C. Accept sanitary sewer infrastructure improvements of one sanitary sewer lift station,
approximately 6,557 feet of 8" sewer pipe, 836 feet of 6" sewer pipe, and all other
appurtenances, located in the Magnolia Ridge I subdivision (East 86th Street North,
approximately' /, mile west of North Memorial Drive)
D. Accept sanitary sewer infrastructure improvements of two sanitary sewer manholes and
approximately 200 LF of 8" PVC sanitary sewer pipe located at the southwest corner of
the Nottingham Hill subdivision (East 96th Street North, west of North 145th East Avenue)
E. Accept a donation from the Owasso Golden Agers - Community Expansion of Nutrition
Assistance (CENA) and approve a budget amendment in the General Fund increasing
estimated revenues, and the appropriation for expenditures in the Community Center
Department by $3,702.00

Tuesday, February 4, 2020
The Owasso City Council met in regular session on Tuesday, February 4, 2020, in the Council
Chambers at Old Central, 109 North Birch, Owasso, Oklahoma, per the Notice of Public Meeting
filed Friday, December 13, 2019; and the Agenda filed in the office of the City Clerk and posted
at City Hall, 200 South Main Street, at 6:00 pm on Friday, January 31, 2020.

Mayor Chris Kelley called the meeting to order at 6:30pm.

The Invocation was offered by Pastor Jonathan Cook of Destiny Life Church.

Chelsea Levo Feary, Character Council Member, presented the character trait for the month
of February.
6. Annual Report of the Owasso Strong Neighborhood Initiative
Jerry Fowler presented the Owasso Strong Neighborhood Initiative Annual Report. Discussion
was held.
Consideration and appropriate action relating to a request for approval of the Consent
Agenda. (All matters listed under "Consent" are considered by the City Council to be routine
and will be enacted by one motion. Any Councilor may, however, remove an item from the
Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable.)

(American Bank of Oklahoma) - concrete approach, sidewalk, stormwater structure
Mr. Bush moved, seconded by Mr. Bonebrake to approve the Consent Agenda, as
presented, with claims totaling $394,933.60.

9. Consideration and appropriate action relating to the acquisition of right -of -way and
easement for the East 116 +h Street North Roadway Improvement Project from Garnett Road to
North 129th East Avenue
Roger Stevens presented the item, recommending authorization for payment to Bale of Hay,
LLC, in the amount of $63,385.00 for the acquisition of right -of -way, easement, and
compensation for damages at 11423 North 1231d East Avenue.
There were no comments from the audience. Mr. Bonebrake moved, seconded by Mr. Dunn
to authorize payment, as recommended.

10. Consideration and appropriate action relating to the purchase of a CNG Bi -Fuel Truck and
declaring a surplus vehicle
Dwayne Henderson presented the item, recommending approval to purchase a 2020 Ford
F150 Crew Cab 4x4 Bi -Fuel truck in the amount of $43,528.00 from Bill Knight Ford of Tulsa,
Oklahoma, per the State of Oklahoma approved contract #SW05; and to declare the 1999
Dodge Dakota (VIN #1 B7GG22X3YS658539) as surplus to the needs of the City and disposal
via on -line auction.
There were no comments from the audience. After discussion, Mr. Bush moved, seconded by
Mr. Dunn to approve the vehicle purchase and declare the vehicle surplus, as
recommended.

11. Report from City Manager
• Monthly Public Works Project Status Report
Warren Lehr introduced Roger Stevens to provide the monthly Public Works project status
report and discussion was held. Mr. Lehr reported on winter weather preparations, the
February 11, 2020 School Board and Bond election, and recognized Alexa Beemer, as the
new City Planner.

(OPGA) met in a joint regular meeting on Tuesday, February 11, 2020, in the Council Chambers at
Old Central, 109 North Birch Street, Owasso, Oklahoma, per the Notice of Public Meeting filed
Friday, December 13, 2019; and the Agenda filed in the office of the City Clerk and posted at City

Warren Lehr introduced Jennifer Newman to present the monthly sales tax report and discussion
was held. Mr. Lehr reported on the 2019 Community Enrichment Award received from the
Owasso Chamber and Owasso SkyWarn Storm Spotter Training to be held March 5, 2020.

