for the East 116th Street North and North 1291h East Avenue Intersection Improvements

Staff recommends approval of the Utility Relocation Agreement between the City of Owasso
and Washington County Rural Water District #3 for the relocation of a water line and all
related appurtenances and authorization to execute the necessary documents.
14. Consideration and appropriate action relating to the acquisition of right -of -way and
easement for the East 116th Street North from Mingo to Garnett Road Roadway Improvement

Staff recommends authorization for payment to the Joy Ann Biggs Revocable Living Trust in
the amount of $27,769.00, for the acquisition of right -of -way and easement, located at 9727
East 1 16th Street North.
15. Consideration and appropriate action relating to a budget amendment for Coronavirus Aid,
Relief and Economic Security (CARES) Act reimbursement

Staff recommends approval of a budget amendment in the General Fund, increasing the
estimated revenue and the appropriation for expenditures by $490,000.00.
16. Consideration and appropriate action relating to a budget amendment for fiscal year end
supplemental appropriations of excess sales tax revenue

estimated revenue and the appropriation for expenditures by $566,410.00.

Tuesday, June 2, 2020
The Owasso City Council met in regular session on Tuesday, June 2, 2020, in the Council Chambers at Old
Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting filed December 13, 2019;
and the Agenda filed in the office of the City Clerk and posted at City Hall, 200 South Main Street, at 6:00
pm on Friday, May 30, 2019. As a result of the COVID -19 Pandemic and the health threats posed by such
pandemic, this meeting was available for public viewing through YouTube Live Stream.

Michele Dempster, Character Council Member, presented the character trait for the month of June.

G. Authorization to submit a request to the Tulsa County Vision Authority to amend the Vision
2025 Capital Improvement Agreements for the Community Center Outdoor Classroom and
Gathering Area Project and Owasso Events Facilities - Sports Park Project #2 by extending
the expiration term for each agreement

Mr. Bush moved, seconded by Mr. Bonebrake to approve the Consent Agenda with City Council
claims totaling $434,045.17, Owasso Public Works Authority claims totaling $746,307.68, and Owasso
Public Golf Authority claims totaling $14,617.74.

Consideration and appropriate action relating to items removed from the Consent Agenda

8. PUBLIC HEARING - The City Council will conduct a public hearing for the purpose of receiving citizen
input relating to the proposed FY 2020 -2021 Annual Operating Budget
Warren Lehr and Linda Jones presented the item. At 7:01 pm, the Mayor opened the Public Hearing for
comment. There were no comments from the audience. At 7:01 pm, the Mayor closed the public
hearing.
9. Consideration and appropriate action relating to the acquisition of right -of -way and easement for the
East 116th Street North from Mingo to Garnett Road Roadway Improvement Project
Roger Stevens presented the item, recommending authorization for payment to Dale W. Baker, in the
amount of $60,417.45, for the acquisition of right -of -way, easement, and compensation for damages at
11607 North 101st East Avenue.
There were no comments from the audience. After discussion, Mr. Bonebrake moved, seconded by Mr.
Bush to authorize payment, as recommended.

10. Report from City Manager /Authority Manager
Warren Lehr introduced Roger Stevens to provide the monthly Public Works project status report. Mr.
Lehr reported on the 2020 Economic Summit, Gathering on Main, Grand Opening for Redbud Festival
Park, Red White and Boom, the Museum and Community Center, Municipal Court, Utility Billing
payment policy procedures, and the COPS Grant.

entered into the executive session. At 9:28 pm, the City Council and Mr. Lehr returned to open session.

Economic Summit, Drive -Thru notarization services at City Hall for absentee ballots, anticipated
budget amendments related to the Coronavirus Aid, Relief, and Economic Security (CARES)
ACT proceeds, resuming utility payment policy procedures on July 1, 2020; and the Grand
Opening for Redbud Festival Park.

BACKGROUND:
The current Hale Acres Sanitary Sewer Line Rehabilitation Project is funded utilizing the 2016, 2017,
2018, 2019, and 2020 Community Development Block Grant (CDBG) funding cycles. Previous
contracts were executed between Tulsa County and the City of Owasso for the utilization of these
funds for the sewer line work. The contract documents for the 2018 and 2019 funding cycles are
set to expire June 30, 2020.
The Tulsa County Board of County Commissioners and Indian Nations Council of Governments
( INCOG) are requesting Contract /Agreement Renewal documents be executed by the City
Manager, extending both contract dates to June 30, 2021. Once the City Manager has signed
the renewal documents, they will be returned to INCOG and taken before the Tulsa County Board
of County Commissioners for the Chair's signature.
RECOMMENDATION:
Staff recommends authorization to execute the 2018 and 2019 Hale Acres Sanitary Sewer
Rehabilitation Project Contract /Agreement Renewal documents submitted by INCOG, extending
the Contract /Agreement expiration term to June 30, 2021.

ANALYSIS:
The property is currently zoned RE in Tulsa County and is contiguous with city limits on the western
boundary of the property. The applicant is requesting the property be assigned a corresponding
zoning of CS upon annexation via a concurrent rezoning request (OZ 20 -02). Typically, property is
annexed either under Agriculture (AG) zoning or as the County's corresponding zoning
designation under the Owasso Zoning Code. However, an applicant may request an alternate
zoning be applied if it corresponds to the Land Use Master Plan. In this case, the GrOwasso 2030
Land Use Master Plan identifies the subject property for commercial land uses. Therefore,
assigning a zoning of CS to the property upon annexation is appropriate.
The subject property is currently used for residential purposes, as two homes presently occupy
each of the two lots. The applicant intends to develop the property for commercial purposes.
Further, the proposed commercial uses will complement the existing commercial uses to the
south and west of the subject property. It should be noted, that the applicant successfully
obtained the necessary signatures to release the private covenant that restricted the subject lots to
residential uses only. State Statute requires 60% of the lot owners must approve the release of such
restrictions. The applicant was successful in this effort and filed the required paperwork with Tulsa
County.
The City of Owasso will provide water, sanitary sewer, Fire, Police, and EMS to the property upon
annexation. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements.
PLANNING COMMISSION:
The Planning Commission voted 3 -0 to recommend approval of OA 20 -02 and OZ 20 -02 at their
regular meeting on June 8, 2020.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1167, approving annexation request OA 20 -02 and
rezoning OZ 20 -02.

WHEREAS, public hearings have been held regarding the request for annexation and
rezoning of the property described as 12901 & 12925 East 76th Street North; and,
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso

ACRES, a Sub - Division of Tulsa County, State of Oklahoma, according to the Recorded Plat
thereof, and
WHEREAS the Plat and Deed of Dedication of said GRACELAND ACRES were recorded
in the office of the Tulsa County Clerk on July 10, 1956 as Plat No. 2095, and
WHEREAS said Deed of Dedication contained Protective Covenants including the
following:
111. All lots in the Tract shall be known and designated as Residential lots. No
structure shall be erected, altered, placed or permitted to remain on any Residential
Lot Building Plot, other than a one detached single - family dwelling, and a private
garage for not more than three cars." and
WHEREAS the undersigned owners agree that changes in circumstances have made it
unreasonable and unfair to enforce the quoted Protective Covenant against all of the lots in the Sub-
Division, and it is in the best interests of the lot owners to promote the best use of each - others
property and promote harmony among the lot owners,
NOW, THEREFORE, the undersigned owners of lots in GRACELAND ACRES agree to
amend, and do hereby amend the Deed of Dedication of said GRACELAND ACRES by deleting the
above - quoted Paragraph 1 in its entirety and substituting therefor the following:
"1.A. All lots in the Sub - Division, except for Lots Seven (7) and Eight (8), Block Four (4),
shall be known and designated as Residential Lots. No structure shall be erected, altered, placed or
permitted to remain on any Residential Building Lot other than one detached single - family dwelling,
and a private garage for not more than three cars. A Residential Building Lot shall be defined as any
platted lot or part of a lot that has been granted `lot -split approval' by the municipal or regional
planning authority having jurisdiction over the Sub - Division.
"1.B. Lots Seven (7) and Eight (8), Block Four (4) may be used either for commercial,
business, or residential purposes at the election of the lot owner(s).
Attached to this Amendment is a Special Certificate of Smith Brothers Abstract identifying
by name the owners of all of the lots contained in Graceland Acres.
This Amendment shall be effective on the 21 st day of January, 2020.

BACKGROUND:
The Community Development Department received a Planned Unit Development (PUD)
application for the Owasso Assisted Living Center, a proposed assisted living development. The
subject property is located north and west of the intersection of East 116th Street North and North
126th East Avenue. The property is approximately 8.722 acres in total size but will be treated as
two separate development areas. The southern area (Development Area A) will be
approximately 2.978 acres in size, and the northern (Development Area B) will be approximately
5.734 acres in size. The property was recently annexed under Ordinance 1166, adopted by the
City Council on May 19, 2020, and was assigned a zoning of Agriculture (AG). A separate
rezoning request (OZ 20 -01) was concurrently filed with this PUD, requesting that the southern
2.978 acres of this property be given a zoning designation of Commercial Shopping (CS) and the
northern section a Residential Multi - Family (RM) designation.

