HomeMy WebLinkAbout1999.02.23_City Council Minutes OW ASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Tuesday, February 23, 1999 The Owasso City Council met in special session on Tuesday, February 23, 1999 in the Lower Level Conference Room at City Hall per the Notice of Public Meeting called on Tuesday, February 16, 1999, and Notice and Agenda filed in the office of the City Clerk and posted on the City Hall bulletin board at 11 :00 a.m. on Monday, February 22, 1999. ITEM 1: CALL TO ORDER AND ROLL CALL. Mayor Bode called the meeting to order at 5:04 p.m. Councilors present: Denise Bode, Mayor; Mark Wilken, Vice Mayor; Mary Lou Barnhouse, Councilor; Melinda Voss, Councilor; Duston Smith, Councilor. Others present: City Manager Jeff Hancock, City Clerk Marcia Boutwell, City Attorney Ron Cates, Human Resources Officer Allan Harder, and representatives of the FOP Lodge and their attorney. A quorum was declared present. ITEM 2: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING POSSIBLE LITIGATION BETWEEN FOP LODGENO 149 AND RANDY BROCK AND THE CITY OF OW ASSO, SUCH DISCUSSION ALLOWED PURSUANT TO 25 O.S., SECTION 307-B(4). Mr Cates said that this request is the result of an opinion rendered on January 27, 1999 by Arbitrator Norwood Ruiz in the Matter of FOP Lodge No 149 and Randy Brock, grievant, and the City of Owasso, Oklahoma, FMCS No 980311-06801-7. Ms Barnhouse moved, seconded by Ms Voss, to enter into executive session for the above-stated purpose. Into executive session at 5 :06 p.m. Out of executive session at 6:00 p.m. ITEM 3: CONSIDERA TION AND APPROPRIATE ACTION RELATING TO AUTHORIZA TION FOR THE CITY ATTORNEY TO INSTITUTE LEGAL ACTION IN THE DISTRICT COURT OF TULSA COUNTY, STATE OF OKLAHOMA, TO SEEK JUDICIAL REVIEW OF AN ARBITRATION DECISION RENDERED BYNORWOOD RUIZ ON JANUARY 27, 1999, IN THE MATTER OF FOP LODGE NO 149 AND RANDY BROCK Mr Wilken moved that, although we do not agree with the language nor the reasoning advanced by the arbitrator in the decision and award, and while we are concerned about but do not concur with any perceived precedential effects, I submit that it is in the best interest of the city at this time to not proceed with a district court appeal of the decision. Motion seconded by Mr Smith. Owasso City Council February 9, 1999 AYE: NAY: Wilken, Smith, Voss, Barnhouse, Bode None Motion carried 5-0. ITEM 4: ADJOURNMENT Ms Barnhouse moved, seconded by Ms Voss, to adjourn.