SUBJECT: Acceptance of Sanitary Sewer Infrastructure Improvements at Magnolia Ridge I
DATE: February 14, 2020
BACKGROUND:
The subject sanitary sewer infrastructure is located in the Magnolia Ridge I subdivision which is on
East 86th Street North, approximately 1/4 mile west of Memorial Drive. This subdivision is within Tulsa
County; however, the sanitary sewer is connected to the City of Owasso sewer system. The
infrastructure consists of one sanitary sewer lift station, approximately 6,557 feet of 8" and 836
feet of 6" sewer pipe and all other appurtenances.
FINAL INSPECTIONS:
Final inspections for the infrastructure components were completed in January 2020, by the
Public Works Department. All standards for acceptance have been met. Additionally, the
construction contractor and design engineer have supplied the necessary two -year
maintenance bond and required as -built drawing.
RECOMMENDATION:
Staff recommends acceptance of the sanitary sewer infrastructure improvements located in the
Magnolia Ridge I subdivision - one sanitary sewer lift station, approximately 6,557 feet of 8"
sewer pipe, 836 feet of 6" sewer pipe, and all other appurtenances.

BACKGROUND:
The Owasso Community Center was built in 1977 with a grant provided by the Federal
Government. The Community Center is a place where residents of all ages can participate in
meaningful programs and activities to enrich their lives.
The Owasso Golden Agers (OGA) is a tax exempt (501 -C -3) organization whose primary purpose
is to receive and manage grant funds to assure that a viable Owasso Senior program is not
totally dependent on local funding.
GRANT:
The OGA have been approved to receive funding in the amount of $3,702.00 for the CENA
program which is made available through the Oklahoma Department of Commerce.
A budget amendment is needed in order to make the OGA donation of the CENA grant funds
available for expenditure in the Community Center FY20 budget. This budget amendment
would increase the General Fund revenues and appropriation for expenditures by $3,702.00.
RECOMMENDATION:
Staff recommends acceptance of the Owasso Golden Agers CENA grant donation and
approval of a budget amendment in the General Fund increasing estimated revenues and the
appropriation for expenditures in the Community Center Department by $3,702.00.

ANALYSIS:
The subject property was zoned RS -3 with Ordinance 1046, which prescribes minimum lot widths
of 65 feet and lot sizes of 7,000 square feet. The final plat for Abbott Farms II consists of 50 Lots in 5
Blocks on 13.09 acres. The project is a continuation of the Abbott Farms development. A temporary
gravel drive will be provided connecting North 101st East Avenue in phase I with phase II for the
purpose of fire access. One additional phase will be forthcoming and will complete the
neighborhood.
The Plat provides a pedestrian connection to the Owasso Sports Park to the east of the project.
Perimeter and interior utility easements are shown on the Plat that will allow utilities adequate
access to provide and maintain service to the proposed development. Stormwater Detention
has been accounted for in the regional dentation pond being constructed by the City in the
Owasso Sports Park. All internal streets will be public and dedicated to the City. There are no
amenities provided within this Plat, as it has straight RS -3 zoning and is not part of a Planned Unit
Development (PUD), which would have required amenities.
The City of Owasso will provide water, sanitary sewer, Fire, Police, and EMS services to the proposed
residential development. The development that occurs on the subject property shall adhere to all
subdivision, zoning, and engineering requirements of the City of Owasso.
PLANNING COMMISSION:
The Owasso Planning Commission recommended approval, with a 4 -0 vote, for the Final Plat of
Abbott Farms II at their regular meeting on February 10, 2020.
RECOMMENDATION:

The Oklahoma Legislature has made numerous changes to state statutes governing alcohol,
controlled dangerous substances and various criminal offenses over the past few years. As a
result of those changes, staff recommends the following amendments to the Owasso Code of
Ordinances to comply with state law.
Ordinance 1159
Sections 3- 108.3 -1 1 1, 3-114, 3 -115.3 -116 and 3 -117
This ordinance provides that certain alcohol establishments may employ, under certain
circumstances, persons who are eighteen (18) years of age, as well as musicians who are less
than eighteen (18) years of age who have parental permission. This ordinance additionally
regulates the transport of alcoholic beverages in a vehicle, the consumption of spirits (alcohol
other than beer or wine) in public, misrepresentation by a person of his or her age to obtain
alcohol, possession or consumption of alcohol by a minor and furnishing alcohol to a person less
than twenty -one (21) years of age.
Ordinance 1160
Sections 10 -401 and 10 -401.1
This ordinance establishes that it shall be unlawful for any person to be intoxicated in public and
disturb the peace of any person. The ordinance further provides that assistance may be
provided to an intoxicated person needing help, and that such a person may be assisted to
their home or to an appropriate facility.

