Main (west side) at 1:00 pm on July 3, 2018. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. The property location was described. A representative for the applicant was present to answer any questions. Staff recommends approval of the preliminary plat request for Charleston Place, subject to Staff and TAC recommendations. Yes US -169 Overlay District OVERVIEW OF UNIFIED SIGN PLANS (USPs): A Unified Sign Plan (USP) is a comprehensive sign permit that establishes the size, location, design, and number of signs in a development. A USP allows City staff to establish signage criteria tailored to the features of a specific development or location. Depending on the characteristics of the development or site, these criteria may vary from the requirements of the Owasso Zoning Code. However, a USP is not intended to be used in a way that circumvents the requirements of the Zoning Code. It is a tool that gives a developer flexibility in meeting their future tenants' signage needs while working with City staff to ensure the approved signage is of a high quality and meets the sprit and intent of the Zoning Code. All USPs must be reviewed by City staff and the Planning Commission to ensure that they meet the following restrictions as set by the Owasso Zoning Code: 1. All USPs shall include the location, size, height, construction material, color, type of illumination, and orientation of all proposed signs. 2. All USPs shall be reviewed by the Owasso Planning Commission and shall conform to all conditions imposed by the Commission. 3. USPs shall include all signage to be located within the perimeters of the subject site whether in excess of the provisions of the current sign code or not. 4. USPs may not propose a total sign square footage exceeding three (3) square feet of signage per every one (1) linear foot of street frontage of the subject property. 5. USPs may not include any prohibited sign. ANALYSIS: Garrett Creek Center Phase II is a commercial development located just west of US -169 and south of E 1 16th St N on N 1351h E Ave. This development has extensive frontage on N 135th E Ave. Initially, the development was comprised of 3 lots in 1 block. Lot 1 has already been developed as a commercial shopping area, and Lots 2 and 3 will likely be developed in a similar fashion. The subject LISP is specifically for Lots 2 and 3 of Garrett Creek Center Phase II. Recently, Lot 2 of Garrett Creek Center Phase II was replatted and now shows 3 lots contained within Lot 2. Lot 1 within Lot 2, Block 1 is currently under development as a Braum's restaurant, and that lot is excluded from this LISP. Braum's intends their lot to have its own signage separate from the rest of the development. The applicant has indicated that as development plans move forward for Garrett Creek Center Phase II, additional Replat or Lot Split applications may be submitted to the to create more individual lots within the development. These additional lots will likely take. the form of several individual lots with frontage on N 1351h E Ave. The layout is anticipated to consist of restaurants and other businesses occupying standalone buildings along the public street frontage and larger, shared buildings for box stores and other businesses set back from the street behind those individual lots. The Conceptual Site Plan included with this LISP shows proposed sign locations, but it will allow a degree of flexibility. The tentative sign placement shown on the Conceptual Site Plan may change as the number and size of lots within the development are determined, but the number of approved signs will not increase. The final sign locations will be dictated by the future outparcel development along N 135th E Ave. As more lots are created and development plans progress, the developer will be required to establish the specific location of each sign using each lot's required Site Plan that goes before TAC for review and approval. Although the exact placement of the proposed signs is unknown at this time, there will be a maximum number of signs stipulated in this LISP. The applicant is proposing a maximum of five (5) monument signs with a maximum height of ten (10) feet to be placed on future lots with frontage on N 135th E Ave. The applicant also proposes one (1) multi- tenant pylon sign with a maximum height of forty (40) feet to be placed on frontage along N 135m E Ave. No other signs would be allowed under this LISP other than wall signs and wayfinding signs. Staff is in agreement with the proposed parameters of the USP, except that staff will be recommending to the Planning Commission that the maximum height of the monument signs be capped at eight (8) feet as opposed to the applicant's proposed ten (10) feet. Through the course of processing this LISP application, there was regular negotiation between the applicant and staff regarding the maximum number of monument signs and the maximum height for those monument signs. The applicant initially proposed a monument sign be allowed for every existing and future lot that had frontage on N 139h E Ave. Future Replats or Lot Splits could result in ten or more lots with frontage on N 135th E Ave, which could result in as many monument signs. Staff felt that this number of monument signs in addition to the multi- tenant pylon sign was excessive, so staff proposed setting a maximum number of monument signs for the development. In terms of sign square footage, the LISP as proposed by the applicant would result in a total of 928 square feet of signage. The LISP with staff's recommendation would result in up to 768 square feet of signage. Both of these calculations meet the requirement for USPs in the Owasso Zoning Code that the total sign square footage not exceed three (3) square feet of signage per every one (1) linear foot of street frontage of the subject property. According