Stephenson, MPA Jurisdiction Director of Community Development SUBJECT: Final Plat - Kum & Go DATE: July 6, 2018 BACKGROUND: The Community Development Department received an application for review and approval of a Final Plat for a Kum & Go, a convenience store and gas station proposed for the southeast corner of E 106th St N and the anticipated realignment of the Owasso Expressway. The subject property is approximately 1.69 acres in size and is zoned OPUD -18 with an underlying zoning of CS (Commercial Shopping). Yes (US -169 Overlay District) Water Provider Washington County Rural Water District #3 Applicable Paybacks Elm Creek Extended Sanitary Sewer Relief Area ($1,580.00 per acre) ANALYSIS: The Final Plat for Kum & Go proposes a one (1) lot, one (1) block development on the southeast corner of E 106th St N and the future location of the realigned Owasso Expressway. The Owasso Expressway realignment project is anticipated to begin this fall. The property is part of OPUD -18, also known as the Coffee Creek PUD, which was approved by City Council in 2000. This area of OPUD -18 was designated for commercial uses. There are three (3) access points designated on the Final Plat. The access point on E 106th St N would be a part of a Mutual Access Easement (MAE) to be shared with the property immediately to the east of the subject property at the time it develops. There are also two (2) access points that will connect to the anticipated location of the realigned Owasso Expressway. The northern access point on the Expressway will be right -in /right -out only, while the southern drive will be full access. Sanitary sewer service to the property would be provided by the City of Owasso. Water service would be provided by Washington County Rural Water District U. Adequate perimeter and interior utility easements are shown on the Final Plat, allowing utility providers to supply and maintain service to the property. Any development that occurs on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso. PLANNING COMMISSION: The Planning Commission will review the Final Plat for Kum & Go at their meeting on July 9, 2018. Stephenson Director of Community Development SUBJECT: Alley Closure - RedbudPark DATE: July 6, 2018 BACKGROUND: Staff is requesting to close an alleyway on the property where the Redbud Festival Park will be located (109 N Main St). The City of Owasso is in the process of constructing the new park south of the Police Station, and a part of this work involves constructing a food truck parking area, of which a portion is located on an existing platted alleyway. Closing the alleyway would prevent through access, and ultimately become a feature of the park. There is an 8 -inch sanitary sewer line that runs within the alley. Staff intends to record a utility easement to ensure that existing and future utilities are protected. The required notice was sent to all franchise utility companies and property owners adjacent to the alley. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee reviewed the request at their meeting on June 20, 2018. No comments or concerns were received from utility providers at the meeting. A portion of the facility known as "the Annex" was omitted from the lease because the City intended to demolish that building. The City later decided not to demolish the Annex because increasing membership at the YMCA necessitated its use. The YMCA has continued to occupy and utilize the structure. Several weeks ago, staff met with representatives from the YMCA, including their legal counsel, to discuss proposed renovations to the Annex. Staff and the YMCA noted that the Annex should be included in the leasehold property described in the 2004 lease given that: 1) It is no longer scheduled for demolition, and, 2) It currently being occupied as a part of the lease by the YMCA and is scheduled for interior renovation. Legal counsel for the YMCA has drafted a proposed Amendment to Lease to include the Annex, and all improvements and fixtures located therein, in the leasehold property. PROPOSED ACTION: Staff will recommend approval of the Amendment to Lease between the City of Owasso and the YMCA of Greater Tulsa. This is the Annex. 3573732.1:930450:01570 S� REAL Pe0y10 • REAL Character • REAI CommunNy TO: The Honorable Chair and Trustees Owasso Public Works Authority FROM: Roger Stevens Public Works Director SUBJECT: Garrett Creek - Morrow Place Sanitary Sewer Assessment Fee and Request for Partial Exclusion DATE: July 6, 2018 BACKGROUND: In order to accommodate the expected residential and commercial growth in the northern section of the city, the City of Owasso, Owasso Land Trust (OLT), and Kellogg Engineering met to evaluate options, and those discussions revealed the best long -term solution was to construct a new lift station and gravity sewer system due north of the existing lift station. In 2011, OLT hired Kellogg Engineering to begin engineering design of the new lift station, force main and gravity sewer line at a cost of $324,464.65. In March 2016, the City Council approved the Garrett Creek /Morrow Place Sanitary Assessment Area via Ordinance 1072. Construction of the improvements were completed in February 2018 With final acceptance and payment approved in March. PROPOSED ASSESSMENT FEE: Staff is proposing a resolution to establish a mandatory assessment fee for properties that are within the assessment area and authorized to tie into or utilize capacity of the Garrett Creek Lift Station and /or gravity sewer line. Payment of this assessment fee would be mandatory and assessment fees would be due upon the approval of a final plat or utilization of capacity. The assessment area includes a total of 760 acres as depicted on the attached map. Within the basin, OLT owns or has first rights to approximately 334 acres or 44% of the land. Therefore, the City believes OLT is responsible for 44% of the engineering design fees ($142,764.16). The city's share ($181,700.49) should be included in the total project cost used to calculate the assessment fee. With the planning and construction cost totaling $2,390,872.18, the proposed assessment fee is $3,146.00 per acre. REQUEST FOR EXCLUSION: OLT is requesting partial exclusion from the proposed per acre assessment fee as consideration for their contribution to the engineering design costs. A proposed agreement has been submitted by OLT for City Council consideration to exclude approximately 57.75 acres from the proposed Garrett Creek /Morrow Place Sanitary Sewer per acre assessment fee of $3,146.00 per acres for a total of $181,700.49.
