Consideration and appropriate action relating to the request for the review of a change of
access application. The property is located at the southwest corner of the intersection of

zoning district under OPUD 98. The change of access is requested in order to shift the Limits
of Access southwards approximately one hundred and twenty -four feet (124'). Also, the
addition of a second Limits of Access approximately twenty -five feet (25') north of where
the Limits of Access are currently shown on the filed plat.

Consideration and appropriate action relating to the request for the review of a

Monday, November 9, 2020
The Owasso Planning Commission met in regular session on Monday, November 9, 2020 at Old
Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side)
at 1 1:45am on November 5, 2020.

ITEM 6. OLS 20 -05 - Lot Split - Hi Point
Consideration and appropriate action relating to the request for the review of a
lot split. The property is located at approximately 11496 North 137th East Avenue
and is zoned CS (Commercial Shopping) zoning district under PUD 21. The lot split
will divide Lots 3 and 4 in order to accommodate a dental office and meet the
frontage requirement of 125 feet.
Mr. Fritschen presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the October 21, 2020 meeting with no comments. Staff

recommends approval of OLS 20 -05, Lot Split for Hi Point. A representative for the applicant was
present to answer any questions or concerns.

subject to TAC and Staff recommendations.

ITEM 7. OLS 20 -06 - Lot Split - Warren Clinic
Consideration and appropriate action relating to the request for the review of a
lot split. The property is located at approximately 13691 East 1 16th Street North
and is zoned CS (Commercial Shopping) zoning district. The proposed lot split
would split a 7.61 acre parent tract into two smaller tracts comprising of
approximately 5.56 acres and 2.05 acres.
Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the October 21, 2020 meeting. A representative for the
applicant was present to answer any questions or concerns.
Staff recommends approval of OLS 20 -06, subject to TAC comments, and subject to the
completion of any one of the following by the applicant:
1. Show that the land for the proposed road has been dedicated as public right -of -way by
separate instrument. This separate instrument must be filed prior to the issuance of any
building permits.
2. Dedicate the right -of -way for the proposed road by plat.
3. File an access easement by separate instrument for the proposed road. This document
must be filed prior to the issuance of any building permits.
Mr. Vines moved, seconded by Dr. Loving, to approve the OLS 20 -06, lot split for Warren Clinic,
subject to TAC and Staff recommendations and subject to completion of one of the above
requirements.

ITEM 8. Preliminary Plat - Abbott Farms III
Consideration and appropriate action relating to the request for the review of a
preliminary plat proposing thirty -seven (37) Lots on six (6) Blocks on approximately
1 1.64 acres. The location of the property is east of the northeast corner of East
106th Street North and North Mingo Road. The property is zoned RS -3 (Residential
Single - Family High Density) zoning district.
Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the October 21, 2020 meeting. A representative for the
applicant was present to answer any questions or concerns. Mr. Vines inquired about the

access into the Sports Park from the reserve area. Mr. Harley Swan with Kellogg Engineering
assured Mr. Vines that there will be access into the Sports Park.

subject to TAC and Staff recommendations.

Consideration and appropriate action relating to the request for the review of a

The location of the property is 13311 East 1 16th Street North and is zoned CS
(Commercial Shopping) zoning district.
Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the October 21, 2020 meeting. A representative for the
applicant was present to answer any questions or concerns.
Mr. Balthrop moved, seconded by Mr. Utturkar, to approve the Final Plat for Tommy's Car Wash,
subject to TAC and Staff recommendations.

SUBJECT: Change of Access - Lot 5a, Block 1, Replat of The Greens at Owasso

BACKGROUND:
The Community Development Department received a request for a change of access for Lot
5a, Block 1, Replat of The Greens at Owasso. The subject property is located at the southwest
corner of the intersection of East 86th Street and North 145th East Avenue. A Replat was approved
for Lot 5, Block 1 of The Greens at Owasso in November of 2018. Further, a lot split was approved
in July of 2020 (OLS 20 -02), splitting the replotted Lot 5a along its north -south axis into two new
lots, referred to as Tract A and Tract B. The applicant is requesting a change of access to shift
the Limits of Access currently shown on the filed plat southwards approximately one hundred
and twenty -four feet (124'). The applicant also requests the addition of a second Limits of
Access approximately twenty -five feet (25') north of where the Limits of Access is currently
shown on the filed plat. One of the proposed Limits of Access will serve both Lot 5a, Block 1 Tract
A and Lot 5a, Block 1 Tract B via a Mutual Access Easement the applicant intends to file.

