The Owasso Economic Development Authority met in regular session on Thursday,
January 11, 1996 in the Owasso City Hall Conference: Room per the Notice of Public Meeting
and Agenda posted on the City Halt bulletin board at 4:00 p.m. on Friday, January 5, 1996.

into a thirty or ninety day Certificate of Deposit.
ITEM 6: COORDINATOR'S REPORT
Mr. Hardin gave a report on the ONG project, the Alzheimer Center and Precision Components.
A presentation was given to Roadway Express containing three tracts of land in the Owasso area.
Phase I is underway on the National Steak and Poutltry road and Phase II is almost complete.
Also, the deal was closed on the Ray Haynes property which is a 6,000 square feet storage
building.

SUBJECT: ENGINEERING CONTRACTS
DATE: February 2, 1996
BACKGROUND
The next step in developing the Betty Smith Business Park is to complete engineering and design for
the infrastructure improvements to the site. There are five separate items to be contracted and
completed before the final plat and site plan can be approved.
First, the preliminary engineering must be performed. This involves surveying the property,
pinning the boundaries, making a preliminary layout of improvements needed to plat the property,
and make preliminary cost estimates. This has already been preformed by Tuttle and Associates
with the understanding that they would receive no compensation for the services if the project is not
funded, or if the OEDA board does not hire them. These services, plus the drainage study, are
necessary for the preliminary plat, which we would like to file on or before February 14. Mr.
Tuttle has submitted a contingent invoice for $ 3000 for preliminary engineering.
Final engineering for stormwater drainage, sanitary sewer, water, access road and entrance is also
required for development of the property. This includes the necessary drainage study for the
preliminary plat. Our proposal includes all studies, tests, engineering drawings and daily inspection
for a " turn key " job on engineering. Mr. Tuttle would also assist in obtaining all necessary
approvals from state and local authorities. He also would review contractors invoices and advise us
on whether to approve payment.
Mr. Cates is preparing contracts based upon scope of services submitted by Mr. Tuttle. The final
agreement will be for multiple contracts, totalling no more than $ 15,000. Since no single contract
exceeds $ 7500, Mr. Cates advises that public bidding is not required under the open bidding act.
The next deadline for fling a preliminary plat with the Owasso Planning Commission is February
14, for the March 12 meeting. In order to meet this deadline, we need the drainage study. The final
plat approval, under this timetable would occur in April. Final engineering design must be
completed before the final plat approval is granted. Each deadline for the planning commission is
the Wednesday after the Tuesday meeting, so that if we do not file the preliminary plat by February
14, the next deadline is March 13, for the April 9 meeting.
RECOMMENDATION:
Because of Mr. Tuttle's familiarity with the project, the reasonableness of his price and the
groundwork he has already performed, staff would recommend that Tuttle and Associates be
contracted to perform the engineering on this project.

SCOPE OF ENGINEERING SERVICES
OEDA - ONG SITE
CONTRACT 1
PHASE I
The engineer will prepare a legal description, pin the
boundary, prepare a plat of survey and show all easements from
a title opinion furnished by an attorney, make a preliminary
layout of the improvements needed to plat and develop the site
and prepare cost estimates of all improvements and advise the
owner of any difficulties or easements required.
PHASE 2
The engineer will prepare a dedication plat, restrictive
covenants, and necessary preliminary drawings or studies and
submit all to the City of Owasso to obtain preliminary and
final plat approval from the City of Owasso. The engineer
will assist the owner in filing the plat at the court house.
All fees associated with submitting or filing the plat will be
paid by the owner. All fees required for obtaining Health
Department approval will be paid by the owner.
CONTRACT 2
PHASE 1
The engineer will prepare final engineering drawings and
obtain approvals from all appropriate Local and State
authorities. The engineer will solicit bids from contractors
and provide the owner with a recommendation of which
contractor to hire. The engineer will prepare and write all
necessary easements that need to be obtained. The owner will
will obtain signatures on any easements.
PHASE 2
The engineer provide one time construction staking of all
utilities and roads. Restaking will be done at an hourly
charge to the owner.
The City will provide onsite resident inspection. The
engineer will make daily visits to the site during
construction to ensure that the intent of the plans is being
followed. The engineer will review and approve all pay
requests for contractors. The engineer will prepare record
drawings after completion of all work and provide them to the
City.
The engineer will provide all services normally required to
develop a site including platting, surveying design of water
sewer storm sewer and paving to allow OEDA to convey title to
a developed tract.

Engineering of the end users building, parking lot and
utilities is not included.

