Consideration and appropriate action relating to the request for the review of a Lot Split
application. The property is located 10010 North 97th East Avenue and is zoned AG
(Agriculture). The parent tract is a 27.9 acres in size and the lot split would create a 3.9 acre
tract that would be split in half to create two (2) lots, each approximately 1.95 acres in size.

Consideration and appropriate action relating to the request for the review of a Lot Split
application. The property is located south of 11422 North 134th East Avenue. The proposed
lot split would create a lot approximately 1.54 acres in size. The property is zoned CS
(Commercial Shopping).
9. Morrow Place Phase II Preliminary /Final Plat
Consideration and appropriate action relating to the request for the review of a
Preliminary/Final Plat application proposing seventy nine (79) Lots on six (6) Blocks on
approximately 23.96 acres. The property is located at the southeast corner of the
intersection of East 126th Street North and North 1291h East Avenue and is zoned RS -3
(Residential Single - Family).

The Owasso Planning Commission met in regular session on Monday, December 7, 2020 at Old
Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side)
at 1 1:45am on December 3, 2020.

ITEM 6. Change of Access - Township 21 Apartments
Consideration and appropriate action relating to the request for the review of a
change of access application. The property is located at the southwest corner of
the intersection of East 86th Street North and North 1451h East Avenue and is zoned
RM (Residential Multi- family) zoning district under OPUD 98. The change of access
is requested in order to shift the Limits of Access southwards approximately one
hundred and twenty -four feet (124'). Also, the addition of a second Limits of
Access approximately twenty -five feet (25') north of where the Limits of Access
are currently shown on the filed plat.

Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the November 18, 2020 meeting with no comments. Staff
recommends approval of the change of access for Township 21 Apartments. A representative
for the applicant was present to answer any questions or concerns.
Mr. Miller moved, seconded by Mr. Utturkar, to approve the Change of Access, subject to TAC and
Staff recommendations.
A vote on the motion was recorded as follows:

ITEM 7. SUP 20 -03 Granny & Dots Daycare
Consideration and appropriate action relating to the request for the review of a
Specific Use Permit. The property is located at the southwest corner of the
intersection of East 86th Street North and North 145th East Avenue and is zoned RM
(Residential Multi- family) zoning district under OPUD 98. The property size is
approximately 1.58 acres.
Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the November 18, 2020 meeting. A representative for the
applicant was present to answer any questions or concerns.
Staff recommends approval of SUP 20 -03 for Granny & Dots Daycare, subject to TAC and Staff
comments.
Mr. Miller moved, seconded by Dr. Loving, to approve SUP 20 -03 for Granny & Dots Daycare,
subject to TAC and Staff recommendations.

BACKGROUND:
The Community Development Department received a rezoning request for property located at
10010 North 971h East Avenue (North Mingo Road). The subject property involves 3.9 acres in the
southeastern corner of the larger 27.86 acre lot located at the aforementioned address. The
subject property is currently zoned Agriculture (AG) and the applicant is requesting a rezoning to
Residential Single - Family Low Density (RS -1). There is a lot split case (OLS 20 -07) associated with
this rezoning case, as the applicant intends to split the 3.9 acre subject property into two
individual tracts.

ANALYSIS:
The applicant is requesting a rezoning from the AG district designation to the RS -1 district
designation for property located at the southeastern corner of the lot located at 10010 North

97th East Avenue. The applicant has indicated they wish to rezone the 3.9 acre subject property
in order to market it for estate -sized single- family homes. Such a use is allowed by right in the RS -1
zoning district.
There is a lot split case associated with this subject property (OLS 20 -07), in which the applicant is
requesting to split the 3.9 acres subject property from the larger tract into two smaller tracts. This
would create two (2) 1.95 acre lots, with 23.96 acres remaining as the parent tract lot. Per the
Owasso Zoning Code, the minimum lot size allowed within an AG district is 2 acres; this means
that the two proposed lots would be nonconforming. This rezoning request would make the two
proposed 1.95 acre lots conforming, as the minimum lot size allowed in the RS -1 district is 13,500
square feet.
The subject property is called out for future residential uses in the GrOwasso 2030 Land Use
Master Plan document. A pair of single - family homes is a good example of a 'residential use"
land use. Further, the properties surrounding the subject property are largely undeveloped
and /or the site of current residential developments. As such, single - family estate -sized homes
would be compatible with the existing surrounding land uses.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the
subject property. Water service will be provided by the City of Owasso, as well. Any
development that occurs on the subject property must adhere to all subdivision, zoning, and
engineering requirements of the City of Owasso.