CONCEPT OF A PUD:
A planned unit development, also known as a PUD, is a development concept that allows for
greater creativity and flexibility than typically allowed under traditional zoning and planning
practices. For example, PUDs often allow developers to place different zonings and land uses in
close proximity to each other. Developers may also have more flexibility in certain aspects of
development, such as building setback requirements and building height limitations, which can
be more restrictive in standard zoning districts. However, a PUD should not be considered a tool
to circumvent the City's Zoning Code and Subdivision Regulations. All aspects of the PUD
application are subject to public comment as well as consideration from the Community
Development Department, Owasso Technical Advisory Committee, Owasso Planning
Commission, and approval by the Owasso City Council.
ANALYSIS:
Owasso Assisted Living Center is a proposed residential assisted living facility. The subject property is
proposed to be broken into two different areas: a northern development area (Development Area
B) and a southern area (Development Area A). Development Area A currently contains a single -
family dwelling unit, which will be used as office space and the Director's residence until such time
as the tract is sold and redeveloped for commercial uses.
The residential care facility will be constructed within Development Area B and will house individuals
who need assistance with daily activities, including individuals who need memory care services. The
proposed development has the ability to bring new, high skilled jobs to the City, as nurses and other
medical professionals will be needed to staff the assisted living center.
An annexation request was approved last month by City Council for the subject property with a
zoning of AG applied to the property (Ordinance 1166). In order to accommodate the proposed
uses, the zoning of AG needs to be changed. As such, a rezoning request was submitted
concurrently with this PUD application. The applicant is seeking to apply CS zoning to Development
Area A. The office space and accessory director's residence proposed for Development Area A
are allowed within the CS zoning category, under the proposed PUD 20 -01.
The applicant is also seeking to change the zoning designation in Development Area B to
Residential Multi- Family (RM) in order to accommodate the assisted living facility. The RM zoning
category allows for the highest possible density residential development, with >12 DU /Ac
allowed; the proposed 16.542 DU /Ac meets the allowable density. Allowed uses in the RM district
include apartments, duplexes, senior assisted living facilities, and townhomes. All development
that proposes an RM zoning, except for single - family detached housing, are required to utilize the
PUD process to gain approval.
There will be three (3) points of access into the property; one from East 1 16th Street North and two
from North 126th East Avenue. Additionally, the PUD document states that in the event the property
is split, there will be wording in the plat covenants that provide for mutual parking privileges
between developed areas. There is a City of Owasso street widening project in progress for East
116th Street North, between Garnett Road and North 129th East Avenue that will affect the
properties southern boundary. Internal access and final access locations will be finalized during the
platting and site planning stages of development.
Street yards with landscaping will be installed along the site's frontage on East 116th Street North
and North 126th East Avenue as required by code as well as a twenty (20) foot buffer yard, with a six
(6) foot opaque fence, and landscaping along the north boundary of the property in order to
protect the existing surrounding residential development. A single monument style ground sign for
the Assisted Living Center (Development Area B) will be allowed on East 116th Street North, in
Development Area A. The sign will be limited to six (6) feet in height and forty -two (42) square feet in
surface area. Additionally, the applicant has asked that Development Area A be allowed a sign

for any future commercial development. Staff is supportive of this request as two ground signs are
allowed on Development Area A because it has frontage on two public streets.
The proposed PUD meets the amenity requirements as required in the Owasso Zoning Code.
Amenities to be provided include, but are not limited to, a courtyard and walking paths for passive
and active recreation and are described in the Conceptual Site Plan. The project will be required
to provide stormwater detention onsite, with the design and placement of such stormwater
detention areas to be determined during the engineering and platting phase of development.
Parking areas meet the requirements of the Owasso Zoning Code in that the project provides 1
space per 3 beds, plus 1 space for each employee working during the largest shift.
The City of Owasso will provide sanitary sewer, Fire, Police, and EMS services to the proposed
development. Washington County Rural Water District #3 will provide water to the proposed
development. If the PUD is approved, the applicant would provide final development plans for
the area being developed for administrative review and approval by City Staff. These plans
shall include civil engineering drawings, landscape plans, drainage plans, and utility plans.
Due to the COVID 19 pandemic, the applicant did not hold a neighborhood meeting but rather
mailed the concept plan to the adjoining neighborhood. The applicant received 3 comments
regarding the proposal.
COMPREHENSIVE PLAN CONSISTENCY:
The GrOwasso 2030 Land Use Master Plan is a document that provides a moderately flexible tool for
evaluating development proposals. Currently, the Master Plan calls for commercial uses on the
subject property. Utilizing the property for a commercial use, like the applicant proposes for
Development Area A, would be consistent with the vision laid out for this property within the Master
Plan. Likewise, using the property for a residential use, like the applicant proposes for Development
Area B, would be a reduction in the intensity of use allowed by the Master Plan. A reduction in the
intensity of a land use is allowed without an amendment to the Master Plan.
The subject property is adjacent to areas called out for commercial land uses on its southern
boundary, and on portions of its eastern and western boundaries. This means the commercial
development proposed in Development Area A, in the southern portion of the site, will be
harmonious with the future surrounding land uses. Similarly, the subject property is adjacent to areas
called out for residential land uses along its northern boundary, as well as on portions of its eastern
and western boundaries. The proposed residential care facility, within Development Area B, will also
serve a residential purpose; therefore, the land use proposed in the northern portion of the property
is agreeable with furniture surrounding land uses.
HARMONY WITH THE EXISTING AND EXPECTED DEVELOPMENT:
The land use proposed in this PUD is both commercial and high density residential. The proposed
commercial land use in Development Area A, in the southern portion of the site, lends itself well
to blending into the commercial corridor along East l 16th Street North envisioned in the Master
Plan. The proposed assisted living facility in Development Area B, in the northern portion of the
site, is well- suited to agree with the future residential district that the Master Plan envisions for the
area north of the property. Further, the proposed PUD is located in an area that is slated to be
the boundary between future commercial and residential land uses. Because of this, the fact
that there are two different proposed land uses for the property is consistent with the vision the
City has for this area. Staff determined the proposed development is in harmony with the
surrounding existing and expected development.

PLANNING ISSUES:
Future planning issues must still be considered if the PUD amendment is approved. If approved,
the applicant will be required to adhere to all City of Owasso subdivision regulations and
engineering requirements.
According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on
any PUD application and determine the following:
1. Whether the PUD is consistent with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development of
surrounding areas.
3. Whether the PUD is a unified treatment of the development possibilities of the project
site.
4. Whether the PUD is consistent with the stated purpose and standards of the PUD
ordinance:
a. To permit innovative land development while maintaining appropriate limitation
on the character and intensity of use assuring compatibility with adjoining and
proximate properties;
b. To permit flexibility within the development to best utilize the unique physical
features of the particular site;
c. To provide and preserve meaningful open space; and
d. To achieve a continuity of function and design within the development.
PLANNING COMMISSION:
The Planning Commission voted 4 -0 to recommend approval of OPUD 20 -01 and OZ 20 -01 at
their regular meeting on June 8, 2020.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1168, approving OPUD 20 -01 and rezoning OZ 20 -01.

II. DESIGN AND INTENT STATEMENT
Owasso Assisted Living Center is a Planned Unit Development (PUD) proposing an assisted living and
commercial development of 8.722 acres (including % of adjacent street rights -of -way) located at the
northwest corner of the intersection of 11611 St. N. and 1261^ E. Ave., in unincorporated Tulsa County (City
of Owasso annexation application pending at time of this writing), Oklahoma.
To meet the growing need in Owasso, the "Owasso Assisted Living Center" proposes an approximately 83-
room residential care facility, of which some units are intended for memory care. The frontage along 116th
St. N. is planned for future commercial development, but the existing dwelling will be used as the facility
director's residence and /or office until market conditions permit commercial development.
At the time this PUD is written, the site is presently in the process of being annexed by request of the
present owner (OA 20 -01).
As planned, the assisted living facility development will feature fully a sprinkled building for fire protection
and solar power for supplemental electricity, to include solar - powered outdoor lighting standards.
By its design, as outlined in the Owasso Zoning Code, this PUD is intended to: provide a unified treatment
of the development possibilities of the project site; encourage creative development of land; promote project
design that is often unseen in conventional development; serve as a tool for intelligent, well - planned, and
quality developments that fit within Owasso's existing neighborhoods and context of the surrounding area;
provide flexibility to allow for the development of properties with unique physical characteristics by
promoting innovative design and providing guidelines which ensure that development is beneficial to the
City of Owasso's future growth (Section 9.1.1). Further, this PUD has been prepared to achieve the 10
specific goals listed in the Owasso Zoning Code: 1. Maintain and Enhance the Quality of Life in Owasso,
2. Provide Opportunities for Urban Infill, 3. Maintain and Promote a Sense of Community, 4. Encourage
Development That Otherwise Could Not Occur on the Site, 5. Preserve and Provide Meaningful Open
Space, 6. Promote Connectivity and Compatibility with Surrounding Development, 7. Inspire Unique and
Thoughtful Development, 8. Support the Development of Strong Neighborhoods, 9. Provide Amenities
Beyond Conventional Development, and 10. Preserve the Physical Characteristics of the Land (Section
9.1.2).
The subject property is presently zoned AG -R in unincorporated Tulsa County, and has been requested to
be assigned a consistent AG Agriculture District upon annexation. In order to permit the land uses and
intensities proposed by this PUD, the Owasso Zoning Code will require the inclusion of certain zoning
districts and certain proportions of underlying zoning districts within the PUD. An accompanying application
is being filed to rezone the commercial frontage to CS Commercial Shopping District and the assisted living

Development Areas are depicted on Exhibit B "PUD Conceptual Site Plan." Commercial Development Area
A is planned for retail- oriented businesses and Development Area B is planned for the assisted living facility.
Although final Development Area boundaries shall be determined by the future subdivision plat(s),
Development Area A corresponds with the underlying CS zoning requested and Development Area B with
the underlying RM zoning requested.

