Main (west side) at 10:30 am on March 5, 2020. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. Preliminary Plat - 13000 Center Consideration and appropriate action relating to the request for the review of a preliminary plat proposing three (3) lots in one (1) block on approximately 2.77 acres: The property location is 13006 East 961h Street North. Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the February 19, 2020 meeting. The applicant was present to address any questions. Staff recommends approval of the preliminary plat. A brief discussion was held regarding the extension the 30' mutual access easement on the east side of the property. The proposed lot split would split the north seventy -five feet (75') including the alley from the parent tract leaving a 6,367 square foot lot. The property is located at 123 East Broadway. Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the February 19, 2020 meeting. Chairperson Vice Chairperson Date I REAL People • REAL Character REAL Community TO: Owasso Planning Commission FROM: Karl Fritschen AICP, RLA Jurisdiction Planning Manager SUBJECT: Annexation (OA 20 -01) - 12525 E 1 16th St North DATE: May 8, 2020 BACKGROUND: The Community Development Department received a request for annexation of property located at 12525 E 116th Street North (northwest corner of the intersection of 126th East Avenue and 1 16th Street North). The subject property is approximately 8.722 acres in size and is currently zoned AG (Agriculture) in Tulsa County. Upon annexation, the property would be brought into Owasso City Limits as AG (Agriculture). The applicant indicated that after annexation they will pursue an application for a PUD consisting of RM and CS zoning to accommodate a skilled nursing facility. The subject property contains one small residential home towards the south half of the property, which the applicant indicated will remain as an office supporting the skilled nursing center. The GrOwasso 2030 Land Use Master Plan identifies the subject property for commercial land uses. The City of Owasso will provide sanitary sewer, Fire, Police, and EMS to the property upon annexation. Water service will be provided by Washington County Rural Water District #3. Any future development that occurs on the subject property must adhere to all Owasso subdivision, zoning, and engineering requirements. Any future rezoning cases for this property would be evaluated using the GrOwasso 2030 Land Use Master Plan. RECOMMENDATION: Staff recommends approval of the annexation request (OA 20 -01), annexing the subject property into Owasso City Limits with the zoning of AG (Agriculture). The property is located northeast of the intersection of East 106'h Street North and Garnett Road. The property lies within PUD 17 -OIA (Ordinance 1154) and is zoned Residential Single - Family High Density (RS -3), Residential Multi - Family (RM), and Commercial Shopping (CS). Parker Village is a mixed -use development with commercial, single family and multifamily elements. — — - The project is divided up into one - hundred - twenty (120) lots in seven (7) blocks. Lot 1, Block 7 consists of the area denoted in the PUD for multi - family uses and Lot 1, Block 6 consist of the area denoted for commercial uses. The remaining lots and blocks are identified for single - family residential uses. The plat consists of three (3) reserve areas, "A ", "B" and "C ". Reserve area "A" is identified as a detention and recreation area, while "B" and "C" will be landscape areas inside the single - family portion of the development. Reserve area "A" will also contain a natural wetland area and a larger stand of native trees which will remain and serve as a buffer with the Maple Glen neighborhood to the north. All of the reserve areas will be maintained by the Homeowners Association established with Covenants, Conditions, and Restrictions (CCR's) in the plat. All of the single family lots conform to the dimensional allowances under PUD 17 -01 A. The Plat provides an internal collector road connecting Garnett Road with North 106'h East Avenue. Perimeter and interior utility easements are shown on the Plat that will allow utilities adequate access to provide and maintain service to the proposed development. Stormwater detention has been accounted for with the large detention area denoted as Reserve area "A" on the plat. All internal streets will be public and dedicated to the City. Amenities will be provided in this development as per PUD 17 -01 A. The City of Owasso will provide water service to Block 6 and 7, while the remaining blocks (single family residential area) will have water provided by Washington County Rural Water District #3. The City of Owasso . will provide sanitary sewer, Fire, Police, and EMS services to the entirety of the development. The development that occurs on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso and those found within PUD 17 -01 A, TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee (TAC) reviewed the Final Plat for Parker Village at their regularly scheduled meeting on April 15, 2020. Comments from that meeting have been attached to this memo. RECOMMENDATION: Staff recommends approval of the Final Plat for Parker Village