ANALYSIS:

Tract C, the remaining parent tract, will be approximately 23.96 acres in size. The purpose of this
lot split is to allow for the sale of Tracts A and B to potential buyers who desire to build estate -
sized single - family homes on said lots. Tract C will remain under its current ownership.
The subject property is currently zoned AG. The proposed new Tracts A and B resulting from this
proposed split would not meet the dimensional requirements for lots within the AG zoning district,
as there is a 2 -acre area minimum lot size within an AG district. However, there is an
accompanying rezoning case (OZ 20 -04), in which the applicant is asking to have Tracts and B
rezoned from AG to RS -l. The rezoning request makes these two proposed lots conforming as to
the minimum lot size allowed in an RS -1 district, which is 13,500 square feet.
Any development occurring on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements. The property has access to utilities and
additional public easements should not be necessary. There is also fifty (50) feet of right -of -way
along Mingo, which should be adequate given the transportation master plan requirements for
Mingo at this location. Given the site is well served with existing utilities and right -of -way has
already been addressed, staff is not requiring the property be platted for two estate size lots.
Access to each of the new tracts will be taken off of North Mingo Road at a location
determined at the time a building permit is submitted for review.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on
December 16th, 2020. No comments were made regarding this lot split request.
RECOMMENDATION:
Staff recommends approval of OLS 20 -07, subject to the approval of rezoning request OZ 20 -04.

BACKGROUND:
The Community Development Department received a Lot Split application for property located
south of 11422 N 1341h E Ave. The subject property comprises a portion of Lot 3, Block 2 of the
Replat of Lot 2, Block 1 of the Garrett Creek Center Phase II subdivision (Parent Tract 1), and a
portion of Lot 3, Block 1 of the Garrett Creek Center Phase II subdivision (Parent Tract 2). The
proposed lot split spans over two different lots, and would split approximately 1.4 acres off of the
southwestern corner of Parent Tract 1 and approximately 0.14 acres off of the northwestern
corner of Parent Tract 2. The lot split would result in the creation of three new lots (Tracts A, B,
and C). All of the subject properties are zoned Commercial Shopping (CS) under Owasso
Planned Unit Development (OPUD) 02 -02. The properties are being split to facilitate the sale Tract
A to a private developer who wishes to construct a multi -use office /commercial building.

The subject properties span over two separate lots that are located in two subdivisions. As such,
there are two Parent Tracts involved in this Lot Split request. Parent Tract 1 refers to a portion of
Lot 3, Block 2 of the Replat of Lot 2, Block 1 of the Garrett Creek Center Phase II subdivision,
which was approved in 2018. Parent Tract 2 refers to a portion of Lot 3, Block 1 of the Garrett
Creek Center Phase II subdivision, which was approved in 2006. The proposed Lot Split divides
approximately 1.4 acres off of the southwestern corner of Parent Tract 1 and approximately 0. 14
acres off of the northwestern corner of Parent Tract 2. These two pieces of property that have
been split off will be combined to form Tract A, which will be approximately 1.54 acres in size.
Tract B will be comprised of the remainder of Parent Tract 1, and will be approximately 9.88
acres in size. Tract C will be comprised of the remainder of Parent Tract 2, and will be
approximately 11.25 acres in size.
The purpose of this lot split is to allow for the sale of Tract A to a private developer, who has
indicated that they intend to construct a three -story, multi -use office /commercial building on
the newly created tract. Tract B and Tract C will remain under their current ownership.
The subject properties are zoned CS under OPUD 02 -02; staff has determined that each of the
resulting tracts meet the dimensional requirements for lots within the CS zoning district. Further,
the PUD document relating to OPUD 02 -02 does not specify additional dimensional requirements
for commercial lots. As such, staff has determined that each of the resulting tracts meet the
dimensional requirements for commercial lots under OPUD 02 -02. Access to Tract A will be taken
from North 1351h East Avenue, via a private road that the purchaser of Tract A intends to
construct. Said purchaser is currently working to file a Mutual Access Easement (MAE) on the
subject property to ensure perpetual access to Tract A from North 135th East Avenue. Access to
Tracts B and C will be determined at the time of their development.
Any development that occurs on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their December 16, 2020 meeting.
Comments from that meeting have been attached to this memo.
RECOMMENDATION:
Staff recommends approval of OLS 20 -08, subject to TAC comments and subject to the filing of a
MAE instrument.