The "Owasso Assisted Living Center" proposes amenities for residents as appropriate for a residential care
facility, including a courtyard and walking paths for passive and active recreation. Zoning Code Section
9.2.12 applies to single - family and multi - family residential developments, as distinguished from residential
care ( "assisted living') facilities. Additional site amenities for residents and their guests may be added as
needed by the facility owners. The Exhibit B "PUD Conceptual Site Plan" represents initial concepts for
amenities.
The Table V -1, Land Use Evaluation Matrix and page V -7 of the of the GrOwasso 2030 Land Use Master
Plan provide that the requested CS zoning is Allowed within the Commercial designation. The requested
RM Residential Multi - Family zoning is understood to be consistent with the Master Plan as it will be
recognized as less intensive than the specific zoning districts Allowed. Existing and proposed zoning are
reflected on Exhibits E and F, respectively.
The PUD will allow the most efficient use of the land which is harmonious with the surrounding land uses,
as represented on Exhibit A, "Aerial Photography & Boundary Depiction." A conceptual development plan
depicting the Development Areas and design features is provided on Exhibit B "PUD Conceptual Site Plan ".
The PUD shall be developed in accordance with the use and development regulations of the City of Owasso
Zoning Code, except as otherwise specified herein. Bulk and area standards within the proposed
Development Standards generally follow those of the proposed underlying CS district for Development Area
A and those of the proposed underlying RM district for Development Area B; where exceptions are
proposed for design flexibility, the concerned bulk and area standard is designated with a "t" symbol in the
tables that follow in Section III of this PUD.
Although Zoning Code Section 9.2.1 would permit at least 143 dwelling units in the proposed underlying
RM zoning district, this PUD will restrict the assisted living facility to 95 total rooms / dwelling units. In
addition to lowering the density otherwise permitted, this PUD will impose higher development standards
than if developed with straight residential zoning.
Allocated commercial or residential density may be transferred to another lot or lots by written instrument
executed by the owner of the lot from which the floor area or residential density is to be allocated and
approved by the Owasso Director of Community Development, provided (1) that the reallocation shall not
exceed 15% of the initial allocation to the lot to which the transfer of floor area or residential density is to
be made unless approved for a PUD Minor Amendment, and (2) the overall densities and intensities, in
terms of dwelling units and nonresidential floor area, shall not exceed those of the initial PUD as approved.
This PUD proposes to establish a conceptual development plan with designation of development areas,
allocation of uses and intensity of uses and development standards and conditions, to be followed by more
specific subdivision plat(s) and commercial detailed site plans for each development.

IV. GENERAL PROVISIONS AND DEVELOPMENT STANDARDS
W.A. ACCESS AND CIRCULATION:
The site has access via 116th St. N. and N. 12611 E. Ave., both presently County roads. A City of Owasso
street widening plan is in design for 1161h St. N. between Garnett Rd. and 129th E. Ave., including the site's
frontage. While drive connection locations and internal access will align with the widening plans and will
be designed during the platting and site planning stages, the conceptual plans for the assisted living facility
are indicated on the Exhibit B "PUD Conceptual Site Plan." Only one (1) point of access will be permitted
to 116t1 St. N. On 1261h E. Ave., a mutual access drive will be constructed on the common line between
the future commercial and assisted living facility lots, and will be secured by mutual access or similar
easement. Subject to land use compatibility, a mutual access or similar easement shall be provided
between Development Area "A" and the lot to the west and at the time of final platting, facilitating east -west
access parallel to 1161" St. N.
Where not in existence, sidewalks along exterior street frontages shall be constructed by the individual lot
developer in accordance with the Owasso Subdivision Regulations. Widening plans presently show a 5'-
wide sidewalk along the site's 1161h St. N. frontage, to be constructed by the City of Owasso. Sidewalks
which are proposed outside of public or private street rights -of -way shall be placed in a sidewalk easement.
Limits of No Access (LNA) will be imposed by the future plat(s) along street frontages, except at approved
street intersections.
W.B. SIGNS: To identify the assisted living facility, a monument style ground sign may be permitted along
1161h St. N. and located within Development Area A, limited to six (6) feet in height and 42 square feet in
display surface area. The ground sign shall be allowed in addition to the one (1) ground sign serving the
host lot as otherwise permitted, provided minimum sign separations are maintained.
Except as otherwise outlined herein and except or as may be approved as a part of any future Unified Sign
Plan (USP), all signage shall comply with the Owasso Zoning Code, and any changes to signage
requirements must be approved by the Community Development Department.
W.C. UTILITIES AND DRAINAGE: The site within the Washington County Rural Water District # 3 (RWD)
water service area. There is an existing 12" waterline along 11 V, St. N. and an existing 4" waterline along
the east side of 126th E. Ave. It is anticipated that the assisted living facility development area will be served
by customary extensions of the existing RWD waterline(s) in the area. Per the City of Owasso atlas data,
there is an existing eight (8) inch sanitary sewerline along the north side of 116th St. N. a few hundred feet
east of the southeast corner of the subject property. This area system drains to the Morrow Lift Station.
Sanitary sewer service plans are in design, but the site will be served. Fire hydrant locations shall be
coordinated with and approved by the Owasso Fire Marshal during platting and commercial site plan stages.
The site contains a small hilltop in a slight ridgeline, is moderately sloped, and drains to the east, north, and
west toward tributaries of Blackjack Creek. An internal stormwater collection and detention system will be
designed and constructed to drain the site to stormwater detention facility(ies), to be sited and designed
during the platting stage. Existing water and sanitary sewer utilities are shown on Exhibit C "Existing
Utilities" of this PUD. This information is per City of Owasso and RWD atlas data and does not reflect the

most recent changes, such as those existing and proposed line extensions relating to the widening of 1161'
St. N.
IV.D. ENVIRONMENTAL ANALYSIS AND TOPOGRAPHY: The site contains a small hilltop in a slight
ridgeline, is moderately sloped, and drains to the east, north, and west toward tributaries of Blackjack Creek.
There are no FEMA- designated Special Flood Hazard Areas within or adjacent to the subject property.
The Soil Survey of Tulsa County, Oklahoma was used to help identify soils types and possible constraints
to development. The site primarily contains Coweta -Bates complex (3 to 5% slopes), with a small strip
along the east side containing Dennis - Pharoah Complex (1 to 3% slopes).
Development constraints associated with these soil types will be addressed in the engineering design phase
of the project. Prior to construction, a geotechnical report will be performed to recommend paving sections
and subgrade design. Soil types and associated slopes and topography are shown on Exhibit D of this
PUD.
IV.E. EXISTING ZONING AND LAND USE: The site is a rural residential tract with a single - family dwelling
and is otherwise generally vacant! agricultural. The site is presently zoned AG -R in unincorporated Tulsa
county and has been requested be assigned a consistent AG Agriculture District upon annexation. An
accompanying application is being filed to rezone the commercial frontage to CS commercial and the
assisted living facility acreage to RM Residential Multi - Family (OZ 20 -01).
IV.F. PLATTING AND SITE PLAN REQUIREMENTS: No building permit shall be issued until a
subdivision plat has been submitted to and approved by the Owasso Planning Commission and the Owasso
City Council and duly filed of record. The required subdivision plat shall include covenants of record
implementing the development standards of the approved PUD and the City of Owasso shall be a
beneficiary thereof. Per Zoning Code Section 11.3, nonresidential buildings within Development Area A
and the assisted living facility in Development Area B shall submit and receive Owasso Community
Development staff approval of a site plan application. The City of Owasso may refer the site plans to the
Owasso Technical Advisory Committee (TAC) for review and recommendations.

IV.G. LANDSCAPING AND SCREENING REQUIREMENTS: Landscaping and screening shall meet or
exceed the requirements of the Owasso Zoning Code at the time of site plan approval and this PUD.
Development Area B will meet the 20% open space, common areas, or amenities requirement as described
in Owasso Zoning Code Section 9.2.2. A screening fence not less than six (6) feet in height and a
landscaped area of not less than 10 feet in width shall be maintained along the boundaries of commercial
areas adjoining residential development or a residential zoning district, provided however, if an adjoining
residential district is undeveloped or used for nonresidential purposes, required screening may be deferred
until residential development occurs. A buffer yard not less than 20' in width and a screening fence not
less than six (6) feet in height shall be installed and maintained along the north PUD boundary adjoining
the rural residential tract. Within the buffer yard along the north line, vegetation shall include, at a minimum,
one (1) tree for each 30 feet, at least 50% of which shall be evergreen. The agricultural tract to the west is
designated Commercial on the GrOwasso 2030 Land Use Master Plan, except for a small part along the
north end of the west line. Since ultimate use and intensities cannot be known at this time, the buffer
requirement along the west PUD boundary shall be suspended unless a lower intensity use is in existence
to the west at the time of site development or redevelopment, which requirement shall meet the Zoning
Code standards then in effect. The assisted living facility in Development Area B shall meet or exceed the
10' street yard requirement along 1261h E. Ave. (Section 19.3.2.a).
All trees shall be planted at least five (5) feet away from all underground utilities. No alteration to approved
landscape plans shall be permitted without approval from the Community Development Department.
Following the completion of the planting of all landscape material, the property owner shall be responsible
for long -term health, care, and maintenance of all plant material on site. Dead and diseased plant material
shall be replaced as per the approved landscape plan.
IV.H. ADDITIONAL DEVELOPMENT STANDARDS: Within commercial Development Area A, the
subdivision plat(s) shall contain restrictive covenants: (1) lot maintenance covenants requiring such lots to
be maintained clear of trash and debris, (2) requiring full screening for outdoor heating, ventilation, and air
conditioning (HVAC) equipment; If there are multiple lots, and in the event of future lot- splits, covenants
shall also include (3) providing for mutual parking privileges, so that all lots may allow their excess parking
spaces to be used by patrons of adjacent lots, and (4) easements allowing cross access between lots.
Within commercial Development Area A, no metal exterior surfaces shall be allowed for commercial exterior
building fagades facing streets or lot boundaries. Outdoor lighting standards shall be limited to 24 feet in
overall height and shall otherwise meet the minimum requirements for lighting outlined in the Owasso
Zoning Code at the time of site plan approval, including shielding and footcandle restrictions at property
boundaries.
IV.I. SCHEDULE OF DEVELOPMENT: Development of the project is expected to commence immediately
upon City of Owasso approval of construction plans and issuance of Building Permit(s). The assisted living
facility in Development Area B is anticipated to be constructed first, within approximately 12 months.