APPROVAL PROCESS:
A change of access to a filed plat requires Planning Commission approval and a favorable
recommendation by the City Engineer. An instrument signed by the City Engineer and Planning
Commission Chairman is recorded with the Tulsa County Clerk, officially amending the platted
limits of access for the subject property and affected plat.
The applicant is requesting a change of access for Lot 5a, Block 1 of The Greens at Owasso. A
lot split was recently approved by the Planning Commission, creating Lot 5a, Block 1 Tract A and
Lot 5a, Block 1 Tract B (OLS 20 -02). The current plat for Lot 5a shows a forty -foot (40') limit of
access (LOA) on North 145th East Avenue, on the eastern boundary of Lot 5a Tract B. The
change of access proposes closing the existing forty -foot (40') LOA that is shown on Lot So Tract
B and creating a new forty -foot (40') access point on the southern boundary of Lot 5a Tract B.
This proposed LOA would act as a mutual access point for both Lot 50 Tract A and Lot 50 Tract B
via Mutual Access Easement (MAE) that the applicant intends to file concurrently with this
change of access request.
The applicant is also requesting the creation of an additional forty -foot (40') LOA, approximately
twenty -five feet (25') north of where the current forty -foot (40') LOA is shown on the plat. This
proposed LOA will serve only Lot 5a Tract B. The applicant worked with Staff to ensure that the
configuration of the drives meets the requirements laid out in the Owasso Zoning Code and will
not hinder traffic flow patterns within the subject property or on the street it abuts. The two
proposed LOA's would be separated by a distance of one hundred and fifty feet (150'),
meeting the separation requirements described in Chapter 11 of the Owasso Zoning Code.
Further, the northern proposed LOA would be separated from the existing driveway that serves
Casey's by a distance of one hundred and fifty feet (150'); this separation also meets the
separation requirement of the Zoning Code. The City Engineer has expressed support for this
change of access request.
This applicant is requesting this change of access for two main reasons. First, a daycare is looking
to locate on Lot So Tract B. Having two points of access for this lot will ensure a smooth flow of
traffic when children are being dropped off and picked up. Second, there are physical
constraints on these two lots that necessitate locating one of the proposed LOA at the southern
property boundary of Lot 5a Tract B. There is a large Army Corp of Engineers (Corp's) regulated
stream that runs roughly along the east -west boundary between Lot 5a Tract A and Lot 5a Tract
B. Crossing said stream with a driveway can be costly; however, it was determined by the
applicant that the most efficient and least impactful place to cross the stream is at the southern-
most point of the two properties. Therefore, one of the proposed LOA is located at the southern
property boundary of Lot 5a Tract B.
In summary, the proposed access changes meet the driveway spacing requirements as outlined
in the Owasso Zoning Code and the proposed change will not cause a major disruption with
traffic flow on North 145th East Avenue. The applicant intends to provide a one way directional
flow for vehicles as they enter the property to drop off and pick up children, thus reducing left
turn movements.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this change of access request for Lot 5a,
Block 1 of the Replat of the Green at Owasso at their regular meeting on November 18, 2020.
There were no comments made regarding this change of access request.
RECOMMENDATION:
Staff recommends approval of the change of access request for Lot 5a, Block I of the Replat of The
Greens at Owasso.

BACKGROUND:
The Community Development Department received an application for review and approval of
a Specific Use Permit for Granny and Dots, a proposed child daycare facility. The property is
located south of the southwest corner of the intersection of East 86th Street and North 145th East
Avenue, just south of the Casey's convenience store. The property is approximately 1.58 acres in
size and is currently zoned Residential Multi - Family (RM) under OPUD 98. The Owasso Zoning
Code requires a Specific Use Permit for child day care facilities in RM zoned districts.

ANALYSIS:
A Specific Use Permit (SUP) is required in certain zoning districts for uses that may be considered
more intensive than what is allowed by right through the City of Owasso Zoning Code. The
subject property is a part of the Replat of The Greens at Owasso and was zoned Residential
Multi - Family (RM) under Ordinance 567. Child Day Care facilities are not allowed in an RM
district, unless the developer can obtain an SUP.

The subject property and the parcels surrounding it are all called out for future commercial uses
in the GrOwasso 2030 Land Use Master Plan. The proposed use of a daycare is compatible with
this vision laid out in the Land use Master Plan, as a daycare is a less intensive use than a
commercial establishment. The subject property is bordered to the east by an elementary
school, to the west by a recently approved apartment building and to the south by existing
apartments. Theses uses are very compatible with the proposed land use of the daycare facility.
Considering all of this, staff has determined that a land use such as a child daycare center may
be appropriate if the correct controls are utilized with a SUP.
The applicant has worked with staff to design the site and structure in an appropriate manner
that conforms to the design requirements of the Zoning Code. A Change of Access request
associated with the subject property is currently under review by Staff and the Planning
Commission. If said request is approved, the proposed daycare facility with take access off of
North 145th East Ave, via two separate drives. The northern drive will be an "enter only" drive,
while the southern drive will allow a two- directional flow of traffic. Said southern drive will also
function as a mutual access drive, serving both the subject property and the property to the
west. The applicant worked with Staff to ensure that the configuration of the drives meets the
spacing requirements laid out in the Owasso Zoning Code and will not hinder traffic flow
patterns within the subject property or on the street it abuts. Further, the applicant has indicated
that the exterior of the proposed building will be resemble a single family home in terms of
appearance, and will therefore blend in with the residential character of the existing apartment
buildings to the south.
Any future development that occurs on the subject property must adhere to all Owasso
subdivision, zoning, and engineering requirements.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this SUP request for Granny and Dots at, their
regular meeting on November 18, 2020. Comments from that meeting are attached to this
memo.
RECOMMENDATION:
Staff recommends approval of the Specific Use Permit (SUP 20 -03) for Granny and Dots, subject to
TAC comments.
