CALL TO ORDER 2. ROLL CALL 3. Approval of Minutes from the February 27, 2007 Regular Meeting — Charles Brown moved to approve the minutes of February 27, 2007. Ken Foster seconded. AYE: Foster, Ramey, Brown, Hauser NAY: None The motion carried 4 -0. 4. OBOA -07 -04 — Duffy - A request for a variance to allow the reduction of 5' of the required 10' side yard setback to 5' to allow for the construction of a swimming pool, located at 9316 North 103 East Avenue. Joe Ramey presented the item and Chip reviewed the staff report. Staff received an application for a variance to allow the reduction of 5' of the required 10' side yard setback to 5' to allow for the construction of a swimming pool. The pool location had been inadvertently moved 4' from its original location on the site plan. Notification letters were mailed to property owners within 300 feet of the property and the request was advertised in the Owasso Reporter. Staff does recommend approval of OBOA 07 -04. Mr. Duffy was present and answered several questions pertaining to the variance. Mr. Duffy explained that a sewer easement runs through the rear yard making it difficult to slide the pool to the west. Ken Foster moved to approve the variance request; Charles Brown seconded the motion. A vote on the motion was recorded as follows: AYE: Foster, Brown, Hauser, Ramey NAY: None The motion carried 4 -0. BOARD OF ADJUSTMENT March 27, 2007 Page 2 of 3 OBOA -07 -05 — Castle Point — A request for a variance to allow the reduction of 30' of the required 50' building line to 20' on property zoned CG (Commercial General) and OM (Office Medium), located at Lot 1, Block 1, Castle Point Commercial Park, just north of The Children's Depot. Joe Ramey presented the item and Chip reviewed the staff report. The applicant is requesting a variance to allow for the reduction of the required 50' building line to 20' to allow for the construction of a multi -story office facility. It will improve the buffer distance between the existing residential development to the east and the proposed office use. Letters were mailed to all property owners within three- hundred (300) feet and the request was advertised in the Owasso Reporter. Staff recommends approval. The architect for the project answered several questions. Mr. Bob Seay (8806 North 121 East Avenue) had several questions regarding the distance from the residential property and the screen fencing on the east side. He also asked about light pollution and the outdoor trash receptacle. Trish Hauser moved to approve the request; Charles Brown seconded the motion. A vote on the motion was recorded as follows: AYE: Foster, Ramey, Hauser, Brown NAY: None The motion was approved 4 -0. 6. OBOA -07 -06 — All American Fitness — A request for a variance to allow the reduction of 15' of the required 50' building line to 35' on property zoned CS (Commercial Shopping), located on Lot 2, Block 1, Tyann Plaza IX. Joe Ramey presented the item and Chip reviewed the staff report. The applicant is requesting a variance to allow for the reduction of the required 50' building line to 35' to allow for the construction of a commercial facility. The proposed structure is to be constructed 15' over the northwestern building line in order to facilitate safe vehicular traffic flow and parking. Letters were mailed to property owners within three- hundred (300) feet of the property and the request was advertised in the Owasso Reporter. Staff recommends approval of OBOA- 07 -06. Steve Compton was present to address any concerns. Ken Foster moved to approve the request; Trish Hauser seconded the motion.