BACKGROUND:
The City of Owasso received a request from Rejoice Christian School for the closing of a waterline
easement as described on plat 6622, Rejoice Christian Campus. The easement is more particularly
described as:
A total of 7,320 square feet of the 20' waterline easement on Lot 1, Block 1, of Rejoice
Christian Campus. The property location is the 13407 E 106th St No, Owasso, Oklahoma.
The subject easement is located on the Rejoice Christian School Campus underneath the proposed
new sports fieldhouse. The waterline within the easement will be relocated to another easement on
the property that will be recorded by separate instrument. The water provider in this location is
Washington County Rural #3. Because the plat was approved by the City Council, with all the
original easements, any closure requests that affect the approved plat regardless of the utility
provider requires City Council action. The applicant has determined this easement will interfere with
the construction of the new fieldhouse.
All required notices were sent to all franchise holders and utility companies. The City of Owasso
Public Works Department was contacted regarding the closing of the easement, and had no
comment since the City does not serve water in this area. No other utilities appear to be affected
by the closing of this easement.
Should the City Council approve to close this easement, the applicant will need to file for vacation
of the easement with the District Court to completely remove it from the books.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the request at their May 20, 2020, meeting. No
comments or concerns regarding negative impacts to utilities were expressed at the meeting.
RECOMMEDATION:
Staff recommends adoption of Ordinance 1169, closing to the public use the waterline easement.

SUBJECT: Recommendation for Contract Award - FY 2020 Pavement Striping Project
DATE: June 12, 2020
BACKGROUND:
Staff prepared the contract document, specifications, and plans for pavement striping,
including bicycle lanes, on North 129th East Avenue from East 76th Street North to East 961h Street
North. With this year's project, specifications were added that mimic Oklahoma Department of
Transportation (ODOT) specifications to provide quality control testing for striping material during
and after installation. As established with ODOT specifications, this project includes tiered test
result limits that can result in reduced payment amounts or material replacement altogether.
Also an emphasis included in this project is a different striping removal method (including the
requirement to repair any pavement joints damaged) that should result in less scarring and
damage on the concrete roadway surface.
SOLICITATION OF BIDS:
In accordance with the Oklahoma Competitive Bidding Act, the notice to bidders was
published in the Tulsa World on Wednesday, May 6, 2020, and Wednesday, May 13, 2020. In
addition, multiple vendors and plan houses were notified of the bid opportunity. The bid opening
occurred on May 28, 2020, with two contractors submitting a bid. A summary of the bid results is
included (refer to Attachment - Bid Tabulation).
City staff completed the bid evaluation, and determined that RoadSafe Traffic Systems, Inc. met
the bid requirements and is a competent, qualified, responsible bidder. All bids included a pre-
established amount of $10,000.00 in project allowance to be used only at the City's discretion for
any unforeseen costs or potential overrun on quantities. After review of the bids, staff has
determined to remove the project allowance, as surface work does not yield much risk in
unforeseen costs in comparison to subsurface work. If an overrun of quantities were to occur, it
would be handled by a change order. Thus, the contract award amount will be $10,000.00 less
than the bid amounts read aloud at the bid opening and recorded on the Bid Tabulation.
FUNDING:
Funding is available in the FY 2019 -2020 Streets Division Budget.
RECOMMENDATION:
Staff recommends awarding the construction bid to RoadSafe Traffic Systems, Inc., of Tulsa,
Oklahoma, in the amount of $177,726.60 and authorization to execute the necessary
documents.

AGREEMENT
THIS AGREEMENT is dated as of the 16°i day of June , 2020 , by and between City of
Owasso (hereinafter called OWNER) and RoadSafe Traffic Systems, Inc. (hereinafter called
CONTRACTOR).
OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth,
agree as follows:
ARTICLE 1. WORK
CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents.
The Work is generally described as follows:

CITY OF OWASSO, OKLAHOMA
The project for which the Work under the contract documents may be the whole or only a part, is
described as follows:
Furnishing materials and placing as specified, thermoplastic pavement marking that includes
approximately 34,300 linear feet of 4" striping, turn arrows, stop bars, and crosswalks and
16,300 linear feet of 6" bike lane striping, symbols and markings at various locations throughout
the city as specified or indicated in the Drawings and Contract Documents.
ARTICLE 2. ENGINEER
The project has been assigned to the Project Manager or his /her duly authorized representative,
who is hereinafter called ENGINEER and who will assume all duties and responsibilities and
will have the rights and authority assigned to ENGINEER in the Contract Documents in
connection with the completion of the Work in accordance with the Contract Documents.
ARTICLE 3. CONTRACT TIME
3.1 The Work will be substantially completed within thirty (30) calendar days from
the date of Notice to Proceed; and completed and ready for final payment in accordance
with the General Conditions within forty -five (45) calendar days from the date of Notice to
Proceed, which will be on or before
3.2 Liquidated Damages. OWNER and CONTRACTOR recognize that time is of the
essence of this Agreement and that OWNER will suffer financial loss if the Work is not

substantially complete within the time specified in paragraph 3.1 above, plus any extensions
thereof allowed in accordance with the General Conditions. They also recognize the delays,
expense and difficulties involved in proving in a legal or arbitration proceeding the actual loss
suffered by OWNER, if the Work is any such proof. OWNER and CONTRACTOR agree that
as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER
Five Hundred Dollars ($500.00) for each consecutive calendar day that expires after
the time specified in paragraph 3.1 for substantial completion until the Work is substantially
complete. After Substantial Completion, if CONTRACTOR shall neglect, refuse or fail to
complete the remaining Work within the time specified in paragraph 3.1 for completion and
readiness for final payment or any proper extension thereof granted by OWNER,
CONTRACTOR shall pay OWNER Five Hundred Dollars ($500.00) for each consecutive
calendar day that expires after the time specified in paragraph 3.1 for completion and readiness
for final payment.
ARTICLE 4. CONTRACT PRICE
4.1 OWNER shall pay CONTRACTOR for performance of the Work in accordance with the
Contract Documents in current funds the amount agreed upon in CONTRACTOR'S bid.
4.2 CONTRACTOR understands that the estimated quantities are not guaranteed and that
the determination of actual quantities and their classification is to be made by the OWNER at the
time of application for payment.
ARTICLE 5. PAYMENT PROCEDURES
CONTRACTOR shall submit Applications for Payment in accordance with the
General Conditions on the Pay Estimate Forms included as Exhibit "A" to this Agreement.
Applications for Payment will be processed by OWNER as provided in the General Conditions.
5.1 Progress Payments. OWNER shall make progress payments on account of the
Contract Price on the basis of CONTRACTOR's Applications for Payment in accordance
with the City of Owasso's Payment Schedule included as Exhibit "B" to this Agreement
during construction as provided below. All progress payments will be on the basis of the
progress of the Work.
5.1.1 Progress payments shall not exceed an amount equal to 95% of the
WORK completed until such time as CONTRACTOR shall complete in excess of fifty percent
(50 %) of the contract amount.
5.1.2 Upon completion in excess of fifty percent (50 %) of the total contract amount,
OWNER shall pay an amount sufficient to increase total payments to CONTRACTOR to 97.5%
of the Contract Price, less such amounts as OWNER shall determine in accordance with
the General Conditions, provided that OWNER has determined that satisfactory progress is
being made, and upon approval by the Surety.
5.2 Final Payment. Upon final completion and acceptance of the Work in
accordance with the General Conditions, OWNER shall pay the Contract Price.

ARTICLE 6. CONTRACTOR'S REPRESENTATIONS
In order to induce OWNER to enter into this Agreement, CONTRACTOR makes the following
representations:
6.1 CONTRACTOR has familiarized himself /herself with the nature and extent of
Contract Documents, Work, locality, and with all local conditions and federal, state and local
laws, ordinances, rules and regulations that in any manner may affect cost, progress or
performance of the Work.
6.2 CONTRACTOR has studied carefully all reports or explorations and tests of
subsurface conditions at or contiguous to the site and all drawings of physical conditions in or
relating to existing surface or subsurface structures at or contiguous to the site (except
underground facilities) which have been identified in the Supplementary Conditions as provided
in the General Conditions. Contractor accepts the determination set forth in the General
Conditions of the extent of the "technical data" contained in such reports and drawings upon
which Contractor is entitled to rely. Contractor acknowledges that such reports and drawings are
not Contract Documents and may not be complete for Contractor's purposes. Contractor
acknowledges that Owner and Engineer do not assume responsibility for the accuracy or
completeness of information and data shown or indicated in the Contract Documents with
respect to underground facilities at or continuous to the site. Contractor has obtained and
carefully studied (or assume responsibility for having done so) all such additional supplementary
examinations, investigations, explorations, tests, studies and data concerning conditions (surface,
subsurface and underground facilities) at or contiguous to the site or otherwise which may affect
cost, progress, performance or furnishing of the Work or which relate to any aspect of the means,
methods, techniques, sequences and procedures of construction to be employed by Contractor,
and safety precautions and programs incident thereto. Contractor does not consider that any
additional examinations, investigations, explorations, tests, studies, or data are necessary for the
performance and furnishing of the Work at the Contract Price, within the Contract Times and in
accordance with the other terms and conditions of the Contract Documents.
6.3 CONTRACTOR has made or caused to be made examinations, investigations, tests
and studies of such reports and related data in addition to those referred to in paragraph 6.2 as
(s)he deems necessary for the performance of the Work at the Contract price, within the Contract
Time and in accordance with the other terms and conditions of the Contract Documents; and no
additional examinations, investigations, tests, reports or similar data are or will be required by
CONTRACTOR for such purposes.
6.4 CONTRACTOR has reviewed and checked all information and data shown or
indicated on the Contract Documents with respect to existing Underground Facilities at or
contiguous to the site and assumes responsibility for the accurate location of said Underground
Facilities. No additional examinations, investigations, explorations, tests, reports, studies or
similar information or data in respect of said Underground Facilities are or will be required by
CONTRACTOR in order to perform and furnish the Work at the Contract Price within the
Contract Time and in accordance with the other terms and conditions of the Contract Documents,
including the General Conditions.

6.5 CONTRACTOR has correlated the results of all such observations, examinations,
investigations, tests, reports and data with the terms and conditions of the Contract Documents.
6.6 CONTRACTOR has given OWNER written notice of all conflicts, errors or
discrepancies that he has discovered in the Contract Documents, and the written resolution
thereof by OWNER is acceptable to CONTRACTOR.
6.7 CONTRACTOR has obligated himself /herself to the OWNER to be responsible for
the workmanship, labor and materials used in the project for one (1) year after the project has
been accepted by the OWNER.
6.8 CONTRACTOR understands that (s)he will be exempt from all sales tax on materials
and other items necessary for the completion of the project. The OWNER has issued him a
Certification of Tax Exempt Project enclosed as Exhibit "C" of this Agreement.

