Athletic Club. The proposed lot split would split the west 250.08' from the parent tract
creating a 2.87 acre lot (Tract A). Another lot would be created to the south containing
1.58 acres (Tract B). The property is located at the southwest corner of E 86th St No & No
145th E Ave and is zoned OPUD -98 /RM (Residential Multi- family).
7. Final Plat - MedwiseUrgent Care
Consideration and appropriate action relating to the request for the review of a final plat
proposing one (1) lot in one (1) block on approximately 0.94 acres. The property is located

Monday, June 8, 2020
The Owasso Planning Commission met in regular session on Monday, June 8, 2020 at Old Central
per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side) at
1 1:45am on June 4, 2020.

ITEM 4. Presentation of the Character Trait of the Month - Flexibility
ITEM 5. Approval of Minutes from May 11, 2020 Regular Meeting.
The Commission reviewed the minutes.
Mr. Miller moved, seconded by Mr. Balthrop, to approve the minutes from the May 11, 2020
Regular Meeting.
A vote on the motion was recorded as follows:
YEA: Mr. Balthrop, Mr. Miller, Mr. Vines, Dr. Loving

ITEM 6. OPUD 20 -01 /OZ 20 -01 - Owasso Assisted Living Center
Consideration and appropriate action relating to the request for the review of a
Planned Unit Development (PUD) with the underlying zoning of CS (Commercial
Shopping) and RM (Residential Multi- family). Development Area A is
approximately 2.670 acres and Development Area B is approximately 5.743 acres.
The subject property is located at 12525 E 1 16th St N.
Mr. Fritschen presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the April 15, 2020 meeting. Staff recommends approval of the
planned unit development and the rezoning request. A representative was present to answer any
questions.

Mr. Vines stated that the signs on E 116th St No will need a sign permit. Also discussed was the
possibility of escrowing the sidewalks along N 126th E Ave. Mr. Eric Enyart with Tanner Consulting
thanked the Commissioners for the review of this request. Mr. Enyart stated that the client will
not have a problem adding the language regarding the sidewalk escrow and will submit a sign
permit when needed.
Mr. Vines moved, seconded by Mr. Balthrop to approve the PUD 20 -01 /OZ 20 -01, subject to any
Staff and /or TAC recommendations. Also subject to adding the language regarding the required
sidewalks along N 126th E Ave will be escrowed.
A vote on the motion was recorded as follows:
YEA: Dr. Loving, Mr. Balthrop, Mr. Miller, Mr. Vines

ITEM 7. OA 20 -02 /07 20 -02 Annexation /Rezoning
Consideration and appropriate action relating to the request for the review of an
annexation and rezoning of approximately 4 acres, more or less. The subject
property is located at 12901 & 12925 E 76th St N, (Lot 7 & Lot 8, Block 4, Graceland
Acres). The property has a current Tulsa County zoning of RE (Residential Estate)
and is requesting CS (Commercial Shopping) zoning.
Mr. Miller asked to be recused from this item. Mr. Fritschen presented the staff report. The location
was described. The Technical Advisory Committee reviewed this request at the May 20, 2020
meeting. Mr. Fritschen stated that it has come to Staff's attention that there was compensation
paid for to homeowners for their time and expense to obtain the signatures to release the private
covenants for an amendment of the Deed of Dedication of Graceland Acres. The amendment
was filed with the Tulsa County Clerk on January 21, 2020. Staff recommends approval of the
annexation /rezoning. A representative for the applicant was present to answer any questions.
There were a few citizens present that requested to address the Commissioners. The public
meeting was opened for speakers at 6:20 pm.
Terry Rowan - 1 2935 E 76th St No - He has lived in Owasso for 50 years. He has seen the failures with
entrances in other locations. What does CS zoning cover? Opposes apartments and has drainage
concerns. Opposes the commercial zoning and is concerned with the lack of privacy if
commercial goes at that corner. H feels his property value will lessen. Stated that It is not ethical to
obtain signatures for money for the amendment.
Liz Dougherty - 12912 E 771h St No - She lives behind the subject property. She is opposed to the CS
zoning. Has lived in Owasso for 18 years and values this town and the value we have on our
homes. It is too close to our house and we will lose our privacy. The noise and traffic would affect
our lives and will increase crime and lower our property values.
Michael Ames - 13000 E 77 St No - He has lived here for 20 years. Receiving compensation for the
homeowner's signature is not ethical. We are supposed to be a city of character. Opposes to the
commercial zoning. It doesn't fit the Owasso City of Character program.
Lou Reynolds - 2727 E 21 St - Mr. Reynolds was present to represent the applicant. He stated that
the Owasso Land Use Master Plan has always shown this property as commercial zoning. Traffic
should not be an issue, there are four lanes on N 129th E Ave and four lanes on E 761h St No. The
property to the south and west is zoned commercial. Annexing and building within the city limits of
Owasso is much better than building in Tulsa County, much higher standards in Owasso. Owasso
subdivision regulations are very strict. The storm water runoff is not allowed to change. The

compensation is due to the consideration for the resident's time and efforts. He requests that the
annexation and rezoning be approved.
Discussion was held regarding the site plan review. Mr. Dempster stated that the city has laws
regarding drainage and strict codes regarding buffering, lighting and fencing to adjacent
properties.
The public meeting was closed at 6:50 pm.
Mr. Vines requested that anybody that wanted to be notified when the site plan is submitted
should leave their contact information with Ms. Hensley.

to any Staff and /or TAC recommendations.

