Consideration and appropriate action relating to the request for the review of a
lot split. The property is located at approximately 13691 East 1 16th Street North and is zoned
CS (Commercial Shopping) zoning district. The proposed lot split would split a 7.61 acre
parent tract into two smaller tracts comprising of approximately 5.56 acres and 2.05 acres.
8. Preliminary Plat - Abbott Farms III
Consideration and appropriate action relating to the request for the review of a
preliminary plat proposing thirty -seven (37) Lots on six (6) Blocks on approximately 11.64
acres. The location of the property is east of the northeast corner of East 106th Street North
and North Mingo Road. The property is zoned RS -3 (Residential Single - Family High Density)
zoning district.

Consideration and appropriate action relating to the request for the review of a final plat
proposing two (2) Lots on one (1) Block on approximately 6.51 acres. The location of the

The Owasso Planning Commission met in regular session on Monday, October 12, 2020 at
Old Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S.
Main (west side) at 10:00am on October 8, 2020.

BACKGROUND:
The Community Development Department received a Lot Split application for two properties
located at approximately 11496 N 137th East Avenue. The property is platted and has been split
before in order to allow for the development of an Arby's restaurant and for the expansion of a
Quick Trip convenience store. The purpose of the proposed lot splits are for the development of
• new Dental Office and to ensure the resulting lots meet the minimum frontage requirement in
• Commercial Shopping (CS) district of 125 feet.

ANALYSIS:
The subject property is located in the Hi -Point subdivision which was platted and recorded in
February 2005. Originally, the plat contained 5 lots on 1 block. In 2013, Quick Trip expanded
their store just north of the subject property and as such needed additional property to the
south. In order to do the expansion they split Lot 1 of the original plat, and then re- platted their
lot (Quick Trip Center #62) with the resulting new tract. In 2014, OLS 14 -03 split the property
again into 3 new tracts. In this case, Lot 2 was split and joined with remainder of Lot 1 that was
left from the Quick Trip lot split. Along with splitting Lot 2, Lots 3 and 4 were also split with case
OLS 14 -03. A few years later, the Arby's restaurant was built and needed additional property, so
they split Lot 2 and joined it with the remaining Lot 1 to build their facility. Essentially, as the lots
developed from north to south, the southern lot lines were adjusted southwards to
accommodate new businesses based on the amount of land they each needed.

The subject property is zoned Commercial Shopping (CS), and is therefore required to have at
least 125 feet of frontage along arterial streets per the Owasso Zoning Code. The proposed Lot
Split associated with this particular case proposes to divide Lots 3 and 4 again in order to
accommodate a new dental office and to ensure the new reconfigured lots meet the minimum
frontage requirement of 125 feet for a CS zoned district. The new Lot 3 will have exactly 125 feet
of frontage and the combined Lots 4 and 5 will be reduced from 399.20 feet to 349.20 feet of
frontage. The attached legal descriptions and exhibits illustrate the reconfigured lots.
Any development that occurs on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their October 21st, 2020 meeting.
There were no comments regarding the lot split request.
RECOMMENDATION:
Staff recommends approval of OLS 20 -05.

BACKGROUND:
The Community Development Department received a Lot Split application for property located

ANALYSIS:
The proposed Lot Split divides a 7.61 acre parcel into two (2) separate lots by splitting out a 2.05
acre piece of the parent tract along its western boundary. The remaining parent tract (Tract A)
will be approximately 5.56 acres in size, and the new smaller lot (Tract B) will be approximately
2.05 acres in size. The purpose of this lot split is to allow for the sale of Tract B to a private
developer, who has indicated that they intend to combine said tract with another tract to the
south and plat it together as one larger lot. The applicant intends to develop the newly platted
site for a medical office. Tract A will remain under its current ownership.
The subject property is zoned CS; staff has determined that each of the two resulting tracts meet
the dimensional requirements for lots within the CS zoning district. Any placement of utility
easements needed for the subject property will be addressed at the platting stage. Access to
the subject property will be taken from a future proposed road just to the east of the subject

tract, as indicated on the attached Lot Split Exhibit. In order to ensure this Lot Split does not
create a non -legal lot that does not have public street frontage, the applicant will need to do
one of the following prior to the issuance of a building permit:
1. Show that the land for the proposed road has been dedicated as public right -of -way by
separate instrument. This separate instrument must be filed prior to the issuance of any
building permits.
2. Dedicate the right -of -way for the proposed road by plat.
3. File an access easement by separate instrument for the proposed road. This document
must be filed prior to the issuance of any building permits.

Preliminary Plat- Abbott Farms III
ANALYSIS:
The subject property was zoned Residential Single - Family High Density (RS -3) with Ordinance
1046, which prescribes minimum lot widths of 65 feet and lot sizes of 7,000 square feet. The
Preliminary Plat for Abbott Farms III consists of thirty -seven (37) Lots on six (6) Blocks with one (1)
reserve area, encompassing a total area of approximately 11.64 acres. Staff has determined that
all of the proposed lots on this Plat meet the aforementioned Bulk and Area Requirements for
property zoned RS -3.
This project is a continuation of the Abbott Farms development, and is the final phase of
development for this neighborhood. Phase III, as described in this Plat, is located in between Phases
I and II of the Abbott Farms neighborhood.
The Plat shows perimeter and interior utility easements that will allow utilities adequate access to
provide and maintain service to the proposed development. Stormwater Detention has been
accounted for in the regional detention pond being constructed by the City in the Owasso
Sports Park. The Plat does show two pedestrian connections to the Owasso Sports Park, along
the east boundary of the subject property. All internal streets will be public and dedicated to the
City. There are no amenities provided within this Plat, as it has straight RS -3 zoning and is not part
of a Planned Unit Development (PUD), which requires amenities.
The City of Owasso will provide water, sanitary sewer, Fire, Police, and EMS services to the proposed
residential development. The development that occurs on the subject property shall adhere to all
subdivision, zoning, and engineering requirements of the City of Owasso.

ANALYSIS:
The Final Plat for Tommy's Car Wash consists of two (2) lots on one (1) block for an automotive
servicing facility. The underlying zoning for this piece of land is CS. The lots depicted on the Final
Plat do not meet the bulk and area requirements for the CS zoning district in terms of terms of
the minimum frontage requirements as outlined in the Owasso Zoning Code. However, a
Variance was approved for the subject property (OBOA 20 -04) that allows for a reduction in the

minimum lot width /lot frontage of 125'. As such, the proposed two (2) lots on the Final Plat are
considered legally non - conforming. Access will be taken from North 116th East Avenue, via a
Mutual Access Easement (MAE) on the existing drive that the subject property will share with the
Taco Bell restaurant immediately to the west. The Final Plat provides the necessary perimeter
utility easements to service the property. Stormwater is accounted for with the large detention
area to the north that was developed to serve the southern portion of PUD 05 -02A.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the
property. Water services will be provided by Washington County Rural Water District #3. Any
development that occurs on the subject property shall adhere to all development, zoning, and
engineering requirements of the City of Owasso.

service and requirements, but has not been finalized, due to offsite influences.
b. Water service has preliminary approval by Board of Directors, but requirements
have not been finalized or completed to date.

a. No comments.