There are no Contract Documents other than those listed above in this Article 7. The Contract
Documents may only be altered, amended or repealed by a Modification (as defined in the
General Conditions).
ARTICLE 8. MISCELLANEOUS
8.1 Terms used in this Agreement which are defined in the General Conditions shall have
the meanings indicated in the General Conditions.
8.2 No assignment by a party hereto of any rights under or interests in the Contract
Documents will be binding on another party hereto without the written consent of the party
sought to be bound; and specifically, but without limitation, monies that may become due and
monies that are due may not be assigned without such consent (except to the extent that the
effect of this restriction may be limited by law) and unless specifically stated to the contrary in
any written consent to an assignment, no assignment will release or discharge the assignor from
any duty or responsibility under the Contract Documents.
8.3 OWNER and CONTRACTOR each binds himself /herself, his/her partners,
successors, assigns, and legal representatives to the other party hereto, his /her partners,
successors, assigns and legal representatives in respect to all covenants, agreements and
obligations contained in the Contract Documents.
8.3 The Agreement (or remaining portions thereof) should continue in effect, be valid and
binding upon both parties even if a provision or part of the Contract Documents should be held
void or unenforceable by law.

BACKGROUND:
As a part of the widening of East 1 161h Street North and North 129th East Avenue Intersection, staff
determined that Washington County RWD #3 water lines were in conflict with future roadway
and drainage improvements. Included in the contract with Walter P. Moore, is the design of
necessary relocations of the District's water lines. The relocations need to occur at the time of
construction of the roadway and drainage to ensure that the future water line is at appropriate
grades and elevations. Due to the rights of the District and that no betterments (improvements)
are requested, the relocation of the water line is the City's responsibility to fund. In order to
avoid additional costs, delays and burdensome coordination between separate contractors
and contracts, the relocations will occur as a part of the roadway construction.
Final design for the roadway widening project was completed in fall of 2019, and Oklahoma
Department of Transportation (ODOT) advertised the project in March 2020. Four (4) bids were
received with Crossland Heavy Contractors, Inc., being the low bidder. The water line portion of
their bid was in the amount of $258,000.00. Tulsa County and the City of Owasso will share the
cost of the relocation 50 % /50 %.
In order to formalize responsibilities, an agreement has been drafted with Washington County
RWD #3 (see Attachment) that includes the following:
The City is to complete the required improvements including field surveys, design and
plan preparation, reviews, permitting, bidding and construction. City of Owasso
estimated cost is $129,000.00;
Washington County RWD #3 water line shall be relocated upon right of way or easement
land obtained by the City of Owasso for that purpose;
The City of Owasso will assure compliance with all local, state, and federal laws, rules,
regulations, ordinances, orders, and required approvals applicable to it or the project.
FUNDING:
Funds are available in the ODOT project construction agreement approved by City Council in
January 2020.
RECOMMENDATION:
Staff recommends approval of the Utility Relocation Agreement with Washington County Rural
Water District #3 pertaining to the Widening of East 116th Street North and North 129th East
Avenue Intersection Improvements and authorization to execute the Agreement.

THIS AGREEMENT made and entered into by and between the City of Owasso, Oklahoma,
hereinafter referred to as the "City" and Rural Water District No. 3, Washington County, Oklahoma,
hereinafter called the "District ".
RECITALS
WHEREAS, the City proposed to construct certain roadway, drainage system improvements in the
vicinity at the E 11601 ST N/ N 129th E Ave Intersection
and such improvements will necessitate the rearrangement and /or relocation of certain water lines
and related appurtenances (i.e., facilities) currently owned, operated and maintained by said
District within the project corridor, and;
WHEREAS, it is understood that the scope of the relocation work is different than the facilities that
exist within the project corridor today, and [check one]:
X such differences do not constitute "betterments" for the District; OR
such differences constitute "betterments" for the District, and the District
shall therefore pay the official bid award of amount of the
project costs, with City paying all remaining costs.
WHEREAS, if District's waterlines and facilities are currently situated in private easement(s), and
District will be giving up certain rights and benefits it enjoys in entering into this Agreement, and to
the extent possible, City will either purchase and pay for utility easement(s) or rights -of -ways for
the benefit of private or public utilities,; and
WHEREAS, for any portions not placed in private easement in the name of the District, City shall
designate a portion or portions of public utility easements and /or rights -of -way for use by the
District. In all circumstances the facilities shall be legally and rightfully relocated upon lands
obtained by City for the benefit of the District, all for the purpose of giving the District the same
rights it enjoys in currently held easements and /or rights of way. In all circumstances the District
shall be afforded sufficient space, same meaning an area approximately 20 feet in width above
ground, to install, construct, maintain, operate and /or replace its waterlines, appurtenances and
facilities; provider further, that all waterlines, appurtenances and facilities shall be spaced pursuant
to ODEQ rules and regulations, whether above or below ground; and
WHEREAS, the City will provide the legal documents to the District that show and describe the
easements and /or rights -of -way upon which the District's facilities will be relocated, and City
herein guarantees title to such easements and /or rights -of -way and agrees to indemnify, defend
and hold District harmless from any suits involving the validity, existence or the District's rights in
and to use said easements and /or rights -of -way, and;
WHEREAS, the City will be responsible for all tasks to complete the required relocation work
including but not necessarily limited to field surveys, design and plan preparation, reviews,
permitting, bidding and construction, all being subject to the review and written approval of the
District. The design and construction work will be performed in complete conformance with the
current Standards for Materials and Construction of the District (see attachment) and;
WHEREAS, the City will be responsible for all associated costs including the District's legal expenses
pertaining to the project, and expenses to have the District's own engineer review and comment on
the plans for the required relocation work, attend meetings and prepare related correspondence,
and technical guidance, and; if there is a "betterment requested by the District", the District will
cover the prorated portion of the additional cost for engineering and plan review by the District's
Engineer.
WHEREAS, it is understood that if said project is to be financed in part from funds appropriated by
the United States by either party, and expended under its regulations, that acceptance of work and
procedure in general are subject to Federal Laws, Rules, Regulations, Orders, and Approvals
applying to it as a Federal Project; provided, however, if the District uses federal money to pay for a
"betterment" and the "betterment" necessitates an environmental study other than what is
necessary for the underlying project, then the District shall bear the costs of the environmental
study. Otherwise, City shall pay for all other environmental study.
WHEREAS, the City will be responsible for assuring compliance with all local, state and federal laws,
rules, regulations, ordinances, orders, and required approvals applicable to it or the Project,
whether by reason of being a Federal Project or otherwise, and;
WHEREAS, the City and /or District both separately or together reserve the right to cancel this
Agreement at any time prior to the beginning of the adjustment or relocation of the facilities of the
District, and;