BACKGROUND
January has been a busy month for OEDA. This summary of project activity is intended to assist
OEDA members in tracking the various ongoing projects.
BETTY SMITH BUSINESS PARK
OEDA accepted the donation of 13.7 acres of land from Hayward and Betty Smith on December 27,
1995, and contracted to purchase an additional 2.0 acres for $ 25,000. The purchase is contingent
upon funding of the industrial access road by the Oklahoma Dept. of Transportation, funding of the
project by the end -user, and completion of engineering for infrastructure.
There is a spurious claim to a one forth mineral interest in the land, which has been referred to
OEDA attorney Ron Cates for appropriate action. Mr. Cates sent a demand letter on January 30,
1996 to the purported mineral interest holder.
On January 24, 1996 there was a meeting in City Hall between representatives of OEDA, RCB and
ONG. A pre loan commitment agreement was discussed, which Mr. Cates is preparing.
The Transportation Committee meets in Oklahoma City on February 5, 1996. The agenda includes
the access road for this project. We are informed that all indications are for approval.
The next deadline for filing a preliminary subdivision plat for the Owasso planning commission is
February 14. This filing requires a plat, survey, legal description, drainage study, and restrictive
covenants. If the February 14 deadline is not met, the next filing deadline is March 13. With the
exception of the drainage study, filing documentation is substantially complete, and we believe that
the February deadline can be met.
ALZHEIMER CARE FACILITY
The Bailey trust has agreed to donate 10 acres to OEDA for the alzheimer care facility and another
project. Upon the request of Mr. Conard, a copy of the letter of intent to donate, as well as a
zoning letter were forwarded to Mr. Conard. He is attempting to obtain HUD financing for the
project.
PRECISION COMPONENTS
Preliminary work has begun for the 3500 square foot addition.
We have met with representatives of INCOG and precision twice to finish up necessary
documentation for release of funds under the CDBG grant for the parking lot.
MISCELLANEOUS MATTERS
OEDA has received a $ 2000.00 grant from Wal Mart for economic development. A possible
application for the funds is for a color scanner for use with the OEDA computer. We have
discovered a new model of scanner which will be compatible with future expansion of the City
computer network. It is anticipated that the board will be requested to consider action on a request
for this equipment in a future meeting.
Warehouse Market has signed a letter of intent to purchase the former Food Lion building on 86th.
A sign has been placed in front of the building announcing it as the future home of the " warehouse
supermarket ".
The OEDA proposal to a national freight handling company for a 80 to 100 door freight dock has
been forwarded to the home office. We anticipate further contact in 60 to 90 days.
We are in preliminary but promising negotiations with a Tulsa manufacturing company for
relocation to Owasso. The company is finalizing some details on corporate restructuring, and will
begin serious planning later this quarter.
OEDA has received notice that the aerospace prospect to which we gave a preliminary proposal has
chosen Ft. Worth for its relocation. The Ft Worth package included free rent for one year, tax
abatement, training, a grant for equipment purchase, and an agreement to buy the old facility if not
purchased.

In regards to the foregoing, it is my clients position that neither you nor the Sammie Durrett
Revocable Trust possess an undivided 1/4 interest in and to the oil, gas and minerals in the North Half
of Section 20, Township 21 North, Range 14 East, and accordingly the Affidavit as well as Deed of
Mineral Interest to Trust filed by you slanders the title possessed by my client in and to the real estate
described above arising by virtue of conveyance dated the 27th day of December, 1995, and recorded
in Book 5771 Page 0441 of the records of the County Clerk of Tulsa County, State of Oklahoma.
This conclusion is supported by observation of the following matters of public record, to -wit:
1. On the 19th day of March, 1947, there was filed a Journal Entry of Judgement
executed by the Honorable Eben L. Taylor, District Judge, in the case of Edna Fern
James vs. Ida I. Tackett, et al. Case No. 74-939, District Court, Tulsa County,
Oklahoma, ajournal entry ofjudgement wherein it was adjudged and decreed by the
Court that Edna Fern James was the owner of the entire and full legal title in fee
simple and of the equitable estate in and to among other properties the Northwest
Quarter of Section 20, Township 21 North, Range 14 East, Tulsa County, Oklahoma;
2.' . That by virtue of General Warranty Deed dated the 13th day of December, 1945,
recorded the 21st day of April, 1947, in Book 1799 Page 396, Edna Fern James, a
widow conveyed to Hayward and Betty Jane Smith, husband and wife, as joint tenants
and not as tenants in common the entire fee simple title in and to, among other
properties, the Northwest Quarter of Section 20, Township 21 North, Range 14 East,
Tulsa County, Oklahora, together with all herediments and appurtenances thereunto
belonging. There is not reservation of any mineral interest contained within such
deed; and,
3. That by virtue of conveyance dated the 27th day of December, 1995, recorded in
Book 5771 Page 0441 of the records of the County Clerk of Tulsa County,
Oklahoma, Hayward Smith and Betty Jane Smith conveyed unto the Owasso
Economic Development Authority the above described real property.
Based upon the foregoing, it is asserted on behalf of my client that your Affidavit as well as
the Mineral Deed to Trust was filed for the purpose of slandering my client's title in and to the above
described real property. Accordingly, demand is hereby made upon you to immediately quit claim
any and all right title and interest in and to the property owned by my client. A proposed quit claim
deed has been prepared for your convenience. Should you refuse to execute and return the foregoing,
my clpeit will have no alternative but to pursue a quiet title action in the District Court of Tulsa