Sections 10-402,10-403 and 10 -403.1
This ordinance defines a controlled dangerous substance within the Owasso Code of
Ordinances and provides penalties for possession of such substances. This ordinance
additionally incorporates and adopts new state law regarding the possession of medical
marijuana.

Sections 10 -201, 10 -424, 10 -417 and 10 -425, repealing 10 -415
This ordinance amends the value of property taken in the Petit larceny, Embezzlement,
Defrauding Hotels, Restaurants and Other Service Providers and Obtaining Property by Trick or
Deception, False Representation, or Pretense sections of the Code of Ordinances. This
ordinance additionally repeals 10 -415, Harmful Deception, because the law contained therein is
adequately addressed in other sections of the Code.
RECOMMENDATION:
Staff will recommend adoption of proposed Ordinance 1159 amending Chapter 1, Alcoholic
Beverages; Taxation and Regulation, of Part 3, Alcoholic Beverages, of the Owasso Code of
Ordinances. Staff will further recommend adoption of proposed Ordinances 1160 and 1161
amending Chapter 4, Offenses against the Health, Welfare and Morals, of Part 10, Offense and
Crimes, of the Owasso Code of Ordinances. Staff will additionally recommend adoption of
Ordinance 1162 amending Chapter 2, Offenses against Property, and Chapter 4, Offenses
against the Health, Welfare and Morals, of Part 10, Offenses and Crimes, of the Owasso Code of

selling of spirits. Provided, that:
A. A mixed beverage, beer and wine, caterer, public event, special event, bottle club,
retail wine or retail beer licensee may employ servers or sales clerks who are at least
eighteen (18) years of age, except persons under twenty -one (21) years of age may not
serve in designated bar or lounge areas, and
B. A mixed beverage, beer and wine, caterer, public event, special event or bottle club
licensee may employ or hire musical bands who have musicians who are under eighteen
(18) years of age if each such musician is either accompanied by a parent or legal
guardian or has on their person, to be made available for inspection upon demand by any
employee of the ABLE Commission or law enforcement officer, a written, notarized affidavit
from the parent or legal guardian giving the underage musician permission to perform in
designated bar or lounge areas.
SECTION TWO (2): Section 3 -111 of the Code of Ordinances of the City of Owasso, Oklahoma, is
hereby amended to read as follows:
SECTION 3 -111 TRANSPORTING ALCOHOLIC BEVERAGES
It is unlawful for any person to knowingly transport in any vehicle upon a public highway,
street or alley any alcoholic beverage except in the original container which shall not have
been opened and the seal upon which shall not have been broken and from which the
original cap or cork shall not have been removed, unless the opened container be in the
rear trunk or rear compartment, which shall include the spare tire compartment in a vehicle
commonly known as a station wagon and panel truck, or any outside compartment which is
not accessible to the driver or any other person in the vehicle while it is in motion. Any
person who violates this Section shall be guilty of a misdemeanor and shall be punished by a
fine of not more than $500.00, or by imprisonment for not more than sixty (60) days, or by
both such fine and imprisonment.

of the ABLE Commission, who is authorized to sell or serve spirits by the individual drink. Any

It is unlawful for any person under twenty -one (21) years of age to misrepresent his or her age