2. City will prepare, or have prepared, engineered drawings showing the present, temporary and
proposed location of the Districts facilities in both plan and profile views, with reference to the
centerline of survey and /or the new and existing easement and /or right -of -way lines using
control stationing and state plain coordinates, if applicable. The plans shall delineate the details
of the work including, but not necessarily limited to, alignment geometry, pipe materials and
pressure class, fitting types and end conditions, restraints, depth of cover and regulatory
mandated separation distances from other utilities.
3. City shall provide District two (2) sets of drawings (11x17) for every review required for the
project, whether required by the City or the District.
4. The City will comply with all applicable laws, rules, statutes, ordinances and regulations
(collectively hereinafter referred to as "laws ") pertaining in any way to the project, including,
without limitation, those necessary to meet the Oklahoma Department of Environmental
Quality (ODEQ) requirements for pollution prevention, including discharges from storm water
runoff on this project, spacing between utilities, and required depth of facilities. Further, City
agrees to secure a Storm Water Permit from ODEQ, when required. City represents and agrees
that the project plans and specifications, required schedules for accomplishing the temporary
and permanent erosion control work, and the storm water pollution prevention plans contained
in the plans constitute the Storm Water Management Plan for the project. City agrees to have
daily operational control of those activities, at the site, either through its third party
representative or in cooperation with ODOT's project manager, necessary to ensure compliance
with plan requirements and permit conditions. City agrees to make sure that the contractor files
any Notice of Intent (NOI), when required, for a general construction Oklahoma Pollutant
Discharge Elimination System Permit with ODEQ which authorizes the discharge of storm
water associated with construction activity from the project site identified in this document.
Such drawings will be attached to and become a part of this agreement.
S. City and the District agree to comply fully with all funding agency requirements, if any, and as
applicable.
6. Upon completion of the plan review process, and written notice by District to City of the
Disti•ict's approval of the plans, City agrees to provide the District with two (2) sets of the final
plans (11x17) for use during bidding and construction.
7. City agrees to provide the District with two (2) sets of all shop drawing submittals for the
District's water line(s) and related appurtenances and facilities, and shall not allow the
installation of any materials without prior written approval from the District. The District shall
review and comment on each submittal and respond to the City of Owasso within 10 business
days of receiving the submittal for review.
8. City agrees to include the District in all coordination and construction progress meetings for the
water line relocation portion of the project and to provide two (2) copies of all related project
correspondence.
9. District will have at least one representative who will review and inspect the Work and
progression on the Project, said representatives to be paid for at District's sole expense. City
agrees to effectively communicate with the District's representative(s) regarding construction
issues and related concerns. Effective communication shall include, but not necessarily be
limited to, written documentation describing any proposed changes to the District's existing
and /or new facilities.
10. City agrees to provide for a qualified inspector, or inspectors, as the case may dictate, that will
be on site during the relocation work. If applicable, ODOT's inspector shall serve as ODOT's and
City's representative and will work with the District and its representatives) as a liaison. The
City's inspector will be responsible for documenting all day -to -day communications with the
District during the construction work. it is agreed that the District's representative shall not
direct any field changes with the Construction Contractor that haven't been previously
approved in writing by the City and /or City's inspector.
11. City agrees to consider and act upon reasonable changes requested by the District that varies
from the approved plans and bid documents. It is anticipated that certain changes may be
required as the result of unforeseen obstacles and /or other utility or roadway changes. The
cost for changes of this nature will be paid entirely by the City. Changes that are not the result
of unforeseen obstacles and result in betterments beyond the scope depicted in the final
approved plans and bid documents shall be paid by the District and will be agreed upon in
writing before any work is performed; provided, however, if such agreement cannot be reached
between City and the District then this Agreement shall be considered null, void and
terminated.
12. The District's representatives shall have any and all reasonable access to the project site during
the installation of the District's water line(s), appurtenances and facilities during the project
roadway and /or bridge construction to protect their new and existing water lines. The District's
project representative shall have final approval of all trenching, bedding, haunching, bacldilling
and final grading over the District's water line, installation of all valves, hydrants, restraints,
pipes, meters and other appurtenances and facilities. Trenches shall remain open until the end
of the work day, so the District's representative can approve them for backfilling. Any conflicts
with the installation of the District's waterlines, appurtenances or facilities in relation to the
overall project construction shall be presented to the District and /or District's Engineer for
resolution. Safety vest and hard hat must be worn by the District representative while present
of the job site.
13. City agrees to allow the District to be present when pressure testing and disinfection of its
water lines, appurtenances and facilities, and City will provide approval to the Contractor only
after receiving written final approval from the District.
14. City agrees to assure minimum down times for the transfer of all services.
15. City agrees to provide the District with two (2) complete sets of Record Drawings for the
Project. The Record Drawings shall be provided in both hard copy and electronic format. The
electronic format shall be on compact disk that includes design files that are directly compatible
with AutoCAD Lt 2007, or any other program approved by the District. If City fails to provide
two (2) complete sets of Record Drawings, District shall have the right to survey, pothole,
review existing records and anything necessary to draft Record Drawings, and all the expenses
associated with same shall be paid by City, subject to the terms and conditions of Paragraph 1.
16. The District shall pay no costs or expenses other than the amount set forth above, if any. Any
cost or expense which is not specifically allocated to the District, in writing, shall be paid by
City.
17. Should any future relocation be required with respect to the District's waterlines,
appurtenances or facilities, the City shall pay all the costs thereof, unless otherwise agreed to, in
writing. After relocation and upon final approval of the District, the District will assume all
operational ownership and maintenance responsibilities of the District's waterlines,
appurtenances and facilities.
18. City states that no building, structure, fence, wall or other above ground structure or
obstruction will be placed, erected, installed or permitted upon the area set aside as an
easement or right -of -way for the District (defined above as being an area approximately 20 feet
in width, above ground, and subject further to ODEQ spacing rules and regulations); provided,
however, that the installation of landscaping and /or paving may occur in said easement or
right -of -way area under the condition that the District shall not be responsible in any manner to
repair any damage to such pavement (including, without limitation, roadways, driveways and
sidewalks, whether asphalt, concrete, rock or any other material) or landscaping in relation to
the District's installation, repair, replacement, operation, maintenance or any other District
activity associated with or relating to its waterlines, appurtenances and facilities (including,
without limitation, damage caused by excavation and damage occasioned by a water leak or
waterline "blow out "). District shall bear no obligation whatsoever for any damages or
expenses associated with any such landscaping, pavement, or any other structure on, at or near
the area given the District to install, maintain, operate, repair or replace its waterlines,
appurtenances and facilities.
19. If the District's waterlines, appurtenances or facilities are damaged through no fault of the
District, the party damaging such waterlines, appurtenances and facilities shall be responsible
for all repair costs, and for the cost of water lost at the then existing rates of the District.
20. The Recitals stated above are considered material terms of this Contract, and the parties agree
to be bound by all statements and representations made in the Recital section above, and said
Recital section shall be considered a part and parcel of the parties' bargained for exchange.
21. It is understood that this Agreement does not change the rights or obligations of the District or
the City as they exist in accordance with present State Law.
22. Benefit; Binding Effect. This Agreement shall inure to the benefit of both of the parties herein,
and to each of the parties' respective successors and assigns. Likewise, this Agreement shall be
binding on the parties hereto and their respective successors and assigns.
23. Partial Invalidity. if any part of any provision of this Agreement shall be invalid or
unenforceable under applicable law, such part shall be ineffective to the extent of such
invalidity only, without in any way affecting the remaining parts of such provision or the
remaining provisions, terms, covenants or conditions of this Agreement.
24. Laws of the State of Oklahoma Govern, Venue. This Agreement shall be governed by the laws of
the State of Oklahoma. Any action taken to enforce the provisions herein shall be filed and
maintained in Washington County, State of Oklahoma, which shall be the venue of any such
action.
25. Attorney's Fees, Costs and Expenses. In the event any action is brought to enforce, or for the
breach of, any provision of this Agreement, the prevailing party shall be entitled to recover its
costs and expenses, including attorney's fees, associated with such action.
26. Entire Agreement. This Agreement represents the entire, integrated agreement between the
City and District, and supersedes all prior negotiations, proposals, representations,
commitments, understandings, contracts or agreements made or entered into by the parties,
either written or oral, with respect to the matters and terms covered by this Agreement.
Additionally, this Agreement may not be modified or amended except by a written instrument
executed by both parties.
27. Duplicate Originals, This Agreement may be executed in duplicate originals, each such
duplicate original shall be deemed to be an original, and all such duplicate originals taken
collectively shall constitute one instrument for all purposes.
28. Notwithstanding any other provision herein stated, it is expressly understood that this
Agreement is strictly by and between City and the District, and provided further no other entity
is deemed to be a beneficiary of this Agreement, whether an intended beneficiary, or otherwise,
and whether reference be made to another entity or class of entity, or not.
IN WITNESS WHEREOF, the parties hereto have caused this Utility Relocation Agreement to be

City staff is currently involved in the acquisition of right -of -way and easements for East 116th
Street North Roadway Improvements from Mingo to Garnett Road. Negotiations for the
purchase of 5,706.36 square feet of right -of -way and 13,285.80 square feet of permanent
easement from the Joy Ann Biggs Revocable Living Trust, located at 9727 East 1 161h Street North,
have been successfully completed and staff is seeking City Council authorization to purchase
the land.
DESCRIPTION /PURCHASE PRICE:
The offer for the right -of -way is $2.00 per square foot, for the purchase price of $11,400.00.
Compensation for permanent easement in the amount of $16,369.00, in addition to the right -of-
way, is included for a total cost of $27,769.00.
FUNDING:
Funding for this purchase is included in the project from the Vision Recapture Fund.
RECOMMENDATION:
Staff recommends authorization for payment in the amount of $27,769.00, to the Joy Ann Biggs
Revocable Living Trust for the acquisition of right -of -way and easement located at 9727 East
1 16th Street North.

BACKGROUND:
The City of Owasso is eligible to receive the Coronavirus Aid, Relief and Economic Security
(CARES) Act, Coronavirus Relief Funds (CRF) to cover unbudgeted expenses related to the
COVID -19 pandemic.
To be eligible for reimbursement, the expenses cannot be included in the governmental entity's
budget prior to March 1, 2020.
Because State Statutes require that City expenses be budgeted, a budget amendment is
necessary to cover these unanticipated expenses. Federal funds through the CARES Act are
anticipated to be received on a reimbursement basis for the direct COVID -19 expenses.
RECOMMENDATION:
Staff recommends approval of a budget amendment in the General Fund, increasing the
estimated revenue and the appropriation for expenditures by $490,000.

BACKGROUND:
The City of Owasso operates under the provisions of the Municipal Budget Act. In accordance
with the Budget Act, all funds of the City with revenues and expenditures are required to have
annual budgets. Expenditures may not legally exceed the appropriation or budget within a
department or a fund.
The City Manager has the authority to transfer appropriations between line items within a
department or to transfer appropriations between departments within the some fund. An
increase in total appropriations in a fund requires City Council approval.
The Trust Authorities, Owasso Public Works Authority (OPWA) and Owasso Public Golf Authority
(OPGA), are required to prepare an annual budget and submit a copy to the City as
beneficiary of the trust. However, there are no further requirements such as a legal restriction on
spending.
PROPOSED ACTION:
Staff is requesting City Council's consideration of a budget amendment in the General Fund.
General Fund Sales Tax Revenue and Transfer:
Under the pledged revenue requirements of the OPWA bond indentures, the City transfers three
cents of its sales tax collections to the OPWA Fund. The OPWA then transfers two cents of the
sales tax, less payback agreements, back to the General Fund and transfers one cent of the
sales tax, less debt service, to the Capital Improvements Fund.
The General Fund sales fax collections for the year total approximately $26.6 million, which is
more than the budgeted revenue. Due to the excess sales tax revenue in the General Fund, the
sales tax transfers to and from the OPWA Fund will exceed budget. Budget amendments in the
amount of $566,410 are requested to allow for the transfer of those unexpected revenues and to
ensure compliance with the voter - approved sales tax ordinance.
RECOMMENDATION:
Staff recommends approval of a budget amendment in the General Fund increasing the
estimated revenue and the appropriation for expenditures by $566,410.

BACKGROUND:
Pursuant to statutory and Charter provisions, an annual operating budget for the General Fund,
Owasso Public Works Authority (OPWA) Fund, Owasso Public Golf Authority (OPGA) Fund and
other funds has been developed and was transmitted for City Council review on May 12, 2020.
The proposed budget was discussed during the May and June City Council work sessions.
Printed copies of the proposed budget have been available for public viewing at City Hall and
on the City's website. Resolution 2020 -14 provides for the adoption of a fiscal year budget for
the City of Owasso, Oklahoma..
PUBLIC HEARING:
On May 27, 2020, a legal notice of a public hearing was published in the Owasso Reporter, and
such hearing was conducted on June 2, 2020. The public hearing provided opportunity for
citizen comment and questions relating to the proposed budget. There were no citizen
comments provided.
RECOMMENDATION:
Staff recommends approval of Resolution 2020 -14, adopting the Fiscal Year 2020 -2021 budget
for the General Fund and Other Funds as established by the Owasso City Council.