to the requirements in the Owasso Zoning Code for property zoned CS (Commercial Shopping) within the US -169 Overlay District, if a USP was not utilized for this development, a maximum of 1,350 square feet of signage would be allowed. However, without the USP, the applicant would not be allowed the proposed forty (40) foot multi- tenant pylon sign. If a USP was not being utilized for this development, any pylon signs would be capped at twenty (20) feet in height and any pole sign would be capped at twenty -five (25) feet. Therefore, staff feels that the 768 square feet of signage is adequate for this development, as the USP would allow an exception for a taller pylon sign than what would typically be allowed by the Zoning Code. Staff also feels that because this USP would allow a multi- tenant pylon sign that exceeds the maximum height allowed in the Overlay District by fifteen (15) feet, then restricting the height and number of the monument signs is necessary. Five (5) monument signs at a maximum of eight (8) feet in height and one (1) multi- tenant pylon sign at forty (40) feet in height would adequately serve the subject property. All lots within the development area are essentially at eye -level for passing cars on US -169, providing excellent visibility for the proposed signs and businesses who will locate there. Also of note is that these square footage calculations do not include the square footage of wall signs and wayfinding signs in the development that will be allowed outside of the restrictions of the USP. It is important to also consider what the signage in the development could look like if a USP is not utilized. As this property has extensive frontage on US -169, it is possible that without the USP, there would be multiple twenty -five (25) foot high pole signs for all lots in the development with frontage on US -169. This is particularly concerning because the total number of lots that will have frontage in this development is currently unknown. Staff believes that this USP would result in quality signage for this development. The allowance of a forty (40) foot high multi- tenant pylon sign is acceptable because the number of monument signs would be limited to five (5), and staff recommends the height of those monument signs be restricted to eight (8) feet. All signs in this USP would be required to adhere to all sign requirements in the Owasso Zoning Code, including the requirement that all signs be placed within a landscaped bed per US -169 Overlay District requirements. TECHNICAL ADVISORY COMMITTEE REVIEW: This item was taken to the TAC for review on August 15, 2018. Comments from the TAC meeting are attached to this memo. RECOMMENDATION: Staff recommends approval of the Unified Sign Plan for Garrett Creek Center Phase 2, Lots 2 and 3, with the following conditions: 1. The maximum allowed signage within the development under the USP, excluding wall signs and wayfinding signs, is five (5) monument signs and one (1) multi- tenant pylon sign. 2. The allowed maximum height of the monument signs is eight (8) feet. 3. The allowed maximum height of the multi- tenant pylon sign is forty (40) feet. 4. No other signs would be allowed in the development other than wall signs and wayfinding signs. 5. All signs must be placed in a landscaped bed. 6. All signs and landscaping shall be located outside of the sight triangle. 7. Final locations of proposed signs must be approved with the Site Plans submitted for individual lots within the development. 8. The language in the "Comprehensive Sign Plan" Document shall be updated to reflect that the USP covers both the Replat of Lot 2 as well as Lot 3 of Garrett Creek Center Phase II. WHEREAS, Declarant is the owner of Replat Center II and is presently improving and developing lots for uses permitted within the CS Zoning District for the City of Owasso, Oklahoma, in Replat Center II; and WHEREAS, except for Lot One (1) of Replat Center II, which shall not be subject to the terms and conditions of this Comprehensive Sign Plan, Declarant will convey the other lots within Replat Center II subject to the terms and conditions of this Comprehensive Sign Plan. NOW, THEREFORE, Declarant hereby declares that all lots (except Lot One (1)) located in Replat Center II shall be and are hereby held, mortgaged, sold and conveyed subject to the following comprehensive sign plan contained herein, which shall run with the land and shall be binding on all parties having or acquiring any right, title or interest in RE -PLAT OF LOT 2 BLOCK 1 GARRETT CREEK CENTER PHASE II. ARTICLE I DEFINITIONS 1. "PYLON SIGN STRUCTURE" shall mean that certain pylon sign plan prepared by Claude Neon Federal Signs, as may be amended from time to time, a copy of which is attached hereto as Exhibit "A" 2. "SIGNAGE AREA" shall mean that signage (identification) panel assigned by Declarant to a Panel Beneficiary (defined below), and allocable share of the Pylon Sign Structure. 3. "PANEL BENEFICIARY" shall mean occupants of Replat Center II, except for Lots (1) and Two (2) which shall not be granted a Signage Area on the Pylon Sign Structure, which Declarant grants permission to have a Signage Area installed, replaced and maintained. 