subject to TAC comments. The proposed subdivision accounts for 3.43 acres of the larger 46.04 -acre tract covered in OPUD 14 -01. The PUD prescribes a minimum lot size of 55 feet, and a maximum building height of 2 stories, or 35 feet. The final plat for Brighton Park Phase I consists of 8 lots in 2 blocks on 3.43 acres. Each lot will have a single - family dwelling unit intended for individual ownership. Perimeter and interior utility easements are shown on the Plat that will allow utilities adequate access to provide and maintain service to the proposed development. Stormwater Detention will be required, but will be evaluated at the time civil plans are submitted and reviewed. There is one point of access from the subdivision onto Mingo Road. All internal streets will be public and dedicated to the City. The Plat doesn't include any amenities, as those will be provided when the remaining portion of the property is platted and developed. Per the Owasso Zoning Code Section 9.2.12 at least one (1) amenity shall be installed at the point where 25% of the project is developed. In this case, the proposed number of lots being platted is only 8, which is much less than the 123 the original preliminary plat that was submitted with the PUD identified. The City of Owasso will provide sanitary sewer, Fire, Police, and EMS services to the proposed residential development. Washington County Rural Water District #3 will provide water to the proposed subdivision. The development that occurs on the subject property shall adhere to all subdivision, zoning, and engineering requirements of the City of Owasso, as well as all requirements set out in Ordinance 1032, which established OPUD 14 -01. The property is located approximately 1/4 mile south of East 716 +h Street North on the west side of North 135th East Avenue. Yes US -169 Overlay District OVERVIEW OF UNIFIED SIGN PLANS (USPs): A Unified Sign Plan (USP) is a comprehensive sign permit that establishes the size, location, design, and number of signs in a development. A USP allows City staff to establish signage criteria tailored to the features of a specific development or location. Depending on the characteristics of the development or site, these criteria may vary from the requirements of the Owasso Zoning Code. However, a USP is not intended to be used in a way that circumvents the requirements of the Zoning Code. It is a tool that gives a developer flexibility in meeting their future tenants' signage needs while working with City staff to ensure the approved signage is of a high quality and meets the sprit and intent of the Zoning Code. All USPs must be reviewed by City staff and the Planning Commission to ensure that they meet the following restrictions as set by the Owasso Zoning Code: 1. All USPs shall include the location, size, height, construction material, color, type of illumination, and orientation of all proposed signs. 2. All USPs shall be reviewed by the Owasso Planning Commission and shall conform to all conditions imposed by the Commission. 3. USPs shall include all signage to be located within the perimeters of the subject site whether in excess of the provisions of the current sign code or not. 4. USPs may not propose a total sign square footage exceeding three (3) square feet of signage per every one (1) linear foot of street frontage of the subject property. 5. USPs may not include any prohibited sign. ANALYSIS: The subject USP involves Lot 3 of Garrett Creek Center Phase II and Lot 2 Block 1 of The Re -Plat of Lot 2, Block 1 of Garrett Creek Center Phase II. The entire property will be developed with commercial uses and is located just west of US -169 and south of East 116th Street North on North 1351h East Avenue. The subject property has approximately 1,271 linear feet (LF) of frontage on North 135th East Avenue /US -169. Specifically, this request involves consideration for an amendment to a previously approved (USP) that was brought to the Planning Commission in September 2018 (attached). At the time when that USP was being processed there were two (2) lots created along North 135th East Avenue that were part of a re -plat of the original Garrett Creek Phase II property. The re -plat was approved just before the USP application was made. A site plan application immediately followed for a new Utica Park Clinic facility on lot 2 created from the replat. Due to the timing of these applications being reviewed relatively close together, there was an error made with regards to the sign permit that was submitted for Utica Park Clinic and it was built eighteen (18) feet in height, where it should have been restricted in height to eight (8) feet under the USP. The original USP included five (5) monument signs for seven parcels fronting North 1351h East Avenue and one (1) forty (40) foot pylon sign. The amended USP calls for two pylon signs thirty (30) feet in height and four (4) eight (8) foot tall monument signs for six frontage lots (See attached exhibit). The proposed pylon signs are located approximately 673' apart. The main difference between the original USP and the proposed amendment is the elimination of the monument sign on the Utica Park Site, as this sign has already been built to a