A RESOLUTION PROVIDING FOR THE ADOPTION OF AN ANNUAL BUDGET FOR FISCAL YEAR
2020 -2021 FOR THE GENERAL FUND AND OTHER FUNDS AS ESTABLISHED BY THE OWASSO CITY
COUNCIL; ESTABLISHING LEVELS OF EXPENDITURES BY DEPARTMENT AND ESTABLISHING
BUDGET AMENDMENT AUTHORITY AS PROVIDED BY STATUTE; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, The City of Owasso has adopted the provisions of the Oklahoma Municipal Budget Act
(the Act); and
WHEREAS, A budget for the fiscal year ending June 30, 2021 (FY 2020 -2021) consistent with the Act
has been prepared: and
WHEREAS, The Act provides for the City Manager, or designee, to transfer any unexpended and
unencumbered appropriation from one department to another within the some fund; and
WHEREAS, The budget has been formally presented to the Owasso City Council at least 30 days
prior to the start of the fiscal year in compliance with the Act; and
WHEREAS, The Owasso City Council published notice of a Public Hearing, and conducted the Public
Hearing on June 2, 2020, in compliance with the Act.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
THAT: The City Council of the City of Owasso does hereby adopt the FY 2020 -2021 Budget
with total resources available in the amount of $82,439,733 and total
fund /departmental appropriations in the amount of $82,314,103; legal
appropriations are hereby established as shown on "Attachment A" for each fund
and department; and
THAT: The June 30, 2020, encumbrances and unexpended appropriation balances for
capital projects in the Vision Recapture Fund, the Half -Penny Sales Tax Fund, the
Capital Improvements Fund, the Ambulance Capital Fund, the Park Development
Fund, the Stormwater Management Fund, and the Capital Improvement Grants
Fund be hereby re- appropriated to the same funds, accounts and for the same
purposes for Fiscal Year 2020 -2021 unless the project or purpose is designated or
declared closed or completed, provided that fund balances in each respective
fund is equal to or greater than the amounts to be re- appropriated; and
THAT: The Sinking Fund Schedules for June 30, 2020, and Sinking Fund Estimate of Needs
for Fiscal Year Ending June 30, 2021, are hereby approved to be filed with the
County Excise Board; and
THAT: The effective date of this Resolution shall be July 1, 2020.

SUBJECT: First Responders Support Services (FRSS) Renewal Agreement

BACKGROUND:
July 2017, the City of Owasso entered into an agreement with First Responder Support Services
(FRSS) for behavioral health services for Emergency Responders. The fiscal year -to -date statistics
through May 2020, reflect a continued increase in usage of services, with 45 active clients, 18 of
which were new participants, for a total of 263 direct service hours. In addition to providing
ongoing counseling services, FRSS has provided 70 hours of combined training to the Police and
Fire departments.
FUNDING:
The cost to continue services for Fiscal Year 2020 -2021 is $39,238.80, which has been included in
the Fiscal Year 2020 -2021 budgets for the Police Department, Half -Penny Sales Tax Fund and the
Fire Department, Half -Penny Sales Tax Fund. This is a $7,548 increase in costs. FRSS based this
increase on a calculation using a formula that brings into balance City of Owasso utilization
consistent with the overall FRSS budget. FRSS has committed to this rate for three years.
FIRST RESPONDER SUPPORT SERVICES:
Approval of the Third Renewal Agreement with FRSS will continue the following services:
• Unlimited number of hours of self - referred counseling services for Firefighter Medics,
Police Officers, Dispatchers, Animal Control Officers, and their immediate family
members.
Up to 55 hours of education and /or training services per department annually.
Consultative services, including but not limited to, Critical Incident and Peer Support
Teams.
RECOMMENDATION:
Staff recommends approval of the Third Renewal Agreement with First Responder Support
Services in the amount of $39,238.80, and authorization to execute the agreement.

THIRD RENEWAL AGREEMENT
THIS THIRD RENEWAL AGREEMENT is made and entered into as of
June 16, 2020, by and between the CITY OF OWASSO, OKLAHOMA, a municipal
corporation, 200 S. Main, Owasso, Oklahoma, 74055 ( "City ") and, FIRST
RESPONDER SUPPORT SERVICES, PLLC a Professional Limited Liability
Company, 1612 Harvard, Tulsa, Oklahoma 74112 ( "FRSS ").
WITNESSETH:
WHEREAS, the parties entered into a Master Services Agreement (the
"Agreement ") dated July 18, 2017 relating to Behavioral Health Services for the City
Police and Fire Departments. Said Agreement covers the period of time commencing
July 1, 2017 to and including June 30, 2018; and
WHEREAS, the parties entered into a FIRST RENEWAL AGREEMENT
renewing and extending the term of the Agreement for the period July 1, 2018 to and
including June 30, 2019; and
WHEREAS, the parties entered into a SECOND RENEWAL AGREEMENT
renewing and extending the term of the Agreement for the period July 1, 2019 to and
including June 30, 2020; and
WHEREAS, the parties desire to renew the Agreement for an additional one (1)
year period as set forth in SECTION IV —TERMS OF AGREEMENT; and
NOW THEREFORE, the parties agree to renew and extend the terms of the above
described Agreement for the period July 1, 2020 to and including June 30, 2021, all
according to the terms, covenants, and conditions set forth in the original Agreement
between the parties, except as amended by the following provision:
SECTION II - METHOD OF PAYMENT:
In consideration for the services provided to the Departments, the
City shall pay to FRSS for the fiscal year July 1, 2020 to June 30,
2021, the annual sum of $ 39,238.80 in two payments of $ 19,619.40
due on July 31, 2020 and January 31, 2021.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on
the date set forth above for the term stipulated herein.

BACKGROUND:
An Executive Session for the purpose of discussing the annual employment evaluation and
personnel matters of the City Manager, Warren Lehr, was conducted by the City Council. Mr.
Lehr's current Employment Agreement includes language to continue the employment
agreement for a second year, effective July 1, 2020, through June 30, 2021, with no changes.
ACTION:
Presented for your consideration is the second year of the two -year Employment Agreement
between the City and City Manager, Warren Lehr.

EMPLOYMENT AGREEMENT
THIS AGREEMENT, made and entered into this 16 °i day of June, 2020, by and between the City of
Owasso, Oklahoma, a municipal corporation, hereinafter called "City ", and Carl "Warren" Lehr, hereinafter
called "Manager ".
WHEREAS, City desires to employ the services of Carl "Warren" Lehr as City Manager of the City of
Owasso, Oklahoma, pursuant to Section 3 -1 of the Charter of the City of Owasso, Oklahoma;
WHEREAS, it is the desire of the City Council to provide certain benefits, establish certain conditions of
employment and to set working conditions of the Manager;
WHEREAS, the Council wishes to secure and retain the services of the Manager and to provide an
inducement for him to remain in such employment;
WHEREAS, it is the desire of the Council to make possible full work productivity and the exercise of
professional judgment by assuring the Manager's morale and peace of mind with respect to future security;
WHEREAS, THE Manager desires to accept employment as City Manager of the City of Owasso,
Oklahoma.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as
follows:
DUTIES. The Council, under the terms and conditions hereof, hereby employs Carl Warren Lehr as City
Manager of the City to perform the functions and duties specified in the Charter and Ordinances of said
City, and to perform other legally permissible and proper duties and fractions as the Council pursuant to
and in accordance with the City Charter shall from time to time assign. Carl Warren Lehr hereby, under
the terms and provisions hereof, accepts such employment.
TERM.
A. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Council to
terminate the services of the Manager at any time as provided in Section 3 -1 (b) of the Charter of the
City of Owasso, Oklahoma, subject only to the provisions set forth in such Charter provision, as well
as Section Six (6) of this Agreement.
B. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Manager to
resign at any time from his position with City, subject only to the provisions contained in Section Six
(6) of this agreement.
C. The Term of this Agreement shall be from July 1, 2019 until June 30, 2021. It is specifically
understood that the Parties will take such actions as are necessary to comply with the Oklahoma
constitutional debt limitations applicable to municipalities in the State of Oklahoma. Accordingly,
any provisions of this Agreement requiring the appropriation of monies by the municipality for Fiscal
Year 2020 -2021, or any other succeeding fiscal year, shall be subject to the express approval of the
City Council.
3. COMPENSATION.
A. Base Salary. The City agrees to pay the Manager for his services an annual base salary of One
Hundred Fifty -Eight Thousand Eighty Dollars ($158,080).
B. Benefits. The City agrees to provide the Manager the same benefits of employment provided to
general employees of City, unless specifically modified herein. Such benefits include, but are not
limited to, group health, dental, and life insurance benefits, and OkMRF retirement programs.
C. Telephone Allowance. The City shall provide the Manager with a mobile telephone allowance in the
sum of twenty-five dollars ($25.00) per month. The Manager shall maintain a personal account for
mobile telephone service and shall not open an account in the name of the City. The Manager shall
have total responsibility for payment of such personal account and the City shall have no obligation
or responsibility related to such personal account other than the monthly payment to the Manager of
the mobile telephone allowance stated herein.
D. Dues. The City agrees to budget for and to pay for professional does and subscriptions of the
Manager necessary for continuation and full participation in national, regional, state and local
associations, including but not limited to the International City/County Management Association, and
the City Manager's Association of Oklahoma and other organizations necessary and desirable for the
Manager's continued professional participation, growth, and advancement, and for the good of the
City.
E. Paid Leave. The City agrees to provide the Manager with an additional forty (40) hours of vacation a
year, above that provided to the general employees of the City, based on tenure with the City.
Vacation shall be accrued on a prorated monthly basis with no maximum accrual. The Manager shall
not use in excess of four (4) consecutive weeks of vacation and a total of six (6) weeks of vacation in
a year, except as may be required under the Family Medical Leave Act (FMLA).
F. The City agrees to provide the Manager all other forms of paid leave extended to other general
employees of the City, including but not limited to paid holidays and sick leave.
Accrued vacation leave shall be paid to the Manager upon termination of employment,
whether voluntary or involuntary.
a) The parties agree accrued vacation leave shall not be paid if the Manager is
terminated during the term of this Agreement for cause, including, but not limited to,
gross neglect of duty, malfeasance, misfeasance or conviction for a felony or crime of
moral turpitude.
CITY VEHICLE. The City shall provide the Manager with a city vehicle for the Manager's business
and incidental personal use. The City shall fully maintain the automobile and cover the vehicle under the
City's Self - Insured Automobile Liability coverage.
5. EXPENSE ALLOWANCE. The City shall provide the Manager with a business expense allowance for
budgeted discretionary business expenses related to the City's business that may be incurred by the
Manager.
6. TERMINATION.
A. By City. City may terminate the employment of Manager, with or without cause, and in accordance
with the City Charter, by directing at least twenty (20) day written notice of termination to Manager
by hand delivery or by certified or registered mail, return receipt requested. Subject only to the
restrictions stated in Sub- Section ii, below, in the event of termination by City while Manager is
ready, willing and able to perform the duties of City Manager, City shall pay out over six (6) months,
phis one additional month per fiscal year completed in employment with the City, but not to exceed a
combined twelve (12) months, the Manager's regular salary and benefits, based on the Manager's
salary at the time of termination.
i. If the Manager dies at any time during which the up to twelve (12) months of severance
payments are being made, the balance of the payments shall be paid to the Manager's
beneficiary.
a) If the Manger dies during his regular employment, severance pay shall not be paid.
ii. The parties hereto expressly agree no severance payment shall be paid if the Manager is
terminated during the term of this Agreement for cause, including, but not limited to, gross
neglect of duty, malfeasance, misfeasance or conviction for any felony or crime of moral
turpitude.
iii. The parties acknowledge that circumstances may arise where, in order to avoid adverse
publicity to the Council and /or Manager, the Manager may tender his resignation from
employment conditioned upon the receipt of severance pay. Should the Council act to accept
the conditional resignation, then upon submission of a properly executed claim in the amount
of such severance pay, the Council shall approve the claim for payment.
B. By Employee. Manager may terminate his employment with City by directing at least sixty (60) days
written notice of termination to the Mayor of City by hand delivery or by certified or registered mail,
return receipt requested. In event of termination by Employee, no severance payment shall be due to
Employee.
7. CONSTRUCTION. The parties agree the terns of this Agreement have been equally bargained and
negotiated for, and further agree the presumption of construing any ambiguity in the Agreement against the
drafter shall not apply.

