met in regular session in the Council Chambers at City Hall per
the Notice of Public Hearing and Agenda posted on City Hall bul-
letin board at 4:00 p.m. on March 16, 1984.
ITEM 1: CALL TO ORDER
The meeting was called to order at 8:57 p.m. with Chairman
Spencer presiding.

Motion was made by Wauhilleau Webb, seconded by Von Stockler, to
approve the Consent Agenda, by reference made a part hereof.

Motion carried.
The City Attorney call a point of order stating that the Consent
Agenda must be passed unanimously. Mrs. Gross asked that Item A
be removed from the Consent Agenda, Mrs. Webb renewed her motion
and Mr. Stockler renewed his second.

B. CONSIDERATION OF RE
ST FOR, EXCEPTION TO MANDATORY REFUSE

Mr. Hynum said the matter had been resolved and Telex is now
using City trash service.
C. REQUEST FOR DISCUSSION REGARDING SOUTHEAST OWASSO SEWER
AREA DR. BRYSON AND V. RADEBAUGH.
This item was postponed to the April 3 agenda.

Mr. Smalley asked what our expectations were for funding on this
project. Mr. Hynum said when we begin Step III, we will receive
reimbursement on steps'I and II. He said the Task Force will
make their recommendations to the State on March 24. The Health
Dept. Board will meet on April 13 to hopefully approve the plan and
then it will go to EPA. Mr. Hynum said that after many conver-
sations with a number of people, he felt the City's chances for
grant money.in the 1984-85 year are good. He said that any money
c,ranted will be done according to current population, not pro-
jected population. Mayor Spencer said the Council should be
careful in making a decision and should possibly reconsider addi-
tions to the present lagoon system.

Mr. Smalley asked how the City would fund the pro'ect.if t

ing is likely to be 55%. Mr. Hynum said about $500,000 couldfcome
from the G.O. Bond issue. He said the City needs to be prepared with
plans, designs and funding for the first of October, the beginning
of their fiscal year. Mr. Stockler asked how much had been spent
on Step I and how much would be spent on Step II. Mr. Hynum said
approximately $35,000 on Step I and.$109,000 on Step II. Mayor
Spencer said he felt the City was taking their chances going on
with the project and not knowing if we will re
ceivefunin
all. Mr. Smalley said he agreed, but at some Point ancommittmentt
must be made to proceed even though the chancey €or funding might
be slim -to none. He said since there were only 17 approved last
year and probably about the same next year and Owasso was #54, the
chances of making it looked slim to him, but we still should proceed.
Mr. Hynum said he felt the City had a better chance than that because
the awards were given on a point system and our project would get
extra points because of the innovative alternative system involved.

approve the contract with Farrar -Hudspeth for engineering fees for
Step II wastewater treatment project.

E. CONSIDERATION OF AUTHORIZATION TO ADVERTISE FOR BIDS ON WATER

Mr. Danny Bird of Al C. Young and Associates stated that the plans
and specifications on all four projects are complete and ready to
be bid. He suggested
each project the date of April 26 to take the bids, having
j's bids opened at thirty minute intervals.
Mr. Spencer asked if Mr. Bird knew about the booster pump the City
bought a few years ago. Mr. Bird said it might be needed at some
time in the future. Mr. Spencer asked if they would use the pressure
reducing valves. Mr. Bird said they could use the valves in the
old part of town.
Motion was made by James Smallev, seconded by Von Stockler, to adver-
tise for bids on April 26 for all four- water and sewer projects.

F. CONSIDERATION OF RECO14MENDATION TO ACCEPT LOW BID ON SANI-
TATION VEHICLES.
Mr. Noel Cudd spoke to the Authority about purchasing an automated
side loader from his company. Mr. Spencer asked him what his bid
had been and he said $123,731, which was the high bid. He asked
the City Attorney if it was ok to be talking with the high.bi.dder
at this point. Mr. Cates said the Authority could consider any-
thing relative to the bids in determining whether to accept the
low bid. He said the Authority would not be able to accept the
high bid at this time.however.

waive competitive bidding requirements and authorize the City
Manager to obtain parts and labor for repair of water lines on
Dogwood Street and to accept the lowest available price in obtain-
ing the services and acquiring the materials for same.

6. REPORT FROM CITY MANAGER
Mr. Hynum reported that the materials to repair the wash unit had
been ordered by the City Mechanic and it is being repaired.
Mr. Hynum asked Mr. Dennis Hodo to report on the study he had
made of the area. Mr. Hodo said that basically because North
Beaumont is a very flat street, it does not drain well. He
said there were several spots where silt deposit buildup is
compounding the problem. He said the ideal solution would be
to install a storm sewer taking the water off of the street and
carry it into a ditch west of the area. He said an immediate
solution would be to keep the silt cleared out of the gutters
and cut the brush particularly west of 3rd street. Mr. Hynum
said the silt has been cleaned out and some of the brush had
been cleared. Mr. Smalley asked if the City had a ditch cleaner.
Mr. Hynum said there is one, but the ignition key has been lost.
7. REPORT FRO14 CITY ATTORNEY
49 Mr. Cates said Mayor Spencer had requested an opinion regarding
the extent of authority of trustees of the Owasso Public Works
Authority.in terms of active management function. He said that
in answer to the request, the Trustees of the Owasso Public Works
Authority, acting as a collective body, by majority rule thereof
may supervise and control directly or indirectly officers and
employees of the Owasso Public Works Authority only. He stated
that the Owasso Public Works Authority and the Owasso City Council
are two seperate corporate bodies. The City Council is the
governing body of this municipal corporation with limitations upon
responsibilities and authority and may not actively manage, directly

or indirectly, employees of the City of Owasso. If the trustees
of the OPWA so deem it, acting as a body, they could control the
day to day operation of the Owasso Public Works Department.
Cates stated that although members of the Owasso City Council are
also members of the OPWA, a member of the Council need not be a
trustee of the OPWA and the two bodies can be two completely
different groups of people.
Mr. Hynum said he had been associated with a city that appointed
a board other than the City Council as a Municipal Services
Authority and that it did not work well.
Mayor Spencer stated that he thought the Trustees should have
an active part in the hiring of employees in the Public Works
Department.
8. NEW BUSINESS
There being no new business before the Owasso Public Works Authority,
meeting adjourned at 10:56 p.m.