ANALYSIS:
The proposed Final Plat for Morrow Place Phase II consists of seventy -nine (79) lots on six (6)
blocks for single - family home sites and is a continuation of the Morrow Place subdivision. The
underlying zoning for the property is RS -3, under OPUD 05 -02A. All of the lots depicted on the
Final Plat meet the bulk and area requirements stipulated in the Morrow Place PUD (OPUD 05-
02A). Per the Owasso Subdivision Regulations, the applicant has one (1) year to secure Council
Paget
Preliminary /Final Plat- Morrow Place Phase II
approval of a Final Plat once a Preliminary Plat is approved; if they fail to secure approval of a
Final Plat within one (1) year, the Preliminary Plat expires and becomes null and void. A
Preliminary Plat for this property was brought before the Owasso Planning Commission in June of
2018, and was subsequently approved. The applicant did not secure approval of this proposed
Final Plat within the allowable timeframe, and therefore voided their Preliminary Plat. Because of
this, the Preliminary Plat for this subdivision must be re- approved. As such, the Preliminary and
Final Plats for this subdivision are being presented for consideration simultaneously.
Access for the subdivision will be taken off of East 126th Street North, via a proposed sixty (60) foot
drive. There will be no points of access along North 129th East Avenue. This second phase of the
Morrow Place neighborhood will connect into the existing first phase just to the south via North
132nd East Avenue. The Final Plat proposes three reserve areas. Reserve Area "A" is situated in
the northwestern portion of the subject property, at the southwestern corner of the intersection
of East 1261h Street North and North 129th East Avenue. This reserve area will serve as stormwater
detention for the subject property. Reserve Areas "B" and "C" are located on either side of the
entrance to the subject property, off of East 126th Street North and will function as landscape
areas. The Final Plat provides all the necessary perimeter utility easements to service the
proposed development.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the
property. Water services will be provided by Washington County Rural Water District #3. Any
development that occurs on the subject property shall adhere to all development, zoning, and
engineering requirements of the City of Owasso.

ANALYSIS:
The subject property was zoned Office (0) under Ordinance 1172 in September 2020. The
proposed use of a religious facility is allowed by right within O district, as per the Owasso Zoning
Code.
The Final Plat for Trinity Presbyterian Church proposes 1 lot on i block on a 14.91 acre tract of
land. There is one point of access for the property, along East 76th Street and 3 point of access
along North Memorial Drive. All of the points of access meet the driveway spacing requirements
outlined in the Zoning Code, which is one hundred fifty (150) feet. The Plat includes a
Stormwater Detention Easement along the front of the property to account for stormwater.

According to the applicant this will also be a wet feature with a fountain. Perimeter and interior
utility easements are shown on the Plat that will allow utilities adequate access to provide and
maintain service to the proposed development. There is an existing twenty (20) foot waterline
easement along the eastern boundary of the site for Washington County Rural Water District #3.
The plat will dedicate 60 feet of right -of -way along North Memorial Drive. Adequate right -of-
way already exists along 76th Street N and no additional will be required.
The City of Owasso will provide Police, Fire, EMS, and sanitary sewer to the property. Water will
be provided by Washington County Rural Water District #3. The development that occurs on
the subject property shall adhere to all subdivision, zoning, design, and engineering
requirements of the City of Owasso.

