hours' notice to
the City Clerk and all media.
5. If a meeting is adjourned with a subject to be continued or
reconvened by special meeting, the date, time and place of the
continued meeting shall be given by announcement at the original
meeting. Only matters appearing on the agenda of the continued
meeting may be discussed at the continued or reconvened meeting.
If the Planning Commission wishes to again consider a matter at a
future but unscheduled date, the item should be postponed rather
than continued. If a matter is "continued," a.date certain for its further
consideration must be set.
6. Notice of each meeting must be posted twenty -four (24) hours in
advance. Only items listed on the agenda may be discussed, unless it
is new business. New business means any matter not known about or
reasonably foreseen prior to the time of posting notice.
7. An emergency meeting may be held without public notice if required.
However, as much notice as is possible and reasonable under the

ANALYSIS:
Morrow Place Phase II is a proposed single - family residential subdivision to be developed within
the Morrow Place Development (PUD 05 -02A), which was approved by City Council in
September 2015. The subject property is governed by PUD 05 -02A and has an underlying zoning
of RS -3 (Residential Single - Family High Density.
The Preliminary Plat for Morrow Place Phase II proposes 79 lots in 6 blocks with an average lot size
of 8,545 square feet. There are no access points to Morrow Place Phase II from N 1291h E Ave
depicted on the plat, but there would be a sixty (60) .foot access point on E 126flh St N. There
would also be a connection between this residential subdivision and the residential
development (Morrow Place) immediately to the south with N 132nd E Ave. All streets within the
development would be public and would meet City standards. Sidewalks would be
constructed within the development as well as along the arterial streets.
There are three (3) reserve areas identified on the Preliminary Plat. Reserve Area "A" is the
location of the detention area in the northwest corner of the development. Reserve Areas "B"
and "C" are located at the entrance to the development from E 1261h St N. The Preliminary Plat
identifies fifty (50) feet of right -of -way and a ten (10) foot landscape and fence easement along
E 126th St N and N 1291h E Ave. Adequate perimeter and interior utility easements are shown on
the Preliminary Plat, allowing access for utility providers to supply and maintain utility service to
the proposed development. The Preliminary Plat calls for the establishment of a Homeowners'
Association for Morrow Place that would be responsible for the maintenance of all reserve areas,
landscaped entryways, open spaces, amenity areas, and stormwater detention areas as well as
all fencing and landscaping along the arterial streets.
Sanitary sewer service would be provided by the City of Owasso. Water service would be
provided by Washington County Rural Water District U. Any development that occurs on the
subject property shall adhere to all subdivision, zoning, and engineering requirements of the City
of Owasso.
TECHNICAL ADVISORY COMMITTEE (TAC):
The Technical Advisory Committee reviewed the Preliminary Plat for Morrow Place Phase II at
their meeting on May 16, 2018. Comments from that meeting are attached to this memo.
RECOMMENDATION:
Staff recommends approval of the Preliminary Plat for Morrow Place Phase II.

Adoption of the New Owasso Zoning Code

BACKGROUND:
The Zoning Code is the document that guides the development process, and it sets standards
that must be met when developing property in Owasso. The Zoning Code also establishes
zoning districts, bulk standards, and design requirements. It is a responsible practice to update
the Zoning Code as often as necessary to keep up with changing standards, technology,
economically- driven changes in the development world, and changes in the community.
TIMELINE:
Staff began the process of updating the Owasso Zoning Code about 18 months ago. Many
cities utilize outside firms to write or update a Zoning Code, but as with the GrOwasso 2030 Land
Use Master Plan update, the proposed Zoning Code was prepared in -house by Community
Development staff. The completed update to the Zoning Code is the result of a long process
that involved well over 1,000 hours of staff time. Input was also received from the Planning
Commission, Board of Adjustment, City Council, and the development community.
Multiple opportunities were made available to the public to review and provide input on the
update to the Zoning Code. The draft of the Zoning Code update was posted to the City of
Owasso webpage for public review and comment on February 12, 2018. A Public Input Meeting
was held on March 29, 2018, from 6:00 -8:00 PM in the Community Room at City Hall. Input
provided by the public at that meeting was summarized and provided to the Planning
Commission at their meeting on April 9, 2018 as well as to City Council at the April 10, 2018 work
session. Notices for the Public Input Meeting as well as the Public Hearings appeared In the
Owasso Reporter on March 21 and March 28, 2018, Public Hearings on the Zoning Code update
were held at the Planning Commission meeting on April 9, 2018, and the City Council meeting
on April 17, 2018. There were no comments or concerns on the Zoning Code update provided
by the public at these Public Hearings.
The Planning Commission has reviewed and provided input throughout the process of updating
the Zoning Code. A special meeting of the Planning Commission was held on March 30, 2017 to
discuss the rough draft of the update. Since then, the Planning Commission has had many
discussions of the Zoning Code at its meetings. A review of the final draft of the Zoning Code
update was conducted at the Planning Commission meeting on May 7, 2018.
The City Council has also provided input throughout this process. Staff presented the initial
rough draft of the Zoning Code update at the August 8, 2017, City Council work session meeting,
and Council provided input at the September 12, 2017, work session. Staff brought an updated
draft of the proposed Zoning Code in two halves to the March 13, 2018, and April 10, 2018, City
Council work sessions for discussion. Finally, staff presented the complete final draft of the
Zoning Code update to City Council work session on May 8, 2018.
Staff is now bringing the completed Zoning Code update to the Planning Commission for
consideration and recommendation at their meeting on June 11, 2018. The Zoning Code
update will then be presented for discussion at the City Council work session on June 12, 2018
before being presented for final consideration and action at the City Council meeting on June
19, 2018.
ANALYSIS:
The proposed Zoning Code utilizes a large part of the existing Zoning Code as a framework, but
every section of the Code has been updated to some extent. A great deal of attention has
been paid to the changing development trends occurring in Owasso. The major changes
proposed to the Zoning Code include the following:
• The Code would establish the Official Zoning Map of Owasso.
• The addition of the RNX (Residential Neighborhood Mixed) Zoning District, which was
passed by Council in 2016 with Ordinance 1087.
• No new zonings of CH (Commercial Heavy) would be allowed in Owasso.
• A new zoning category called DM (Downtown Mixed) would be created to
accommodate the downtown development.
• The creation of the PF (Public Facilities) zoning district, which is intended to set a
standard zoning district for public /institutional /quasi- public uses that are distributed
throughout Owasso. This includes uses like public parks, City /Municipal buildings or
yards; public safety facilities, public schools, cultural areas, and utilities.
• Permitted and prohibited uses for all Zoning Districts would be simplified into tables
and re- categorized under definitions of uses in the North American Industry
Classification System (NAICS) guide.
• The creation of a chapter specifically for Overlay Districts.
• The creation of Temporary Use Permits and requirements for them. The City would
regulate sno -cone stands and flower tents among other uses. They would be
approved with Administrative Review rather than going to the Board of Adjustment.
• A new chapter called "Site Design Standards" would be created, which would
include Site Plan requirements, required screening, site access requirements, and
architectural design requirements.
• Mechanical equipment would no longer be allowed to encroach into the side yard
setback.
• For carports, language would be added to assist with determining a
recommendation and decision when brought before the Board of Adjustment,
whereas none currently exists.
• The height requirements for Accessory Structures would be changed.