B. An intoxicated person in a public place who appears to be in need of help, if the
person consents to the offered help, may be assisted to his or her home, an
alternative facility pursuant to the provisions of the Oklahoma Alcohol and Drug
Abuse Services Act, or to an approved treatment facility by a police officer.
C. A person who appears to be intoxicated, and as a result of such intoxication is
unconscious in a public place or reasonably appears to be in danger of harming
himself or herself or others, may be taken into protective custody by a peace officer
and immediately brought to an approved treatment facility for medical or
nonmedical detoxification.
SECTION TWO (2): Section 10 -401.1 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 10 -401.1 CONSUMPTION OF INTOXICATING SUBSTANCES
It is unlawful for any person to drink or otherwise consume any intoxicating substance,
or intoxicating compound of any kind, or inhale glue, paint or other intoxicating
substance, and to disturb the peace of any person in any public place, or in or upon
any passenger coach, streetcar, or in or upon any other vehicle commonly used for
the transportation of passengers, or in or about any depot, platform, waiting station
or room unless authorized by the Oklahoma Alcoholic Beverage Control Act. Any

1. Hallucinogenic substances, including mescaline, psilocybin, and various types of
methoxyampheta mines.
2. Stimulants such as amphetamines and methamphetamines.
3. Barbiturates and other depressants such as amobarbital, secobarbital,
pentobarbital, phenobarbital, methaqualone, phencyclidine, and diazepam.
Drug paraphernalia means any equipment, product, or material of any kind which is
primarily intended or designed for use in manufacturing, compounding, converting,
concealing, producing, processing, preparing, injecting, ingesting, inhaling, or
otherwise introducing into the human body a controlled substance, possession of
which is unlawful under this chapter. It includes, but is not limited to, items intended or
designed for use in ingesting, inhaling, or otherwise introducing cocaine, PCP,
methomph eta mine, or amphetamines into the human body, such as:
1. Metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes with or without
screens, permanent screens, hashish heads, or punctured metal bowls;
2. Water pipes;
3. Carburetion tubes and devices;
4. Smoking and carburetion masks;
5. Roach clips;
6. Miniature spoons with level capacities of one -tenth cubic centimeter or less;
7. Chamber pipes;
8. Carburetor pipes;
9. Electric pipes;
10. Air - driven pipes;
11. Chillums;
12. Bongs;
13. Ice pipes or chillers;

Marijuana means all parts of the plant Cannabis Sativa L., whether growing or not;
the seeds thereof; the resin extracted from any part of such plant; and every
compound, manufacture, salt, derivative, mixture or preparation of such plant, its
seeds or resin. This definition shall not include the mature stalks of such plant; fiber
produced from such stalks; oil, cake made from the seeds of such plant, any other
compound, manufacture, sale, derivative, mixture or preparation of such mature
stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of
such plant which is incapable of germination.
Practitioner means:
1. A physician, dentist, podiatrist, veterinarian, scientific investigator, or other
person who is authorized by state or federal law to distribute, dispense, conduct
research with respect to, use for scientific purposes or administer a controlled
dangerous substance in the course of professional practice or research in this state;
or
2. A pharmacy, hospital, laboratory, or other institution authorized by state or
federal law to distribute, dispense, or conduct research with respect to use for
scientific purposes or administer marijuana or a controlled dangerous substance in
the course of a registered professional practice or research in this state.
Simulated controlled dangerous substance means any substance which is not a
controlled substance nor marijuana, but which identifies itself by using a common
name or slang term associated with marijuana or with substances identified as a
controlled dangerous substance, or which indicates on its label or accompanying
promotional material or concerning which it is represented that the product simulates
the effect of a substance, or which by appearance, making or packaging would
lead a reasonable person to believe the substance was marijuana or a controlled
substance.
SECTION TWO (2): Section 10 -403 of the Code of Ordinances of the City of Owasso, Oklahoma, is
hereby amended to read as follows:
SECTION 10 -403 POSSESSION OF CONTROLLED DANGEROUS SUBSTANCES
A. It shall be unlawful for any person to knowingly or intentionally possess any controlled
dangerous substance or simulated controlled dangerous substance, other than
marijuana, unless such substance was obtained directly, or pursuant to a valid
prescription or order, from a practitioner, while acting in the course of his professional
practice. Any person who violates this subsection shall be guilty of a misdemeanor
and shall be punished by a fine of not more than $750.00, or by imprisonment of not
more than 60 days, or by both such fine and imprisonment.
B. A person in possession of an Oklahoma state - issued medical marijuana license
shall be able to legally possess up to three (3) ounces of marijuana on their person, six
(6) mature marijuana plants, six (6) seedling plants, one (1) ounce of concentrated
marijuana, seventy -two (72) ounces of edible marijuana, and eight (8) ounces of
marijuana in their residence. It shall be unlawful for any person to knowingly or