4. "COSTS" means the total annual costs directly related to the Signage Area and allocable share of the Pylon Sign Structure, including (without limitation) ad valorem taxes, insurance, electrical, repairs, and all construction, maintenance and repair relating thereto. ARTICLE Il SIGN PLAN 1. PYLON SIGN. The Declarant intends (but shall not be obligated) to erect one (1) freestanding Pylon Sign Structure in Replat Center II at the approximate location designated as "Sign A" on the Site Plan attached hereto and made a part hereof as Exhibit "B ", such location to be in the sole and complete discretion of the Developer and subject to change with the approval of the City of Owasso, including (without limitation) cabinets and wiring for the Signage Area, upon which certain identification panel(s) for Panel Beneficiaries may be installed, replaced and maintained. Each Panel Beneficiary's allocable share of the Costs shall be based, in part, on the portion of Signage Area assigned to each Panel Beneficiary, even if such Signage Area is not used. The size and location of the identification panel in the Signage Area shall be determined by the Declarant in its sole and complete discretion. Initially, the design of the Pylon Sign Structure, including the space for the various Signage Areas, shall be as shown on Exhibit "A" attached hereto; provided, however, the plan and design of the Pylon Sign Structure is subject to modification, correction, replacement and/or termination by the Declarant in its sole and complete determination, in which case this Comprehensive Sign Plan shall be updated with a new Exhibit "A ". Each Panel Beneficiary, prior to attaching its identification panel to its assigned Signage Area, shall, at its sole cost and expense, (i) obtain Declarant's written approval of its identification panel plan; (ii) obtain all permits and governmental approvals required for such installation, (iii) obtain casualty insurance in an amount not less than $1,000,000.00 per occurrence and $2,000,000.00 in the aggregate, designating the Declarant and the Association as additional insureds and loss payees, and deliver to Declarant and Association prior to installing its panel; and thereafter (iv) fabricate its identification panel, install the panel within its assigned Signage Area and connect the panel to the power source provided, and (v) maintain and/or replace the identification panel (including any backlit lighting) pursuant to City of Owasso sign plan requirements, and in a safe condition and good state of repair. If a Signage Area and /or the identification panel thereon is damaged by a Panel Beneficiary, or anyone by, through or under it, then such Panel Beneficiary shall immediately cause the damage to be repaired and shall, and by installing its identification panel, does indemnify, defend and hold Declarant harmless from any and all damage and /or destruction caused to the Pylon Sign Structure and /or Signage Areas arising from the installation, maintenance, repair and /or replacement of its panel The maintenance and/or replacement of the Pylon Sign Structure shall be performed by the Garrett Creek Center Owners Association, Inc., an Oklahoma non - profit corporation, its successors and assigns (the "Association "). All "Costs" of the Panel Beneficiary shall be paid to the Association upon demand and shall be subject to the Association's enforcement rights contained in the Declaration of Covenants, Conditions and Restrictions for RE -PLAT OF LOT 2 BLOCK 1 GARRETT CREEK CENTER PHASE II, as amended, including (without limitation) imposition of a lien on the Lot where the delinquent Panel Beneficiary is located. Declarant shall have the right, in its sole and complete discretion, to assign single -sided or double -sided Signage Areas; and to reassign the Signage Area of a Panel Beneficiary. All Signage Areas not assigned to a Panel Beneficiary are specifically reserved to Declarant. Notwithstanding anything to the contrary herein, the Declarant shall not be liable for any damages, costs, fees or expenses arising from the condemnation or other governmental taking of the Pylon Sign Structure. The maintenance of the landscaping around all monument and pylon signs is the responsibility of the Garrett Creels Center Owners Association, Inc. 2. MONUMENT SIGN. There will five (5) monument signs allowed within Replat Center II. A monument sign shall be oriented perpendicular to the direction of travel so that drivers have a clear view of the sign. Monument signs shall not exceed 70 square feet for each side, not including the base or supporting structure. Monument signs shall only identify the business constructed on the Lot. Monument signs shall not exceed eight (8) feet in height and shall comply with the specifications identified on attached Exhibit "C" ; provided, however, the plan and design of the monument sign (a) must comply with Owasso Zoning Code, and (b) shall be subject to the modification, correction and/or replacement by the Declarant in its sole and complete determination, in which case this Comprehensive Sign Plan shall be updated with a new Exhibit "C ". Monument signs (including the design of the sign base, as well as the sign area itself) shall compliment the architecture of the building on the Lot, and shall be constructed of such materials similar to those used on the building on the Lot. All monument signs shall be setback at least 10 feet from the property line, shall not obscure driveway or intersection line -of- sight for vehicles or pedestrians, and shall not obstruct utility services. 3. OCCUPANT SIGNS. Either the owner of a Lot in Replat Center II or its tenant shall be permitted one (1) identification name sign affixed to the building on the front of the fagade. Buildings with multiple tenants shall not be permitted occupant signs on the building and shall be subject to the Pylon Sign requirements herein. Any occupant sign shall be in compliance with Owasso Zoning Code. 4. TEMPORARY SIGNS. Temporary signs which comply with the Owasso Zoning Code are permitted on all Lots within Replat Center II and shall only be erected after the applicant receives such sign permit from the City of Owasso. 5. FOR SALE SIGNS. For Sale, For Rent, or For Lease signs which comply with the Owasso Zoning Code are permitted on all Lots within Replat Center II and shall only be erected after the applicant receives such sign permit from the City of Owasso. 6. CONSTRUCTION AND PROJECT SIGNS.