BACKGROUND:
The Community Development Department received a Lot Split application for property located
at the southwest corner of the intersection of East 86th Street and North 145th East Avenue. The
property is currently platted as Lot 5A, Block 1 of the Replat of The Greens at Owasso. The
proposed lot spilt would split the current lot along the north -south axis, two- hundred and fifty feet
(250) in from the northwest corner of the parent tract. This will create two (2) lots. Tract A, the
newly- created western lot, will be approximately 2.87 acres in size. Tract B, the new eastern lot,
will be approximately 1.58 acres in size.

ANALYSIS:
The proposed Lot Split divides a 4.45 acre parcel into two (2) separate lots. The western lot (Tract
A) will be approximately 2.87 acres, and the eastern lot (Tract B) will be approximately 1.58
acres. The property is zoned Residential Multi - Family (RM) and each of the resulting tracts meets
the dimensional requirements of the RM district. The purpose of the Lot Split is to allow for the sale
of Tract A to a private developer who has indicated they wish to build a small multi - family
complex on the property. The recorded plat indicates limits of no access (LNA) along East 86th
Street North, because of this and the regulated stream on the property, Tract A will be required
to take access from the private road denoted as East 83rd Street North (to be changed to North
143rd East Ave) to the west. Because of this, a letter of permission or agreement will be required
from the property owner of the road. This was one of the comments made during the Technical
Advisory Committee (TAC) meeting. Tract B will remain under its current ownership.
Any development that occurs on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements.
TECHNICAL ADVISORY COMMITTEE:
The TAC reviewed this item at their regularly scheduled meeting on June 17, 2020. Comments
from that meeting are attached to this memo.
RECOMMENDATION:
Staff recommends approval of OLS 20 -02 subject to TAC comments.

ANALYSIS:
The subject property was zoned CS (Commercial Shopping) under OPUD 05 -02A (Ordinance
1060 in 2015). OPUD 05 -02A amended OPUD 05 -02 by shifting density allowances to areas
different than originally intended and allowing multi - family development within the PUD's
commercially -zoned areas. The proposed use of an urgent care center is allowed by right within
CS districts under OPUD 05 -02A.
The Final Plat for MedWise Urgent Care proposes I lot on 1 block on a 0.933 acre tract of land.
There will be one point of access for the property, along East I I6th Street North via a Mutual
Access Easement and drive (MAE) connecting the subject property to the unplatted land to the
east. This drive will ultimately serve future development on the property to the east, thus
consolidating driveway cuts along 116'h St N. There is an additional MAE along the western
boundary of the subject property connecting it to the neighboring plat to the west. Limits of no
access (LNA) have been identified on the remaining property boundaries outside of the MAEs.
The Plat includes a Stormwater Detention Easement along the subject property's northern
boundary. Perimeter and interior utility easements are shown on the Plat that will allow utilities
adequate access to provide and maintain service to the proposed development.
The City of Owasso will provide Police, Fire, EMS, and sanitary sewer to the property. Water will
be provided by Rogers County Rural Water District #3. The development that occurs on the
subject property shall adhere to all subdivision, zoning, and engineering requirements of the City
of Owasso in addition to those established under the OPUD 05 -02A.
TECHNICAL ADVISORY COMMITTEE
The (TAC) reviewed the Final Plat for MedWise Urgent Care at their regularly scheduled meeting
on June 17th, 2020. There were no comments from the TAC meeting.
RECOMMENDATION:
Staff recommends approval of the Final Plat for MedWise Urgent Care.

ANALYSIS:
The final plat for the 13000 Center proposes (3) lots in one (1) block for a commercial/ office
development. The subject property was annexed with Ordinance 869. Lot 1 is proposed for a
retail /restaurant use, Lot 2 for a future office use, and Lot 3 will remain under the ownership of
the Owasso Assembly of God Church.
Each of the lots within the subdivision meets the minimum standards for lot dimensions in the CS
zoning district. The access along 1291h East Avenue (Lot 3) will be restricted with limits -of -no
access (LNA). A joint mutual access with the CVS pharmacy will be allowed with the existing
driveway so as to avoid introducing additional curb cuts in this location. Access to Lot 2 will be
maintained with the provision for mutual access along the south boundary of Lot 1. Once the
plat is recorded this will ensure permanent access between these two lots.
The Final Plat provides the necessary perimeter utility easements to service the property.
Stormwater is being accounted for with an offsite stormwater detention pond located south of
the existing Church.
Sanitary sewer, Police, Fire, EMS, and water services will be provided by the City of Owasso. Any
development that occurs on the subject property shall adhere to all development, zoning, and
engineering requirements of the City of Owasso.