intentionally possess marijuana without an Oklahoma state - issued medical marijuana
license or to possess marijuana in excess of the limits prescribed in this subsection
unless authorized by the Oklahoma statutes. Any person who violates this section
shall be guilty of a misdemeanor and shall be punished by a fine of not more than
$400.00, plus costs.
C. Any person who is in possession of marijuana in an amount not to exceed one and
one -half (1.5) ounces who can state a medical condition, but is not in possession of a
state - issued medical marijuana license shall be guilty of a misdemeanor and shall be
punished by a fine of not more than $400.00, plus costs. Any law enforcement officer
who comes into contact with a person in violation of this subsection and who is
satisfied as to the identity of the person, as well as any other pertinent information the
law enforcement officer deems necessary, shall issue to the person a written citation
containing a notice to answer the charge in Owasso Municipal Court. Upon
receiving the written promise of the alleged violator to answer as specified in the
citation, the law enforcement officer shall release the person upon personal
recognizance unless there has been a violation of another provision of law.
SECTION THREE (3): Section 10 -403.1 of the Code of Ordinances of the City of Owasso,
Oklahoma, is hereby amended to read as follows:
SECTION 10 -403.1 POSSESSION OF PARAPHERNAILA
A. No person shall use or possess drug paraphernalia to plant, propagate, cultivate,
grow, harvest, manufacture, compound, convert, produce, process, prepare, test,
analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise
introduce into the human body a controlled dangerous substance, other than
medical marijuana, in violation of the Uniform Controlled Dangerous Substances Act,
63 O.S. § 2 -101, et seq. Any person who violates this subsection shall be guilty of a
misdemeanor and shall be punished by a fine of not more than $750.00, or by
imprisonment of not more than 60 days, or by both such fine and imprisonment.
B. No person shall deliver, sell, possess or manufacture drug paraphernalia knowing,
or under circumstances where one reasonably should know, it will be used to plant,
propagate, cultivate, grow, harvest, manufacture, compound, convert, produce,
process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest,
inhale or otherwise introduce into the human body a controlled dangerous
substance, other than medical marijuana, in violation of the Uniform Controlled
Dangerous Substances Act, 63 O.S. § 2 -101, et seq. Any person who violates this
subsection shall be guilty of a misdemeanor and shall be punished by a fine of not
more than $750.00, or by imprisonment of not more than 60 days, or by both such fine
and imprisonment.
C. Subsections A and B shall not be applicable to practitioners to the extent such
paraphernalia is used as a part of their lawful practice of the profession.
D. Subsection A shall not be applicable to the possession of paraphernalia by persons
involved in the medical or veterinary equipment supply business, where such
possession is a necessary and appropriate part of servicing lawful medical or
veterinary practitioners.

E. In determining whether an item constitutes drug paraphernalia, in addition to all
other logically relevant factors, in the following may be considered:
1. Instructions, oral or written, provided with the item concerning its use;
2. Descriptive materials accompanying the item which explain or depict its use;
3. National and local advertising concerning its use;
4. The manner in which the item is displayed for sale;
5. Whether the owner, or anyone in control of the item, is a legitimate supplier of like or
related items to the community, such as a licensed distributor or dealer of tobacco
products;
6. Direct or circumstantial evidence of the ratio of sales of the item (s) to the total sales
of the business enterprise;
7. The existence and scope of legitimate uses of the item in the community; and
8. Expert testimony concerning its use.
F. Any device used for the consumption of medical marijuana shall be considered
legal to be sold, manufactured, distributed, and possessed.
SECTION FOUR (4): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid, or ineffective, the
remaining portion shall not be affected, but shall remain in full force and effect.
SECTION FIVE (5): CODIFICATION
This ordinance shall be codified in Part Ten (10) Offenses and Crimes, of the Owasso Code of
Ordinances.
SECTION SIX (6): REPEALER
That all ordinances or parts of ordinances in conflict herewith be, and the some are hereby
expressly repealed.
SECTION SEVEN (7): FILING OF ORDINANCE
That there be filed in the office of the County Clerk of Tulsa County, Oklahoma, a true and
correct copy of this Ordinance.
SECTION EIGHT (8): DECLARING AN EFFECTIVE DATE
The provisions of this ordinance shall become effective thirty (30) days from the date of final
passage as provided by state law.