ANALYSIS:
Crossroads Christian Center was platted in Tulsa County in 1996 and contained a total of 10
acres. The applicant is requesting partial vacation of the existing plat "Crossroads Christian
Center" for the purpose of preparing a new plat for a medical clinic. The area to be vacated

from the original plat is the western 3.08 acres, which was also rezoned and annexed under
ordinance 1 155 in November 2019.
Oklahoma State Statue allows for partial plat vacation so long as the owner of the property
consents to the partial vacation. There is only one owner involved and they have approved
and signed the application, allowing the vacation process to move forward. State Statute also
requires that the vacation of the plat or portion thereof in which the property is situated be
approved by the local municipal body in which the plat is located. As such, the Owasso City
Council must take action on this partial plat vacation request. State Statute further cites that
"the vacation shall operate to destroy the force and effect of the recording of the plat so
vacated, and to divest all public rights in the public ways, commons, and public grounds laid
out as described in the plat ". Upon vacation, one separate instrument will remain on the
property, which is a ten (10) foot Washington County Rural #3 waterline easement (document
#4619, Page 1276)
As mentioned, a new plat will be forthcoming to accommodate the new medical clinic. Said
new plat will establish all new easements, access points, and setbacks. The vacation process
ensures a clean slate upon which to prepare the new plat.
TECHNICAL ADVISORY COMMITTEE
The Technical Advisory Committee (TAC) reviewed the Partial Plat Vacation request for
Crossroads Christian Center at their regularly scheduled meeting on December 16. Comments
from this meeting are attached with this memo.
RECOMMENDATION:
Staff recommends approval of the partial plat vacation of Crossroads Christian Center, subject
to TAC comments.

RECITALS:
A. The Plat of Crossroads Christian Center was recorded in the office of the Tulsa
County Clerk as Plat No. 5157 on November 1, 1996.
B. The Plat affects a tract of land that is located in Section 4, T -21 -N, R14 -E, in the
City of Owasso, Tulsa County, more particularly described as Lot 1, Block 1, CROSSROADS

C. The undersigned property owners are the owners of all of the property in the Plat.
D. The undersigned owners desire to vacate a portion of the Plat and the covenants

Recommended Language for Subdivision Plats
1. Water Facilities: The owner of each lot shall be responsible for the protection of
the public water mains located on such owner's lot and shall prevent the alteration
of grade from the original contours or from any construction activity which may
interfere with said facilities. Said alteration of grade restrictions shall be limited to
the easement areas.
Washington County Rural Water District (RWD) No. 3 shall be responsible for
ordinary maintenance of its facilities, but the owner of each lot will pay for
damage or relocation of such facilities caused or necessitated by acts of the owner
or his agents or contractors. RWD No. 3 shall have the right to access with its
equipment to all easement ways shown on the plat for installing, maintaining,
removing or replacing any portion of its underground water facilities. The
foregoing covenants concerning water facilities shall be enforceable by
Washington County RWD No. 3 and the owner of each lot agrees to be bound
hereby.
2. Landscape and Paving Repair: The owner of each lot shall be responsible for the
repair and replacement of any landscaping and paving located within the utility
easements in the event it is necessary to repair any underground water mains. No
lot owner shall plant any trees or shrubbery in dedicated utility easements or
right -of -way which would potentially endanger, threaten or harm any water
utilities located within said easements or rights -of -way. If it is determined that
any trees or shrubbery located within said easements or rights -of -way are
damaging or endangering utilities in said easements or rights -of -way, the District
shall have the right to remove said trees or shrubbery upon five (S) days notice
thereof at the lot owner's expense, or within such time the lot owner may remove
same.