height greater than what the original USP allowed, and replacing the forty (40) foot pylon sign with two thirty (30) foot pylon signs. The applicant indicated that as development plans move forward for this property, additional Replat or Lot Split applications may be forthcoming to create more lots within the development. These additional lots will likely take the form of several individual lots having frontage on North 135th East Avenue. The layout is anticipated to consist of restaurants and other businesses occupying standalone buildings along the public street frontage and larger shared multi- tenant buildings, box stores, and other businesses set back from the street behind the individual outparcel lots. The Conceptual Site Plan included with this USP shows proposed sign locations, but it will allow some degree of flexibility. The tentative sign placement shown on the Conceptual Site Plan may change as the number and size of lots within the development are determined. However, the number of approved signs will not increase and all ground signage on the property will be restricted to this USP, should it be approved. The exact sign locations will be dictated by the future outparcel development along North 1351h East Avenue. As more lots are created and development plans progress, the developer will be required to establish the specific location of each sign using each lot's required Site Plan that goes before TAC for review and approval. No other signs would be allowed under this USP other than wall signs and wayfinding signs. In summary the applicant is gaining one additional pylon sign, but each of them will be 10 feet shorter that the one that was originally allowed. Further, the ratio of allowed monument signs essentially stays the same with four (4) signs on six (6) lots compared with five (5) signs on seven (7) lots as allowed under the previous USP. In terms of sign square footage, the amended USP as proposed by the applicant would result in a total of 920 square feet of signage area. This number meets the requirement for USPs in the Owasso Zoning Code in that the total sign square footage not exceed three (3) square feet of signage per every one (1) linear foot of street frontage of the subject property. Also of note is that these square footage calculations do not include the square footage of wall signs and wayfinding signs in the development that will be allowed outside of the restrictions of the USP. Overall, the USP is a good tool to use for larger commercial areas that will have less visible development behind outparcels, while adding a level of predictability and design uniformity. It is important to also consider what the signage in the development could look like if a USP is not utilized. As this property has extensive frontage on US -169, it is possible that without the USP, there would be multiple twenty -five (25) foot high pole signs for all lots in the development with frontage on US -169. This is noteworthy because the total number of lots that will have frontage in this development is currently unknown. Allowing each outparcel development to have their own pole sign would result in a cluttered non - uniform look along the frontage and be visually unattractive. All signs in this USP would be required to adhere to all sign requirements in the Owasso Zoning Code, including the requirement that all signs be placed within a landscaped bed per US -169 Overlay District requirements. TECHNICAL ADVISORY COMMITTEE REVIEW: This item was taken to the TAC for review on April 15, 2020. Comments from the TAC meeting are attached to this memo. RECOMMENDATION: Staff recommends approval of the Amended Unified Sign Plan (OUSP 20 -01) with the following conditions: 1. The maximum allowed signage within the development under the USP, excluding wall signs and wayfinding signs, is four (4) monument signs and two (2) multi- tenant pylon signs as indicated in the attached Comprehensive Sign Plan document. 2. The Declarant intends (but shall not be obligated) to erect two (2) freestanding Pylon Sign Structures in Replat Center II at the approximate locations designated on the Site Plan attached hereto and made a part hereof as Exhibit `B ", such locations to be in the sole and complete discretion of the Developer and subject to change with the approval of the City of Owasso, including (without limitation) cabinets and wiring for the Signage Area, upon which certain identification panel(s) for Panel Beneficiaries may be installed, replaced and maintained. Each Panel Beneficiary's allocable share of the Costs shall be based, in part, on the portion of Signage Area assigned to each Panel Beneficiary, even if such Signage Area is not used. The size and location of the identification panel in the Signage Area shall be determined by the Declarant in its sole and complete discretion. Initially, the design of the Pylon Sign Structures, including the space for the various Signage Areas, shall be as shown on Exhibit "A" attached hereto; provided, however, the plan and design of the Pylon Sign Structures is subject to modification, correction, replacement and/or termination by the Declarant in its sole and complete determination, and subject to approval by the