MORALS, OF THE CODE OF ORDINANCES, CITY OF OWASSO, OKLAHOMA, AMENDING
SECTION 10 -201, PETIT LARCENY PROHIBITED; AMENDING SECTION 10 -424 , EMBEZZLEMENT
PROHIBITED; AMENDING SECTION 10 -417, DEFRAUDING HOTELS, RESTAURANTS, AND OTHER
SERVICE PROVIDERS; AMENDING SECTION 10 -425, OBTAINING PROPERTY BY TRICK OR
DECEPTION, FALSE REPRESENTATION, OR PRETENSE; REPEALING SECTION 10 -415, HARMFUL
DECEPTION; ESTABLISHING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA
THAT TO WIT:
SECTION ONE (1): Section 10 -201 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 10 -201 PETIT LARCENY PROHIBITED
A. Petit larceny is the taking of personal property of value less than $1,000.00,
accompanied by fraud or stealth and with the intent to deprive another thereof,
provided that it does not include the taking of such property from the person of
another.
B. Petit larceny is unlawful, and any person who commits petit larceny shall be guilty
of a misdemeanor and shall be punished by a fine of not less than $10.00 or more than
$500.00, or by imprisonment of not more than 60 days, or both such fine and
imprisonment.
SECTION TWO (2): Section 10 -424 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 10 -424 EMBEZZLEMENT PROHIBITED
A. It shall be unlawful for any person to knowingly embezzle money, property, or
anything of value from any other person, corporation or legal entity. Any person who
commits embezzlement shall be guilty of a misdemeanor and shall be punished by a
fine of not more than $750.00, or by imprisonment of not more than 60 days, or by both
such fine and imprisonment.
B. Embezzlement is defined as the fraudulent appropriation of money or property of
value less than $1,000.00, owned by any person, corporation or legal entity, for any use
or purpose not intended or authorized by its owner, or the concealment of the
property with the fraudulent intent to appropriate it to such use or purpose.
Embezzlement does not require a distinct act of taking, but only a fraudulent
concealment, appropriation, conversion, or use of the property.

SECTION THREE (3): Section 10 -417 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 10 -417 DEFRAUDING HOTELS RESTAURANTS AND OTHER SERVICE PROVIDERS
A. It shall be unlawful for any person to obtain food, lodging, services, or other
accommodations at any hotel, inn, restaurant, boarding house, rooming house, motel,
apartment house, apartment, rental unit, or other service provider with the intent to
defraud the owner or keeper thereof, of a value less than $1,000.00. Proof that the
lodging, food, services, or other accommodations were obtained by false pretense or
by false or fictitious show, or that a check was given where payment was refused, or
that the person left the hotel, inn, restaurant, boarding house, rooming house, motel,
apartment house, apartment, rental unit, or other service provider without payment or
offering to pay for such food, lodging, services or other accommodation, shall be
prima facie proof of the intent to defraud. Provided that this section shall not apply
where there has been an agreement in writing for delay in payment.
B. Any person who violates this section shall be guilty of a misdemeanor and shall be
punished by a fine of not more than $500.00, or by imprisonment of not more than 60
days, or by both such fine and imprisonment.
SECTION FOUR (4): Section 10 -425 of the Code of Ordinances of the City of Owasso, Oklahoma,
is hereby amended to read as follows:
SECTION 10 -425 OBTAINING PROPERTY BY TRICK OR DECEPTION FALSE REPRESENTATION
OR PRETENSE
A. It shall be unlawful for any person, with the intent to cheat and defraud, to obtain
or attempt to obtain from any person, firm, or corporation any money, property or
valuable thing, of a value less than $1,000.00, by means or by use of any trick or
deception, or false or fraudulent representation or statement or pretense, or by any
other means or instruments or device commonly called the "confidence game," or by
means or use of any false or bogus checks, or by any other written or printed or
engraved instrument or spurious coin.
B. Any person who violates this section shall be guilty of a misdemeanor and shall be
punished by a fine of not more than $750.00, or by imprisonment of not more than 60
days, or by both such fine and imprisonment.
SECTION FIVE (5): REPEALER
Section 10 -415 pertaining to Harmful Deception shall be repealed in its entirety.
SECTION SIX (6): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid, or ineffective, the
remaining portion shall not be affected, but shall remain in full force and effect.
SECTION SEVEN (7): CODIFICATION
This ordinance shall be codified in Part 10, of the Owasso Code of Ordinances.

