HomeMy WebLinkAbout1983.05.17_OPWA MinutesOn Tuesday, May 17, 1983, the Owasso Public Works Authority met in regular session in the Council Chambers at City Hall per the Notice of Public Hearing and Agenda psoted on City Hall Bulletin Board at 4:00 p.m. on May 13, 1983, and by reference is made a part hereof. ITEM 1: CALL TO ORDER The meeting was called to order at 8:18 p.m. with Chairman Spencer presiding. ITEM 2: FLAG SALUTE ITEM 3: ROLL CALL PRESENT: Boyd Spencer, Chairman Wauhilleau Webb, Vice -Chairman Von Stockler, Trustee James Smalley, Trustee Dale Block, City Manager Ron Cates, City Attorney Ann Hendrickson, City Clerk ABSENT: ITEM 4: Phyllis Gross, Trustee APPROVAL OF MINUTES OF REGULAR SESSION OF OWASSO PUBLIC WORKS ATUHORITY, MAY 3, 9983. Motion was made by Von Stockler, seconded by James Smalley, to approve the minutes of May 3, 1983, by reference made a part hereof. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. ITEM 5: BUSINESS A. ACKNOWLEDGEMENT OF WATER LINE PERMIT #WL-83-205/OKLAHOMA STATE DEPT. OF HEALTH ELM CREEK CONDOMINIUMS. Motion was made by Mayor Spencer, seconded by Von Stockler, to acknowledge receipt of Water Line Permit #WL-83-205/Oklahoma State Dept. of Health/Elm Creek Condominiums. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. B. CONSIDERATION OF STAFF RECOMMENDATIONS OF POLY CART BIDS. Mr. Block said that the two bidders, J & R Equipment Company of Oklahoma City and Williams Equipment Company of Owasso, were very OWASSO PUBLIC WORKS AUTHORITY PAGE TWO MAY 17, 1983 owl close in their bids on the 80 gal. containers (within 35 cents) and there was a difference of $1.10 on the 90 gal. containers. The main difference was the Williams bid included an additional expense to convert the City's trucks to use the 90 gal. contain- ers, while J & R Equipment required no additional charge for conversion. If the City decides to stay with the 80 gallon con- tainers, the local supplier would probably be the best choice. If the City decides to purchase the larger, less expensive 90 gallon containers, and if J & R Equipment can demonstrate their ability to accomodate the larger container with no expense to the City, then Mr. Block's recommendation would be to accept the bid from J & R Equipment. Mr. Williams was present at the meeting and asked about the Zarn cart's latch for the lid. He said a good wind latch is very important. He said he doubted the Zarn cart could be dumped efficiently without a major conversion on the dumpers. Mr. Block stated that his recommendation to accept the J & R bid was subject to a demonstration showing they can perform as they have stated in writing. He also stated that there is a latch on the Zarn cart. Motion was made by Mayor Spencer, seconded by Von Stockler, to accept the recommendation of the City Manager to accept the bid from J & R Equipment Company subject to committments made by Zarn Company concerning no conversion costs and a demonstra- tion of their ability to perform with both cart sizes. AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. C. CONSIDERATION OF ENGINEERING AGREEMENT WITH AL C. YOUNG AND ASSOCIATES FOR WATER AND SEWER IMPROVEMENTS. Mr. Block explained that the figure that he and the engineering company have agreed to ($139,000) includes work done prior to the election. If the bond issue is not approved, the agreement will terminate without any penalty to the City and the City will pay for work done to that time. Consideration of approval of the agreement at this time is being submitted to avoid a two week delay in work should the bond issue pass. Mr. Cates pointed out some changes that had been made in the agreement; deletion of termination sections on pages 10 and 12 and addition of pages 13 and 14. Motion was made by Von Stockler, seconded by James Smalley to accept the engineering agreement with Al C. Young and Associates OWASSO PUBLIC WORKS AUTHORITY PAGE THREE AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. 6. REPORT FROM CITY ATTORNEY Passed. 7. REPORT FROM CITY MANAGER MAY 17, 1983 Mr. Block reported that an excellent job was being done of repair- ing the driveways on Dogwood and individual lines are being tied into the houses. As soon as there is some dry weather, the work will be completed including curbs and sidewalks. 8. APPROVAL OF CLAIMS Mr. Block said that the reason the purchase of poly carts was on the claims list was that there were so many new houses being sold that he had to buy a few more before the bid procedure was finished. Motion was made by James Smalley, seconded by Von Stockler, to approve the O.P.W.A. claims for April in the amount of $62,494.47 AYE: Messrs. Spencer, Stockler, Smalley; Mrs. Webb NAY: None Motion carried. 9. NEW BUSINESS Mayor Spencer asked the City Manager for a report on the engineer- ing work being done by Farrar -Hudspeth. Mr. Block said our rep- resentative from Farrar -Hudspeth will be in the City on Thursday for a review meeting and invited any Council members who could to attend. He said the work should be finished the latter part of July or the first of August. He said that problems that had come up during the study indicate areas that the proposed new sewer Line would improve. Mr. Block said he would issue an interim report 40 after the meeting on Thursday. Mrs. Webb said that Mrs. McNiel had asked the City Attorney for permission to speak to the Council and that she recommended that Mrs. McNiel be allowed to speak during New Business if it is not a violation of the Open Meeting Law. The City Attorney said it would be ok. Mrs. McNiel said she was very unhappy about her claim being denied and wanted to know what the City Attorney meant when he said it OWASSO PUBLIC WORKS AUTHORITY PAGE FOUR MAY 17, 1983 was denied because of the way it was presented. Mr. Cates said that the claims presented by Mrs. McNiel in the amount of $6,482.74 to the City of Owasso has been denied and while he was making no statement as to liability, the amount of the claim as submitted was not a proper claim against the City of Owasso. Mrs. McNiel asked if the City was denying liability. Mr. Cates said the City was not admitting anything at this point. Mrs. McNiel asked how the City could deny liability when it was the City's sewer that caused the damage. Mr. Cates said that it was his opinion that if there was any liability it would not be to the extent of the claim as presented. He said this matter would be referred to the carrier for further action and as far as the City is concerned at this time, the claim has been denied. Mrs. McNiel said she thought this was a very poor way for the Council to represent the people. Mr. Cates said that the Council represents the citizens and they are charged by law to protect the public treasury, as in this case when a claim is filed against that treasury. Mrs. McNiel said she did not think she would get anywhere with the insurance carrier. She said they had witnesses as to the damage. Mr. Cates recommended that when they meet with the insurance any testimonial or physical evidence be made available to them.