BACKGROUND:
Subsequent to an Executive Session for the purpose of discussing the annual employment
evaluation and personnel matters of the City Attorney, Julie Lombardi, a proposed Employment
Agreement was developed. The proposed agreement is effective July 1, 2020, and contains
language that continues the Employment Agreement into Fiscal Year 2021 -2022, contingent
upon City Council approval of funding through the budget process for the second year. Other
than date changes, there are no other changes to the Employment Agreement.
ACTION:
Presented for your consideration is an Employment Agreement between the City and City
Attorney, Julie Lombardi. Outside attorney Keith Wilkes has reviewed the proposed Employment
Agreement.

EMPLOYMENT AGREEMENT
This EMPLOYMENT AGREEMENT ( "Agreement ") is hereby made and entered into this 16'h
day of June, 2020, by and between the City of Owasso, Oklahoma, a municipal corporation, acting by and
through its duly elected City Council ( "Owasso "), and Julie Lombardi ( "Lombardi ") (collectively "Parties ").
WHEREAS, Owasso desires to employ the services of Julie Lombardi as City Attorney of and for
Owasso, and the City Council desires, on behalf of Owasso, to provide certain benefits, establish certain
conditions of employment, and to set working conditions for Lombardi;
WHEREAS, Owasso wishes to secure and retain the professional services of Lombardi and to
provide an inducement for Lombardi to remain in such employment;
WHEREAS, it is the desire of Owasso to make possible full work productivity and the exercise of
professional judgment by assuring Lombardi's morale and peace of mind with respect to future security; and,
WHEREAS, Lombardi desires to accept employment as City Attorney of the City of Owasso,
Oklahoma, subject to the terms and conditions of this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties agree
as follows:
1. DUTIES.
Owasso under the terms and conditions hereof, hereby employs Lombardi, and Lombardi hereby
accepts employment as City Attorney of Owasso, to perform the functions and duties specified in the
Charter and Ordinances of Owasso, and to perform other proper legal tasks, duties and functions as
Owasso, by and through its City Council, shall assign from time to time.
2. TERM.
A. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the City
Council to terminate the services of Lombardi at any time as provided in Section 2 -104 of the
Code of Ordinances of Owasso, Oklahoma, as well as Section Four (4) of this Agreement.
B. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of Lombardi to
voluntarily terminate her employment with Owasso at any time, subject only to the provisions
contained in Section Six (6) of this Agreement.
C. The Term of this Agreement shall be from July 1, 2020, until June 30, 2022. It is specifically
understood that the Parties will take such actions as are necessary to comply with the Oklahoma
constitutional debt limitations applicable to municipalities in the State of Oklahoma.
Accordingly, any provisions of this Agreement requiring the appropriation of monies by the
municipality for Fiscal Year 2021 -2022, or any other succeeding fiscal year, shall be subject to
the express approval of the City Council.
3. COMPENSATION.
A. Base Salary. Owasso agrees to pay Lombardi an annualized base salary of One Hundred Thirty
Thousand Dollars ($130,000).
B. Benefits. Owasso shall provide Lombardi with the same benefits of employment provided to
general employees of Owasso, unless specifically modified herein, subject to the requirements of
any such benefit plan or policy. Such benefits include, but are not limited to, group health,
dental, and life insurance benefits, and OMRF retirement programs.
C. Dues. Owasso shall budget for and pay professional dues, continued legal education expenses
and costs, and subscriptions necessary for Lombardi to maintain and continue full admission and
participation in national, regional, state and local associations, including, but not limited to, the
Oklahoma Bar Association, the Tulsa County Bar Association, the Oklahoma Association of
Municipal Attorneys, and any other such professional organization necessary and desirable for
Lombardi's continued professional licensing and admissions, participation, growth, and
advancement for the good of Owasso.
D. Paid Leave. Owasso agrees to provide Lombardi all forms of paid leave extended to other
general employees of Owasso, including but not limited to paid holidays, vacation and sick leave.
Accrued vacation leave shall be paid to Lombardi upon termination of employment, whether
voluntary or involuntary, as provided for under Oklahoma law.
E. Laptop /Mobile Technology. Recognizing the importance of security and access to City systems,
whether at the office or away, Owasso shall provide Lombardi, a laptop /tablet, mobile
connectivity, and related software, for the primary purpose of City related use. Upon termination
of Lombardi's employment, issued laptop /tablet and mobile connectivity device shall be returned
to Owasso.
4. TERMINATION.
A. By Owasso. Owasso may terminate the employment of Lombardi, with or without cause, by
providing Lombardi with a minimum twenty (20) day written notice of said action hand delivery,
certified or registered mail, return receipt requested. Subject only to the restrictions stated in Sub -
Section ii, below, in the event of involuntary termination by Owasso while Lombardi is ready,
willing and able to perform the duties of City Attorney, Owasso shall pay Lombardi six (6)
months of severance pay in equal monthly installments, plus one additional month per fiscal year
of completed employment by Lombardi with Owasso, not to exceed a combined twelve (12)
months. The monthly severance payment will be an amount equal to Lombardi's regular salary
and benefits at the time of the termination, less any applicable and required payroll withholdings.
i. In the event of Lombardi's death at any time during the severance period, the balance of
the severance payments shall be paid to Lombardi's designated beneficiary. In the event
of Lombardi's death during her regular employment, severance pay shall not be due or
owing.
ii. The Parties expressly agree no severance payment shall be paid if Lombardi is terminated
"for cause" during the term of this Agreement. "For cause" includes, but is not limited to,
gross neglect of duty, malfeasance, misfeasance or the conviction or plea of guilty for or
to any felony or crime of moral turpitude.
iii. The Parties acknowledge and agree certain circumstances may arise where, to avoid
adverse publicity to Owasso, its City Council and /or Lombardi, Lombardi may tender her
resignation from employment conditioned upon the receipt of severance pay as described
in Section 4(A), above. Should the City Council accept the conditional resignation, then

upon submission of a properly executed claim in the amount of such severance pay, the
Council shall approve the claim for payment.
B. By Employee. Lombardi may voluntarily terminate her employment with Owasso by directing at
least sixty (60) days written notice of termination to the Mayor of Owasso, via hand - delivery,
certified or registered mail, return receipt requested. In event of the voluntary termination by
Lombardi, no severance pay shall be due and owing to Lombardi. Nothing in this Sub - Section
shall interfere or conflict with Lombardi's rights or Owasso's obligations under Section 4(A)(iii),
above.
CONSTRUCTION.
Parties acknowledge the terms of this Agreement have been equally bargained and negotiated for, and
further agree the legal presumption of construing any ambiguity in the Agreement against the drafter
shall not apply.
6. SEVERABILITY.
The Parties agree that if any section, sub - section, or part of this Agreement is deemed to be void or
voidable by a court of competent jurisdiction, the remaining section, sub - sections and terms and
conditions of this Agreement shall survive.

If a legal dispute arises between the Parties, Owasso and Lombardi agree any and all litigation arising
out of such dispute, if any, shall rest only in Tulsa County District Court for the State of Oklahoma.

BACKGROUND:
Pursuant to authority contained in Article 2, Section 2 -4, subsection (e) of the Charter of the City
of Owasso, the City Council has established ordinances that provide, generally, for the Mayor to
appoint members to various boards, commissions, trusts, and committees; such appointments
are subject to confirmation by the City Council. Additionally, the Council has established the
same procedure, by precedent, for those appointments not specifically addressed by
ordinance.
In order to continue citizen participation on the various boards, committees, trusts, and
commissions, discussion occurred during the June workession regarding the annual appointment
process. It is, therefore, the purpose of this memorandum to recommend for Council
confirmation the following appointments to the positions as indicated:

Robert Curfman, Seat 3, Business Person - term expires June 30, 2023