BACKGROUND:
This is a condemnation matter filed by the City of Owasso against Key Plus Properties, LLC, to
obtain property deemed necessary for the East 1161h Street North and North Garnett Road
Intersection Improvement Project. The parties to this litigation have mutually declared their
willingness to participate in mediation. For purposes of mediation, it is necessary for the City of
Owasso to designate a settlement representative and give that representative full and final
settlement authority. Staff recommends the City Manager, Warren Lehr, be designated as the
City's representative and given full and final settlement authority.
PROPOSED ACTION:
Approval of proposed Resolution 2020 -05, conferring full and final settlement authority upon the
City Manager, or his designee if necessitated, and additionally naming the City Manager or his
designee as the City's representative at the scheduled mediation.
RECOMMENDATION:
Staff recommends the City Council designate the City Manager, Warren Lehr, as the City's
authorized settlement representative for mediation in the case of City of Owasso v. Key Plus
Properties, LLC, and additionally confer full and final settlement authority upon the City Manager
in this matter through approval of proposed Resolution 2020 -05, memorializing the same.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso I Roger Stevens is hereby granted this Tier I Permit to
construct 7,200 linear feet of eight (6) inch PVC potable water line and all appurtenances to serve the Stone
Creek of Owasso, located in Section 34, T -21 -N, R -14 -E, Rogers County, Oklahoma, in accordance with
the plans approved February 3, 2020.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance with
the "Oklahoma Pollutant Discharge Elimination System Standards - OPDES" (OAC 252:606) rules and to
comply with the state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of approval
or the phases not under construction will be resubmitted for approval as a new project.
3) That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:656- 5- 4(c)(3) of the standards for Water
Pollution Control Facility Construction.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 10 gallons per inch of pipe
diameter per mile per day.
6) That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.
7) That the permittee will take steps to assure that the connection of house services to the sewers is
done in such a manner that the functioning of the sewers will not be Impaired and that earth and
ground water will be excluded from the sewers when the connection is completed.

8) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the construction
of this project.
9) That the recipient of the permit is responsible for the continued operation and maintenance of these
facilities in accordance with rules and regulations adopted by the Environmental Quality Board, and
that this Department will be notified in writing of any sale or transfer of ownership of these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
11) That the permittee is required to inform the developer /builder that a DEQ Storm Water Construction
Permit is required for a construction site that will disturb one (1) acre or more in accordance with
OPDES, 27A O.S. 2 -6 -201 et. seq. For information or a copy of the GENERAL PERMIT (OKR10)
FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES, Notice of Intent
(NOI) form, Notice of Termination (NOT) form, or guidance on preparation of a Pollution Prevention
Plan, contact thq Storm Water Unit of the Water Quality Division at P.O. Box 1677, Oklahoma City,
OK 73101 -1677 or by phone at (405) 702 -8100.
12) That all manholes shall be constructed in accordance with the standards for Water Pollution Control
Facility Construction (OAC 252:656 -5 -3), as adopted by the Oklahoma Department of
Environmental Quality.
13) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in Water
Pollution Control Facility Construction OAC 252:656- 5- 4(c)(1) and OAC 252:656- 5- 4(c)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested using the ASTM air test procedure with no detectable leakage prior to backfilling,
in accordance with the standards for Water Pollution Control Facility Construction OAC 252:656-5 -
4(c)(3). —
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will constitute
acceptance of the permit and all conditions and provisions.
