Mr. Karl Fritschen presented the staff report. The property location was described. Karl explained that the request does not bring forth a rezoning request to change the zoning from AG. Two neighborhood meetings were held by the applicant on November 15, 2017 to provide an opportunity to answer any questions or concerns. Staff published the legal notice in the Owasso Reporter and mailed notices to property owners within a 300' radius of the property. Platting and the site plan will be reviewed by staff. Ms. Carolyn Back with Wallace Engineering made a brief presentation. She stated that there were 47 notices sent to property owners inviting them to attend one of the community meetings regarding the A New Leaf Community. Both meetings that were held, a total of 10 people attended. Ms. Back discussed the buffering that has been added along the northeastern corner of the site (Design Statement, Section 5.8). Ms. Mary Ogle, President of The New Leaf Community, requested a brief presentation. Ms. Ogle stated that The New Leaf Community provides adults to work and live independent lives. There will be approximately 25 — 30 administrative employees. Most of the residents work outside of the community during the day. Some may live there, but most will come in during the day only in order to help with the horticultural chores. The Chairperson opened the floor for the public to speak. Mr. Michael Stacy —14417 E 94th St N — He had density concerns and gated community concerns. He noted that the dorms had been reclassed as community homes. He stated that the city is losing out on the tax base with the loss of single family homes on the subject property. He also wanted to know what "enhanced screening" means. He explained that screening with berms was his preference. Mr. Stacy stated that it looks like a care and provider facility, AG zoning is not a typical type of zoning use for that type of facility. Ms. Ogle explained that The New Leaf is not an institution. They are people that need support with various tasks and it's their home. There is 24 hour care if the clients need any type of assistance. Mr. Miller also stated that it is not an institution. He had a relative that was involved with The New Leaf Community and it was amazing for her. There should not be any concerns with this facility. The Chairperson closed the public hearing at 6:50 pm. Mr. Stephenson explained how a planned unit development works. He explained how this project is a lower density than could actually go there. Mr. Stephenson commended Wallace Engineering and Selser Schaefer Architects for their excellent work on the project. OWASSO PLANNING COMMISSION December 11, 2017 Page No. 4 Staff recommends approval of OPUD 17 -03, A New Leaf Community. The entirety of the subject property would be brought into the city limits as AG (Agriculture) zoning district. Chairperson Vice Chairperson Date REAL Peopb- REALCharactr -REAL CommuNly TO: Owasso Planning Commission FROM: Morgan M. Pemberton Assistant City Planner SUBJECT: Rezoning (OZ 17 -09) — SE Corner of E 89th St N and N Mingo Rd DATE: January 3, 2018 BACKGROUND: The Community Development Department received a rezoning request for property located on the southeast corner of E 89th St N and N Mingo Rd. The subject property is within PUD 9 for the Bailey Ranch Golf and Community Development. The applicant is seeking a rezoning from RS -3 (Residential Single - Family High Density) to RNX (Residential Neighborhood Mixed). Lots /Blocks: ,. : 1 Lot, 1 Block LandUse'Plon Transitional Within PUD ?tn. PUD 9 Within Overlay District? No Water Proviaer ee City of Owasso Applicable- Payback4' Ranch Creek Sewer Service Assessment Area ($610.33 per acre) Storm Siren Fee ($50.00 per acre) ANALYSIS: The subject property is a part of PUD 9, also known as the Bailey Ranch Golf and Community Development PUD that was adopted in April 1991 with Ordinance 429. The general area covered by PUD 9 is east of N Mingo Rd, reaching from E 96th St N to just south of E 86th St N. The PUD established various types of residential zoning as well as commercially -zoned areas within its boundaries. Within the PUD document, the subject property in this rezoning request was originally called out for Residential Patio Homes and was zoned RS -3 (Residential Single - Family High Density). The applicant is requesting a rezoning from RS -3 to RNX (Residential Neighborhood Mixed) with the intention of creating a senior housing development on the property. RNX zoning allows residential density of up to 12 units per acre, which will permit the density being sought by the proposed senior housing development. The PUD document permits the transfer of units between development areas as long as the overall density allowed within PUD 9 is not exceeded. Rezoning the subject property from RS -3 to RNX essentially increases the number of units allowed to be developed on the property, which in effect decreases the number of units available to develop on the rest of the property within PUD 9. The PUD document allows for a total of 2,335 dwelling units for both single- and multi - family residences within the entirety of PUD 9. Currently, 939 units have been built, leaving a balance of 1,396 units still available to be developed. A zoning of RNX on the subject property, which is 7.76 acres in size, would only allow a total of 93 units to be developed on the property. This number of units would not cause the overall density within the PUD as a whole to go over the allowed amount. This rezoning request is seeking to allow a higher density of units than was originally called out for in the PUD document for the subject property. Therefore, as per the PUD requirements in the Owasso Zoning Code, a Minor PUD Amendment is being administratively processed concurrently with this rezoning request to approve the transfer of allowed units to the subject property. Any development of the property will have to follow all City of Owasso development standards. The Final Plat for this development will be presented for consideration and recommendation at a later date. The GrOwasso 2030 Land Use Master Plan calls out this property for transitional land uses. As the property is adjacent to an apartment complex to the south and a neighborhood of patio homes to the north, a senior housing development would act as a good land use transition between the existing surrounding residential developments. Therefore staff has determined that a senior housing development with a zoning of RNX is an appropriate land use for the property and is in compliance with the GrOwasso 2030 Land Use Master Plan. The City of Owasso would provide sanitary sewer, Fire, Police, EMS, and water service to the property. Any future development that occurs on the subject property must adhere to all Owasso subdivision, zoning, and engineering requirements. RECOMMENDATION: Staff recommends approval of the rezoning request (OZ 17 -09), rezoning the subject property to RNX (Residential Neighborhood Mixed).
