ORDINANCE 1143
AN ORDINANCE ACCEPTING, ADDING, AND ANNEXING TO THE CITY OF OWASSO,
OKLAHOMA, ADDITIONAL LANDS AND TERRITORY, REFERENCED IN APPLICATION OA
18 -04 AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WHEREAS, public hearings have been held regarding the request for annexation of the
property located on the northwest corner of East 76th Street North and North Memorial Drive;
and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for or against the requested annexation of the property
referenced in application OA 18 -04.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
THAT TO WIT:
SECTION 1.
A tract of land, being more particularly described as follows:
THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (SE /4 SE /4), LESS THE WEST
100 FEET AND LESS BEGINNING 532.11 FEET WEST AND 60 FEET NORTH OF THE
SOUTHEAST CORNER OF THE SOUTHEAST QUARTER (SE /4); THENCE WEST 690.43 FEET;
THENCE NORTH 1261.78 FEET; THENCE EAST 690.43 FEET; THENCE SOUTH 1261.88
FEET TO THE POINT OF BEGINNING; AND LESS THE SOUTH 60 FEET THEREOF, AND LESS
THE EAST 16.5 FEET THEREOF, AND LESS THE SOUTHEAST HALF (SE /2) OF THE NORTH
15 FEET OF THE SOUTH 75 FEET OF THE WEST 15 FEET OF THE EAST 65 FEET THEREOF, IN
SECTION TWENTY -SIX (26), TOWNSHIP TWENTY -ONE (21) NORTH, RANGE THIRTEEN
(13) EAST OF THE INDIAN BASE AND MERIDIAN, TULSA COUNTY, STATE OF
OKLAHOMA, ACCORDING TO THE UNITED STATES GOVERNMENT SURVEY THEREOF.
The some is hereby annexed to, made a part of, and added to the City of Owasso, Oklahoma,
and its corporate limits. All persons residing therein, and all property situated thereon, shall be
subject to the jurisdiction, control, laws, and ordinances of the City of Owasso, Oklahoma, in all
respects and particulars.
SECTION 2.
From and after the passage and publication of this Ordinance, the real estate and territory
described above shall be a part of the City of Owasso, Oklahoma, and in Ward 4.
SECTION 3.
All ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed to the
extent of the conflict only.

SECTION 4.
If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the
remaining portion shall not be affected but shall remain in full force and effect.
SECTION 5.
The provisions of this ordinance shall become effective April 3, 2019.
SECTION 6.
There shall be filed in the office of the County Clerk of Tulsa County, Oklahoma, a true and
correct copy of this ordinance and correct map of the territory annexed.

BACKGROUND:
The Community Development Department received a request for annexation of property
located on the northwest corner of East 76th Street North and North Memorial Drive. The subject
property is approximately 14.98 acres in size and is currently zoned AG (Agriculture) in Tulsa
County. Upon annexation, the property would be brought into Owasso City Limits as AG
(Agriculture).

ANALYSIS:
The property is currently zoned AG (Agriculture) in Tulsa County, and the applicant requests that
the property retain its current zoning upon annexation. The subject property is currently
undeveloped, and the applicant has indicated that development plans are in the works but a
few years away.
The GrOwasso 2030 Land Use Master Plan identifies the southern half of the subject property at
the hard corner of East 76th Street North and North Memorial Drive for commercial land uses. The
remainder of the northern half of the property is identified for transitional land uses. Because the
subject property is bisected in this way by the Land Use Master Plan, and because development
plans are not yet solidified, staff has determined that retaining the AG zoning upon annexation
would allow flexibility for future development.
The City of Owasso will provide sanitary sewer, Fire, Police, and EMS to the property upon
annexation. Water service will be provided to the property by Washington County Rural Water
District #3. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements. Any future rezoning case for this
property would be evaluated using the GrOwasso 2030 Land Use Master Plan.
PLANNING COMMISSION:
The Owasso Planning Commission voted 3 -0 to recommend approval at their meeting on
December 10, 2018.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1143, annexing the subject property referenced in
annexation application OA 18 -04.