Lot Split - The Greens at Owasso
Daniel Dearing with Public Works stated that a detention pond is downstream. Applicant
needs to discuss detention with the private property owner downstream.
Relabel E 83 St N to N 143 E Ave.
Request an agreement letter with the church regarding the use of the private road to
the west.
Preliminary Plat - Owasso Assisted Living Center
Below are some reminder comments for the submittal:
• Show any easement locations outside the boundaries of this plat. Show any proposed
storm water detention facilitates with dashed lines and responsible parties for long term
maintenance
• Show all adjoining zoning
• The location of the one access point on 1 16th St N will be determined at the time of the
June TAC meeting, once all parties have looked at it. Said access point shall include a
MAE running to the lot to the west in the event it was ever to develop.
• Need 2' topo information for property and beyond property 200'
• Provide an oil and gas well letter from the Corporation Commission
• Show all utilities or other features where LOA's are proposed that may cause any conflicts
with construction (i.e. power poles, pedestals, etc.)
• Show all driveway locations across all streets
• The assisted living center will need to have an address off N 126th E Ave. The
commercial area will use the 12525 address off 1 16th St N. The address for the assisted
living center lot will be 11630 N 1261h E Ave. Please show these on the plat.
• Add a note in the DOD page that all development on this property or any subsequent
lots created from lot splits shall follow the approved PUD or any amendments thereto.
Additionally, add language to the DOD page that if the property is split to create two
separate lots, that perpetual access shall be allowed between the two lots.
• Add a note on the DOD page that the RM zoned portion of the property shall be
restricted to seniors in need of assisted living arrangements, bound by OPUD 20 -01.
• Correct the word "magetic" on Sheet 1 in #3 (b) Notes.
• Strike the "Minimum Bicycle Parking" in Section II, Development Area B.
• In the DOD Section II (3 a), state that the sidewalks may be escrowed or constructed.
In Section II (d) in the DOD, strike all language after the first sentence. Starting at
"Development Area B will meet ...... all the way through (e). This language should be part
of the site plan.
• The language in the DOD, Section 1, G needs to read "No access on E 1 16th St North until
a site plan is submitted for the commercial lot ". A temporary access will be shown on N
126th E Ave until commercial lot is established.
• The Standards /Restrictions in Section II of the DOD needs to match the language of
PUD 20 -01.

• Note location on the FEMA Flood Insurance Rate Map.
Within the Data Summary Table, add "(13000 Center)" after " -Lot 1, Block 1" under the
"DEVELOPMENT AREA" header.
• Change the title of the plan to "Smoothie King" rather than "13000 Center" on the Site
Plan's title block. Remove the word "Subdivision" under the title block.
• Show the address of the site under the title block at the top of the Site Plan, 12922 E 96'h
St N.
• Show radiuses for drive entries.
Show and label the sidewalk extension all the way across the street yard on the Site Plan.
Denote the height of each light pole within the parking lot. The height of such poles is
restricted to 20 feet, per the zoning code.
• Try to verify the time trash will be collected from the dumpster, as its position on the
eastern side of the building means it is close to the adjacent residential development.
There is a concern the trash collection will occur early in the morning and disturb the
adjacent residential properties.
If applicable, show the location and dimensions of rooftop HVAC units. Make sure the
proposed parapet wall screens these units on all sides.
• On the Elevations sheet, show the height /top of the roof (in order to ensure any rooftop
HVAC units are properly screened).
• Lighting is too bright along the eastern back curb. A max of 0.5 foot - candle is allowed on
property lines that abut residential developments.
• On the Landscape Plan, change the title to "Tropical Smoothie" and get rid of the whole
paragraph under the title block
• On the Landscape Plan, please provide notation about the proposed fence.
• On the Landscape Plan, add sight triangles.
• On the Landscape Plan, add the following items to the "Landscape Specifications"
section:
• "Following completion of planning, the property owner is responsible for long-
term health and maintenance of all plant material on site. Dead or dying plant
material shall be replaced."
• "All trees must be planted at least five feet (5') away from all underground
utilities."
• Fencing along the east side needs to cover both lots 13105 & 13106.
• Trash enclosures and the cooler need to match the exterior of the building.
• Show the dimensions of the monument sign, as per Owasso Zoning Code.
• Submit a sign permit when ready.

a) The Plat easements appear to be okay.
b) The Plat language appears to be okay.
c) We have communicated requirements to the developer. No additional responses
have been received at this time.
d) At such time as water service is requested, all requirements of the district must be
met.
e) Additional requirements may be necessary.
3. Final Plat — Medwise Urgent Care
a) This item is in Washington County RWD #3 service area.
b) I cannot comment on the Plat easements at this time, for appropriate space or
location.
c) There are no water lines or services on site at this time.
d) At such time as water service is requested, all requirements of the district must be
met.
4. Site Plan — Medwise Urgent Care
a) This item is in Washington County RWD #3 service area.