City of Owasso, in which case this Comprehensive Sign Plan shall be updated with a new Exhibit "A ". Monument signs (including the design of the sign base, as well as the sign area itself) shall compliment the architecture of the building on the Lot, and shall be constructed of such materials similar to those used on the building on the Lot. All monument signs shall be setback at least 10feet from the property line, shall not obscure driveway or intersection line -of -sight for vehicles or pedestrians, and shall not obstruct utility services. Each Lot Owner in the Comprehensive Sign Tracts, prior to construction of its monument sign, shall, at its sole cost and expense, (i) obtain Declarant's written approval of its monument sign plan; (ii) obtain all permits and governmental approvals required for such installation, (iii) obtain casualty insurance in an amount not less than $1,000,000.00 per occurrence and $2,000,000.00 in the aggregate, designating the Declarant and the Association as additional insureds and loss payees, and deliver to Declarant and Association prior to construction of its sign; and thereafter (iv) construct, maintain and /or replace the monument sign pursuant to City of Owasso sign plan requirements, and in a safe condition and good state of repair. Notwithstanding anything in this document to the contrary, as of the recording date of this Comprehensive Sign Plan, there are four (4) lots with frontage on 135 °i East Avenue that are subject to the rights of installation of a monument sign. In the event the lots subject to monument sign rights are split or divided, there shall be no more than four (4) monument signs installed under the terms of this Comprehensive Sign Plan and the Developer, in its sole discretion, shall have the right to determine which frontage lots shall have monument signage rights. OCCUPANT SIGNS. In addition to the Pylon Sign requirements set forth herein, buildings in the Comprehensive Sign Tracts shall be permitted to affix identification signage to the building provided such Occupant sign is in compliance with Owasso Zoning Code. TEMPORARY SIGNS. Temporary signs which comply with the Owasso Zoning Code are permitted on all Lots within the Comprehensive Sign Tracts and shall only be erected after the applicant receives such sign permit from the City of Owasso. 5. FOR SALE SIGNS. For Sale, For Rent, or For Lease signs which comply with the Owasso Zoning Code are permitted on all Lots within the Comprehensive Sign Tracts and shall only be erected after the applicant receives such sign permit from the City of Owasso. 6. CONSTRUCTION AND PROJECT SIGNS. Construction and Project signs which comply with the Owasso Zoning Code are permitted on all Lots within the Comprehensive Sign Tracts and shall only be erected after the applicant receives such sign permit from the City of Owasso. ARTICLE III MISCELLANEOUS 1. ENFORCEMENT: The Declarant and/or Association shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter imposed by the provisions of this Comprehensive Sign Plan; provided, however, the Declarant shall not be obligated to enforce any condition, covenant, restriction, reservation, lien or charge through legal proceedings or otherwise. Failure by the Declarant or by the Association to enforce any provision herein contained shall in no event be deemed a waiver of the right to do so thereafter. 2. NO WAIVER: The failure of the Declarant or the Association to enforce any given provision herein at any time, and from time to time, shall not be deemed to be a waiver or relinquishment of any right or remedy, nor a modification of the provisions of this Comprehensive Sign Plan. 3. SEVERABILITY: Invalidation of anyone of these provisions by judgment or court order shall in no way affect any other provisions which shall remain in full force and effect. 4. BINDING EFFECT; AMENDMENT: The provisions of this Comprehensive Sign Plan shall run with and bind the land, and shall be binding upon all parties and all persons claiming under them, and shall inure to the benefit of and be enforceable by the Declarant and /or the Association, their respective legal representatives, successors and assigns. The provisions of this Comprehensive Sign Plan may be amended, in whole or in part, modified, added to or changed at any time by an instrument signed by the Declarant until such time as Declarant no longer owns any property in the Comprehensive Sign Tracts, at which time thereafter at any time by an instrument signed by the Association. Any amendment must be properly recorded. 5. CHOICE OF LAW/VENUE /ATTORNEY FEES: This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma. Exclusive venue for any action brought in connection with this Comprehensive Sign Plan shall lie in Tulsa County, Oklahoma. If legal proceedings are instituted in connection with the rights or enforcement of the remedies provided herein, the prevailing party shall be entitled to recover its costs and expenses including, without limitation, reasonable attorneys' fees. 6. COMMON AREA GROUNDS: Maintenance of the ground area around Pylon Sign shall be performed by the Association in accordance with the applicable declarations of covenants, conditions and restrictions.
